Updyke to Stand Trial for Allegedly Setting Fire in Sandy Club Restroom

DUBOIS – A DuBois woman will stand trial for allegedly setting a fire in a local club’s restroom after a bartender denied her alcohol.

Desiree Marie Updyke, 31, 215 S. Church St., DuBois, is charged with 19 counts of arson-danger of death or bodily injury, arson-inhabited building, risking a catastrophe, criminal mischief, 19 counts of recklessly endangering another person, and disorderly conduct.

After a preliminary hearing Friday, District Judge Patrick Ford ruled all charges be sent on to the court of common pleas. She is free on $50,000 unsecured bail. One of the conditions of her bail prohibits her from consuming alcohol.

The charges stem from an incident during the early hours of Nov. 15 at the Sandy Club on Forest Avenue in DuBois.

The first witness was the bartender, Tammy Butlin, who was working that evening at the club. She said Updyke and her husband were both at the bar drinking.

Toward the end of the night Butlin felt Updyke was so intoxicated that she should not have another drink. Updyke had already consumed seven or eight bottles of lite beer.

When Updyke did ask for another drink she was told by Butlin that she had enough. Updyke rolled her eyes at her husband, Butlin said, and stated that she had to “listen to this without a drink.” Butlin told Updyke’s husband to take her home.

Updkye continued to argue with Butlin and was upset that her husband was able to continue drinking. She also argued with him because he wasn’t sticking up for her. This exchange went back and forth, Butlin said until Updyke went into the bathroom.

She was in there about five minutes or so, Butlin testified before she returned to the bar. Shortly after, Butlin noticed smoke coming from the bathroom.

Butlin went to the restroom door and opened it. Black smoke came out, she said. She then yelled at everyone to get out and she called 911.

During cross examination by Updyke’s attorney, Bruce Manchester, Butlin explained that normally Updyke was a “happy drunk,” and this was not typical behavior for her. Usually she and her husband were shut off around the same time at the end of the night, and Updyke was upset on this night because her husband was able to continue to drink.

Butlin also confirmed that she saw no one else enter the bathroom after Updyke left it. She stated she kept watching because Updyke was acting odd and she wanted her husband to take her home.

The time between Updyke leaving the restroom and Butlin seeing the smoke was about three minutes, she said.

Patty Marsh testified that she was at the Sandy Club that night and went into the restroom’s first stall around 2:30 a.m. Every thing at that point was normal and no one else was in there, she said.

Another witness at the scene, Brian Marnatti, testified that he smelled smoke that night and saw it was coming from the bathroom. When he opened the door, black smoke came out of one of the stalls. He found a fire extinguisher and was able to put the fire out.

He also testified that he was the one who provided security camera footage to investigators. He viewed the footage himself, which showed Updyke entering the bathroom and exiting just before the smoke was seen, he said.

Cpl. Greg Agosti, fire marshal for the Pennsylvania State Police, testified that he investigated the fire. It started in the first bathroom stall where there was burned material on the floor and plastic.

“The fire started on the floor and went up the wall,” he said.

A toilet paper dispenser had been consumed by the fire but there was wadded up toilet paper on the floor in the other stall that did not catch on fire.

He viewed the surveillance footage and also saw Updyke enter the bathroom with a lit cigarette. She was in there for four minutes before leaving. Shortly after this, smoke was visible and no one else had entered the room.

Agosti stated he did a recreation to determine the origin of the fire. This included trying to set toilet paper on fire with a lit cigarette. Although the paper would light, it would burn out quickly, he said. The only trial that matched the fire pattern and damage from the bathroom, involved using a direct flame on a roll of toilet paper with wadded up toilet paper in the center in the toilet paper dispenser.

He determined the cause of this fire was a direct flame, which would be a match or lighter, he said.

When asked by District Attorney William A. Shaw Jr. if there was any danger to the patrons in the club that night, Agosti said “absolutely.” There was a risk of smoke inhalation and the fire could have easily gotten to the ceiling. He noted that Marnatti put himself in danger when he extinguished the fire.

Irvine Waives Charges for Allegedly Resisting Police, Drug Possession

DUBOIS – A Brockway man who ran from police into a creek waived his right to a preliminary hearing Friday during Centralized Court at District Judge Patrick Ford’s office.

Timothy Ryan Irvine, 26, 354 Egypt Rd., Brockway, is charged with intentional possession of a controlled substance by person not registered, possession of a small amount of marijuana, possession of drug paraphernalia, recklessly endangering another person, resisting arrest and escape as a result of an incident on Nov. 17 in DuBois. He remains in the Clearfield County Jail in lieu of $25,000 bail.

According to the affidavit of probable cause, police learned Irvine, who had an active arrest warrant, was working construction at a site on DuBois Street in DuBois. At 10:50 a.m. they arrived near the construction scene, where Irvine was standing in a parking lot. He was advised to stay put there but he immediately began to flee on foot.

Officers followed him down an embankment into Sandy Lick Creek. He still did not comply with their commands to stop. Irvine proceeded into the water as an officer pulled out his Taser.

This officer warned Irvine that if he did not stop he would use the Taser, but Irvine didn’t listen. The officer then used the Taser but the prongs struck the water. Another officer went into the creek and grabbed Irvine, who continued to resist.

Two other officers went into the water and used their Tasers. After a few more minutes of fighting, he was eventually handcuffed.

Irvine had a black fanny pack that contained several oxycodone tablets, three syringes, a small plastic bag of marijuana, a metal spoon/knife combo with white powder residue on it, and two lock blade knives.

Prior to their encounter, officers had received information that Irvine might have a hand gun but no gun was found. Officers commented that because Irvine continually tried to reach something in a pocket as he ran, it is possible he discarded something while he was in the water. Police did search that area, but were unable to find anything.

According to online court documents, Irvine is charged in Jefferson County with manufacture/delivery/possession with intent to deliver a controlled substance, two counts of operating a methamphetamine lab, possession of red phosphorus, risking a catastrophe, deposits/stores/disposes chemical waste, knowingly possessing ephedrine, flight to avoid apprehension/trial/punishment and criminal conspiracy/operating a methamphetamine lab.

Embick Pleads Guilty to Having Sex with Teen Boys

CLEARFIELD – A Curwensville woman will be spending time in jail for having sex with two teen boys.

Stephanie Ann Embick, 31, 583 Naulton Rd., Curwensville, pleaded guilty Monday to statutory sexual assault-11 years or older, two counts of corruption of minors and indecent assault person less than 16-years of age.

President Judge Fredric J. Ammerman sentenced her to six months to one year in jail and two years consecutive probation. She was ordered to complete the Project Point of Light program and she will have to register her address under Megan’s Law for 15 years.

Because of the felony charge, she must submit to DNA testing at a cost of $250. She was fined $450 plus costs.

The charges stem from an incident in August of 2014 when she had sex with two boys after inviting them into her home.

Prior to sentencing, her attorney, Curtis Irwin stated that Embick was intoxicated during the incident. He asked the judge to give her a chance because this “was a one time incident.”

Ammerman called this “a rather odd case” and noted that she could have gone to a bar and picked up a man instead of approaching the teens outside her home. He also commented that this will “follow her forever.”

Because of her limited prior record, Ammerman stated that he couldn’t justify sending her to state prison.

According to the affidavit of probable cause, the boys told police they were riding their bikes on the street around 2 a.m. when Embick walked up to them. The boys said she touched and rubbed on them before she invited them into her home. She was intoxicated according to one of the victims who said she smelled of alcohol and was slurring her words.

She asked them to lie down on the couch. The boys didn’t do this, but instead sat on the opposite ends of the couch while she sat between them. She then reached over and turned off the lamp, leaving them in the dark.

One of them said he couldn’t tell how close she was but he could feel her breath on his cheek as she spoke. She started kissing one of the boys. Embick then got onto the floor and asked the boys to join her.

One of them did. While they were on the floor, she told him “I want you” and “I love you.” The victim got up and sat back on the couch.

Embick then pulled on his leg and got him back on the floor. She performed a sex act on him before they had intercourse, he told police.

Afterward, this first victim returned to the couch and the second victim got onto the floor where he had sex with her, according to the second victim.

When they were finished the boys sat around and “chatted” for two or three hours before they left.

During an interview with police, Embick initially denied sexual contact with either teen but eventually admitted to it. She said it just happened and she wasn’t sure how it was initiated.

CLEARFIELD – A Clearfield woman accused of selling cocaine pleaded guilty Monday during a special sentencing session of court.

Jody Rae Little, 52, 319 E. Market St., Clearfield, an inmate of the jail, pleaded guilty to possession with intent to deliver a controlled substance.

She was sentenced by President Judge Fredric J. Ammerman to six months to one year in jail and one year consecutive probation. She must attend drug and alcohol counseling and submit to DNA testing at a cost of $250. She was fined $100 plus costs.

Little was arrested as part of the “Operation Leaf Rake” investigation in September. According to a press release from District Attorney William A. Shaw Jr., this was a cooperative investigation coordinated by the Clearfield County District Attorney’s Office and the Pennsylvania Office of Attorney General, Bureau of Narcotics Investigation (State College Office).

The investigation focused on street and mid-level drug dealers who were selling controlled substances on the streets, in parking lots, in local establishments and in apartments and houses throughout the county.

According to the affidavit of probable cause, on Jan. 14 a confidential informant and undercover officer met with Little in the kitchen of her Clearfield home. The officer gave her $200 to purchase crack cocaine. Little said she would pick out “some good ones” for him.

She then went into another room. When she returned, she gave the undercover officer four small, plastic bags containing a white crystal substance. She told them she “hand-picked them.”

When the substances were tested, they were confirmed to be a total of 1.15 grams of cocaine.

In a separate case, Little pleaded guilty to two counts of possession of drug paraphernalia. For this she was sentenced to three months to one year in jail. This sentence will run concurrent with her other sentence. She was fined $50 plus costs.

DuBois Men Accused of Placing Deer Hair on Wrecked Vehicle

DUBOIS -Two DuBois men are facing felony insurance fraud charges for allegedly placing deer hair on a wrecked vehicle.

Colton Sharp, 20, 174 Swashbuckle Ct., 1576 Treasure Lake, DuBois and Scott Charles Sharp, 42, 55 Saint Marc Rd., 1766 Treasure Lake, DuBois, were charged through District Judge Patrick Ford’s office as a result of their alleged actions after Colton Sharp was in a car accident on Oct. 24, 2013.

According to the affidavit of probable cause, in November of 2013, police were contacted by Progressive Insurance Company regarding an insurance claim from Tera Huston on Oct. 24, 2013.

She reported that her son, Colton Sharp, wrecked her 2005 Subaru and she wanted to purchase collision insurance for that vehicle that she bought on Sept. 11, 2013. Progressive does allow a grace period to add new vehicles to a policy but this attempt to add the car was beyond their 30-day period, according to the criminal complaint.

The representative of Progressive told police that Colton Sharp provided a statement about the accident. He allegedly told them when a deer came onto the roadway he swerved to miss it and went off the road, causing the vehicle to roll twice. He said he didn’t know if he had struck the deer or not until he and his father later checked the vehicle and it had deer hair on it.

This statement to the insurance company was different than what he had told the original investigating officer on the incident. He told police on the day of the accident that he was traveling west on Bay Road near the back gate of Treasure Lake.

He said he was going about 29 miles per hour when he swerved to miss a deer. He said he lost control as the vehicle left the roadway. It struck an embankment and rolled over.

It was determined after an investigation that Sharp’s vehicle struck the embankment then traveled 96 feet, rolling over before coming to rest upright. High speed was listed as a contributing factor.

The original investigating officer did not see any deer hair on the vehicle. Sharp never told him he struck a deer, only that he had swerved to miss it. The vehicle was towed to a local business.

When Colton Sharp was questioned by police on Oct. 19, 2015, he was advised of the questions from the insurance company on the accident. Sharp agreed he told Progressive Insurance he and his father had found deer hair on the vehicle.

The officer advised Sharp that he was being deceptive because the police didn’t observe any deer hair on the car. Sharp then admitted he and his father, Scott Sharp, went to the towing lot after the accident and placed deer hair on the exterior of the car.

He said he got the hair from a deer his friend had killed in archery season. He also reported that he purchased the vehicle on Sept. 11, 2013 and failed to transfer it onto his insurance plan.

Scott Sharp was then questioned. He stated he was also responsible for placing the deer hair on the vehicle. He added that he realized this was wrong. He told police that Colton’s mother had no involvement with the incident.

The preliminary hearings in this case are scheduled for Jan. 15.

CLEARFIELD – A Madera man will stand trial for allegedly raping a girl over an approximate three-year period.

Robert Philbert Myers, 35, of Madera is facing 150 counts each of rape forcible compulsion and statutory sexual assault-11 years older; 100 counts each of involuntary deviate sexual intercourse-forcible compulsion and IDSI-person less than 16 years of age; and 250 counts each of indecent assault-forcible compulsion and indecent assault-person less than 16 years of age. These charges were held for court following a preliminary hearing on Wednesday.

Myers was free on $75,000 unsecured bail. However, his bail was modified to $150,000 monetary at his preliminary hearing. Myers is currently incarcerated at the Clearfield County Jail.

According to the affidavit of probable cause, on May 7 state police received a report from a girl who alleged she had been raped over an approximate three-year period. State police noted that the exact timeframe is unknown; however, the victim indicated it was at least three years of consecutive incidents with the most recent being in summer of 2014.

During interviews with state police and at the Children’s Advocacy Center, the victim said when she was 12-13 years old, Myers allegedly started to “awkwardly” brush against her lower back, buttocks and thigh area. Further, she alleged that Myers forced her to have sex with him for approximately three years.

The victim said that Myers allegedly raped her most of the time at a Madera residence. She said the first alleged rape occurred in Myers’ work truck somewhere pulled off the road, and it caused her pain. The victim said that one other alleged rape incident also occurred in Myers’ work truck.

She said when the alleged rapes occurred at the residence, Myers would ask if she wanted to go to the basement. She would say no, but Myers would be persistent and she was afraid of him. She said as a result, she would do what Myers told her to.

She also alleged that Myers forced her to perform a sex act on him at the residence. She said it occurred often and sometimes almost every day. She said the frequency of the alleged rapes varied from as often to two to three times per week to as little as once every three weeks.

According to the victim, Myers allegedly offered her trades for sex. For example, she said he allegedly helped with her car payment if she didn’t have enough money. She also alleged that Myers gave her cigarettes for sex; during the second alleged rape in his work truck, she said he even gave her marijuana.

The victim said Myers became very upset with her during the last alleged rape incident. She said it occurred in August of 2014, and Myers allegedly told her not to tell anyone. He allegedly warned her that she would get into more trouble than him.

The victim said Myers also allegedly threatened her with ultimatums if she didn’t give him sexual gratification.

CLEARFIELD – The two inmates who allegedly escaped from the State Correctional Institution at the Quehanna Boot Camp in November waived charges to court on Wednesday.

Nicholas Guido, 30, and Trent Robert Maffei, 20, have both been charged with escape, F3, by the Clearfield-based state police. Bail has been set at $100,000 for both Guido and Maffei.

According to the affidavit of probable cause, at approximately 12:50 p.m. Nov. 1, Guido and Maffei allegedly escaped from the SCI at the Quehanna Boot Camp in Karthaus.

Guido and Maffei were both inmates at the boot camp. Guido and Maffei were ordered to the Quehanna Boot Camp by the Courts of Common Pleas in Allegheny and Juniata counties, respectively.

Guido and Maffei were each serving 24-month State Intermediate Punishment (SIP) sentences. Guido was sentenced for a burglary with no person present in Allegheny County and Maffei for possession with intent to deliver in Juniata County.

Guido and Maffei were with other inmates outside within the boot camp property Nov. 1. Both were allegedly observed running to a black Sedan that parked off of Route 1011. Both Guido and Maffei allegedly entered the vehicle, which then fled north.

State police allegedly believed Guido and Maffei were in the Harrisburg area following their escape and with Blondena Marie Thompson, 19, of Hummelstown. Thompson has been charged with two counts of hindering apprehension or prosecution by Newport-based state police and is incarcerated in the Perry County Prison in lieu of $20,000 bail.

State police told the Carlisle Sentinel that Thompson allegedly allowed Guido and Maffei to use a phone, as well as provided them with transportation. All three were located by authorities and allegedly in Thompson’s vehicle on Nov. 2.

CLEARFIELD – During Centralized Court on Wednesday at the Clearfield County Jail, two former fire company officers accused of stealing more than $4,000 had all charges held for court.

Scott Norman McCracken, 38, and Jennifer Irene McCracken, 36, both of Grampian, have been charged with 13 counts each of theft by unlawful taking and theft by failure to make the required disposition of funds and one count of conspiracy/theft by unlawful taking.

According to the affidavit of probable cause, state police were contacted by a trustee of the Grampian-Penn-Bloom Fire Company. The trustee told state police Scott McCracken was the fire company’s president and treasurer of the fire police, and his wife, Jennifer McCracken, was the secretary for both the fire company and fire police.

While holding their officer positions within the fire company, the trustee told state police that Scott and Jennifer McCracken were in charge of the checkbooks. The trustee noted to state police that the couple wasn’t any longer in charge at the Grampian-Penn-Bloom Fire Company.

The trustee told state police a certified public accountant had completed a financial examination of the fire company’s records.  The results, the trustee said, identified 13 different checks written with payees allegedly listed as Jennifer McCracken on eight and Scott McCracken on four; a family member of Scott McCracken was allegedly listed as payee on one check.

The trustee told state police that there wouldn’t have been any reason for the fire company to write checks personally to Scott and Jennifer McCracken. The total for the 13 checks allegedly written out to the defendants was $4,350, according to the affidavit.

State police obtained a search warrant for the bank accounts of Scott and Jennifer McCracken. The results allegedly showed that the defendants appeared to be in financial distress with many overdraft fees. The 13 dispositions were provided by the fire company trustees and verified with the search warrant.

Pusey Gets 25-50 Years for Sexually Assaulting 9-year-old Girl

Wescott Pusey (Provided photo)

CLEARFIELD – A Hawk Run man will spend up to 50 years in state prison for sexually assaulting a 9-year-old girl.

Wescott Pusey, 41, 171 Telcott St., Hawk Run, was found guilty of involuntary deviate sexual intercourse with a child, and 30 counts each of aggravated indecent assault of a child, corruption of minors and indecent assault of person less than 13 years of age after a trial in August. On Thursday Judge Paul E. Cherry sentenced him to a total of 25 to 50 years in state prison.

A hearing was held prior to sentencing to determine if Pusey was a sexually violent predator. William Allenbaugh, a licensed psychologist and member of the sex offender assessment board, testified that he reviewed the case and he did determine that Pusey was a sexually violent predator.

Pusey’s attorney, Ronald Collins, argued regarding inconsistencies in the case surrounding the time period involved. Allenbaugh stated that the assaults occurred over a three-year period, according to the court documents he reviewed. Collins pointed to testimony from the victim and others and stated that it is possible the assaults all happened within a six-month period.

Allenbaugh explained that it didn’t matter if it was only six months because it has to be at least six months of abuse to fall into the predator category.

“The reality is that he did not stop himself,” he stated.

In his closing arguments in the hearing, District Attorney William A. Shaw Jr. stated that Pusey victimized a pre-pubescent child over a period of time and this meets the criteria for a pedophilia disorder.

Cherry decided that Pusey does meet the statutory requirements and ruled Pusey to be a sexually violent predator. Pusey will have to register his address with law enforcement for the rest of his life under Megan’s Law.

Prior to announcing the sentence, Cherry referred to Pusey as “sick” and stated that he needed help. He commented that Pusey had violated the sacred trust between an adult and child and noted the girl would have to “live with this forever.”

Pusey himself addressed the court asking Cherry to consider everything he has lost including his family and ministry. He asked for mercy.

According to the affidavit of probable cause, in May of 2014, police began investigating Pusey after receiving a report that he was inappropriately touching a 9-year-old girl while at a residence in Boggs Township.

The victim’s mother told police the girl mentioned to her that Pusey had a dirty habit. When she questioned the girl about this, the victim told her mother that when she watched television with Pusey, he would put his hand down her pants. She said this had been going on for over a year.

On one occasion, he came into the bathroom when she was naked and about to get in the shower. He was shirtless and hugged her. When she told him to stop, he said “just give me a couple minutes.”

Two other children told police that they had seen Pusey touching the girl while they watched TV and at other times.

Clearfield Woman Waives Charges in Theft Cases

CLEARFIELD – A Clearfield woman accused of stealing a combined total of more than $15,000 from her boyfriend and his mother waived all charges during Centralized Court on Wednesday at the Clearfield County Jail.

Linda Levoy Peters, 62, of Clearfield has been charged with 113 counts each of access device issued to another who didn’t authorize use, theft by unlawful taking and receiving stolen property.

In a second case, she has been charged with 70 counts each of access device issued to another who didn’t authorize use, theft by unlawful taking and receiving stolen property.

According to the affidavit of probable cause in the first case, the victim reported to Clearfield Borough police the alleged theft of money from his credit card. He alleged to police that his girlfriend, Peters, was stealing money from his accounts.

He explained to police that he’d provided Peters with his credit card to make purchases. However, he allegedly didn’t authorize 113 transactions made by Peters. The total allegedly stolen during the unauthorized transactions was $6,240, police said.

According to the affidavit in the second case, the victim contacted Clearfield County 911 to report the alleged theft of money from her credit card and bank accounts. Due to medical issues, she asked police to contact a family member for additional details about the alleged theft.

She told police that her son’s girlfriend, Peters, was allegedly stealing money from her accounts. She said the couple lived nearby and Peters helped her with purchases at the grocery store, with doctor’s appointments and household chores.

When police spoke with a family member of the victim, she said the victim had a Northwest Savings Bank card, a Discover credit card and a Wal-Mart Master Card. The Northwest Savings Bank account allegedly had a zero balance and was overdrawn; it also allegedly had numerous late charges and fees.

On April 30 a pin number was established for the Discover credit card. Afterwards there were allegedly withdrawals made at the Sheetz store on Nichols Street in Clearfield. In July there was allegedly an e-mail created for the Discover credit card in Peters’ name, so statements could be sent to her.

The Clearfield County Area Agency on Aging was contacted and assigned a caseworker to assist with a forensic analysis. The victim spoke to Peters, who had moved from her home to a motel room, and Peters allegedly confessed to stealing money.

On July 30 police interviewed Peters, who again allegedly confessed that she used money from the victim’s accounts for personal use without her permission. However, she told police that she didn’t know how much she had stolen.

A CCAAA caseworker and police met with the victim and her family member after an audit was completed and allegedly determined 70 transactions were unauthorized, which totaled $9,047.24.

Peters’ bail has been set at $25,000 unsecured in each case.

DUBOIS – A DuBois man accused of raping a mentally challenged boy waived his right to a preliminary hearing Friday during Centralized Court at District Judge Patrick Ford’s office.

Chris Lorene Turner, 52, an inmate of the jail, is charged with five counts each of rape of mentally disabled person, statutory sexual assault/11 years older, involuntary deviate sexual intercourse with person with mental disability, involuntary deviate sexual intercourse person less than 16 years of age and another sex-related offense. He remains in the county jail in lieu of $50,000 bail.

The charges stem from incidents in Huston Township between February of 2013 and February of 2014. According to the affidavit of probable cause, Clearfield County Children, Youth and Family Services reported that the victim disclosed to them that he was abused as a child.

He said he was first allegedly abused by the defendant when he was 5 years old and he went into treatment at age 10. The last time Turner allegedly sexually abused him was when he was 14 years old and he brought a gun to silence him.

The victim said he told his grandmother what was happening, but she didn’t believe him. She felt he was lying because he as a low IQ.

Police interviewed Turner Nov. 24 at the jail. He allegedly related that in February of 2013 he performed oral sex on the victim who was then 14 years old. He allegedly admitted it occurred five times on five, separate days. He allegedly stated that one of these times he had anal sex with him.
