The charges stem from a report of an assault that happened on Friday, March 15, and into Saturday, March 16.

Smith was lodged in the Jefferson County Jail on multiple state parole warrants and is awaiting a preliminary hearing on this incident.

Details of the case:

According to a criminal complaint, around 7:20 a.m. on Saturday, March 16, PSP Punxsutawney were dispatched to a residence for a report of a sexual and physical assault.

The known female victim reported that around 5 p.m. on Friday, March 15, Smith came into her residence in Punxsutawney and requested that she leave with him.

She stated that after consistent attempts to get her to leave, she went with him to avoid an altercation in front of her children and her friend. She then entered her vehicle with Smith driving.

The victim reported that Smith drove recklessly into Indiana County to the Hemlock Lake area where he stripped down naked and jumped into the lake.

He then got back into the vehicle where he allegedly forced the victim to get undressed and then performed oral sex on her, according to the complaint.

The victim also reported that while Smith was driving, he made threats to her that they were “going to die tonight.” She stated that she made several attempts to exit the vehicle while it was in motion, but each time she attempted to get out, Smith would grab her and stop her.

She also reported that he indicated he was going to drive the vehicle off a cliff, and he continued to drive at high rates of speed, according to the complaint.

At one point, the victim said she did manage to escape the vehicle and ran toward a house on Timber Lane, in Young Township, Jefferson County, screaming for help, but Smith caught her, tackled her and then grabbed her by the neck and dragged her back to the vehicle.

She stated he was “trying to break her neck” and was strangling her to the point that she felt she was going to lose consciousness. She asked Smith to stop and let her go, but he denied her requests.

Smith then took her to his father’s residence on Timber Lane in Young Township. The victim witnessed Smith telling his father that “he might be going to jail tonight for the things that he is doing to her,” according to the complaint.

Smith then took her to the basement of the residence where he took possession of a shotgun and “racked” it. He then showed her shotgun bullets and explained to her what each bullet would do to her before pointing the gun at her and then at himself, the complaint indicates.

The victim reported that Smith then got on top of her and choked her with both hands, twisting her head in an attempt to break her neck.

She stated she felt he was going to kill her, but he wanted to have sex with her, so she did what he said to stay alive and engaged in sexual intercourse with him, against her will. The victim reported Smith also forced her to perform oral sex on him, according to the complaint.

The victim told police that Smith allowed her to leave after she agreed to return there by 12 p.m. on Saturday, March 16, and agreed not to contact law enforcement.

The victim then drove to her own residence in Punxsutawney and immediately contacted the Punxsutawney-based state police for help.

Around 3:45 p.m. on Saturday, March 15, a trooper with the Punxsutawney-based state police, went to the Timber Lane residence with a search warrant. Smith fled from the rear of the residence and was apprehended.

The complaint also notes that the shotgun utilized during the incident was located next to Smith’s bed in the basement and was seized along with clothing and bedding associated with the sexual assaults.

Around 4:16 p.m. on Saturday, March 15, Smith was read his rights, and he agreed to an interview with the trooper.

According to the complaint, Smith confirmed going to the victim’s residence in Punxsutawney and leaving with her in her vehicle and also confirmed that he did “strip down” at Hemlock Lake and jumped into the lake.

Smith went on to state that the victim talked to him about killing herself, and he told her that he would do it, too. He indicated they had sex in the vehicle and at his father’s house in the basement on his bed.

Smith also confirmed that at one point, the victim exited the vehicle and was screaming, and he chased her down and got her back into the vehicle.

When asked why she ran from the vehicle, he could not provide a reason other than her being intoxicated. He also confirmed they were arguing throughout the night, the complaint states.

According to the complaint, Smith acknowledged that he knew and understood that he is a person who is not permitted to possess a firearm, even though he had a firearm in his possession.

He also said that the sexual relations were consensual; however, he indicated after they had sex once, he inquired about having sex a second time and she said “no.”

He confirmed that he told his father that he might be going to jail “for the way she is acting.,” according to the complaint.

Grampian Man Accused of Leading Police on High-speed Pursuit Waives Hearing

CLEARFIELD – A Grampian man has been accused of leading police on a high-speed pursuit.

Dustin L. Welder, 32, has been charged by Officer Joseph Witherite of the Curwensville Borough police with felony fleeing and attempting to elude an officer; misdemeanor DUI/controlled substance; three misdemeanor counts of intentional possession of a controlled substance; six misdemeanor counts of use/possession of drug paraphernalia; and 10 summaries.

Welder waived his right to a preliminary hearing Wednesday during centralized court at the Clearfield County Jail. His bail is currently set at $50,000 monetary.

According to the affidavit of probable cause, shortly after 7 p.m. March 14, Witherite was on routine patrol at the intersection of Mary Lane and Naulton Road and saw a dark blue Jeep Cherokee travel by his police unit.

Because of his past encounters with the same vehicle, he pulled out and turned onto Naulton Road. He saw the operator quickly turn left onto West Street and he made the same turn to continue observations of the vehicle.

At this point, Witherite said the operator accelerated, causing a cloud of dust to form and debris to be thrown about the air. He proceeded to activate his overhead emergency lights to initiate a traffic stop.

However, the operator reportedly continued to accelerate, driving in an “unsafe” manner in an attempt to flee from him. The vehicle crossed over Bailey Road without stopping, continued on West Street and turned right onto Wood Street.

From there, the vehicle turned right onto Hudson Street and then onto Bailey Road without stopping at properly posted stop signs. Witherite proceeded to activate his audible signals along with his emergency lights.

On Bailey Road, the Jeep passed another driver who had pulled off the roadway in order to avoid a collision. At the end of Bailey Road, the vehicle turned right onto Shadybrook Road before continuing onto Ferncliff and Morgan roads.

While on Morgan Road, the vehicle came to an abrupt stop and was put in reverse. It then started to back up toward the police unit, and Witherite was reportedly forced to swerve to avoid a collision.

The Jeep then went forward and fled on Morgan Road and Naulton Road Extension, where Witherite said it was driven in an “extremely hazardous” manner on the wrong side of the roadway.

By this point, Witherite had already requested assistance from the Lawrence Township police and state police. He sought additional assistance from Sandy Township officers with the vehicle heading toward the DuBois area.

The pursuit continued onto Ridge Avenue, Ridge Avenue Extension and Greenwood Road. From there, the vehicle turned left onto Bear Run Road, where road conditions became difficult to drive in and Witherite lost sight of the vehicle.

However, he continued to follow tracks left in the mud and in some areas snow until he observed the Jeep turning around up ahead. Witherite was unable to drive any further down Bear Run Road due to a tree blocking the roadway.

Witherite saw the operator turn around and drive toward his police unit. As the vehicle went by, Witherite yelled for the operator to stop but he did not; he drove through the woods until re-entering Bear Run Road.

Witherite turned around and started to pursue the Jeep but once again found it difficult due to road conditions and the operator having a head start. The operator also turned before spike trips set up by police and continued through the woods.

Officer Elliott Neeper of the Lawrence Township police was eventually able to stop the vehicle. Because the suspect had ignored Neeper’s commands and attempted to flee on foot, Neeper deployed his taser; this allowed Witherite and Neeper to apprehend him.

While he was being taken into custody, the suspect identified himself to the officers as Welder, and Witherite learned he had an active warrant through the Clearfield-based state police.

Inside his hoodie pocket, Welder allegedly had a pink zip-up bag containing syringes and several baggies of methamphetamine.  Welder told Neeper – when asked – that he had used the drug earlier that same day.

Neeper, who is also a Drug Recognition Expert, administered field sobriety examinations on Welder. At one point, he observed a white substance in Welder’s nostril; Welder reportedly said a blood test would show results for methamphetamine and Subutex.

Upon completion of his examination, Neeper determined Welder was under the influence and subsequently transported him to the Penn Highlands Clearfield Hospital to have a legal blood draw. All evidence will be sent to the crime lab for analysis.

Inmate Accused of Concealing Drugs in Underwear

CLEARFIELD – A county inmate has been accused of concealing baggies of drugs in his underwear.

Steven P. Shanechuck, 31, of Clearfield has been charged by Officer Levi Olson of the Lawrence Township police with a felony count each of contraband/controlled substance, possession of controlled substance-contraband/inmate and manufacture, delivery or possession with intent to manufacture or deliver.

He has also been charged with three misdemeanor counts of intentional possession of a controlled substance and four misdemeanor counts of use/possession of drug paraphernalia.

Shanechuck waived his right to a preliminary hearing Wednesday during centralized court at the Clearfield County Jail. His bail is currently set at $50,000 monetary.

The charges stem from a strip search of Shanechuck during an inmate in-take process March 6 at the jail, according to the affidavit of probable cause filed with the office of Magisterial District Judge Mike Morris.

At the jail, Olson was provided a copy of a prison official’s in-take report, and then retrieved a gallon-sized Ziploc bag from a locker in the sally port area.

It allegedly contained two tied baggies of a crystal substance; one tied baggie of white pills; one large piece of a crystal substance, which was neither wrapped nor packaged; and an empty, clear Ziploc baggie.

Multiple items had feces on them, Olson said. The prison official advised Shanechuck was brought in on a warrant, was strip-searched at 1 p.m. and was found in possession of these items.

Prior to this, the official said Shanechuck had been in a holding cell and he tried to claim he found the items there.

Olson seized the Ziploc bag of evidence, which was logged at the station. The suspected methamphetamine and pills were sent to the Pennsylvania State Police Regional Crime Lab in Erie for analysis.

Death Row Inmate’s Appeal Results in Lesser Sentence

Daniel L. Crispell (Pennsylvania Department of Corrections photo)

CLEARFIELD –A death row inmate’s appeal has resulted in a lesser sentence.

Daniel L. Crispell, now 48, was convicted in 1990 of the murder, kidnapping and robbery of Ella M. Brown, 48, who he and Christopher Weatherill abducted from the DuBois Mall in October of 1989.

According to previous reports, Crispell and Weatherill took her to a remote location in Sandy Township where she was stabbed to death. They then fled the area in her vehicle and were later taken into custody in Arizona after Crispell was caught trying to steal a purse from another woman.

Although Crispell was given the death penalty, and scheduled to be executed on Oct. 19, 2011, a stay of execution was issued in September of 2011 pending the conclusion of his appeal, according to court documents.

The appeal eventually went to the Superior Court where it was ruled that his attorney made a mistake by not using any information on Crispell’s troubled childhood or other mental problems during the penalty phase of his trial, which could have swayed the jury to give him life in prison rather than the death penalty.

Crispell was granted a new penalty phase hearing, which was scheduled for Wednesday morning.

After Crispell waived his right to a new hearing, Senior Judge John B. Leete of Potter County sentenced Crispell to life in prison without parole on the murder charge, a concurrent term of 10 to 20 years for robbery, 10 to 20 years consecutive for the kidnapping, five to 10 years consecutive for conspiracy, and 42 months to 90 months consecutive for theft, according to a court employee.

Part of the condition of this sentence required that Crispell waive all future appellate rights.

Weatherill, who is serving a life sentence in the state prison system, was convicted of second-degree murder, kidnapping and robbery in August of 1990.

His case is also on appeal because life in prison without parole has been determined to be cruel and unusual punishment for a juvenile offender. He was only 17 years old at the time of the crime.

His case is reportedly scheduled for a status conference in May.

Two Men Waive Hearings in Unrelated Assault Cases

DUBOIS – Two men charged with assault in unrelated incidents waived their rights to preliminary hearings Friday during centralized court in District Judge Patrick Ford’s office.

Kevin Alexander Kear, 27, of DuBois was charged by Sandy Township police with statement under penalty, simple assault, defiant trespass, terroristic threats and disorderly conduct after an incident on March 8.

Following a report from a woman saying Kear was threatening to shoot himself, police declared a state of emergency in the area of his Oklahoma-Salem Road residence, closing the roadway and evacuating neighboring residences as a precaution. School busses were also rerouted, according to the criminal complaint.

After several hours, Kear was reportedly taken into custody without incident.

An investigation into the gun revealed that Kear had purchased the gun locally within an hour of showing up at the victim’s door and threatening to kill her.

He allegedly answered questions during the background check falsely in order to purchase the gun.

Kear remains incarcerated at the county jail on $25,000 bail.

Eric C. Whitehouse, 51, also of DuBois, is charged with unlawful restraint, terroristic threats, simple assault, false imprisonment, recklessly endangering another person, driving under the influence and harassment.

According to the affidavit in this case, the victim said Whitehouse was acting erratically throughout the day on March 12, continually stating “we need to leave before they kill us”.

After ordering her to pack a bag, he suddenly grabbed her hair, began dragging her down a flight of stairs in their DuBois apartment building and forced her into a vehicle, police said.

As he drove, he reportedly kept his grip on her hair and head and continued to threaten her.

Police were able to stop the vehicle after seeing Whitehouse driving without having his hands on the steering wheel and shaking his hands at the passenger.

Whitehouse’s bail was lowered Friday from $25,000 to $10,000, but he remains incarcerated at the county jail.

EXPLOREJEFFERSON: Reynoldsville Couple Accused of Providing Forged Doctor’s Excuses to School

REYNOLDSVILLE BOROUGH (EYT) – A Reynoldsville couple is facing forgery and related charges after they allegedly provided forged doctor’s excuses to their children’s school.

According to court documents, the Reynoldsville Borough Police Department filed the following criminal charges against 39-year-old Cherie Ama Glenn and 41-year-old James C. Reeseman, both of Reynoldsville:

– Forgery – Unauthorized Act in Writing, Misdemeanor 1 (13 counts)
– Tamper Records or ID – Writing, Misdemeanor 1 (13 counts)

According to a criminal complaint, on March 4, Chief Troy Bell of the Reynoldsville Borough Police Department was requested to respond to C.G. Johnson Elementary School in Reynoldsville for a report of fraud.

Bell met the school truancy officer who reported that two juveniles had multiple reports of absences, and their parents, Cherie Glenn and James Reeseman, had turned in forged excuses for the absences.

According to the complaint, the truancy officer called Penn Highlands Healthcare and was advised the children had not been provided an excuse since May of 2018.

Copies of the excuses were provided to Bell, including excuses for Dec. 11, 2018, Jan. 4, 2019, Jan. 9, 2019, Jan. 11, 2019, and Jan. 15, 2019. The excuses were either dropped off at the school or provided by e-mail, according to the complaint.

Contact was made with Reeseman by phone, and he agreed to meet with Bell. Reeseman made the statement there were doctor’s excuses for all of the juveniles’ absences and further stated he took the children to both Med Express and Q Care, according to the complaint.

The complaint states that Reeseman did not meet with Bell at the agreed time.

On March 5, Bell met with a Physician’s Assistant (PA) from Q Care. The PA said she was familiar with the situation, as she had been contacted about the excuses and the children missing school.

When provided with copies of the excuses, she confirmed she did not provide any of them to the family and noted she had not seen one of the juveniles since 2017, and neither of the juveniles had been seen at or provided an excuse by Q Care since May of 2018, the complaint indicates.

The PA explained the system that they use to generate work or school excuses and said that she believes Reeseman and Glenn must have a copy of an old excuse they are editing and providing to the school.

She also noted that one of the excuses used a different date format that she uses, and another said “can return to work” rather than “school.”

She also noted Reeseman was provided with a work excuse in March of 2018, which they could be using and editing, according to the complaint.

Bell visited the school again on March 6 and was provided three more excuses that were turned in to the school by Glenn in the past.

According to the complaint, all three excuses were for dates that did not include a visit to Q Care.

The complaint notes Glenn was responsible for handing in 11 of the excuses and Reeseman was responsible for handing in two of the excuses, based on the e-mails in which the excuses were being provided.

Glenn and Reeseman were separately interviewed on March 15.

According to the complaint, both Reeseman and Glenn denied falsifying the excuses. Reeseman reported the excuses were provided to him by Glenn, while Glenn stated she “had no idea where they came from” because Reeseman handled them. Glenn also told police she would not know how to create a document to falsify the excuses.

Based on the investigation, charges were filed through Magisterial District Judge David B. Inzana’s office against both Reeseman and Glenn on Tuesday, March 19.

Preliminary hearings are scheduled for 1 p.m. Thursday, April 25, with Inzana presiding.

Maines Sentenced in Madera Murder Case

CLEARFIELD – The aunt of a Blandburg man had harsh words for his convicted murderer Monday morning during sentencing court.

Johnathan Blair Maines, 21, was found guilty of third-degree murder for the death of Joshua Sahm after a trial in January.

Witnesses who testified during the trial painted a picture of a “drug house” where the residents did methamphetamine all night before the day of the murder.

Maines stabbed Sahm in both the back and the neck because he was jealous of him, District Attorney William A. Shaw Jr. said during his closing arguments.

After the stabbing, Maines, Ashley Storm and Keith Pinter ran from the home while Sahm fell down a stairway, bleeding. He died on the way to the hospital, according to reports

Prior to sentencing Monday, Michelle O’Dell addressed the court, saying her nephew was a “kind, loving, person” who loved life and being with his family. She referred to Maines as a “cowardly punk” who fled while Sahm was suffering and dying.

“I hope you are beaten and raped every day” in prison she said, adding “and that it gets worse each day.”

“Our family is forever broken,” O’Dell said. She asked Judge Paul E. Cherry to not let Maines destroy another family by giving him the maximum sentence.

Sahm’s uncle David Sahm, echoed their heartbreak, saying “our family weeps.” He stated that no one deserves to die the way Joshua Sahm died. “I can’t believe he was left bleeding at the bottom of the steps.”

Comments were also made regarding Maines not showing any remorse. His attorney, Joshua Maines, explained that Johnathan has maintained that he did not commit the crime, but that does not mean he does not feel sorry that it occurred.

“Our thoughts continue to be with you,” he said addressing the family members, adding that he hopes that they can be healed from their suffering.

Johnathan’s father and sister also spoke, asking the judge to show mercy.

Cherry commented that this was “one of the most senseless acts this court has seen in the 15 years I have been on the bench and as a district attorney for nine years.”

“This was over what? Drugs? A girl?” Cherry also said that Johnathan has shown no remorse.  “His family wants me to show mercy, but no mercy was shown toward the victim.”

Cherry then sentenced him to 20 to 40 years in state prison.

Johnathan also had a probation violation on a previous prohibited offensive weapon charge. After Shaw argued for a consecutive sentence for this, Cherry gave Johnathan an additional two to five years in prison.

Because Johnathan is maintaining his innocence, his attorney said he will be filing appeals challenging the evidence in this case.

In an interview Monday afternoon, Shaw said an appeal is expected in most cases and they will “deal with them as they come.”

Satisfied with Cherry giving Johnathan the maximum sentence, Shaw explained he argued for the violation sentence to be consecutive because he didn’t “think he should have been rewarded with a concurrent sentence when he is not taking responsibility or showing remorse.”

He referred to the investigation as a “difficult” one because the people involved were all using drugs, and he was pleased with Trooper Scott Sankey doing a “really nice job.”

Overall this case is a “worse case example of the dangers of drug use with two people’s lives needlessly ruined.”
