Fugitive of the Week: Joni Shawley (Provided photo)

CLEARFIELD – A wanted fugitive, Joni Shawley, 34, of Madera has voluntarily surrendered, according to District Attorney William A. Shaw Jr.

Shawley was added to the Clearfield County Fugitive of the Week list on Monday.

On Sept. 25, 2015, Officer Daniel Podliski of the Clearfield Borough Police Department and agents of the Office of the Attorney General, filed a criminal complaint against Shawley. She was charged with delivery of a controlled substance, F, two counts, and criminal use of a communication facility, F3.

According to the affidavit of probable cause, on Jan. 5, 2015, agents received a call from a confidential informant who stated that he/she had contact with an individual, identified as Shawley, who sells prescription medication.

The next day, agents and Podliski met with the CI to set up a purchase of prescription drugs from Shawley. After exchanging a series of text messages and phone calls, the CI allegedly set up a purchase of Adderall and Hydrocodone pills from Shawley.

The CI and an agent then allegedly met with Shawley outside of a local business to complete the drug transaction. The Adderall and Hydrocodone pills, which were purchased, were sent to for laboratory testing.

A preliminary hearing was held Oct. 21, 2015, at which time all charges were held to court. On March 31 Shawley failed to appear at a Pre-trial Conference, and a warrant was issued for her arrest.

Shaw stated that on Tuesday Shawley voluntarily surrendered herself to deputies from the Clearfield County Sheriff’s Office. He thanked the Clearfield County Sheriff’s Office for its assistance with this case.

Anyone with knowledge of a fugitive’s location is asked to call Clearfield County Crime Stoppers at 800-376-4700. All calls to Crime Stoppers are confidential.

HARRISBURG – Pennsylvania State Police have announced the number of firearms purchase denials, subsequent investigations and arrests as a result of such investigations for the first quarter of 2016.

In Pennsylvania, the Pennsylvania Instant Check System (PICS) is used by county sheriffs, chiefs of police of cities of the first class and licensed firearms dealers to determine an individual’s legal ability to acquire a license to carry firearms or obtain a firearm through a purchase or transfer.

“When an individual attempts to provide false information on a state or federal form, an investigation is initiated and an investigation referral is sent to the corresponding law enforcement agency,” said Major Scott Price, director of the Bureau of Records and Identification.

“According to Pennsylvania law, a person commits a felony of the third degree if they make a false oral or written statement on any federal or state agency form or willfully presents false identification that is likely to deceive the seller, licensed dealer or licensed manufacturer. During the PICS process, some individuals are identified as having an active warrant for their arrest as well,” said Price.

During the first quarter, the following investigations were initiated by the state police Firearms Division and referred to Troops, municipal police departments and the Bureau of Alcohol, Tobacco, Firearms and Explosives for further investigation and possible prosecution.

Bloom Pleads Guilty to Assaulting Three People

CLEARFIELD – A Curwensville man accused of assaulting three people at a local club pleaded guilty Monday in Clearfield County Court.

Shad Lucas Bloom, 27, 11669 Curwensville-Tyrone Hwy., Curwensville, an inmate of the jail, pleaded guilty to three counts of simple assault and was sentenced to five months to two years in state prison by President Judge Fredric J. Ammerman.

He was fined $3 plus costs and he must pay over $800 in restitution.

Prior to sentencing, one of the victims addressed the court explaining that he still has problems as a result of the assault. He said he has double vision, and he has no smell or taste abilities. He asked to be reimbursed for a loss in his earnings.

Bloom also spoke, apologizing for what he had done and saying he wished he had acted differently. He stated that he was trying to defuse the situation and instead it “spiraled out of control.”

His attorney, Curtis Irwin, noted that Bloom is on state parole and will be transferred to a state prison to complete his sentence. He asked that Ammerman give Bloom a county sentence because he has already served five months. The county could parole him and then transfer him to state prison to serve out his parole violation, he suggested.

Ammerman commented that no matter what he did, Bloom would be going back to state prison and he couldn’t control what the state parole board did with Bloom. He noted that Bloom had almost finished his state parole when this incident occurred.

His parole sentence is from March of 2008 when Bloom was given five to 10 years in state prison for eight counts of aggravated assault. According to published reports, in the early morning hours of April 22, 2007 Bloom led police on a high-speed chase through Clearfield Borough and Lawrence Township, which ended with him crashing into a DuBois City Police car.

In all he struck three police vehicles and two officers were injured. He was originally charged with criminal attempt/criminal homicide in this case.

According to the affidavit of probable cause in the latest case, on Oct. 31 police were called to the Curwensville Moose in response to a report of an assault in the parking lot. After a number of people returned to the lot following a wagon ride, three people were involved in an altercation.

After this was broken up, they tried to enter the bar area but the victim was refused access by a member. Bloom approached the victim and they began arguing. Bloom then threw the victim to the ground, causing injuries. A second victim saw what was happening and yelled for Bloom to stop. Bloom then threw her to the ground causing her to be injured. After seeing this, the second victim’s husband approached Bloom, who struck him once in the face with a closed fist, knocking him unconscious. Bloom then entered his vehicle and fled the scene.

This third victim suffered several broken bones in his face and a concussion.

CLEARFIELD – A DuBois man who threatened to shoot a woman and her children was sentenced Tuesday during plea and sentencing court in Clearfield County.

Joseph Francis Alvin, 32, 135 E. Weber Ave., DuBois, an inmate of the jail, pleaded guilty to simple assault and harassment.

President Judge Fredric J. Ammerman sentenced him to 30 days to 60 days in jail and two years consecutive probation. He was fined $135 plus costs. Alvin was ordered to complete anger management counseling, drug/alcohol counseling and undergo a mental health assessment.

The charges stem from an incident on Nov. 18 at Alvin’s residence.

Prior to sentencing, the victim told Ammerman she wants to have contact with Alvin so that she can be a support system for him.

Ammerman stated that he has no tolerance for violence against women or children and warned Alvin that if he violates his probation, he would sentence him to state prison.

According to the affidavit of probable cause, police were called to the home at 8:26 p.m. The victim said Alvin was screaming at her and threatening to harm her and her children. She explained that he had been sent to a mental health facility the previous week for threatening to shoot her.

Before they arrived, police were advised that he left the residence in a gold Nissan Altima. Then he returned, and left again as an officer appeared on the scene. Another officer in a vehicle got behind Alvin’s vehicle, activated his emergency lights and followed Alvin’s vehicle as he made a circle around the block and back to the residence.

The officers made contact with him, asking what was going on. He said he and the victim got into an argument so he left the residence. He came back because he saw police were there.

The victim told police that earlier that day she discovered Alvin was abusing his medications.  She then told him she wanted him out of the house and he said he was going to move out.

Later when she arrived home from work, he was still there and sleeping, she told police. When he woke up he told her if she died, he would kick her in the face. He started yelling at her asking if she was going to “302 him again or call the cops.” He stated that just because she didn’t find a gun didn’t mean he did not have one. She asked him if he had a gun and he laughed at her, she said.

According to the complaint, as she got their things together because they were leaving for the night, he approached her in an aggressive manner. She sat back because she thought he was going to hit her. Alvin got right in her face and said “[Expletive], I hate you and I will shoot you in the face. Don’t think I won’t.”

She then got off the couch and started to call 911. As she did this, he told her to call the cops because he would shoot them too. Before he left the home, he pointed his finger at her like a gun and said “bang, bang, your kids are dead.”

While she waited for police, she said he came back around the block, got out of his car and started screaming, that she was “done.” He then got into the trunk of his car and started running towards the door. She went inside the home and locked the door as she waited for police.

According to online court documents, Alvin was charged with disorderly conduct after an incident at his residence on Nov. 7 when he was allegedly confrontational with officers and was ordered to stop causing a disturbance. However, he allegedly went back outside and began using profanity and yelling again, according to a police report.

Sedor to Stand Trial for Allegedly Assaulting Pregnant Woman, Putting Gun to her Head

DUBOIS – A DuBois man will stand trial for allegedly assaulting a pregnant woman and putting a gun to her head.

Jeremy Sedor, 39, 20 Clipper Ct., DuBois, was charged by Sandy Township police with terroristic threats, unlawful restraint, two counts of simple assault, recklessly endangering another person and harassment after an incident at his residence on March 22.

Following a preliminary hearing during centralized court on Friday, District Judge James Hawkins sent these charges on to the court of common pleas. Sedor’s bail was set at $25,000, unsecured.

According to the affidavit of probable cause, police received a call from the victim at 3:24 a.m. reporting an assault by Sedor.

When an officer spoke with her at a location away from the home, he saw blood splattered on her face, chest, hands and clothing. Her nose was bleeding; she had red marks around her neck and her mouth and contusions on her left knee. There was also blood outside her vehicle. The victim explained to the officer that she is seven months pregnant.

She said the assault began after she confronted Sedor about having contact with his ex-girlfriend and he “flipped out.” He threw her down a hallway and then down some steps.

She tried to leave and was loading some belongings into her vehicle in the garage when he physically held her to keep her from leaving, according to the complaint. At one point he grabbed her by the throat and took her vehicle key from her. He then allegedly slammed her into the garage wall and threw her down onto the concrete as she tried to gather her things.

He went into the house and allegedly returned with a gun. He held it to his head, stating he was going to kill himself. She told police he then turned the gun on her, pointing it at her head stating he was going to kill her and then himself. As he was doing this, she was punching at his face in an attempt to get away.

Eventually she was able to get into the driver’s seat of the vehicle. Sedor then tried to rip her out of the vehicle and again grabbed her around the head, she said. While he was doing this, she bit him in the shoulder to try to get him to let her go. She told police Sedor tried to rip her out of the vehicle and punched her in the stomach.

Officers attempted to make contact with Sedor at the residence, but he fled the scene before they arrived. In the driveway, they found blood and pieces of a rain guard from the driver’s side window of a vehicle that had been ripped off.

CLEARFIELD – District Attorney William A. Shaw Jr. has announced Clearfield County’s Fugitive of the Week.

Shaw identified the fugitive as Mathew Silvis, 28, of Park Street, Sykesville. Silvis is wanted for failure to appear at a pre-trial conference on March 31.

On Oct. 7, 2015, Officer Derrick Welsh of the Sandy Township Police Department filed a criminal complaint against Silvis. He charged Silvis with driving under the influence of a controlled substance, M1; use/possession of drug paraphernalia, M; and careless driving, S.

According to the affidavit of probable cause, on Aug. 1, 2015, police were dispatched for a report about a vehicle accident. Upon arrival at the scene, Welsh made contact with the operator of the vehicle who was later identified as Silvis.

Welsh immediately detected signs of impairment. After a series of sobriety tests, Welsh determined that Silvis was allegedly under the influence of a drug or combination of drugs.

Silvis was then allegedly found to be in possession of three, different types of prescription pills and a glass pipe. Silvis was transported to the DuBois Penn Highlands Hospital for blood testing.

A preliminary hearing was held Nov. 13, 2015, at which time all charges were held to court. On March 31 Silvis failed to appear at a pre-trial conference, and a warrant was issued for his arrest.

Silvis is described as a Caucasian male who stands 6 feet tall. He has brown hair and eyes.

Anyone with knowledge of Silvis’ location is asked to call Clearfield County Crime Stoppers at 800-376-4700. All calls to Crime Stoppers are confidential.

John Paul Lutzow, 33, of Clearfield has been charged by Clearfield Borough police with six counts each of photograph/film/depict on computer sex act-knowingly or permitting child, child pornography and criminal use of a communications facility and 15 counts of corruption of minors.

Lutzow is currently incarcerated at the Clearfield County Jail in lieu of $50,000 bail. His preliminary hearing has been scheduled for 11:45 a.m. April 20 during centralized court at the jail.

According to the affidavit of probable cause, on March 9 police received information that Lutzow had allegedly exchanged nude photos with a teenage girl who had recently stayed at his residence. A witness told police she had observed the explicit messages between Lutzow and the victim.

Police subsequently responded to the Lutzow residence and obtained consent to search his phone. It was seized by police. Lutzow told police he didn’t know anything about messages between him and the victim

After returning to the station, police looked through Lutzow’s phone. Police were able to observe some messages to and from the victim, which had been deleted. An e-mail observed by police prompted for a text messaging application to be reinstalled to continue a conversation with the victim.

Police proceeded to interview the victim at the station. On Feb. 20 she told police she spent the night with her friend at the Lutzow residence and approximately one week later, she and Lutzow started talking “inappropriately.”

The first three or four days, she said they just talked until Lutzow allegedly sent her a photograph of his private area. Afterward she told police that Lutzow asked her to send him photographs of her “private parts,” which she did, and he stated he “liked them.”

Lutzow told her that he had dreams about having sexual relations with her friend, the victim alleged in her interview with police. She also told police she was afraid for her friend and didn’t want to see her get hurt.

The girl told police Lutzow admitted to her that in the past, he’s had sexual relations with a teen. The victim stated that because she became afraid for her friend, she sent the photographs to Lutzow. She and Lutzow used a text messaging app to send the photographs back and forth, she told police, and she provided Lutzow’s username.

On March 10 Lutzow agreed to an interview with police. He told police he believed the allegations against him were made up. Lutzow denied sending/receiving any sexual photographs with the victim.

On March 23 police received information from the victim’s father who had an iPod with a text messaging app. Lutzow was in her contacts, he told police.

On March 31 police attended a Child Advocacy Center interview with the victim. During the interview, she provided a similar account as she had previously to police.

On April 4 police reviewed the extracted data from all devices that were returned from a detective with the State College police. On the victim’s cell phone, police observed multiple images of her that were partially or completely nude.

There were a total of 74 images on the victim’s phone, which were similar to those described in her interview with police and at the CAC, according to the affidavit.

On Lutzow’s phone, there weren’t any pornographic images physically located. The detective was also unable to locate the text messaging app on the phone and to identify if it had been previously installed on it.

On the victim’s iPod, police observed multiple photographs of a male with his pants down who matched the victim’s description of Lutzow. There were nine, different photographs of Lutzow’s private area, according to the affidavit.

Also, the detective was able to recover some of the deleted incoming and outgoing messages from the text messaging app on the victim’s iPod.

On April 6 police made contact with Lutzow, and he agreed to come to the station for a second interview. During the interview, he denied the photographs recovered from the victim’s iPod were of his private area.

However, police observed that Lutzow was wearing similar clothing in both the photographs and during his interview. Police also noted other similar identifying characteristics.

Lutzow eventually admitted to police that photographs recovered from the victim’s iPod were of his private area. He admitted to sending them to her through a text messaging app on an old cellular phone. Lutzow also admitted to requesting that the victim send him inappropriate photographs of herself.

Lutzow told police he committed the crimes because he was “lonely,” and he knows that he is a “piece of [expletive]” for doing it.  “I want to die,” he told police.

Cole Accused of Not Properly Caring for Autistic Child

DUBOIS – A Penfield woman has been charged by state police with a felony count of endangering the welfare of children for allegedly not caring properly for her three-year old autistic child.

Christal Ann Cole, 32, 37 Pondersoa Dr., Penfield, was charged after an incident Jan. 29 at 6:15 p.m. when a woman allegedly found the child clothed only in pajamas, shivering on her front porch. The victim had no jacket or shoes. The woman reported that the child who was getting into her garbage bags said “help” to her.

According to the affidavit of probable cause, this witness did not know the child or her mother, but she believed the victim belonged next door. She said when she took the victim to the residence the front door of the trailer was open.

The woman yelled but she did not get a response. After she stepped into the home and said “hello,’ Cole came out of the rear bedroom and appeared to have been awakened. She told the woman she was sleeping when the victim wandered out the front door.

After the witness left the residence, she could hear Cole allegedly screaming at the child. The witness stated that this is not the first time the victim was outside without supervision. Once last summer, this witness found the girl under her porch and other times she saw the victim wandering around without supervision, she told police.

Another resident of the witness’ home told police that he was home all afternoon. At 3:30 p.m., he heard a knock on the door and their dog started barking. But when he opened the door he didn’t see anyone around. He stated that this could have been the victim. He added that he has seen the child outside alone all the time.

When Cole was interviewed by police, she said she and her mother were sleeping at the time of the incident. They both went to the rear bedroom around 4 p.m. The victim was also taking a nap on a circular bed in the living room where she prefers to sleep. Cole explained the child had a bed in her room, but she doesn’t like to sleep in it. She said she had already spoken to the landlord about getting a different lock on the door that the child couldn’t reach.

Police were called back to the Cole residence March 19 for a reported disturbance. Neighbors said they could hear yelling inside the trailer. Several of them had knocked on the doors and windows without a response.

When police arrived, they heard the three-year-old yelling and being defiant. After the officer knocked on both doors and several windows announcing himself, Cole finally came to the door. She was very lethargic, slow and appeared intoxicated, he reported. There was an overwhelming odor of mint mouthwash coming from her. She admitted to being under the influence of alcohol but claimed she only had one drink.

Cole’s mother explained she was trying to give the child a bath and said she would watch over the child because Cole seemed incapable of doing it. Cole told the officer they had installed an alarm on the top of the front door to alert them if the child wandered off.

An officer spoke with a caseworker from Children, Youth and Family Services about this case March 30. The caseworker said her investigation revealed that the child had not been receiving proper medical care. Cole claimed she did not have transportation to a doctor but when the worker offered to provide transportation, Cole didn’t call her back with an appointment date and time.

Cole’s preliminary hearing is scheduled for centralized court on April 29.

Donnelly Facing Two Felony Counts of Retail Theft

DUBOIS – A DuBois man has been charged with two felony counts of retail theft for stealing from a local Wal-Mart on two, different occasions.

Daniel Joseph Donnelly, 32, 26 E. Weber Ave., DuBois, was charged by Sandy Township police after Donnelly was seen on surveillance footage from Wal-Mart removing two GPS units from a display on Feb. 14.

According to the affidavit of probable cause, a loss prevention employee noticed the units that had been on mounting posts were missing. As the surveillance footage was reviewed to determine what had happened, employees could see two men entering the store and proceeding to the electronics department.

One of these men removed the GPS units by force and put them in a shopping cart under some clothing. This man selected various video games and put them under the clothing, as well. The man then took the cart to another section of the store.

The video allegedly shows this man walking out of the store with a big bulge sticking out of the back of his winter coat. The other man was not around at this time.

The shopping cart was found in the last aisle with nothing but the clothing items in it. Employees checked that area and were unable to find the missing merchandise.

The man left the store just 13 minutes after he entered. The total value of this theft was $637.68.

An employee recognized the man as someone who had been arrested a year ago for a similar incident. Photos of both incidents showed the man who was wearing the same winter coat on both occasions.

The newer photos were shown to the officer who handled the previous incident and he remembered Donnelly. Another officer was also able to confirm the man as Donnelly.

The loss prevention manager advised police that Donnelly was a suspect in another theft in September. At that time, the store had only a photo to provide police and the officers did not do a report on that incident.

According to the employee, on Sept. 28 an unknown male was seen walking through the ladies department with a GPS box in his hand. He appeared suspicious, so the employee followed him. Moments later he observed the man conceal the GPS box under his jacket. The man then had a square-shaped bulge underneath his coat.

The man went out the grocery exit where the EAS system beeped, which indicated he had something that had not been deactivated. A cashier tried to get the man’s attention, but he didn’t stop.

When the employee who was following him pointed out to the man that the other employees were trying to get his attention, the man swore and said he didn’t have time for this.

The employee followed him outside the store where the man got into a vehicle. The employee said he could not stop him because he had just gotten off work. This employee identified the man as Donnelly. The value of the GPS unit was $199.

Police discovered that Donnelly had pleaded guilty to two previous retail thefts.

Donnelly is scheduled for a preliminary hearing May 6 during centralized court at District Judge Patrick Ford’s office.

CLEARFIELD – All charges were held to court after a preliminary hearing in the case against a Pittsburgh woman who is accused of attempting to jump from a second-floor window of the Clearfield County Courthouse in early March.

Nicolette Joann Holzer, 35, of Pittsburgh has been charged with criminal attempt/escape; resisting arrest; four counts of disorderly conduct; and criminal mischief. She is incarcerated at the county jail in lieu of $100,000 bail.

According to the affidavit of probable cause, on March 8 sheriff’s deputies were assigned to motions court being held before Clearfield County President Judge Fredric Ammerman. Probation officers escorted Holzer to a holding room just outside of the courtroom for detainment.

As standardized practice, Holzer was detained with her hands handcuffed behind her back and placed on the couch just inside the doorway. Deputies described Holzer as being agitated and crying while repeatedly saying, “I need help! I am addicted to methamphetamine, and I need to go to rehab!”

Holzer also stated, “You guys don’t do an [expletive] thing for people who need help!” A probation officer, Steve Gillespie, went into the courtroom to notify Ammerman that Holzer was recently tested, and it showed positive results for methamphetamine. When Gillespie returned to the holding room, he notified Holzer she was going to county jail.

At that point, Holzer “lunged off” the couch toward a window across the room. A deputy tried to grab Holzer’s arm to get her back to the couch but only caught the end of her jacket. Holzer broke away from the deputy’s grasp and lunged into the window while screaming, “I just want to die,” according to the affidavit.

Holzer made contact with the window and broke the glass with her head in an attempt to jump out of it. The deputy grabbed Holzer’s arm and pulled her out and away from the window. Holzer was then taken to the ground by the deputy.

Gillespie assisted the deputy with controlling Holzer, who was allegedly kicking, screaming and resisting efforts to control her. Holzer was advised by the deputy to stop fighting and relax.  However, Holzer allegedly continued to resist and screamed that she “wanted to [expletive] die.”

Holzer repeatedly hit her face off of the floor. Another deputy had to assist in order to prevent Holzer from sustaining further injury, according to the affidavit. The sheriff and his chief deputy entered the holding room, and a third deputy retrieved a set of shackles and placed them on Holzer.

Holzer permitted them to sit her up to be examined for injuries. Holzer had a minor laceration to the center of her forehead, which caused minor bleeding. Deputies attempted to clean and examine the wound.

In order to de-escalate Holzer’s anxiety, deputies moved the handcuffs from behind her back to the front with a restraint belt being used. Deputies also requested emergency personnel to respond to the scene.

Holzer was placed back onto the couch to await the arrival of emergency personnel. She continued to cry and stated, “I don’t want to hurt you guys, just myself. Death is better than going back to jail. That place is bad for me.”

When emergency personnel arrived, deputies assisted them with taking Holzer to the ambulance outside. Holzer was placed into the back and secured to the stretcher with three safety seatbelts due to her physical combativeness. A deputy accompanied emergency personnel transporting Holzer for treatment.
