Driver in High-speed State Police Pursuit Waives Hearing

CLEARFIELD – A Sandy Ridge man is facing charges after leading a state trooper on a high-speed pursuit while under the influence of an illegal drug.

Joshua Duane Knepp, 20, has been charged by Trooper John A. Bacher IV of the Clearfield-based state police with two felony counts of fleeing or attempting to elude an officer.

Knepp has also been charged with misdemeanor counts of intentional possession of a controlled substance, use/possession of drug paraphernalia and DUI/controlled substance, plus 24 summaries.

Knepp waived his right to a preliminary hearing Wednesday during centralized court at the Clearfield County Jail. His bail has been set at $25,000 monetary.

According to the affidavit of probable cause, on Aug. 14, Bacher was fueling up his patrol unit at Snappy’s Convenience Store when he saw a crotch rocket making a redundant trip around Houtzdale.

This caught his attention and he began to follow the motorbike on Sue Street. From a distance of approximately 15 feet, it didn’t appear to have a license plate and Bacher activated his emergency lights.

When Bacher attempted a traffic stop, the driver proceeded to turn right onto Sterling Avenue. At its intersection with Spring Street, Bacher was within two feet of the motorbike and saw its license plate was concealed by the rear wheel.

At this time, Bacher saw the registration had expired in May. The driver accelerated south and a pursuit ensued with Bacher’s siren activated. It continued onto Route 253 into Ramey at speeds reportedly in excess of 100 miles per hour.

Bacher pursued the driver back into Houtzdale on Route 253 and then into Osceola Mills on Route 53. He said the driver ignored every stop sign and red light and crossed the center line numerous times as he fled.

When the pursuit reached Phoenix Road in Rush Township, Trooper Shane Murarik was traveling towards Bacher’s patrol unit and the motorbike was between the two PSP units. The driver slowed to a coast and began to weave around Murarik’s unit.

Bacher proceeded to exit his unit and ran up to the motorbike. He yelled, “freeze,” which the driver failed to do. Bacher subsequently deployed his taser to strike the driver and terminate the pursuit.

The driver was identified as Knepp and his license was under DUI suspension. During a search of his person, he was found in possession of three suspected Klonopin pills in a clear plastic bag in his pocket.

Knepp was also wearing a backpack, which he gave consent for state police to search. Inside the backpack was a lockbox and Knepp provided the combination and it contained residue.

Another consent search was given from the rear lockbox of the crotch rocket. It yielded a small tactical pouch containing approximately $2,200 in bulk cash in numerous denominations and was found to be consistent with illegal drug activities.

One bill was rolled up as though it had been used as a snorting device, Bacher said in the affidavit.  He observed Knepp’s eyes and noted they were extremely glassy and bloodshot; his pupils weren’t even, which is attributed to being under the influence of an illegal drug.

Knepp allegedly admitted to using marijuana approximately three hours before the incident. He was taken for a legal blood draw and for the purposes of a medical clearance.

DuBois Man Accused of Having Sex with Mentally Disabled Woman

DUBOIS – A DuBois man is facing rape charges for allegedly having sex with a mentally disabled woman.

Joseph Brian Himes, 33, was charged by DuBois City police after an incident on Feb. 27.

According to the affidavit of probable cause, the victim’s mother returned home to find her daughter’s bedroom door closed.

When she knocked and tried to open it, she realized someone was holding it shut. She used such force to open the door that the door jamb became dislodged from the wall.

A man hurriedly left the room and said his name was Joe. The victim identified the man as the one with a Facebook profile named “Joe Wad.”

The victim allegedly told her mother they had sex, but she didn’t want to do it.

After police arrived, she was taken for a sexual assault examination that showed she had suffered internal trauma. DNA swabs were also taken as evidence.

As part of the investigation, the victim was interviewed by an expert at the Child Advocacy of Clearfield County where she indicated that the sexual encounter was not consensual.

In the opinion of the interviewer, the victim was not capable of consenting even if there was consent at the time of the assault.

A further background check on the victim revealed that she was intellectually disabled and had a low IQ.

When Himes was questioned by police, he admitted the profile “Joe Wad” was his and said he knew the victim. He denied having sex with her saying “No. It would be wrong.”

He submitted to a DNA swab to be compared to the samples taken from the victim.

Himes is charged with felony rape forcible compulsion, felony rape mentally disabled person, felony sexual assault, misdemeanor indecent assault person with mental disability and misdemeanor indecent assault.

He is being held on $50,000 bail with a preliminary hearing scheduled for Sept. 7.

EXPLOREJEFFERSON: Jefferson Co. Man Accused of Sending Ex-Girlfriend Over $3,000 Worth of Crude T-Shirts and Underwear

YOUNG TWP., Pa. (EYT) – A Jefferson County man is facing criminal charges after he allegedly used a cellular phone to access a woman’s accounts and order sex toys and thousands of dollars worth of shirts with crude statements on them.

Court documents indicate that the Punxsutawney-based State Police filed criminal charges against 25-year-old Daniel F Smith Jr. of Punxsutawney on August 21.

According to a criminal complaint, around 7:30 a.m. on June 6, Trooper Mosier of the Punxsutawney-based State Police spoke with a known victim who stated that a man she had formerly dated, Daniel Smith, used a cellular phone to access various accounts without her permission.

The victim used the phone occasionally when the two were dating but returned it to Smith after they broke up.

Smith allegedly used the phone to send Facebook messages to the victim’s coworkers, changed the passwords on two of her email accounts, shared screenshots of her messages on both Instagram and Pinterest, and posted her Snapchat information on the app “MeetMe” in an effort to have random men contact her.

He also allegedly used the phone to order over $3,000.00 worth of t-shirts and underwear with crude statements on them such as “Sl*t,” “Truck Sl*t,” and “Just Another Sl*t on Birth Control.”

Additionally, he allegedly ordered a sign and a toe ring with crude statements on them, a number of bondage restraints, and various sex toys.

The victim was able to cancel all of the orders except for four of the t-shirts, totaling $70.90.

Trooper Mosier spoke to Smith via phone around 3:10 p.m. on June 6.

Smith stated that he reset the phone to factory settings and sold it after his relationship with the victim ended. He could not remember the date he sold the phone but said it was shortly after they broke up.

Smith said he sold the phone on Craigslist. He also said he did not know the buyer, and that he met the individual at an area Walmart where he claims to have exchanged the phone for $200.

According to the complaint, when questioned about accessing the information, Smith said he didn’t have the phone and had reset it.

He also told Tpr. Mosier that “the bank would pay for the stuff ordered” and “she could send all the stuff back and she wouldn’t be out any money.”

Additionally, Smith allegedly called the victim nine times on June 2 between the hours of 4:09 a.m. and 4:28 a.m. for “no legitimate purpose.”

The following charges were subsequently filed on Tuesday, August 21, in Magisterial District Judge Jacqueline J. Mizerock’s office:

Denny Scott Bailey (Provided photo)

CLEARFIELD – An accused murderer will face charges for assaulting a corrections officer at the Clearfield County Jail, Lawrence Township police say.

Denny Scott Bailey, 38, of Woodland allegedly became “uncooperative” and “head-butted” a CO in the face on Friday evening. Charges are currently pending at this time.

In early April, Bailey and Kenja Kasheem Tew, 22, of Glen Richey were charged with criminal homicide, assault, kidnapping to inflict injury or terror, conspiracy and related charges for the death of Chase Anderson, 19, of Curwensville in August of 2017.

According to previously-published GANT News reports, the investigation began when Anderson’s mother reported him missing Aug. 22, 2017 to the Curwensville Borough Police Department.

Through witness interviews, it was learned that Tew had allegedly made comments that Anderson was “not coming back alive” or “not coming back at all.”

After Tew was in custody, he took investigators from the Pennsylvania State Police to Anderson’s burnt and decomposed body in a wooded area in Pike Township.

On Sept. 19, 2017, Bailey showed PSP investigators where he’d buried the murder weapons near his residence.

Investigators also learned that Tew and Bailey had used the “ruse” of a drug package to get Anderson to the wooded area where they murdered him.

Once there, they assaulted him, state police said. Each alleged the other stabbed Anderson several times before burning his body.

Chantell Renee Demi, 27, of Woodland told investigators that she went to the store and bought duct tape, garbage bags, etc., for Bailey.

She admitted to picking out the location and helping Tew and Bailey clean up when they got home after the murder.

Later Demi helped destroy the vehicle that Bailey and Tew used to take Anderson into the woods. She was allegedly assisted by Joseph Ralston, 38, of Curwensville, who has also been charged for his involvement in the cover up.

Demi recently pleaded guilty to conspiracy to commit murder and related charges. She’s also agreed to cooperate with the commonwealth in the prosecution of her co-defendants. She will receive a minimum sentence of 20 to 40 years of incarceration.

Kruise Pleads Guilty in Lawrence Twp. Burglary, Arson Case

CLEARFIELD – The second of two men charged with burglary and arson for entering a home in Lawrence Township pleaded guilty Tuesday during colloquy court.

Nevin Edward Kruise, 27, of Westover pleaded guilty to arson, burglary, risking a catastrophe, reckless burning, possessing instruments of crime and tampering with evidence.

He was sentenced by Judge Fredric J. Ammerman to one to 10 years in state prison and he must pay restitution of over $56,000.

The charges stem from a break in at a Lawrence Township home on May 24.

Prior to sentencing, Ammerman commented that he is “disgusted with this whole situation,” adding it was “bad enough if they did not light the fire.”

He went on to assure the victims that he remembered their feelings about the case from the sentencing hearing of the other man, Stephen Jon Zimmerman, 20, of New Millport in August.

During that hearing, Ammerman read from a victim impact statement that stated the children of the family live in fear that the “bad guys are coming back.”

“Our home was our safe space,” he read. They went on to question why the men didn’t just take what they wanted and go instead of starting the fire.

At that time, Ammerman commented that he would like to have given Zimmerman 10 to 20 years in prison, but he could not and he said the same thing about Kruise.

Both men did not have much of a criminal record, which is why their minimum sentences were so low, he explained.

When Kruise was asked if he wanted to address the court, he stated that he was sorry.

According to the affidavit of probable cause, when the owner of the home returned he noticed that his ATV was missing and the front door of the residence was wide open.

Once inside, he found a pour pattern on the floor of what appeared to be gasoline and there was fire damage to his living room furniture.

It was discovered the burglars had gotten in through an open bathroom window by removing the screen.

Jewelry, a video game console, DVDs and other items were missing. Damage indicated that the actors had tried to gain entry to a gun safe.

On June 6, a man contacted police reporting that someone had tried to sell him an ATV through Facebook messenger. This witness then contacted the person selling the vehicle, Zimmerman, and got photos that confirmed it was the missing ATV.

During his contact with this witness, Zimmerman admitted the ATV was stolen.

The witness advised police that Zimmerman would be at the Glen Richey Fire Hall at a certain time.

Police responded to the scene where they took Zimmerman into custody.

During an interview, Zimmerman identified Kruise as the one who actually entered the home through the window and who tried to enter the safe while Zimmerman loaded the ATV. He also claimed Kruise poured gasoline through the residence and lit it.

Kruise was found at a Grampian residence and taken into custody.

In his interview with police, Kruise said it was Zimmerman, who initially entered the home and later set a fire with gasoline.

Three Men Sent to State Prison in Unrelated Drug Cases

CLEARFIELD – Three men accused of dealing methamphetamine and other drugs in unrelated cases were sentenced to state prison during colloquy court Tuesday.

Derrick John Graham, 29, of Clearfield pleaded guilty to felony counts of possession with intent to deliver a controlled substance and criminal use of communication facility and was sentenced by Judge Fredric J. Ammerman to six months to two years in state prison.

Graham was arrested after an encounter with Clearfield Borough police on April 29, 2017 near East Seventh Street.

According to the affidavit of probable cause, Graham was questioned after he was seen in a vehicle sitting in a parking lot where suspected drug activity was occurring.

After speaking with him, police determined he was under the influence.

A search revealed he reportedly had six bags of marijuana, three bags of methamphetamine, an assortment of pills and drug paraphernalia.

A message on his phone confirmed that he had been arranging drug sales, police said.

Robert Lee Miller, Jr., 47, also of Clearfield, pleaded guilty to felony counts of possession with intent to deliver-methamphetamine, dealing in proceeds of unlawful activities and criminal use of communication facility as well as driving under the influence and possession of drug paraphernalia.

Ammerman sentenced him to 21 months to five years in state prison.

Clearfield Borough police say on Sept. 18, 2017, a white truck was spotted with Miller driving it. Because of prior dealings with him, the officer was aware he had a suspended driver’s license. He then initiated a traffic stop.

Miller appeared to be under the influence and was taken into custody, according to the affidavit.

A search of his person uncovered $4,511 in cash, police said.

In his vehicle officers reportedly found over 10 grams of methamphetamine, 1.2 grams of the stimulant Pentylone and drug paraphernalia.

His phone had messages that appeared to be setting up purchases of meth, marijuana and Percocet.

William Patrick Donnelly, 36, of Philadelphia pleaded guilty to felony counts of criminal use of communication facility and delivery of a controlled substance in addition to misdemeanor possession of drug paraphernalia.

He received 35 months to six years in state prison.

Donnelly was arrested June 1 after a controlled purchase of methamphetamine from a confidential informant. He had 3.5 grams of methamphetamine and cocaine, according to this affidavit.

On Friday, Donnelly waived his right to a preliminary hearing in a new drug case, for which he is charged with a felony count of dealing in proceeds of unlawful activities, a misdemeanor count of intentional possession of a controlled substance and possession of drug paraphernalia as well as three traffic summaries.

His vehicle was stopped Aug. 22 in DuBois.

At that time, Donnelly was found to be carrying meth and $4,948 in cash, according to the report.

Quick Sent to State Prison for Burglarizing Residences in East End

CLEARFIELD – A Clearfield man was sent to state prison Tuesday for burglarizing residences in Clearfield’s East End.

Travis James Quick, 34, pleaded guilty to two counts of burglary and was sentenced by Judge Fredric J. Ammerman to nine months to two years less one day in prison and one year consecutive probation.

The charges stem from an incident on April 27 when Quick was spotted taking things from several porches in the neighborhood by a resident.

Prior to sentencing, his attorney, Steven Johnston, asked for a county sentence because this was “the least dangerous burglary you could do.”

Johnston also claimed Quick thought he was at his brother’s house.

According to the affidavit of probable cause, Clearfield Borough police were called to the area for a report of a man removing things from a neighbor’s porch.

When they arrived the man had left, but officers were able to locate him walking nearby.

They described him as having slurred speech and being slow in his movements. He was carrying several items including a hatchet device in a holster.

When asked to drop the hatchet, he complied.

It was determined that he had two warrants and he was taken into custody.

When he was searched, a plastic case with a green leafy substance and a semi-crushed pill later determined to be Subutex were found.

The witness had security cameras around her home. When police watched the footage, they could see Quick walking around, picking up items and taking them.

The items in his possession at the time of his arrest were checked and several of them appeared to be new or may have come from vehicles.

When the resident of the second house was interviewed, he said he returned home to find items on his porch that were misplaced or did not belong to him.

A cooler on the porch had been inside his residence and a sound bar on the porch that was later determined to be from another neighbor’s home.

Inside the second residence, a box holding a new shop vac was opened and the contents strewn around a storage room. Other items were missing from the room and a few items that did not belong to the resident were also found there.

In his interview with police, Quick said he was under the influence and must have thought he was at his brother’s home.

He also apologized and said he was “not a thief.”

Couple Accused of Growing Marijuana at Morrisdale Residence

CLEARFIELD – A couple has been accused of growing marijuana at a Morrisdale residence.

Austin Michael Mullan, 25, of Smithmill has been charged by the Pennsylvania State Police with felony manufacture, delivery or possession with intent to manufacture or deliver and misdemeanor counts of intentional possession of a controlled substance, use/possession of drug paraphernalia and corruption of minors.

Jollene Marie Boyer-Rabenstein, 38, of Morrisdale has also been charged with felony conspiracy/manufacture, delivery or possession with intent to manufacture or deliver and misdemeanor counts of intentional possession of a controlled substance, use/possession of drug paraphernalia and corruption of minors.

Mullan and Rabenstein are scheduled to appear for preliminary hearings at 11 a.m. Sept. 12 at the Clearfield County Jail. Bail has been set at $50,000 unsecured for Mullan and $15,000 monetary for Rabenstein.

The charges stem from a drug investigation that occurred in August in the 300 block of Church Road, according to the affidavit of probable cause.

On Aug. 2, a witness told investigators she owned the residence and rented it out to Mullan and Rabenstein.

She said on July 28, she was there to advise the couple that she needed to inspect the home for insurance purposes.

While in the backyard, she reportedly observed several marijuana plants that were three- to four-feet tall. These were planted in pots on the couple’s back deck.

She said a child appeared to be pruning the plants, and she also observed several smaller plants growing in red solo cups on a window sill inside the home.

The witness took pictures of the marijuana plants, which she observed again on the back deck on Aug. 1 when she returned to perform maintenance work.

The investigating trooper observed the witness’ pictures and traveled to the couple’s residence the next day in his undercover vehicle.

He observed one marijuana plant on the back deck that was three- to four-feet tall. On Aug. 3, he obtained a search warrant and executed it with members of the Troop C crime and vice units.

Troopers located Mullan and Rabenstein inside the home, along with her four children.

A search allegedly yielded three live marijuana plants growing in pots on the back deck. These plants were NIK tested and showed positive for the presence of marijuana.

Four starter marijuana “clones” were planted in small cups on the window sill in the kitchen and numerous items of drug paraphernalia were located within the residence, state police said.

In addition, scattered marijuana leaves and a small amount of processed marijuana were found, according to the affidavit.

When the investigating trooper advised Rabenstein of the search warrant, she blurted out that she planned on getting her medical marijuana card.

The evidence was transported to the Clearfield-based state police barracks, where a trooper NIK tested the marijuana. It showed a positive result for the drug.

DuBois Man Accused of Trying to Blow Up Home

DUBOIS – A DuBois man has been accused of trying to blow up a home by leaving the gas on in the residence.

DuBois City police say David E. Olewinski, 50, turned the gas on in his home on Sept. 4. After his wife smelled the gas, she asked him why he turned it on. He said he didn’t remember doing it.

Further investigation revealed that Olewinski told someone he was going to burn the house down and was overheard by a juvenile witness. Neighbors were able to smell the gas outside the residence, according to the affidavit of probable cause.

The next day, the victim reported to police that she and Olewinski were separating and as he was packing his things, he assaulted her.

Olewinski allegedly pushed a crossbow into her and asked if she wanted “to die today.” He then reportedly struck her with a package of arrows, causing her to sustain injuries to her back and cuts to her arm.

Before he left, he punched her twice on the side of the head and lip, according to police. He then fled the scene in her vehicle.

After she reported the assault, the victim told police about the incident with the gas the previous night.

When he was taken into custody, Olewinski was found to have marijuana and drug paraphernalia, according to the report.

Olewinski is charged with a felony count of risking a catastrophe, and misdemeanor counts of simple assault, terroristic threats, possession of marijuana and possession of drug paraphernalia, as well as a summary harassment.

He is incarcerated in lieu of $25,000 bail with a preliminary hearing scheduled for Friday during centralized court in District Judge Pat Ford’s office.

Jail Inmate Allegedly Received Pills While Kissing His Brother at Court

DUBOIS – A jail inmate is facing contraband charges for allegedly receiving pills from his brother during a kiss when he appeared for a preliminary hearing.

Michael W. Miles, 40, was charged with felony possession of a controlled substance, contraband/inmate and a misdemeanor count of intentional possession of a controlled substance after an incident at District Judge Pat Ford’s office during centralized court on July 6.

According to the affidavit of probable cause, after Miles, an inmate, waived his hearing on terroristic threats and harassment, he asked officers if he could say goodbye to his brother. He was allowed to give him a hug under the officer’s supervision. The officer saw the two kiss each other with open mouths.

A victim/witness employee reportedly let an officer know that prior to the kiss, Miles’ brother had placed something in his mouth.

Both men were seized, and the officer attempted to stop Miles from swallowing, but he swallowed and had nothing in his mouth when he opened it.

Miles was transported back to the jail where he admitted he had swallowed something, police said. It was determined that he would need to be medically cleared before being admitted to the jail.

Miles was then taken to Penn Highlands Clearfield’s emergency department.

While waiting for treatment, Miles agreed to speak with the officer and reportedly admitted to swallowing a cellophane wrapper that contained pills.

When asked what pills, he replied that it would have been Klonopin or Subutex pills, which are all his brother could have gotten, police said.

The officer asked if he had ever done this before, because it was so quick. Miles allegedly responded that it is their “move.”

Despite admitting to swallowing the pills, he refused to admit that his brother was involved.

After Miles vomited several times, the contents of the vomit were checked by the nursing director. She was able to locate the cellophane wrapper, according to the report.

Miles waived his right to a preliminary hearing on the new charges on Friday during centralized court. He is being held on $10,000 bail.

AG Shapiro Charges Three in Clearfield Drug Ring that Sold $1.5 Million in Crystal Meth, Cocaine

Defendants charged with selling drugs at home in presence of two children

HARRISBURG — Attorney General Josh Shapiro today announced felony charges against three Clearfield County residents for their roles in a drug ring that trafficked and sold crystal methamphetamine and cocaine in Pennsylvania and Ohio.

The charges include drug offenses and child endangerment, since two children were present at the home during many drug sales allegedly committed by the defendants.

The charges announced by Shapiro today were recommended by the 43rd Pennsylvania Statewide Investigating Grand Jury.

According to the Grand Jury’s presentment, Sondra McQuillen, 53, of the 3100 block of Sanborn Road, Houtzdale, traveled to Akron, Ohio on 26 occasions, where she obtained methamphetamine, cocaine and other drugs from a source.

The Grand Jury found that Jason Merritts, 37, and Joyce Merritts, 32, of the 1000 block of Park Avenue Extension, Clearfield County, bought the methamphetamine from McQuillen, and sold the drugs to a confidential informant working with the Attorney General’s office.

McQuillen was charged with multiple counts of possession with the intent to deliver, delivery, corrupt organizations, and dealing in proceeds of unlawful activities.

The Merritts face similar charges for 18 purchases of methamphetamine – as well as being charged with endangering the welfare of children, since their 10- and 12-year-old children were present during many of the drug buys in their home.

“The illegal distribution of drugs is fueling an epidemic across Pennsylvania,” Shapiro said. “Crystal methamphetamine trafficking is on the rise again, particularly in rural parts of our Commonwealth – and our agents and prosecutors will investigate and charge it wherever we find it.

“This case is particularly egregious, since the defendants are charged with selling drugs in the presence of two young children. That’s reprehensible and we’re holding them accountable.”

The investigation was developed by the Pennsylvania Office of Attorney General Bureau of Narcotics Investigation and Drug Control.  The investigators used a confidential informant in September of 2017, who made controlled purchases of drugs from Jason and Joyce Merritts.

Following those purchases, investigators identified the local sources, Sondra McQuillen and Donald Mullens and subsequently the source in Ohio, James Thomas, who is alleged to have delivered pound quantities of methamphetamine on multiple occasions.

In July of 2018, investigators followed McQuillen on three separate occasions to Ohio where she picked up the drugs.  On July 26, investigators conducted a traffic stop and searched her vehicle, seizing six ounces of methamphetamine, two eighth ounces of cocaine and other drugs.

The Merritts were arrested the same July day on charges stemming from one of the controlled purchases, pending the issuance of the Grand Jury presentment, which recommended multiple, additional charges against them.

Working with the Grand Jury, agents and prosecutors in the Attorney General’s Office brought individuals before the panel who testified and identified Sondra McQuillen and Donald Mullins, who died of a drug overdose in May, as the original Clearfield County sources of the drugs.

Joint coordination between the Attorney General’s office, Akron, Ohio law enforcement and the Drug Enforcement Administration (DEA) led to James Thomas being charged federally in connection with drug seizures of approximately one pound of methamphetamine, cocaine, firearms and almost $50,000 cash from his home and business.

The estimated street value of all of the crystal methamphetamine, cocaine and other drugs distributed by this drug ring during its operation is $1.5 million.

“Thanks to strong law enforcement collaboration between our office, Akron, Ohio law enforcement and the DEA – and the hard work of the men and women of the 43rd Statewide Investigative Grand Jury – we’ve broken up this drug ring peddling its poisons in Pennsylvania,” Shapiro said.

“We’re doing whatever it takes to attack this problem in cities, towns and counties across Pennsylvania – and anywhere else our investigations may lead.”
