DuBois Nurse Facing Felony Drug Charges

DUBOIS – Felony drug charges have been filed against a DuBois nurse accused of taking mediation intended for patients at a local nursing home.

Amanda Lynn Cluff, 31, was charged May 1 by Sandy Township police with 21 felony counts of acquiring or obtaining possession of a controlled substance by misrepresentation, 21 misdemeanor counts each of refusal to keep records required and procuring for self/other drugs by fraud, as well as 20 misdemeanor counts of intentional possession of a controlled substance.

Her preliminary hearing is scheduled for June 7 during centralized court in District Judge Patrick Ford’s office in DuBois.

The charges stem from her actions when she allegedly signed hydrocodone and tramadol pills out for patients on a narcotic count sheet at the nursing home where she worked.

According to the affidavit of probable cause, Cluff marked the pills as being for five different residents who were prescribed the medication “as needed.”

Her activity reportedly became suspicious because she then failed to record these doses on the medical administration record for those patients.

She was allegedly doing this beginning Jan. 2 and ending on her last date of employment on Feb. 13.

During an interview with police on Feb. 13 at the nursing home about her inconsistent record keeping, she allegedly admitted she had a problem with drugs, namely methamphetamine and opioids over the last three months and had taken the pills for her own use.

When asked if she had taken anything that day, Cluff pulled 20 pills out of her shirt pocket, that included 11 acetaminophen and hydrocodone bitartrate pills, four acetaminophen and oxycodone hydrochloride pills, two lorcet plus acetaminophen/hydrocodone bitrate pills, two acetaminophen and codeine phosphate pills and one morphine sulfate extended release pill, according to the report.

WASHINGTON TOWNSHIP (EYT) – A 28-year-old man is facing criminal charges after he allegedly threatened to burn a Washington Township woman’s house down and kill her and her dogs.

According to court documents, Marienville-based state police filed criminal charges against Steven Wade Brown of Luthersburg, Clearfield County, in Magisterial District Judge Timothy P. Schill’s office on April 29.

The charges stem from an incident(s) that occurred at a residence located on state Route 36, in Tionesta, Washington Township, Clarion County.

According to a criminal complaint, on April 13, PSP Marienville received a call from a known Washington Township woman who stated that Steven Brown had been harassing her for months by phone, using vulgar language, calling her 10 to 15 times a day and blocking his number.

The victim said that Brown has been threatening to burn her house down, beat the (expletive) out of her, kill her and kill her dogs.

She stated that the harassing calls from Brown have been an ongoing situation since February when he was released from the Quehanna Boot Camp, according to the complaint.

She also told police there have been previous harassment and terroristic threat allegations against Brown handled by PSP DuBois.

On April 13 at 3 p.m., while troopers were talking to the victim, she received two phone calls with no caller ID within a minute’s timeframe. She answered the phone on speaker both times. During the call, all that was heard was breathing but no words.

The victim said multiple times: “What do you want Steve? Stop calling me!”

Brown was contacted via phone and interviewed at 6:52 p.m. on April 13.

During the call, he allegedly admitted to calling the victim but related he never made any threats during any phone calls, according to the complaint.

He stated that “he was calling the victim to ask her to tell her daughter to leave him alone,” the complaint states.

A trooper informed Brown that he would be filing charges for terroristic threats and harassment based on the information he received.

Brown stated that “he would plead guilty to harassment all day but not terroristic threats.

“He related harassment is just a summary but terroristic threats are nothing to joke about. He related those were the same charges that were brought against him with the last situation handled by Trooper Connor PSP DuBois,” the complaint indicates.

Brown allegedly said that Trooper Connor told him to not contact the victim or anyone in that family after the last incident, according to the complaint.

After the call with Brown ended, Brown called the trooper back twice to relate that he would plead guilty to harassment and stated: “Why would I threaten to burn their house down?”

Brown was arraigned at 9 a.m. on April 30 on the following charges:

– Terroristic Threats W/Intent To Terrorize Another, Misdemeanor 1
– Harassment – Communicate Lewd, Threatening, Etc. Language, Misdemeanor 3

Brown’s bail was set at $10,000 monetary (10 percent). He is free on a $1,000 cash security posted by a private surety.

A preliminary hearing is scheduled for 2:15 p.m. on May 7 with Judge Schill presiding.

CLEARFIELD – A Clearfield man accused of possessing methamphetamine after a search warrant was executed on his apartment pleaded guilty during colloquy court Monday.

Joshua Allen Root, 34, was sentenced by President Judge Fredric J. Ammerman to nine months to two years less one day in jail, plus one-year consecutive probation for felony possession with intent to deliver methamphetamine.

These charges stem from a search of his Lawrence Township apartment in November that was done because of information gathered from a series of arrests and activity reported by security personnel at the apartment complex.

According to the affidavit of probable cause, Root was discovered on a second-floor of the apartment when officers arrived to execute the warrant.

In his bedroom, they found baggies containing a white crystal substance, various drug paraphernalia, a blue notebook with names and dollar amounts written next to them and a realistic looking air pistol.

When another individual in the apartment was questioned, she told police Root had given her part of a Subutex tablet.

In his interview with police, Root admitted he had given Subutex to the woman and that a syringe also contained methamphetamine for her to inject.

The other resident of the apartment Cherie Elise Del-Re, 29, was not at home during the search.

Officers found various drug paraphernalia, a buprenorphine tablet, marijuana and air pistols in her room.

Additionally, officers found a bag containing pills of suspected buprenorphine in a cabinet in the kitchen, a yellow notepad with pricing information for “chicken” ranging between $100 and $200 and various drug paraphernalia.

In March Del-Re pleaded guilty to felony possession with intent to deliver a controlled substance-marijuana when she received a county sentence of 90 days to two years less on day and one-year consecutive probation from Judge Paul Cherry.

CLEARFIELD – An Indiana man who pleaded guilty Monday to various felony charges including aggravated cruelty to animals received a lengthy state prison sentence.

Skylar Thomas Williams, 22, was arrested by Lawrence Township police after an investigation into the shooting of a dog on Hill Street.

Police discovered Williams had been staying in a local motel room where they found drugs, guns and a large sum of money.

Williams was sentenced by President Judge Fredric J. Ammerman to two to four years in state prison on the cruelty charge, and two to four years each for felony counts of possession with intent to deliver a controlled substance, possession of firearm prohibited, receiving stolen property and firearm with number missing or altered.

Some of the sentences will run concurrent to each other, giving him a total sentence of six to 12 years in state prison.

In April, his co-defendant, Morgan Diane Reffett, 22, pleaded guilty to felony conspiracy/possession with intent to deliver a controlled substance and was sentenced to 90 days to one year in jail and two years consecutive probation.

According to the affidavit of probable cause, police received a report of a dog being shot in the Hill Street area on Dec. 30.

After obtaining security video from a home near the site of the incident, a witness identified Williams and Reffett. In the video, the two are seen walking up the street and about 45 seconds later, running back down the street.

Police learned Williams had been staying at a local motel where they made contact with him and Reffett. The room had the odor of burnt marijuana.

When asked if there was anything illegal in the room, Williams stated “well, obviously” and advised them there were two handguns in a dresser drawer, one of which was used in the shooting.

In an interview with investigators, Williams claimed two dogs were jumping and lunging at them. With “no other options, he fired one shot on the dog and ran away,” according to the report.

He also admitted to police that he was a drug dealer who needed the guns for protection. He added that he also needed to protect himself from the threats he received after shooting the dog.

At the time of his arrest, Williams had 15 bags of heroin and approximately $1,180 in cash.

A search warrant executed on the motel room uncovered the guns, a small amount of marijuana, a small bag of methamphetamine, cigars that contained marijuana, various drug paraphernalia, multiple cell phones and a counterfeit $20 bill.

The total amount found in the room and from Williams was $5,577.

CLEARFIELD – A Curwensville man accused of using a using a debit card without permission of its owner and withdrawing over $3,000 pleaded guilty Tuesday.

Philip Roy Shape, 23, pleaded guilty to five misdemeanor counts of access device fraud before President Judge Fredric J. Ammerman, who sentenced him to two years probation.

It was part of his plea agreement that he pay the restitution of over $3,900 in full prior to sentencing.

According to the affidavit of probable cause, in January of 2018, the victim reported to police some questionable transactions on her debit card that included online purchases. The victim did not own a computer and said she does not buy things online.

She suspected Shape and a relative whom she had given the card to use before Thanksgiving.

Surveillance footage from the bank showed an unknown male with glasses and facial hair making a transaction at the ATM.

When the additional transactions were reviewed, the same man, later identified as Shape, was seen.

He made several withdrawals within a week at two different banks and a convenience store in November and December of 2017 that totaled over $3,300.

A transaction made at a local business was also traced to Shape.

When questioned about how Shape may have gotten her PIN number, the victim said she never gave it to anyone. She added that she keeps the number in a different wallet than her bank and financial cards.

Both wallets were kept in the same purse, which she kept in her kitchen, which Shape may have had access to.

Shape was questioned in May of 2018 in a formal interview with investigators.

He stated “I’m not gonna lie. I did use the card, but I had permission to use the card.”

Shape was shown the bank statements that included the ATM withdrawals and over $570 worth of purchases from Amazon.

At first, he claimed that he paid her back, and then later admitted to the crime, saying “no sense in lying. I used the card,” according to the report.

DuBois Woman Waives Hearing in Contraband Case

CLEARFIELD – A DuBois woman has been accused of concealing two baggies of drugs in her mouth at the Clearfield County Jail.

Megan Louise Snyder, 36, has been charged by Deputy David Johnston of the Clearfield County Sheriff’s Office with a felony count of contraband/controlled substance and misdemeanor use/possession of drug paraphernalia (two counts) and intentional possession of a controlled substance.

Snyder waived her right to a preliminary hearing Wednesday during centralized court at the jail. Her bail is currently set at $10,000 unsecured.

The charges stem from April 30, 2018 when DuBois City police had contact with Snyder and found there was an active bench warrant through Clearfield County for her failure to make payment, according to the affidavit of probable cause.

Police and deputies made arrangements to meet at the Rockton Fire Hall, so that Snyder could be taken into custody. When deputies arrived, she was removed from the police unit while trying to smoke a cigarette.

The city officer took the unlit cigarette from Snyder and discarded it. He told deputies that he had searched Snyder and when he asked if she was in possession of any contraband/drugs, she said no.

As Johnston secured Snyder, he asked again if she had any contraband/drugs. He explained that now was the time to advise the deputies, because if she’d be found in possession at the jail, she’d face felonies. Snyder reportedly said no.

At the jail, a female corrections officer searched Snyder and removed some of her personal belongings. She then asked Snyder to open her mouth; Johnston had reportedly observed Snyder reaching into her mouth.

Snyder proceeded to remove two plastic baggies containing a light-colored, powdery substance, which she later said was methamphetamine. Another CO turned the evidence over to Johnston.

During an interview with Johnston May 1, Snyder admitted the baggies contained methamphetamine, and that her husband had tossed them to her. When asked why she didn’t tell authorities after being asked multiple times, she said she was “nervous.”

Snyder said she thought about telling deputies while en route to the jail but then didn’t. She said she’d be willing to provide a written statement but wasn’t physically able to. Johnston believed her condition was drug-related and ended the interview.

Later May 1, 2018, Johnston was contacted by the Collections Office, which advised Snyder would be released from jail because her owed payment had been made in full. He went back to the jail to attempt to obtain a written statement.

However, Snyder appeared sick and Johnston eventually decided to end the interview. He asked her if she’d ingested any drugs while concealing the baggies in her mouth; he also related she wouldn’t be in any additional trouble, but he wanted her to get medically treated, if necessary.

On May 3, 2018, Johnston removed the evidence to be sent to the Pennsylvania State Police’s Erie Crime Laboratory.

On Oct. 4, 2018, he received a laboratory report that showed the baggies contained methamphetamine and amphetamine, both are Schedule II controlled substances, according to the affidavit.

BREAKING: Caretaker Accused of Assaulting Elderly Resident of Local Nursing Facility

$

CLEARFIELD – A caretaker has been accused of assaulting an elderly resident of a local nursing facility.

Chance T. Myers, 27, of Morrisdale has been charged by Officer Zachary S. Cowan of the Lawrence Township police with neglect of care-dependent person, strikes/shoves/kicks or attempts/threatens care-dependent person, simple assault and recklessly endangering another person, all misdemeanor offenses.

Myers was arraigned at 11:45 a.m. Thursday by Magisterial District Judge Mike Morris. Unable to post $50,000 bail, he was incarcerated in the Clearfield County Jail. Myers is scheduled to appear for a preliminary hearing Wednesday.

The charges stem from a report of abuse at the Mountain Laurel Healthcare & Rehabilitation Center that was received March 1, according to the affidavit of probable cause.

When Cowan began his investigation, he spoke to Rose Flynn, the registered nurse supervisor, who said an 85-year-old woman resident told her a caretaker at the facility had hurt her.

The victim alleged that she had her foot stepped on, was grabbed by her neck, had her head pushed on and her walker was flipped upside down in an effort to make her fall.

Flynn said she was told this abuse had occurred the previous night or the night before, but that the victim also said it’d been ongoing for approximately one month.

She said after receipt of the report, she observed bruising on the victim’s neck, foot and chest, and emergency services were contacted to transport the victim for a medical evaluation.

Cowan also spoke with a staff member, Alexis Narby, who had discovered the victim’s injuries. She said a male certified nursing assistant was responsible for taking care of the victim, and she identified him as Myers.

Flynn also confirmed the victim’s caretaker was Myers, and indicated he’s had multiple allegations since he started working at the facility, but he’s “always been found innocent.”

Narby said when she asked how the bruising occurred, the victim described how Myers grabbed her neck with his thumb being under her jaw and with his hand being wrapped behind it.

When asked about her bruised foot, the victim told her she’d asked Myers not to step on her foot, then he intentionally did. The victim confirmed information provided by Flynn and Narby, saying “this guy scares and hurts” her.

Cowan said the victim had “fresh” bruises that were dark purple in color, and her left foot appeared swollen and severely bruised, as well.

He said one bruise extended down the back of her neck on her left side, and two smaller bruises were located on her chest. He took photographs to document the injuries.

Later, Cowan spoke by phone with Jennifer Anderson, nursing director, who had made contact with Myers to notify him of his suspension since he was scheduled to come into work.

She said anytime he was met with allegations before, he immediately denied wrong-doing. This time, she said he repeatedly stated “uh” and stalled when asked to answer to his actions.

Eventually, Anderson said that Myers did deny the allegations, and she had since written a statement concerning their interview. She indicated she would provide it to Cowan.

She said the county’s Area Agency on Aging had been notified of the reported abuse, and either she or the CCAAA would provide any necessary hospital records once the victim was discharged, and she’d prepare other related paperwork and statements for him.

Upon review of collected information as part of his investigation, Cowan learned the victim frequently needed assistance and used her call bell. However, it was found her use of her call bell had declined with the onset of the alleged abuse.

It was found that during Myers’ interview with Anderson, he allegedly admitted to having answered the victim’s bell with and without assistance from other staff. Medical records also showed the victim’s injuries included bruising, the affidavit states.

During an interview with Cowan and Police Chief Doug Clark on March 12, Myers reportedly appeared nervous and scared; he avoided eye contact on several occasions.

Initially, he claimed he didn’t assist the victim very often or alone, but then changed his story saying he had and regularly.

He also claimed he’d never stepped on her foot, and that he’d assisted her with getting into bed but had help.

Then, he admitted he had assisted her with getting into bed alone, but when he demonstrated his procedure, it reportedly didn’t make any sense to police.

According to Myers’ demonstration, he only had control of the victim’s legs and let her upper torso fall freely onto the bed. When asked if this was a proper form of assistance, he agreed that it was not.

Cowan said he continually made attempts to deny he had cared for the victim alone, even though he admitted that he had both prior to and the date of her injuries.

After being told the victim had identified him, Myers reportedly had no response until saying he felt concerned and wanted to request an attorney.

The interview was then terminated, even though Cowan said it was “apparent” he had information concerning the injuries the victim had suffered under his care.

On March 14, Cowan conducted a follow-up interview with the victim, who corroborated her previous story a second time. When asked about the identity of her caretaker, she gave a description but said she no longer sees him there.

While there, she asked to get into bed and a nurse came in to assist her.  The nurse explained that the victim is normally in bed and uses her call bell when she needs to use the restroom.

Cowan remained in the room to observe the nurse assist the victim into her bed. Afterward she said the victim is able to get herself in and needs minimal help.

A final interview was conducted with the victim on April 10, and her story hadn’t changed at all from her previous statements, according to the affidavit.

CLEARFIELD – A Houtzdale man has been accused of burglarizing a Bradford Township residence and detached garage.

Dana Noel Vaughn, 33, has been charged by Trooper Andrew Mills of the Clearfield-based state police with felony burglary and criminal trespass; two misdemeanor counts of DUI; and related offenses.

Vaughn waived his right to a preliminary hearing Wednesday during centralized court at the Clearfield County Jail. His bail is currently set at $30,000 monetary.

The charges stem from an incident April 14 on Shiloh Road in Bradford Township, according to the affidavit of probable cause.

The caller reportedly observed a tan passenger car parked in the driveway, and someone was shining a flashlight into the windows.

Upon arrival on-scene, troopers approached the residence and observed Vaughn as he walked out of the garage.

It was learned he didn’t have permission to be there or inside, and he’d allegedly forced entry into the residence and detached garage.

State police said he broke a window in order to get inside the residence from which he carried out stereo equipment.

Vaughn sat the equipment beside the door before entering the garage and allegedly breaking the driver’s side window of the victim’s Ford Sport Trac.

State police determined Vaughn had parked his car in the driveway, just prior to their arrival. During the encounter, a trooper detected the odor of alcohol on Vaughn’s breath and person.

His eyes were reportedly bloodshot and glassy, and he admitted to having consumed alcoholic beverages.

Vaughn was administered a Horizontal Gaze Nystagmus Test (HGNT), and displayed signs of impairment. He also submitted to a preliminary breath test, which indicated for the presence of alcohol.

State police transported Vaughn to the barracks for processing and also administered a chemical test of breath, which indicated his BAC was .146 percent, according to the affidavit.

DUBOIS – A Rockton man is facing charges for allegedly touching a 3-year-old girl inappropriately.

Richard Alan McCracken, 62, was charged May 9 by state police in DuBois with three felony counts of aggravated indecent assault and three misdemeanor counts of indecent assault for his alleged actions between Feb. 1 and March 21 at a Rockton residence.

According to the affidavit of probable cause, the child’s mother contacted child line to report her daughter had soreness in her private area as well as redness that was noted during a doctor’s appointment.

The girl reportedly said she was touched “down there” by McCracken.

The nurse practitioner who examined her signed a document stating that she believed the child had suffered sexual abuse.

When McCracken was interviewed by investigators, he admitted to touching her private area on at least three occasions, police said.

McCracken was also subjected to a polygraph test. After he returned home, his wife told officers he admitted to her he had touched the victim.

He then grabbed a gun, saying he was going to shoot himself because he didn’t know what to do, according to the report.

Later he was taken to Penn Highlands DuBois.

A preliminary hearing for McCracken is scheduled for Friday at District Judge Patrick Ford’s office.

McCracken is incarcerated in the county jail in lieu of $75,000 bail.

LAWRENCE TOWNSHIP – A 28-year-old Williamsport man, Shawn Shipton, is in jail after leading police on a pursuit Saturday night that resulted in two, separate crashes in Clearfield County.

The pursuit began when Clearfield Trooper Todd Shive attempted to stop a 2004 Pontiac Sunfire on Interstate 80 at mile-marker 118 east in Lawrence Township, according to a news release issued by state police.

However, its driver – later identified as Shipton – reportedly failed to stop and exited I-80 at Clearfield. Shive eventually lost sight of the suspect vehicle, which was located by township officers traveling in two, separate units.

State police say it struck a township patrol unit, then fled. A second township unit was also involved in a crash at the Hyde light with an unrelated, civilian vehicle and the driver was seriously injured.

The pursuit continued until the suspect vehicle crashed on Independent Drive in Bradford Township. The occupants fled but were later located in a restaurant near the crash scene.

Shipton, along with the female occupant, initially claimed they were traveling on I-80 but were “car-jacked” while pulled over to rest. Later, Shipton allegedly admitted he led police on the pursuit.

State police say Shipton was lodged in county jail, and the female was released.

State Police, Troop C, Forensic Services Unit and a Collision Analysis and Reconstruction Specialist assisted with the Hyde crash investigation.

Also, multiple patrol units from Clearfield, Punxsutawney, Ridgway and Rockview assisted with the incident.
