CLEARFIELD – Clearfield County’s Fugitive of the Week for the week of Nov. 2 has been identified as Austin Patterson, 20, of Fourth Street, Clearfield. Patterson is wanted for failure to appear at a preliminary hearing that was held Oct. 28.

On Sept. 24 Patrolman Elliott Neeper of the Lawrence Township Police Department filed a criminal complaint against Patterson. He charged Patterson with burglary, F2; criminal trespass, F2; theft by unlawful taking, F3; receiving stolen property, F3; and criminal mischief, M3.

According to the affidavit of probable cause, on Sept. 16 Neeper received a report about suspicious items, which were abandoned outside of a local business. Upon arrival Neeper allegedly observed various electronics and DJ equipment located outside of the business along with a two-wheeled hand cart.

Officers traveled to a local storage unit facility, where they allegedly observed that the padlock for one of the units had been removed from it. Officers then contacted the property manager who was able to retrieve the surveillance video.

The suspects transferred the items to a vehicle but left behind the two-wheeled hand cart and a pair of recently-purchased bolt cutters. Officers were then able to obtain surveillance video of three males recently purchasing the bolt cutters from a local business.

According to the affidavit, one of the individuals was identified as Patterson. As a result, officers were able to further identify the suspect vehicle as belonging to Patterson. When later confronted by officers, Patterson allegedly admitted to involvement in the burglary.

Hackett Gets State Prison for having Meth Lab

Mark Charles Hackett (Provided photo)

Mark Charles Hackett (Provided photo)

CLEARFIELD – A Clearfield man accused of having a methamphetamine lab in his apartment pleaded guilty Tuesday during plea and sentencing court.

Mark Charles Hackett, 54, currently an inmate of state prison, pleaded guilty before President Judge Fredric J. Ammerman to criminal attempt/manufacture of a controlled substance, operating a methamphetamine lab and deposits, stores or disposes of chemical waste.

He was sentenced to a total of one to 10 years in state prison. This sentence will run consecutive to any sentence he receives from a state parole revocation.

In October of 2014, the other apartments in Hackett’s building were evacuated by members of the Clearfield Borough police, the Lawrence Township police, the Clearfield Fire Department, Clearfield Emergency Medical Services and the Clearfield County Emergency Management Agency.

Seven nearby residences were also evacuated while police investigated the scene due to the dangers of manufacturing the drug, according to previously published reports.

According to testimony at the preliminary hearing, Keith Summerson, a state parole agent, and an agent with the Pennsylvania Office of Attorney General, Bureau of Narcotics, Investigation and Drug Control, received information from a confidential informant who said Hackett was cooking methamphetamine at his home. He contacted his supervisor and received permission to search Hackett’s residence for evidence of a violation.

Summerson went with Officer Jacob Rhymestine of the Clearfield Borough police to Hackett’s residence. He testified that a female answered the door while Hackett was on the couch. Hackett was handcuffed and placed in the kitchen. Rhymestine watched him while Summerson searched the apartment. The female told him there was a backpack hidden in the kitchen ceiling tiles.

When he checked the ceiling Summerson pushed the tiles and could see a black bag. Summerson asked another agent, Lon Miller, who had arrived on scene to help him. Miller got up on a table, reached up and pulled down the bag. Inside it they found a bottle with battery shavings, a bottle with a white substance, a Coleman fuel canister and baggies with white pellets.

Because these items are precursors for cooking methamphetamines, the search was stopped. Summerson asked Rhymestine to get a search warrant.

Rhymestine verified much of Summerson’s story during his testimony. However, he was unable to confirm which of the agents actually pulled the bag from the ceiling. Rhymestine explained that his focus was on watching Hackett and not the search.

At Summerson’s request, Rhymestine said he went back to the police station to speak to officials about getting a search warrant for the apartment. When he returned to the building other officers had secured and evacuated it. Rhymestine provided security outside for the rest of the evening.

An agent with the AG’s Bureau of Narcotics, Investigation and Drug Control was called in to assist with the investigation. The agent testified that he interviewed Hackett, who agreed to speak with him after he was read his rights. Hackett told him he tried to manufacture methamphetamine in a soda bottle but it failed. Hackett agreed to a search and signed a consent to search form.

The agent said there were concerns with securing the apartment because of the volatile chemicals involved in the making of methamphetamine. The state police were notified and a response team sent to the area.

Chemists dressed in suits with respirators went into the residence to check for chemicals. Everything they found was taken to a crime lab in Harrisburg, the agent said.

A report from the lab concluded that several materials were found that are used to manufacture methamphetamines. Some of the residue indicated an effort to make methamphetamine had been successful.

The only defense witness was the informant. The CI testified that they had charges pending against them when they went to the police with information about Hackett’s intentions to make methamphetamine.

“I knew there was illegal activity happening (at Hackett’s apartment),” the CI said, adding that they knew this was “not right.”

Hackett had asked the informant to buy cold medicine that can only be purchased with an identity card at a pharmacy counter. This is used in the making of methamphetamine.

Attorney Gary Knaresboro, who was representing Hackett, asked the CI if they took photos of the ingredients for methamphetamine. The CI said yes and these photos were given to police.

The informant said a female showed them items in a bag in a closet and helped them take the pictures. At that time the items were in a garbage bag in a suitcase. Later these things were put in the backpack and hidden in the ceiling tiles.

During cross examination, District Attorney William A. Shaw Jr. asked what else the CI saw at the apartment. The informant said they saw a soda bottle that was burned. The informant said the female told them it had blown up.

Hackett’s previous drug charges include possession of a controlled substance with intent to deliver in two cases. He pleaded guilty in July of 2012 and was sentenced to serve nine months to five years in state prison. In July of 2005, he pleaded guilty to possession of a controlled substance and was sentenced to 60 days in jail and two years probation.

Ware Jr., who had recruited him to travel to Clearfield to deliver and sell cocaine.

Prior to sentencing, it was noted by Senior Deputy Attorney General David Gorman that McCoon had cooperated with the investigation and testified both before a Grand Jury and at Ware’s trial. He has already served almost two years in jail beginning with his original arrest in 2013. His credit toward his sentence will begin July 21.

McCoon’s attorney, Ronald Collins explained the unique structure of the plea was due to McCoon’s issues with immigration.

McCoon testified during Ware’s trial that he met Ware through a mutual friend in the Bronx in April of 2013. Ware offered him a job selling drugs for him in Clearfield.

“I needed the money,” McCoon said because he was out of work. At first he turned the offer down but in August of 2013 he agreed to work with Ware.

He explained Ware needed someone to oversee his drug business in Clearfield because he was constantly losing money due to people either stealing the money or drugs. On that trip, he said they had about $5,000 in crack cocaine packaged in half gram bags. Ware told him he had been doing this for two or three years.

McCoon said at first he stayed with people in the area. Other times he stayed at various hotels with the bill being paid by Ware. When he ran out of drugs, he would call Ware and he would bring more.

The longest McCoon said he stayed in Clearfield was three or four weeks in September/October of 2013. In November he stayed at a hotel in DuBois because he was afraid he was going to be arrested.

It was during one of his trips back to New York in November of 2013 that McCoon’s vehicle was spotted by Pennsylvania State Troopers who were alerted he was wanted for questioning in a separate case. He was taken into custody. Because the offense was alleged to have happened in his van, it was searched after a warrant was obtained. Police found 11.47 grams of crack cocaine packaged in little bags inside a sock in a duffle bag in the van.

After a trial in June, Ware was found guilty of two counts of possession with intent to deliver a controlled substance, criminal use of communication facility, dealing in proceeds of unlawful activity, criminal conspiracy and delivery of a controlled substance in one case and possession with intent to deliver a controlled substance, criminal conspiracy/delivery of a controlled substance, corrupt organizations, criminal conspiracy/corrupt organizations, dealing in proceeds of unlawful activity, and criminal use of communication facility in a second case. In August, Ammerman sentenced Ware to a total of 11 to 25 years in state prison.

Several other local people involved in his drug distribution network were among those arrested in the recent “Operation Leaf Rake” drug bust.

Also involved in this cocaine trafficking ring was Shaking Devine Saunders, 37, 8418 Rockaway Beach Blvd., Far Rockaway, NY, Edward Allen, 39, 431 Beach St., Far Rockaway, NY, David Batista, 31, 2288 Mott Ave., Queens, NY, and Lashanda Lashell Mount, 29, 25 Pyramid Pines, Saratoga Springs, NY. They were found to be in possession of 38.62 grams of crack cocaine after a traffic stop in February of 2014.

In November of 2014, both Saunders and Allen pleaded guilty to drug charges and were each sentenced to serve 27 months to seven years in state prison. In April Mount pleaded guilty to criminal conspiracy/possession with intent to deliver a controlled substance. She was sentenced to nine months to 16 months in jail. In July Batista pleaded guilty and was sentenced to 27 months to seven years in state prison.

CLEARFIELD – A man accused of having a methamphetamine lab at an apartment in Lawrence Park Village waived his right to a preliminary hearing during Centralized Court on Wednesday at the Clearfield County Jail.

Larry Ray Rubly Jr., 43, of Clearfield has been charged with possession of red phosphorous with intent to manufacture a controlled substance, risking catastrophe, criminal attempt/manufacture, delivery or possession with intent to manufacture or deliver, operating a methamphetamine lab and deposits, stores or disposes of chemical waste.

According to the criminal complaint filed by Officer Elliott Neeper of the Lawrence Township police, on Aug. 20 officers received a call from State Parole Agent Keith Summerson, who requested assistance in conducting a follow-up with Larry Rubly Jr. Larry Rubly Jr. was to be staying in apartment 6B at Lawrence Park Village.

Upon arrival Summerson made contact with Mandy Rubly. She confirmed Larry Rubly Jr. was at the apartment, advised he was upstairs and showed the state parole agent to his location. When the state parole agent made contact with Larry Rubly Jr., he was in an upstairs bedroom.

Larry Rubly Jr.’s pants were down around his ankles, and he was allegedly attempting to stick himself with a needle in the leg area. The state parole agent was able to handcuff Larry Rubly Jr.; however, he (Larry Rubly Jr.) discarded the needle.

Larry Rubly Jr. was subsequently taken into custody by the state parole agent. The state parole agent also allegedly located a prohibited offensive weapon in the bedroom that Larry Rubly Jr. stayed in.

While the state parole agents searched for the discarded needle, they also allegedly located multiple items consistent with the manufacture of methamphetamine.

According to the criminal complaint, a two-liter Mountain Dew bottle was allegedly located on the far side of Larry Rubly Jr.’s bed in which a clear, small tube was sticking from the top. Another container was allegedly found directly beside the bottle with an unknown substance inside.  On the heater for the bedroom along the far wall, there allegedly was a container of Drano drain cleaner.

Upon officers looking around Larry Rubly Jr.’s bedroom, they allegedly observed in plain view a container of Ronsonol lighter fluid on a bedroom dresser. Also on the dresser, there was allegedly a coffee pot with residue and a large packet of clear baggies commonly used for drug distribution.

Officers also allegedly observed Larry Rubly Jr.’s driver’s license laying on the bed. While exiting the bedroom, officers allegedly observed a bag containing a packet of a 12-hour decongestant containing 20 tablets.

Based upon these observations, officers determined enough items were present to indicate the possibility of an active methamphetamine lab in Apartment 6B.

Police located a female inside the apartment. She was in the living room and told police she had health issues that prevented her from leaving her bed. She also indicated she was the owner of the apartment and advised Mandy and Larry Rubly Jr. had been staying with her.

Police obtained written consent to search the apartment. Then, police proceeded with an evacuation due to the inherent dangers that exist with the manufacture of methamphetamine.

While attempting to secure the scene after the evacuation, officers allegedly located additional items in plain view that are used for the manufacture of methamphetamine at the bottom of the staircase of the apartment. A large one-gallon container of muriatic acid was allegedly found along with a grocery bag containing used items for the manufacture of methamphetamine.

There was allegedly an additional one-gallon container with white residue with these items.  Inside the grocery bag, officers could allegedly observe used cold compress containers, used suspected lithium batteries, Ronsonol lighter fluid and plastic tubing.

Also inside the grocery bag in plain view, there allegedly was a receipt from Wal-Mart for the purchase of pseudoephedrine tablets on Aug. 19.

Officers then contacted the state Attorney General’s Drug Task Force Unit and the Pennsylvania State Police Clandestine Methamphetamine Lab Unit.

Police transported Mandy Rubly to the station for an interview about her knowledge of items used for the manufacture of methamphetamine being inside the apartment. She initially denied any knowledge that Larry Rubly Jr. was making or using any type of methamphetamine products.

However, she eventually admitted to viewing the two-liter Mountain Dew bottle in the bedroom. She also stated that there was a liquor bottle that contained a brown liquid inside the bedroom.

Mandy Rubly stated when she confronted Larry Rubly Jr. about the two bottles he related he had urinated inside them. She stated that he told her that he would throw out the bottles.

According to police, Mandy Rubly also allegedly admitted to observing a clear bottle with a black top labeled salt.  She stated that she asked Larry Rubly Jr. about this, and he told her that he had been eating in the bedroom.  However, she told police she’d never seen him eating in the bedroom.

She also allegedly admitted to purchasing Sudafed at Wal-Mart sometime at the end of July. Police confirmed that she purchased Sudafed on Aug. 6. However, she denied purchasing pseudoephedrine for the purpose of manufacturing methamphetamine or for supplying Larry Rubly Jr. with it to manufacture methamphetamine.

Police received additional information from another female who was suspected of purchasing pseudoephedrine and supplying it to Larry Rubly Jr. She was located at Lawrence Park Village.

She told police that on Aug. 19 Larry Rubly Jr. asked her to purchase pseudoephedrine for him at Wal-Mart. She stated that she declined at first; however, Larry Rubly Jr. called repeatedly and she eventually agreed to.

The female said she met with Larry Rubly Jr. and Mandy Rubly. She said both were present when Larry Rubly Jr. handed her a gift card, gave her the pin number and told her specifically which type of medication to purchase and to also use the card as credit, if possible.

The female said they told her to buy one box of the 12-hour, generic Sudafed.  She went to Wal-Mart where she purchased the pseudoephedrine.  When she returned she said she met both Larry Rubly Jr. and Mandy Rubly to give them the pseudoephedrine. She said Larry Rubly Jr. opened the package to make sure it was what he’d requested her to purchase.

The female told police she put the gift card back in the Wal-Mart bag. Before she left she said Larry Rubly Jr. asked a male for any empty bottles that he had, and he took an empty Juicy Juice bottle.

When Mandy Rubly was interviewed a second time by police, she denied witnessing Larry Rubly Jr. giving the gift card to the female. She also denied going with Larry Rubly Jr. to obtain the pseudoephedrine from the female.

CLEARFIELD – A Hyde man will spend time in state prison for pulling a gun and threatening to kill another man.

Thomas Stephen Scott, 49, 1407 Vaughn St., Hyde, pleaded guilty to a felony charge of possession of firearm prohibited and terroristic threats in one case; terroristic threats and simple assault in a second case; and possession of a controlled substance, possession of drug paraphernalia and possession of a small amount of marijuana in a third case during plea and sentencing court Tuesday. In addition he pleaded guilty to driving under the influence in two separate cases.

He was sentenced to a total of two to five years in state prison by President Judge Fredric J. Ammerman.

According to the affidavit in the first case, on the evening of June 18, Scott confronted the victim about coming up behind him at the Fraternal Order of Eagles in Clearfield and Scott threatened to shoot him. A man stepped in front of Scott in an attempt to calm Scott down.

When the victim turned to leave, Scott kicked him in the lower back. While he attempted to get Scott away from the victim, the man felt an object pushing against his body. The man later saw the wooden handgrips on a pistol that Scott had concealed on his person.

Scott continued to threaten the others and cause problems for the bartender. The bartender shut Scott off and told him to leave the Eagles. Security camera footage shows Scott pulling the revolver from his waistband as he is walking out and putting it in his hand.

This victim told police he felt that the threats Scott made were serious and that he feared for his life.

A written complaint was filed with the Eagles about Scott’s actions. When Scott returned to the Eagles the next morning he was given a 90-day suspension and he got upset. He crumpled up the suspension letter and threw it.

According to the affidavit of probable cause in the second case, Scott knocked on the door of the victim who is the manager of the Eagles, the next morning and spoke with him on his front porch. He accused him of being responsible for suspending him the night before.

After a verbal altercation, Scott brandished a revolver with a brown handle and black stainless steel barrel. He pointed the gun directly in the face of the victim while stating he was there to kill him.

This statement was also heard by a witness who was inside the residence. The verbal confrontation continued and eventually, Scott put the gun down and began to walk toward his vehicle. As he did this, he pointed the revolver at the victim approximately three more times while warning him that he needed to watch his back. He again threatened to kill him.

Later that evening, police received information that Scott was at a tavern on Third Street in Clearfield. When they arrived, they saw Scott walking to his vehicle. He was taken into custody and searched. Officers found he was in possession of a silver pipe, a baggy containing a green leafy substance, and five pills later identified as oxycodone.

Police looked into Scott’s criminal history and discovered he was convicted of a simple assault in a domestic violence case, which prohibits Scott from possessing a firearm.

CLEARFIELD – All charges were held for court against a Clearfield man who has been accused of sexually assaulting a woman following a preliminary hearing Wednesday during Centralized Court at the Clearfield County Jail.

August Eugene Grannis, 33, of Clearfield has been charged with aggravated indecent assault without consent, indecent assault without consent of other and harassment.

According to the affidavit of probable cause, on July 19 Clearfield Borough police received a report about an alleged sexual assault. Upon responding to the report, the victim told police Grannis had inappropriately touched her, and when she told him no, he didn’t stop.

During an interview with police, the victim said another male and Grannis had been drinking. She said when they came back and she was alone talking with Grannis, he began moving closer, which made her uncomfortable. The victim said Grannis allegedly began inappropriately touching her.

She said she told Grannis that she was going to yell for the male to come back into the room. Then, when she tried to get up, the victim said that Grannis allegedly stood over top of her. She told Grannis she had text-messaged and asked for the male to come back, which she said caused Grannis to stop his actions.

During the incident, the victim’s friend said the male had gone back upstairs to see what was going on when he overheard the victim saying “I’ll yell for him.” The friend told police that the male didn’t know what to do, and she text-messaged the victim. After Grannis left, the friend said the victim came downstairs and was crying.

During a phone call with police, Grannis allegedly admitted he had inappropriately touched the victim; however, he claimed that he stopped when she asked him to. Grannis also told police he wasn’t going to lie or hide and would come in for an interview July 20.

In an interview with police, a male said he and Grannis had been talking to the victim. He left the room and went downstairs to talk with friends. While downstairs, the male said he had a “gut feeling” that something wasn’t right and went back upstairs.

As he was going upstairs, the male said he allegedly heard the victim saying “I will holler for him if you don’t stop.” He said he panicked but at the same time didn’t want to make any assumptions. When he went downstairs, he told a female friend who text-messaged the victim.

After his friend and the victim exchanged text messages, the male said that Grannis allegedly came downstairs and left. He said the victim came downstairs and told them Grannis stopped his actions and left after the text message exchange.

When asked if Grannis had been drinking prior to the incident, the male told police that Grannis had quite a bit of “Jager” and “Jack.” He told police that Grannis was “pretty intoxicated.”

On July 20 Grannis allegedly claimed that he’s had consensual sexual relations with the victim.

Judge Rejects Former Carnival Worker’s Plea in Indecent Assault Case

CLEARFIELD – A former carnival worker was in court Tuesday to plead guilty for inappropriately touching a 13-year-old girl.

Tyler John Sears, 21, 406 W. Clay St., Mebane, NC, currently an inmate of the jail, was charged with indecent assault after an incident Aug. 5 in Lawrence Township when he allegedly touched the victim’s breast and kissed her neck.

Sears had signed a plea agreement for 87 days or time served in this case. After hearing comments from the girl’s mother, father and step-father who all disagreed with the sentence, President Judge Fredric J. Ammerman rejected the plea. His case will be added to the trial list.

The girl’s mother called the sentence “a slap on the wrist.” Her father stated that his daughter is just a child and he felt Sears should be reprimanded more harshly. Her step-father described her as naive and said Sears took advantage of her. He was also upset that Sears had “violated my space” and “hurt my daughter.”

According to the affidavit of probable cause, Sears met the victim while he was working on the midway on Aug. 2 during the Clearfield County Fair. She told police she gave him her phone number on Aug. 4 and they began texting each other. On Aug. 5 she invited him to her home and they met in the backyard. A friend of the victim was also present.

While there, Sears grabbed the girl’s breast. The girl pushed his hand away, but Sears then kissed her on the neck. The victim and her friend ran into her home.

She told police he knew she was 13 years old. Unfortunately the victim had deleted all of their text messages from her phone.

Police contacted the friend who confirmed the victim’s story.

Officers next spoke to Sears at the fair grounds. He was taken to the police station where he was questioned.

At first he denied meeting with the girl or her friend, but he consented to a search of his phone. An officer was able to find the text message conversation he had with the victim, which included directions to her home.

Sears then changed his story admitting he had met the girls. He denied kissing the victim and said they only “hung out.” He said he did know she was only 13 years old.

Eventually, he corroborated the victim’s story. He stated he knew a “skin on skin charge” would be coming out of this and he had “messed up.”

Leverett Pleads Guilty to Lesser Charges in Stalking Case

CLEARFIELD – A Texas man charged with stalking a hotel employee pleaded guilty to lesser charges Tuesday during plea and sentencing court.

Joshua Leverett, 19, 11320 Tom Viozas Dr., El Paso, Texas, an inmate of the jail, pleaded guilty to two summary counts each of harassment and disorderly conduct. He was sentenced by Judge Fredric J. Ammerman to 95 days to one year in jail. He was fined only $4 plus costs.

Ammerman noted that Leverett is “not from around here” and was only in the area because of a gas leak. He said he expected that Leverett would never come back and speculated the county would never receive payment for his fines and costs.

The charges stem from incidents on Aug. 2 in Lawrence Township. According to the affidavit of probable cause, the victim called police to report that a man staying at the hotel had been following her around and refusing to leave her alone. When she arrived for her shift, Leverett was sitting on a bench outside the entrance. He followed her into the lobby area where he stayed for most of the evening.

He started with small talk and was polite. But as the night wore on, he referred to how he had been in jail and asked her many times to go back to his room.

She tried to keep her answers as short as possible, hoping he would “get the hint” and leave her alone. Although she isn’t supposed to leave the front desk, she repeatedly asked the bartender if she could help her in an effort to get away from Leverett. She also tried to look busy so he would leave her alone, but he stayed near her.

At one point, she left the front desk to lock the entrance to the pool area after it closed. He followed her and pulled her close when she tried to lock the pool door. She turned and was able to push him away. He tried to grab her and again she pushed him away.

When she got back to the front desk, he asked her if they were going to talk about what happened at the pool. She told him nothing happened because she wasn’t sure what to say. She was very scared but she didn’t want to anger him for fear he would hurt her.

He stayed in the lobby area and kept asking if she would go to his room. He said he would “only need 10 to 45 minutes of her time.” He said it was probably her only chance to see him because he and his friends were leaving in the morning.

The victim called a co-worker to tell him what was happening and explain how she was reluctant to walk to her car after her shift ended because she wasn’t sure what Leverett would do to her outside.

When the co-worker entered the property, Leverett left the lobby and went to his room. The victim said she broke down crying and called her manager to tell her of the situation. She returned home and told her husband. She was very emotional and they agreed she needed to call police.
