Shaw identified the fugitive as Andrew Slogosky, 28, of Presqueisle Street, Philipsburg. Slogosky is wanted for failure to appear at Arraignment Court on Dec. 30, 2015.

On Oct. 8, 2015, Officer Shawn Kronenwetter of the Lawrence Township Police Department filed a criminal complaint against Slogosky. He charged Slogosky with receiving stolen property, M1, and retail theft, M1.

An employee, along with Kronenwetter, was able to view the make and model of Slogosky’s vehicle and its registration.

CLEARFIELD – Clearfield County District Attorney William A. Shaw Jr. has announced the capture of a wanted fugitive.

Shaw identified the fugitive as Austin Patterson, 21, of Clearfield. Patterson was added to the Clearfield County Fugitive of the Week list on Nov. 2, 2015.

On Sept. 24, 2015, Patrolman Elliott Neeper of the Lawrence Township Police Department filed a criminal complaint against Patterson. He charged Patterson with burglary, F2; criminal trespass, F2; theft by unlawful taking, F3; receiving stolen property, F3; and criminal mischief, M3.

According to the affidavit of probable cause, on Sept. 16, 2015, Neeper received a report about suspicious items abandoned outside of a local business.

Upon arrival Neeper allegedly observed various electronics and DJ equipment located outside of the business along with a two-wheeled hand cart.

Officers traveled to a local storage unit facility, where they allegedly observed that the padlock on one of the units had been removed. Officers then contacted the property manager who was able to pull the surveillance video.

CLEARFIELD – A motion to suppress evidence in the cases against a former Arizona man and a DuBois woman accused of selling drugs in a motel room was discussed in Clearfield County Court.

This week’s testimony was a continuance of testimony given during Motions Court last week.

Matthew Thomas Marley, 41, and Danielle Yontosh, 42, 324 Knarr St., DuBois are charged with manufacture/delivery/possession with intent to deliver a controlled substance, criminal conspiracy, possession of drug paraphernalia, corruptions of minors, endangering the welfare of children and dealing in proceeds of illegal activity. Both are in the county jail in lieu of $100,000 bail each.

The charges stem from an incident on Sept. 29 at a motel on the Clearfield-Shawville Highway in Lawrence Township when officers found Marley in a room with methamphetamine, traces of drugs, pills, drug paraphernalia and more than $11,000 in cash.

Sgt. Crystal Panebianco of the Lawrence Township police testified last week that officers were at the motel to serve a warrant on another individual who was known to reside there. They checked room 227, which was registered to Yontosh.

Panebianco explained at first there was no response to her knocking, but after a third series of knocks she heard a toilet flush. She admitted she thought this was because drugs were being flushed away. She knocked again asking for Yontosh and telling her she needed to open the door.

Instead a man, later identified as Marley, opened the door widely. Marley was wearing shorts and a T-shirt. A small, naked, female child was sitting up in the bed.

This caused Panebianco some concern initially, but there were three, other people in the room. Marely was later identified as the girl’s father, according to court documents.

Senior Deputy Attorney General David Gorman, who is prosecuting the case, asked her why she entered the room. Panebianco explained that she wanted to know what was going on with the child who could have been sexually abused or exposed to drug activity. She also needed to show the people in the room photos of the suspect who was the object of her warrant.

She stated there was a male sitting on a chair and female sitting on the couch.

When Panebianco went into the bathroom she could see water on the floor from the toilet. There was drug paraphernalia on the night stand within reach of the child.

Children, Youth and Family Services was contacted regarding the girl, she testified.

Because of the possible drug activity and in consideration for the officers’ safety, Panebianco had everyone in the room identified and searched. The room was secured and a search warrant was requested.

Yontosh was located in the lobby and brought back to the room within 10 to 15 minutes.

CYS responded within 20 to 30 minutes and took the child into custody, she said.

During cross-examination by Patrick Lavelle, who represents Yontosh, Panebianco stated the purpose of their visit was to locate another suspect who had been there two days prior to this incident.

Lavelle asked why someone flushing a toilet was unusual. She responded that people often flush drugs to avoid charges.

Leanne Nedza, attorney for Marley, had her read another report that stated she did not see the child until she entered the room. Panebianco agreed that she had created this report.

Nedza asked Panebianco about photos taken at the scene. During this series of questions, Panebianco admitted that some items had been moved before the photos were taken, including a bag with drug paraphernalia and items taken from Marley that were placed on to the nightstand.

Panebianco explained that only the pack of cigarettes was placed on the night stand for the photo. The other drug paraphernalia on that stand was there when she entered the room and was within the child’s reach.

Gorman, during re-direct examination, asked Panebianco again if she saw the child before she entered the room and she confirmed she did.

According to a court employee, four people, including an agent with the Pennsylvania Attorney General’s office, testified this week in the continuation of the discussion.

During the preliminary hearing in the Marley case, the agent testified that he/she was notified regarding the activity of room 227. He/she was able to obtain a warrant and the room was searched.

An inventory list included $11,870 found in a grocery bag in a clothes basket, $238 in a jacket, multiple cell phones, a container with various pills in it, a metal container with different pills, pieces of pills, marijuana, a packet of suspected heroin and various drug paraphernalia.

When he/she questioned Marley at the police station, he said he was from Arizona and had connections with a drug cartel. He met Yontosh in Arizona and they moved back to this area, her home state. She knew people in this area who were in the drug business and could introduce him, he said.

Gorman asked for the agent’s opinion on what was going on in that room. He/she replied that it was a drug business.

During her cross examination at the preliminary hearing, Nedza asked if any large quantities of drugs had been found in the room. The agent admitted there wasn’t but that it was likely drugs were being flushed down the toilet as the officers knocked on the door.

Nedza also pointed out the lack of a scale and large amounts of plastic bags for the packaging of drugs. The agent responded by saying that the large amount of money and the way it was found was a clear sign of drug activity.

Nedza said in a phone interview that Marley testified briefly this week, confirming he had stayed overnight in that room. The two other witnesses were other officers who were on the scene that day.

President Judge Fredric J. Ammerman asked both sides to provide briefs on the suppression issue within 40 days. After reviewing that information, he will make his decision.

Dylan Michael Tapper, 19, 357 S. 14th St., Reynoldsville, and Darren Mark Foradori, 18, 501 Jackson St., Reynoldsville, are both charged with two counts of aggravated assault, three counts of simple assault, criminal mischief, three counts of harassment and recklessly endangering another person. They are in the Clearfield County Jail in lieu of $50,000 bail each.

The charges stem from an incident on Jan. 1 at 3:30 a.m. at a Union Township camp.

According to the affidavit of probable cause, police interviewed four victims at Penn Highlands DuBois. Victim No. 1 told them that she and three others returned to the camp to retrieve another girl who was at the party.

When they pulled into the driveway, Tapper and Foradori immediately rushed toward the vehicle and began punching and kicking it. They then allegedly pulled Victim No. 2 from beside the vehicle and struck him on the side of the head with a stick or pipe. He fell to the ground as Tapper and Foradori continued the assault.

Tapper allegedly punched and kicked the victim in the head and body as this victim tried to cover himself. At this time, multiple people from the party attempted to stop Tapper. Two females (Victims No. 3 and No. 4) also attempted to intervene and were allegedly struck and pushed.

Victim No. 3 told police she had been contacted by Victim No. 1 who advised that her daughter was at an “out of control party” where Victim No. 1 had been assaulted. She requested Victim No. 3 meet Victim No. 1 and her husband to go back to the party to retrieve the daughter. After meeting at a location away from the party, they traveled to the camp.

When they arrived, Victim No. 3 said they were met by Tapper and Foradori, who seemed to be “crazed and out of control.” Tapper began to beat his chest and yelled “you know who I am. I am Dylan (expletive) Tapper!” She said her husband, Victim No. 2, was drug from beside the car and struck with something. While he was on the ground, they allegedly continued to assault him by punching and kicking him.

She tried to intervene and was pushed by both teens. As she went to the ground, she fell and heard a snap in her knee and was immediately in extreme pain.

Victim No. 4 told police that she went to the camp with the others to get Victim No. 3’s daughter. She then corroborated the other victims’ stories.

Victim No. 2 told officers that after he exited the vehicle he was assaulted by Tapper. He was able to grab Tapper and place him on the ground.

At that time, Foradori and two unknown males assaulted him by striking him in the head causing him to fall to the ground. He was allegedly punched and kicked repeatedly by Foradori, Tapper and the two unknown males.

Police returned to the camp but no one was there. They did see beer cans strewn throughout the driveway leading to the camp. Behind the camp, in a clearing, they saw a man standing beside a truck. This man said he got to the party late and did not witness any of the events the others had described. At some point, he had gotten in his truck and had fallen asleep.

The officers canvassed the property and were unable to locate anyone else. In the area where the assault was said to occur, they found a stick that was three feet long. It did not have any blood or hair on it, but it had a crack near one of the ends that caused a split down the stick, which is consistent with an impact strike.

After a preliminary hearing Friday, the felony count of corruption of minors and the indecent exposure charges were dismissed. District Judge Patrick Ford sent the other charges on to the court of common pleas.

According to the affidavit of probable cause, police were investigating a report of a theft by Fultz when they arrived at her apartment on Aug. 7. Her apartment door was open and after announcing themselves as police officers, they saw Fultz and a male appear out of a room to the left of the stairs. Fultz emitted a strong odor of an alcoholic beverage and was holding a can of beer.

Upon entering, the officers also made contact with two other juvenile males. A case of beer was on the living room floor and multiple empty cans were on the floor, tables and in the kitchen sink. Both males were asked how much they had to drink. All three males admitted they had consumed some of the beer.

One of the males provided a written statement to police on Aug. 9, advising Fultz had provided the alcohol for them. He said she called him into the restroom at one point during the night. When he opened the door, she had her pants completely down, fully exposing herself to him.

He left the bathroom and she approached him, saying “no, it’s OK.” She then hugged him and stated “I don’t care if you’re 15, just don’t get me for rape.”

The day following the incident he received numerous calls from Fultz. When he answered she offered to pay him two, different amounts of money, $400 and then $800 to withhold information from police. She wanted him to say he was already drunk when he arrived at her apartment.

Another one of the males provided a statement saying, that she purchased and supplied the beer. He said he also knew that Fultz had offered the other male money to withhold information.

Fultz was on probation in Jefferson County at the time of the incident. Her probation was revoked in November and she was sentenced to 18 months to three years in state prison.

Local Bakery Owner Sentenced in Indecent Assault Case

CLEARFIELD – A local bakery owner found guilty of indecent assault after an October trial was sentenced Tuesday.

Uzi Kornhauser, 57, 3100 Oklahoma-Salem Rd., DuBois, was charged with three counts of indecent assault after an incident at his bakery in February when he touched a customer inappropriately and kissed her.

In October, Kornhauser was found guilty of one count of indecent assault after a trial by jury and Judge Paul Cherry found him guilty of a summary harassment charge.

He was sentenced Tuesday to 30 days to one year in jail and one year consecutive probation by Cherry.

District Attorney William A. Shaw Jr. noted that Kornhauser had undergone an assessment to determine whether or not he was a sexually violent predator. The investigator determined Kornhauser did not meet the criteria of a predator.

However, Kornhauser will still have to register his address with law enforcement officials for 15 years. He was ordered to complete the Project Point of Light program and pay restitution of more than $1,200. He was fined $400 plus costs.

Prior to sentencing, Gary Knaresboro, attorney for Kornhauser, asked the judge to consider a probation only sentence because Kornhauser is the sole operator of his own business.

Cherry noted that recently the business was shut down for two weeks while Kornhauser was out of town.

Kornhauser responded that he was visiting his 84-year-old mother and business was slow at that time of year.

Several people spoke in favor of Kornhauser, stating that he is a hard worker. Cherry noted he had also received several letters on Kornhauser’s behalf.

“There is no doubt in the court’s mind that he is a hard worker and has a good reputation,” Cherry said. “But I can’t disregard that the jury convicted him of indecent assault. I have to weigh the crime with consideration of the victim.”

According to testimony at the trial, the victim was sitting at a table in Uzi’s Pastries when he kissed her twice and hugged her while he touched her breast. Before she was able to leave, she said he grabbed her shoulders from behind and then “bear-hugged” her. She said she could also feel him touching her all over her body. He turned her face and kissed her again, twice on the lips.

According to her, she kept walking until she was out of Kornhauser’s embrace. She put her jacket on and collected her purse from her table, so that she could leave the bakery. When she got near the door, she said Kornhauser reached around her. She said he grabbed her buttocks and commented to her “nice butt.”

CLEARFIELD – An ex-NFL player for the Seattle Seahawks, Denver Broncos and Philadelphia Eagles accused of assaulting and threatening his girlfriend had his preliminary hearing continued for six months in order for him to complete anger management during Centralized Court Wednesday at the Clearfield County Jail.

John Moffitt, 29, of Guilford, Conn., has been charged by the state police at Clearfield with terroristic threats, simple assault and harassment. The charges stem from an alleged domestic simple assault incident that occurred Dec. 30 near the Kwik Fill in Kylertown.

Moffitt will complete anger management in the state of Washington, return to court in six months to show proof of completion and likely enter a plea at that time. He is to have no contact with the victim who has Protection from Abuse orders against him. Moffitt’s bail has been set at $10,000 unsecured, according to Magisterial District Judge James Hawkins.

According to the affidavit of probable cause, on Dec. 30 the victim reported to state police that she and her boyfriend, Moffitt, were on their way to Seattle. She said that Moffitt started smoking a cigarette and she told him she thought he’d given up smoking.

The victim said she took Moffitt’s pack of cigarettes and threw it out the window while they were traveling. Both Moffitt and the victim told state police they engaged in a verbal altercation, which allegedly escalated to him hitting her in her facial area several times over the course of two hours.

Additionally, Moffitt allegedly dumped two bottles of water on her head, grabbed and twisted her wrist, spit on her three times and bit her finger. The victim was observed with a bump on the back of her head, a cut on her right hand, redness on her left arm, a small scratch on her right arm and bruising to her left eye, state police said.

During the altercation, Moffitt allegedly threatened to hit, abuse and “torture” the victim the whole way back to Seattle. He commented that he was allegedly “going to do something horrible to her in the future.” Moffitt also commented to the victim if he was going to jail, then he was going to “make it count.”

The victim told state police that she felt threatened by Moffitt’s comments to her.

According to previously published NFL reports, Moffitt, an offensive guard, most recently played for the Philadelphia Eagles. He was drafted in the third round and 75th overall by the Seattle Seahawks in 2011; he played college football at the University of Wisconsin.

Moffitt abruptly decided to walk away and retire from the NFL in November of 2013 while holding a roster spot with the Denver Broncos. In 2015, he announced his decision to come out of retirement after he had completed drug rehabilitation.

After being out of the league for 19 months, Moffitt returned to NFL football and signed a one-year deal with the Philadelphia Eagles this past summer. He was released by the Eagles in September.

Walls Pleads Guilty to Stealing Metal from RJ Corman

CLEARFIELD – A Morrisdale man accused of stealing metal from RJ Corman pleaded guilty Tuesday during sentencing court.

Frank Edward Walls Jr., 49, pleaded guilty to theft by unlawful taking and was sentenced by Judge Paul E. Cherry to 45 days to one year in jail and one year consecutive probation. He was fined $250 plus costs and he must pay more than $6,000 in restitution.

Prior to sentencing, a representative of RJ Corman addressed the court, explaining they gave him “a chance to be honest” when he was asked several times about the thefts. Walls was one of four employees of RJ Corman charged with stealing railroad ties and other metal and selling them as scrap.

According to the affidavit in this case, Walls was with Michael Hummel and Paul Harris on Sept. 12, 2013 when they drove to GC Scrap Metal LLC in Osceola Mills in RJ Corman vehicles loaded with railroad steel weighing a total of 23,010 pounds. They were each paid $997.

The items were rails, tie plates, spikes and comp bars and had a higher value than just scrap metal.

In October, Hummel, 47, 163 Palmer St., Clearfield, pleaded guilty to a felony count of criminal conspiracy/theft by unlawful taking and 10 misdemeanor counts of theft by unlawful taking. He received a sentence of 90 days to one year in jail and two years consecutive probation. He was ordered to pay more than $32,000 in restitution.

Hummel was accused of selling metal 12, different times. The total amount Hummel took was listed in his affidavit as 35,170 pounds.

Harris was scheduled to be sentenced in November, but Cherry rejected his plea offer for a 90-day sentence. He was asking for a minimum 12-month sentence.

According to his affidavit, in addition to his trip to the scrap yard with Hummel and Walls, Harris brought 11,820 pounds to the scrap yard on Dec. 14, 2013.

Attorney John Sughrue, who is representing GC Scrap Metal LLC, addressed the court, saying his client has a “significant issue” with the restitution in these cases. He noted that he asked for cash reimbursement in all four cases. He stated that the metal seized by investigators was more than the men had sold to the scrap yard.

Sughrue said they also did not understand why RJ Corman was being reimbursed because the items were returned to them.

District Attorney William A. Shaw Jr. disagreed with Sughrue’s statements. He said they only took metal that was identified with the RJ Corman name.

Assistant District Attorney Ryan Dobo also stated that they “did a lot of research on the restitution owed.”

Sughrue asked for a restitution hearing. Ron Collins, who was representing Walls, agreed to this and added that Willis Leonard Hull is also a client of his and would want a hearing.

In August, Hull pleaded guilty to 10 felony counts of theft by unlawful taking and 18 misdemeanor counts of theft by unlawful taking for similar thefts from RJ Corman that occurred between October of 2010 and October of 2013. He was sentenced to 90 days to one year in jail and four years consecutive probation. He was ordered to pay restitution of more than $164,600.

At the time Hummel was sentenced, his attorney also requested a restitution hearing.

Cherry ruled that a restitution hearing be scheduled to allow for more specific information on each case and to discuss Sughrue’s claims.
