Woman Gets State Prison for Stealing from Employer

CLEARFIELD – A Philipsburg woman accused of stealing from her employer pleaded guilty recently in Clearfield County Court.

Darcie Sue Womer, 26, 111 Stewart Ln., Philipsburg, pleaded guilty before Judge Paul E.  Cherry to felony counts of forgery and theft by unlawful taking.

She was sentenced to 10 months to three years in state prison, according to court documents. She must pay over $3,100 in restitution.

The charges stem from incidents while she was employed at the Auto Zone in Philipsburg.

According to the affidavit of probable cause, on July 9 an employee told police that there was a large sum of money missing in the last few weeks. He had looked at reports that showed Womer had completed many returns to numerous people but many of these returns did not have a customer signature. Instead these returns had x’s.

When another employee spoke with her, Womer admitted to taking parts from their inventory, scanning them, and using the name of a prior customer to complete a return transaction. She either forged a signature, wrote a line or an x on the forms, she said. She kept the money and then returned the part to the store’s inventory. These transactions totaled $3,163.62.

During an interview with a police officer, Womer stated that she felt pressured into doing the returns because she was low on money and wanted to help her family. She started making these fraudulent transactions on June 27, she admitted.

DUBOIS – A DuBois man accused of showing online pornographic videos to a teenage girl, as well as having sexual contact and taking an inappropriate picture of her pleaded guilty Thursday instead of taking his case to trial in Clearfield County Court.

Jarrod Morgan Gesin, 36, of DuBois pleaded guilty to all of the charges, including photograph/film/depict on computer sex act/knowingly or permitting child; child pornography; corruption of minors; and indecent assault. “It’s the same as going to trial and getting a conviction on everything,” said District Attorney William A. Shaw Jr.

Gesin will have to undergo an assessment to determine if he is a sexually violent predator. An assessment hearing and sentencing will be scheduled within 90 days, and Gesin’s sentence will be up to the judge, he said. Shaw noted that Gesin has a prior record, but he wasn’t certain if it included any sex-related offenses.

According to the affidavit of probable cause, DuBois City police received a report about a sexual assault from a teenage girl on Feb. 15, 2015. The day before, she told police she was alone in the living area with Gesin watching television when he brought up the topic of pornography and asked if she watched any.

The victim told police that Gesin then accessed pornographic Web sites on his cell phone and showed videos to her. She said Gesin was mostly watching the videos while she was trying to watch a movie on television.  She also told police that Gesin showed her images, which contained nudity, of his “online girlfriend” from his cell phone.

According to the victim, Gesin talked inappropriately to her. She also said he took an inappropriate picture of her, as well as had sexual contact with her during the incident.

Police obtained and executed a search warrant, seizing a phone, charger and cable from Gesin’s room. Gesin asked police if he could show them the pictures on his phone, as he believed he knew why they were seizing it.

During an interview with police, Gesin admitted to watching pornographic videos from Web sites while at the house. However, he claimed that he stopped when the victim came downstairs.

When police asked him how the victim knew which pornographic Web sites he was on, Gesin replied that she must have seen the screen on his cell phone. Gesin denied that he had any sexual contact with the victim or that he had any naked pictures of her.

Police said a search warrant was obtained and executed on the cell phone. Pennsylvania State Police then conducted a forensic examination of the cell phone, which turned up an inappropriate picture of the victim; it had been taken on the date and time coinciding with her report to police.

Convicted Rapist Gets State Prison for Assaulting Area Woman

CLEARFIELD – A convicted rapist accused of assaulting an area woman was sentenced to state prison Thursday by Judge Paul E. Cherry.

Demmin Dwayne McKinney, 41, an inmate of the Clearfield County Jail, pleaded guilty to failure to comply with registration requirements, indecent assault and false identification to law enforcement. He was sentenced to 42 months to 10 years in state prison.

Originally he was also charged with rape and involuntary deviate sexual intercourse.

The charges stem from an incident in Clearfield Borough on March 26 when McKinney who was having a sexual relationship with the victim allegedly raped her.

Prior to sentencing a hearing was held to determine whether he should be classified as a sexually violent predator.

Molly Wagner, a member of the Sex Offender Assessment Board testified that she spoke to the victim about her relationship with McKinney that began after they met online.

The victim told Wagner they started having consensual sex often after first meeting in February of 2015.

When asked by McKinney’s attorney Curtis Irwin if Wagner was aware of his prior history, Wagner admitted that McKinney had a previous victim who was only 13 years old.

She agreed this was a different than that case, and that McKinney had not used threats or violence in the assault. She stated that McKinney suffered from a personality disorder.

Irwin noted that Wagner never spoke with McKinney.

McKinney testified that he did speak with another person from the sexual offender’s board at the jail. He stated that he signed papers at that time regarding the case. McKinney explained the other investigator told him the questions would be the same in any other interviews so he declined another interview with Wagner.

“I didn’t want to talk to anyone else,” McKinney said.

Because Wagner did not speak with McKinney before preparing her report on him, Irwin asked for another assessment.

Cherry denied this and declared McKinney a sexually violent predator based on the information in Wagner’s report.

According to the affidavit of probable cause, the victim reported March 26, 2015 that her boyfriend had raped her the previous night. She showed police a contusion on her right arm that she had gotten from him a few days earlier. She said she didn’t report the incident because he “sweet talked” her and convinced her everything was OK.

She told officers she wanted him removed from her apartment and asked for a protection from abuse order. She was issued an emergency PFA through a local magistrate.

When police tried to serve the PFA they were unable to identify him with the name the victim had provided. After several different names and birthdates were given, the man was transported to the county jail.

He eventually gave his correct name as Demmin McKinney. He admitted to police that he had run away from a halfway house after serving eight years in state prison for the rape of a person less than 16 years old.

He explained he used online dating sites to meet up with women so he could stay on the run.

Police interviewed the victim again. She explained she met McKinney on an internet Web site and he gave her his phone number. Shortly after this, he said he wanted to move in with her and get married. She admitted the relationship was sexual but said that night was the only time he forced himself on her.

In July McKinney was sentenced to 60 days in jail for violating the PFA by writing to the victim from jail, according to a previously published report.

DuBois Man Accused of Repeatedly Calling 911 Waives Hearings

DUBOIS – A DuBois man accused of repeatedly calling 911 waived his rights to preliminary hearings Friday during centralized court.

Calvin Leroy Bloom, 52, 208 S. Brady St., DuBois, is charged with communication with 911 and harassment in two cases, false reports and communications with 911 in a third case, terroristic threats, harassment and communication with 911 in a fourth case and communication with 911, harassment and disorderly conduct in a fifth case. In a sixth case, he is charged with possession of a small amount of marijuana. He is on supervised bail of $5,000, unsecured in each case.

According to the affidavits of probable cause, the calls began in January. Between Jan. 30 through Feb. 4, Bloom allegedly called 911 over 10 times during which he demanded outrageous things.

He asked to speak to the president or to be “patched through to the White House.” Other times he demanded police officers bring him beer, asked to speak to Megan Kelly of Fox News and claimed to be God. Once he stated he was in love and trying to quit smoking.

Bloom even called to ask how many times he had called 911. He was repeatedly warned he could be arrested because he was taking officers away from their regular duties.

During one officer’s shift on Feb. 20, Bloom allegedly called 911 four times reporting he was “locked up in the pit of hell,” warning that they were going to “burn,” complaining about babysitting and saying someone “blew their brains out.”

When officers spoke with him at a friend’s apartment he was highly intoxicated. He claimed a homicide he had reported did not happen yet. The friend said he came to her place to use the phone to call 911.

On March 7 he called again saying he didn’t like people putting their feet in his doorway. He allegedly made seven calls to 911 between 7:27 a.m. and 9:49 a.m. He was again advised not to call 911 unless he had an emergency.

Also on that date, police checked on him at his residence. As he talked to an officer, Bloom was looking for a cigarette butt. When he did this, he moved a small bag of what appeared to be marijuana.

He then allegedly picked it up and said “I suppose you want this,” tossing it onto a coffee table near the officer. The contents of the bag later tested positive for marijuana.

Police were alerted on March 12 that the 911 center had received six calls in 30 minutes from Bloom, according to the complaint. He was irate and swearing at the operators. When an officer contacted him, Bloom swore at him and hung up.

On March 29 Bloom called 911 allegedly saying there are “guns everywhere.” He said he would get a gun, the police would have guns and the whole place would be surrounded with guns. He swore at the operator before he hung up.

When an officer called him, he allegedly swore at him. Bloom was asked why he was calling 911. He replied “come on up here if you want to get shot.” Bloom was advised to stop threatening police but he stated he would come there (the station) and “kick your [expletive].” He was told that was not the best thing for him to do, but Bloom repeated his threat before hanging up the phone.

Bloom was contacted again with a similar result, but Bloom never showed up at the police station.

Later that evening, police say Bloom called again swearing, stating he needed to go to jail because no one cared and accusing the police of playing games with him.

After police responded to his apartment, they asked why he called 911 asking to be locked up. Bloom asked if they were going to lock him up again. He was advised to stop calling 911 and was told if he did and it wasn’t an emergency, he would be arrested. Bloom swore at them as they left the residence.

Shortly after this Bloom allegedly called yet again stating “I don’t have an emergency. This is Calvin. I just wanted to tell you, [expletive] you!”

DUBOIS – A DuBois man has been charged with indecent exposure for allegedly standing naked in his doorway near an elementary school.

Gregory V. Moore, 65, 201 Juniata St., DuBois, was also charged by DuBois City police with open lewdness and disorderly conduct. His preliminary hearing is scheduled for May 27.

According to the affidavit of probable cause, on Feb. 23 at 2:50 p.m., a woman allegedly saw a man standing in the doorway of the residence at 201 Juniata St.

She told police the man dropped his pants and then dropped his shorts while he touched himself. This doorway faces the Juniata Elementary School where children were playing in the playground/parking area.

She told police he stood there for a period of time, and he was visible to anyone in that area. Eventually he shut the door. The witness pulled her vehicle into the school where she informed the principal and school police officer.

During an interview with police, Moore admitted he was home at the time of the incident. When the officer questioned him further, Moore said he did not want to talk to him.

The witness was shown a photo lineup of eight men. She was able to pick out Moore as the one she saw in the doorway.

Poorman Accused of Stealing from Elderly Woman

DUBOIS – A woman has been accused of theft for taking funds from an elderly woman.

Aimee Sue Poorman, 50, whose current address is listed as Gendive, Mont., was charged by Pennsylvania State Police with a felony count of theft by unlawful taking as a result of her actions beginning in April of 2012 when she was granted power of attorney for the victim.

A preliminary hearing in this case is scheduled for centralized court in DuBois on June 10.

According to the affidavit of probable cause, in June of 2014 the victim’s daughter told police that Poorman was cashing checks signed by the victim. She also received a bill from collections for more than $9,500 from a credit card.

The daughter told police that Poorman cashed out the victim’s IRA for $24,723.12. Of this $10,000 was put into the victim’s money market account and $10,000 was put into the victim’s peak account, but no one knew what happened to the remaining cash.

When a trooper spoke with the daughter again in February of 2015, she said she was getting all the paperwork together for the case. She also said her mother’s car had been sold and she didn’t know where that money went.

A representative from the Clearfield County Area Agency on Aging had tracked Poorman down, and Poorman was supposed to be paying $25 per month toward the money taken, she said

The next time the trooper had contact with the victim’s daughter was in October of 2015. At that time, she told them her mother had dementia. She again stated that Poorman cashed out the IRA and put funds into other accounts but kept more than $4,000. She also accused Poorman of cashing out a $160,000 CD.

A trooper spoke with Poorman later that month via telephone. Poorman said that the victim told her to use what she needed to keep the bills current. She admitted to writing checks to herself and said all the receipts were in a china cabinet.

She said the IRA money went into the victim’s other accounts. The CD was either split between the accounts or put into just one of them, but she couldn’t remember. Poorman suggested the cash may have been taken to her house and stated she did not spend any money out of the CD.

Poorman did admit to using between $50,000 and $60,000 that the victim knew about for bills. She explained she had to have a four-wheel drive vehicle to get her in and out of the doctor’s office so she bought a Chevy Blazer. She also admitted she bought heating oil.

Poorman explained her house was in foreclosure. She said she wanted to pay the money back, adding she didn’t do it maliciously. When the victim said to use what she needed, she said she just did it and didn’t question anything.

CLEARFIELD – An Osceola Mills woman was sentenced to jail Tuesday for breaking into a residence.

Heidi Jo Lego, 36, 110 Stone St., Osceola Mills, was sentenced to 60 days to one year in jail and two years consecutive probation for criminal trespass, harassment and public drunkenness after she pleaded guilty. Judge Paul E. Cherry also fined her $400 plus costs.

The charges stem from a July 5 incident in Osceola Mills when Lego drunkenly entered a home, fought with the resident and continually insisted she was in her own home.

The victim told police, according to the affidavit of probable cause, that he and a friend watching television upstairs when they heard someone walking on the stairs.

The victim looked out of his room and he could see someone was there. This person got to the top of the stairs and then fell down causing damage to a sliding door. After the person got up, she entered the bedroom.

When the victim told her to get out of his house, she refused.  She claimed that she lived here and she wasn’t leaving her house. Again she was told to get out. She refused and slapped him in the face.

She went back downstairs but wouldn’t leave because it was her house, she said. She even told him he had no right to be inside her home.

After the police came, she told them the same thing and said she was not leaving.

The victim said he didn’t know her or why she was there. He told police he had not given her permission to be inside his home.

CLEARFIELD – A Clearfield man accused of exchanging inappropriate photographs with a teenage girl waived his right to a preliminary hearing Wednesday during Centralized Court at the Clearfield County Jail.

John Paul Lutzow, 33, of Clearfield has been charged by Clearfield Borough police with six counts each of photograph/film/depict on computer sex act-knowingly or permitting child, child pornography and criminal use of a communications facility and 15 counts of corruption of minors. Lutzow is currently incarcerated at the jail in lieu of $50,000 bail

According to the affidavit of probable cause, on March 9 police received information that Lutzow had allegedly exchanged nude photos with a teenage girl who had recently stayed at his residence. A witness told police she had observed the explicit messages between Lutzow and the victim.

Police subsequently responded to the Lutzow residence and obtained consent to search his phone. It was seized by police. Lutzow told police he didn’t know anything about messages between him and the victim

After returning to the station, police looked through Lutzow’s phone. Police were able to observe some messages to and from the victim, which had been deleted. An e-mail observed by police prompted for a text messaging application to be reinstalled to continue a conversation with the victim.

Police proceeded to interview the victim at the station on Feb. 20. She told police she had spent the night with her friend at the Lutzow residence and approximately one week later, she and Lutzow started talking “inappropriately.”

The first three or four days, she said they just talked until Lutzow allegedly sent her a photograph of his private area. Afterward she told police that Lutzow asked her to send him photographs of her “private parts,” which she did, and he stated he “liked them.”

She and Lutzow used a text messaging app to send the photographs back and forth, she told police, and she provided Lutzow’s username.

On March 10 Lutzow agreed to an interview with police. He told police he believed the allegations against him were made up. Lutzow denied sending/receiving any sexual photographs with the victim.

On March 23 police received information from the victim’s father who had an iPod with a text messaging app. Lutzow was in her contacts, he told police.

On March 31 police attended a Child Advocacy Center interview with the victim. During the interview, she provided a similar account as she had previously to police.

On April 4 police reviewed the extracted data from all devices that were returned from a detective with the State College police. On the victim’s cell phone, police observed multiple images of her that were partially or completely nude.

There were a total of 74 images on the victim’s phone, which were similar to those described in her interview with police and at the CAC, according to the affidavit.

On Lutzow’s phone, there weren’t any pornographic images physically located. The detective was also unable to locate the text messaging app on the phone and to identify if it had been previously installed on it.

On the victim’s iPod, police observed multiple photographs of a male with his pants down who matched the victim’s description of Lutzow. There were nine, different photographs of Lutzow’s private area, according to the affidavit.

Also, the detective was able to recover some of the deleted incoming and outgoing messages from the text messaging app on the victim’s iPod.

On April 6 police made contact with Lutzow, and he agreed to come to the station for a second interview. During the interview, he denied the photographs recovered from the victim’s iPod were of his private area.

However, police observed that Lutzow was wearing similar clothing in both the photographs and during his interview. Police also noted other similar identifying characteristics.

Lutzow eventually admitted to police that photographs recovered from the victim’s iPod were of his private area. He admitted to sending them to her through a text messaging app on an old cellular phone. Lutzow also admitted to asking that the victim send him inappropriate photographs of herself.

Lutzow told police he committed the crimes because he was “lonely,” and he knows that he is a “piece of [expletive]” for doing it.  “I want to die,” he told police.

BREAKING: Former CCCTC Executive Director Gets Probation for Not Reporting Inappropriate Behavior of Substitute Teacher

CLEARFIELD – A former Clearfield County Career and Technology Center executive director accused of not reporting the inappropriate behavior of a substitute teacher was in court Thursday.

William H. Weaver, 56, 152 Lighthouse Ln., Bellefonte, pleaded guilty before Judge Paul E. Cherry to two misdemeanor counts of failure to report or refer and disorderly conduct. He was sentenced to two years probation.

Weaver is not to hold any position where he would be overseeing juveniles. He was ordered to undergo a mental health assessment and complete 100 hours of community service. Weaver was fined $1,100 plus costs.

These charges stem from incidents at the school when Darice J. Brady-McKee, 35, LaJose allegedly talked about her sexual encounters, displayed part of her breast and legs to students and showed other students naked photos of a man.

Prior to sentencing Assistant District Attorney Ryan Dobo explained that there were questions regarding the plea during a pre-sentence conference. He told Cherry that the charges were downgraded from a third-degree felony to a second degree misdemeanor based on the information. He said for the crime to be considered a felony, the Commonwealth would have to prove the defendant acted willfully and there were questions as to whether he was willful in this case or not.

“I think probation is appropriate,” Dobo said.

Weaver’s attorney, Karen Muir, stated that he was “ready to accept the consequences” of his actions and wanted to move forward.

When asked if he wanted to say anything, Weaver said no.

One other administrator, Cathy M. Thomas, 62, 274 Saint Agnes Dr., Morrisdale, who was the assistant director at the time of the incidents, is also charged in this case. Both she and Weaver have since resigned their positions. Her case is still pending.bna

Brady-McKee was originally charged with two felony counts of dissemination explicit sexual material to minors and 30 counts of corruption of minors. She pleaded guilty in March to one count of corruption of minors. Cherry sentenced her to three years probation and she was fined $350 plus costs.

According to the affidavit of probable cause, several students reported Brady-McKee to their regular teacher when she returned. They said Brady-McKee made comments about her personal sex life and showed them bruises on her breast from a sexual encounter. This was then reported to Thomas because Weaver was not in that day. He was however, informed of the situation when he returned.

The students supplied written statements of what had occurred. When police talked to Weaver about it, he stated he spoke to Brady-McKee in March 2015 and she denied the accusations. She was placed on a list of substitutes to call only if there was no one else available. Because of multiple teachers calling off work, he did allow her to substitute for a different class on March 31, 2015 and again on May 1.

When the students saw she was back on May 1, they complained and many of them contacted their parents. One of these parents then contacted police.

An officer asked Weaver why he didn’t report the March incident to the parents, Children and Youth Services or Child-Line but he didn’t give an answer.

An investigation was done starting with the statements the students had written.

Later when police attempted to contact Weaver, they discovered the phone number given by the school was incorrect and they were unable to set up an interview.

Several “Operation Ice Storm” Drug Suspects Appear for Hearings

DUBOIS – Several people arrested after the “Operation Ice Storm” drug investigation had preliminary hearings scheduled for Tuesday during a special session of centralized court in District Judge Patrick Ford’s office.

In March, over 30 people were arrested for their connection with a drug ring that was selling methamphetamine and heroin in the area, according to previously published reports.

The arrests were the result of a year long investigation that involved the DuBois City and Sandy Township police departments, the Clearfield County Drug Task Force, the District Attorney and the Pennsylvania Office of Attorney General.

According to one grand jury testimony in the investigation, on April 20, 2015, Robert Selfridge in cooperation with authorities, purchased an eight-ball or 3.5 grams of methamphetamine from Lacey Dean. She told Selfridge that she would be obtaining the drug from “King Douche,” a nickname used by Brian Duttry.

He met with Dean at the DuBois Mall parking lot where he paid her $550. She left that area and drove to Brockway where she met Duttry. Eventually she left him and returned to the mall lot to deliver the drug to Selfridge.

Cassidy Kaizer told the grand jury that she was getting methamphetamine from Eric McDonald, who also used Duttry as a source. Another woman testified that she was getting methamphetamine from Duttry at the end of 2014 into 2015. According to other testimony, Brian Schaeffer would drive Duttry to Philadelphia to pick up the drug.

On April 27, 2015, Duttry allegedly left an eyeglass case containing 26 grams of meth in a jewelry store.

This investigation also involved the execution of a search warrant on a vehicle driven by Hank Petrillo on June 19, 2015. Traveling with him from Philadelphia was Jessica Vicklund and Joseph Alvin. Officers found approximately 12.38 grams of heroin and 12.91 grams of meth in the vehicle. Other items located were related to the packaging of drugs. Alvin had over $2,600 in cash.

A confidential informant had made two controlled purchases from Vickland earlier in June.

Another informant bought meth from Kelly Zameroski, who was arrested after a traffic stop in October. Officers found four grams of meth, $8,000 in cash, ledgers with names of customers listing their drug debts, and packaging materials.

Zameroski told investigators she was getting meth from Selfridge and Nicolette Holzer. She said of the $8,000 found in her vehicle $4,650 was to be paid to Holzer.

Duttry, 33, 1633 Hungry Hollow Road, DuBois, is charged with manufacture/delivery/possession with intent to deliver a controlled substance, criminal conspiracy, criminal use of communication facility and dealing in proceeds of unlawful acts in one case and manufacture/delivery/possession with intent to deliver a controlled substance, criminal conspiracy, criminal use of communication facility, possession of a controlled substance and criminal solicitation/simple assault in another case.

According to the affidavit in the second case, during a drug buy, Duttry asked an informant to beat up a woman for ripping off his girlfriend.

After a preliminary hearing, Ford ruled all charges be sent on to the court of common pleas. Duttry’s bail is $25,000 in each case. Duttry is currently an inmate of the Elk County Jail.

Lacey Marie Dean, 34, 113 Main St., Brookville, is charged with manufacture/delivery/possession with intent to deliver a controlled substance, criminal conspiracy, criminal use of communication facility and dealing in proceeds of unlawful acts. After her hearing Tuesday, Ford sent her charges on to the county court. Her bail is $5,000, unsecured.

According to grand jury testimony, Eric McDonald was at the 312 W. Long Ave. residence of Nathan Smith. When they searched that apartment at the end of August, they found several items used to manufacture meth. The area was evacuated as a precaution.

Smith testified before the grand jury that McDonald stayed one day before returning to Corine Shannon’s apartment.

Shannon testified that McDonald asked if he could stay at her apartment to make meth to sell to pay his landlord. In exchange for the use of their apartment, Shannon said he gave her meth.

McDonald, 30, 320 W. Long Ave., DuBois, an inmate of the jail, is charged with manufacture/delivery/possession with intent to manufacture or deliver a controlled substance, criminal conspiracy, operating a meth lab, possession of red phosphorus, recklessly endangering another person, and risking a catastrophe. He waived his right to a hearing in March. He remains in the Clearfield County Jail in lieu of $25,000, bail.

The following co-defendants waived their rights to preliminary hearings Tuesday.

Joseph Francis Alvin, 32, 162 Hanes Dr., DuBois, is charged with manufacture/delivery/possession with intent to deliver a controlled substance, criminal conspiracy and dealing in proceeds of unlawful activities. His bail is $25,000.

Jessica Vickland, 35, 314 Shaffer Ave., DuBois, is charged with manufacture/delivery/possession with intent to deliver a controlled substance, criminal conspiracy, criminal use of communication facility and dealing in proceeds of unlawful activities. Her bail is $25,000.

Kelly Elizabeth Zameroski, 22, 661 Juniata St. Ext., DuBois, is charged with manufacture/delivery/possession with intent to deliver a controlled substance, criminal conspiracy, criminal use of communication facility and dealing in proceeds of unlawful activities. Her bail is $100,000.

Nathan Smith, 32, 312 W. Long Ave., DuBois, is charged with manufacture/delivery/possession with intent to deliver a controlled substance and criminal conspiracy. His bail is $1,000.

Corine Darci Shannon, 35, 9 N. Jared St., DuBois, is charged with manufacture/delivery/possession with intent to deliver a controlled substance and criminal conspiracy. Her bail is $10,000.

Frederick Oddo, 46, 226 Jefferson St., Brookville, an inmate of the jail, is charged with deliver firearms after 48 hours elapsed, possession of firearm prohibited, and firearm ownership-duty of other person. He is accused of selling a firearm to Selfridge. In a second case he is charged with false identification to law enforcement. His bail is $10,000 in the first case and $1,000 in the second.

Selfridge had been charged with possession of firearm prohibited, and firearm ownership-duty of other person with his hearing also scheduled for Tuesday. At that time, these charges were withdrawn.

Selfridge is still facing two counts each of manufacture/delivery/possession of a controlled substance with intent to deliver, possession of firearms prohibited, firearms not to be carried without a license, possession of drug paraphernalia as well as flight to avoid apprehension and default in required appearance. He is scheduled to be sentenced in this case on June 14, according to online court documents.

In unrelated cases, the following defendants waived their hearings, sending their charges on to the county court.

Justin M. Zeruth, 28, 36 Courson Rd., DuBois, is charged with manufacture/delivery/possession with intent to deliver a controlled substance, possession of a controlled substance, possession of drug paraphernalia, dealing in proceeds of unlawful activities, and criminal conspiracy. His bail is $1,000.

According to his affidavit, police went to a hotel room in DuBois Dec. 3 to investigate a report of a strong odor of marijuana. Zeruth and another individual were found in the room allegedly with over $1,000 in cash, drug paraphernalia, and methamphetamine.

Joseph Clair Frantz, 27, 205½ E. Washington St., DuBois, is charged with manufacture/delivery/possession with intent to deliver a controlled substance, criminal conspiracy and possession of a controlled substance. His bail is $1,000. According to his complaint, Frantz was allegedly involved with the sale of 1.24 grams of meth to an informant on March 26.

Mazza Waives Charges in Home Invasion, Drug Cases

DUBOIS – A DuBois man allegedly involved in a home invasion and robbery waived his right to a preliminary hearing during a special session of centralized court Tuesday.

Joseph Michael Mazza, 23, 128 Reed St., DuBois, an inmate of the Jefferson County Jail, is charged with robbery, criminal conspiracy/robbery, burglary, criminal conspiracy/burglary, firearms not to be carried without a license, possession of firearm prohibited and aggravated assault.

These charges stem from a June incident in Kittaning when Mazza and two other people allegedly entered a home demanding money and drugs that they believed had been stolen from them.

According to court documents, police had been tipped off that Brandon Patino was selling drugs out of his West Long Avenue apartment in DuBois. A search warrant was executed on the residence, but Patino was not at home. Officers found guns, $15,000 in cash and items used to package drugs.

During Patino’s preliminary hearing in March, Mazza testified that he knew Patino was receiving meth from California in the mail and selling it. He wasn’t sure how much he was getting but said he thought it was a lot. He stated the drugs were coming in voodoo dolls that were hollow.

Not long after the raid at his apartment, Patino called Mazza asking for help.  “He wanted to get money back from a girl who robbed him.”

Mazza stated that at one point, Patino was contemplating whether he should kill everyone “so there would be no witnesses” but decided that was a bad idea.

The two men put bandanas on their faces and went into the home. Patino hit a “kid” that was in the kitchen when they entered. They held the occupants at gun point, Mazza said. Patino hit the girl who supposedly robbed him and he was trying to figure out where the drugs were.

Karli Chambers also entered the residence. She pulled the phone wires out and yelled at the girl, he said.

Mazza said he was nervous and at one point the gun went off. They dispersed, he said, with Chambers grabbing the cell phones, a wallet and a purse.

Patino allegedly gave him more than two bricks of heroin for his help.

Patino, 34, currently an inmate of the Clearfield County Jail, is charged with five counts of possession of firearms prohibited, five counts of firearms not to be carried without a license, dealing in proceeds of unlawful activity, manufacture/delivery/possession with intent to deliver a controlled substance, criminal conspiracy-manufacture/delivery/possession with intent to deliver a controlled substance, burglary, robbery, criminal conspiracy/robbery, and aggravated assault. Patino’s bail is $50,000.

In a second case, Mazza is charged with possession of firearm prohibited, possession of a controlled substance, manufacture/delivery/possession with intent to deliver a controlled substance, possession of drug paraphernalia, possession with intent to deliver drug paraphernalia, dealing in proceeds of unlawful activity, and prohibited offensive weapon. He waived these charges as well. His bail in this case is $1,000.

According to that affidavit, a probation officer discovered Mazza had guns in his possession. After police executed a search warrant on his residence, they found an assault rifle, numerous glass pipes, bongs, over 100 grams of marijuana, 32.30 grams of cocaine, knives, brass knuckles, a stun gun and more drug paraphernalia.

Myers Pleads Guilty in Jewelry Theft Case

CLEARFIELD – A DuBois man accused of stealing more than $6,000 in jewelry from his neighbor pleaded guilty Tuesday during plea and sentencing court.

Donald Robert Myers, 38, 59 Atlantic Ave., DuBois, pleaded guilty to a felony count of theft by unlawful taking and was sentenced by Judge Paul E. Cherry to two years probation.

It was part of his plea agreement that he pay restitution in full prior to sentencing or serve 90 days in jail. It was stated he had already paid the requested $1,300 in restitution. He was fined $250 plus costs and was ordered to have no contact with the victim.

Myers was charged after an incident in July of 2015.

According to the affidavit of probable cause, Myers went into the Sandy Township police station and met with an officer. Myers stated that he thought had “messed up.”

He explained that a week ago, he had found some jewelry on his front porch. He said that he buys property from storage sheds and he believed one of his children must have found the jewelry in something he had purchased and was playing with it on the porch.

He took this jewelry to Ben Rossi Jewelers and got $300 for it.

During the interview, he started to cry and told the officer that he got a call from his neighbor who said jewelry was missing from her house. He was very emotional as he again told the officer that he messed up.

While the officer was meeting with Myers he got a dispatch call to make contact with the victim. He excused himself from Myers and called the victim. She told the officer that she had numerous pieces of jewelry stolen and she suspected Myers had taken it.

The victim explained that she and her family were out of town on a family vacation in July and she had made arrangements with Myers to check on the house and let her dogs out.

When she returned, she noticed the jewelry was missing. She text-messaged Myers and told him she was missing jewelry. Myers then told her that it has to be there and he would help her look for it.

She became suspicious of Myers after she asked him a few times more about the jewelry. Myers either ignored her or was playing it off. On July 29, she text-messaged him again and asked for her jewelry back.

After a little while, Myers’ wife, Tracy, text-messaged the victim asking her to call. When she did, Tracy Myers explained that Myers told her he found the jewelry under her bushes when he was cutting her grass.

He had taken the jewelry to Ben Rossi and had cashed it in for $300.

The victim gave the officer a description of the stolen items. There were four diamond and gold rings and two sets of diamond and gold earrings. The total value of the items she listed as $6,376.

After speaking with the victim, the officer went back to the interview room to speak to Myers. The officer advised him he had spoken with the victim and asked about Myers finding the items in the yard.

He denied this and continued stating he found them on the porch. The officer said he wanted to talk to Myers’ wife and Myers gave him her cell phone number.

The officer spoke to Tracy Myers, who confirmed her story that he told her he found the jewelry under a bush at the side of her home. She told the officer it was a mistake and they would get them back.

The officer returned to the interview room and advised Myers he did not believe his story. Myers was then advised of his rights. Myers agreed to continue speaking with the officer.

When the officer pointed out that his story was not consistent with his wife’s story, Myers began to cry and kept saying he was sorry. He said he was trying to get the jewelry back.

He eventually stated that he was in the victim’s home taking care of the dogs when he saw the rings and earrings on a table. He admitted he took three rings and a set of earrings and sold them.

The officer met with John Rossi of Ben Rossi Jewelers, who confirmed Myers cashed in five pieces of jewelry for $300. Rossi turned over one set of earrings that the store still had in his possession. He stated he had already sent out the other pieces, but he would try to get them back.

Rossi did eventually get back these pieces as well and turned them over to police. The victim identified the items as the ones that were missing from her home. Only one item was not recovered, a diamond wedding band with a value of $600.
