DUBOIS – Multiple charges have been filed against a Brockport woman following a traffic accident on Interstate 80.

According to an affidavit of probable cause, filed with District Judge Patrick Ford’s office Feb. 9, Michelle Lynn Bizzak, 29, 1225 Rattlesnake Rd., Brockport, is charged by the DuBois-based state police with driving under the influence of alcohol or a controlled substance, endangering the welfare of children, driving while operating privilege is suspended or revoked, careless driving, reckless driving, failure to notify police of an accident and two summary traffic charges.

According to the affidavit, police were dispatched to a traffic accident at 4:13 p.m. Jan. 11 on I-80 near mile marker 106.9 in Union Township. When they arrived, police saw a red Kia Soul with moderate damage to its front end and roof as a result of rolling end-over-end. Police discovered Bizzak and two juvenile children were the only people in the vehicle when the crash occurred.

Police briefly spoke to Bizzak inside an ambulance and Bizzak allegedly told police her license had been suspended. Police also noticed a faint smell of marijuana and that Bizzak’s speech was slurred and slow. Police also noticed Bizzak appeared to be confused and disoriented and her head kept nodding.

Police spoke to Bizzak at Penn Highlands DuBois later that day and she allegedly said she had taken the children to Clearfield. Bizzak told police she had the vehicle’s cruise control set at 74 miles-per-hour and she “must have hit some black ice” because the vehicle traveled into the left lane. Bizzak allegedly told police she hit the rumble strip on the left shoulder and over-steered the vehicle causing it to flip over.

Bizzak also allegedly told police she receives daily treatments at a methadone clinic in Clearfield and that she also takes other medications as prescribed by her doctors. Police noted that while they were speaking to Bizzak, her eyes were fully dilated. Bizzak also refused to sign a consent form for blood testing.

Staff at the hospital had taken blood and urine samples while treating Bizzak.

Another officer arrived at the hospital who spoke to Bizzak. Bizzak allegedly told the officer that she did not want to consent to a blood draw because she “took a couple of hits of marijuana at a friend’s house.”

The officers then prepared a warrant to obtain Bizzak’s blood, urine and medical records and the specimens were taken for testing, which came back positive for marijuana, methadone and various prescription medications.
