Sentencing Hearing Continued for Physician’s Assistant Accused in Prescription Drug Scheme After Courtroom Clash

CLEARFIELD- The sentencing hearing for a physician’s assistant accused of dispensing illegal prescriptions was continued Monday after a clash between her attorney and the district attorney.

Holly Jean Hipps, 42, of Olanta was charged with acquiring or obtaining a controlled substance by fraud, conspiracy and administration of a controlled substance by a practitioner, all felony charges and additional drug charges, after an investigation into her activity in 2017.

Hipps is accused of writing prescriptions for Dennis Lee Lingle, 61, of Clearfield and others related to him as well as a former patient at the Discovery House in Clearfield where the staff does not prescribe narcotics and for a co-worker, according to the affidavit of probable cause.

Some of these were reportedly written after her PA medical license and DEA registration expired on Oct. 31, 2016.

Hipps was formerly employed at the Caring Healthcare Network in Philipsburg in addition to the Discovery House, according to the complaint.

She had signed an open plea, leaving her sentence to be decided by the judge.

Her attorney, David Hopkins, argued on Monday during sentencing court for his client to receive a probation only sentence because she found “herself in a difficult situation” after she wrote one prescription and was threatened to write more or go to jail.

It was her word against his, Hopkins stated. This was not a situation for her “to profit.”

He also claimed that the investigator, Agent Duane Musser of the Attorney General’s office, told him at the preliminary hearing that he didn’t believe Hipps should go to jail.

Judge Fredric J. Ammerman asked if anyone else heard this and First Assistant Ryan Dobo, who was at the hearing, said Musser didn’t mention this to him.

Hopkins referenced the sentence of a local doctor charged with similar crimes who is serving four to eight years in prison, saying she should not be held to the same standard because “one person got his hooks into her and wouldn’t let go.”

Ammerman suggested that she should have gone to the authorities who would have “wired her up” to prove her case.

District Attorney William A. Shaw Jr. countered Hopkins’s argument by stating that she was “giving out thousands of opioid pills” while the county was in an opioid crisis.

Shaw went on to say she was doing this for her own benefit and because she was authorized to write scripts, she should be held to the same standard as the doctor.

He also mentioned that AG Josh Shapiro is “doing everything to battle the opioid crisis” and he would agree.

Hopkins asked for a continuance and the judge agreed with this to allow Musser to attend the sentencing hearing and voice his opinion.

According to the criminal complaint, Hipps wrote prescriptions for Dennis Lee Lingle, 61, of Clearfield, a friend of Lingle’s, Lingle’s wife and Lingle’s wife’s cousin who stated Lingle told him he paid Hipps $1,500 for each prescription.

Lingle is facing charges of conspiracy/acquiring or obtaining possession of a controlled substance by misrepresentation, acquiring or obtaining possession of a controlled substance by misrepresentation and conspiracy/administer of controlled substance by practitioner. His case is still pending.

State police at Clearfield

  • On Sept. 1, Lawrence Township police received information that a 29-year-old Williamsburg, Pa., man planned to sell a stolen handgun at the Bigler Minit Mart in Bradford Township. State troopers, along with township officers, responded to the scene and made contact with the man. Authorities allegedly recovered two stolen handguns, drug paraphernalia and several miscellaneous cards belonging to other people. He was subsequently arrested and housed in county jail.

Trial Cancelled for Olanta Man Accused of Assaulting State Trooper

CLEARFIELD – The trial for an Olanta man accused of assaulting a state trooper has been cancelled.

Dale Edward Shaffer, 35, was charged with aggravated assault, disarming a law enforcement officer, two counts of endangering the welfare of children, simple assault, fleeing or attempting to elude police and harassment after an incident in Olanta on April 30.

Shaffer was scheduled to go to trial on Sept. 24-25, but that was cancelled Monday after he signed a plea agreement. He will be sentenced within 60 days.

According to the affidavit of probable cause, a trooper was patrolling when he saw a Mazda SUV that had a registration number belonging to a Honda.

The trooper pursued the vehicle through Knox Township where it drove down Zion Road, then Clark Road and then turned onto a dirt gas well road. On this road, they encountered a natural barrier that prohibited them from continuing.

The Mazda stopped and the driver got out. The trooper also left his vehicle and a physical altercation ensued where Shaffer delivered several punches to the trooper’s head. He also attempted to strangle him.

During the struggle, Shaffer grabbed the trooper’s gun and tried to remove it from his holster.

Shaffer stated “give me your gun. Give me your gun.” Eventually he fled on foot.

When another trooper arrived on the scene, he called for an ambulance. They discovered Shaffer had left two girls, aged two years old and three years old in car seats in the backseat of the Mazda.

They reportedly identified Shaffer as their father and the older child confirmed she was riding with her “daddy.”

A helicopter was utilized by state police to search the area before Shaffer was taken into custody, according to previous reports.

Shaffer remains incarcerated in lieu of $150,000 bail.

Warrant Issued for Man Accused in Domestic Assault

CURWENSVILLE – A warrant has been issued for Calvin Winston following a recent domestic assault incident at a Susquehanna Avenue address, Curwensville Borough police say.

Winston has been charged with two misdemeanor counts of simple assault; one misdemeanor count of harassment; and one summary count of harassment.

According to the incident report, a female victim called 911 to report she engaged in a verbal argument with Winston and it turned physical.

Winston allegedly struck her in the head with a stainless-steel mug. Upon arrival, police observed injuries to the female’s forehead.

Lawrence Township

  • Police reported on a drug-related incident that occurred Tuesday at the Lawrence Township Rec Park. During routine patrol, an officer observed a vehicle exit the park after hours. The park is properly posted for “no trespassing after dark,” and so police initiated a traffic stop. The male driver was known to officers due to prior incidents and was asked for consent to search his vehicle, which he denied. Ultimately officers contacted a K-9 unit, at which point the driver allegedly admitted there were items of drug paraphernalia inside the vehicle; a subsequent search of his vehicle confirmed this. Charges will be filed against the driver.
  • Police received a report about an incident of burglary/theft that occurred at a camp Sept. 7 on Little Medix Road. According to police, the victim found his camp door had been kicked in. Once inside, he discovered that two flat screen televisions, two tool boxes and multiple clothing items had allegedly been stolen. The suspects are unknown at this time.

Curwensville Borough

  • Police received a report about a landlord-tenant issue. Upon arrival, police determined that it was civil in nature.
  • Police received a report about a suspicious male in the area of Fredericka and Grandview avenues. A witness told police she had observed the male standing in the tree line to watch her. He then fled the area and she left to contact police. Upon arrival, police were unable to locate the male.
  • Police received a report about an incident of theft that occurred at a Swoope Street residence. During the incident, someone allegedly stole an item from a female’s apartment. Police are continuing their investigation at this time.
  • Police received a report about drug paraphernalia at the Curwensville Commons. Upon arrival, police located a syringe in the parking lot. Police took possession of the syringe and it was disposed of properly.

Couple Accused of Growing Marijuana Waives Hearings

CLEARFIELD – A couple has been accused of growing marijuana at a Morrisdale residence.

Austin Michael Mullan, 25, of Smithmill has been charged by the Pennsylvania State Police with felony manufacture, delivery or possession with intent to manufacture or deliver and misdemeanor counts of intentional possession of a controlled substance, use/possession of drug paraphernalia and corruption of minors.

Jollene Marie Boyer-Rabenstein, 38, of Morrisdale has also been charged with felony conspiracy/manufacture, delivery or possession with intent to manufacture or deliver and misdemeanor counts of intentional possession of a controlled substance, use/possession of drug paraphernalia and corruption of minors.

Mullan and Rabenstein waived their rights to preliminary hearings during centralized court Wednesday at the Clearfield County Jail. Bail has been set at $50,000 unsecured for Mullan and $1,000 monetary for Rabenstein.

The charges stem from a drug investigation that occurred in August in the 300 block of Church Road, according to the affidavit of probable cause.

On Aug. 2, a witness told investigators she owned the residence and rented it out to Mullan and Rabenstein. She said on July 28, she was there to advise the couple that she needed to inspect the home for insurance purposes.

While in the backyard, she reportedly observed several marijuana plants that were three- to four-feet tall. These were planted in pots on the couple’s back deck.

She said a child appeared to be pruning the plants, and she also observed several smaller plants growing in red solo cups on a window sill inside the home.

The witness took pictures of the marijuana plants, which she observed again on the back deck on Aug. 1 when she returned to perform maintenance work.

The investigating trooper observed the witness’ pictures and traveled to the couple’s residence the next day in his undercover vehicle.

He observed one marijuana plant on the back deck that was three- to four-feet tall. On Aug. 3, he obtained a search warrant and executed it with members of the Troop C crime and vice units.

Troopers located Mullan and Rabenstein inside the home, along with her four children.

A search allegedly yielded three live marijuana plants growing in pots on the back deck. These plants were NIK tested and showed positive for the presence of marijuana.

Four starter marijuana “clones” were planted in small cups on the window sill in the kitchen and numerous items of drug paraphernalia were located within the residence, state police said.

In addition, scattered marijuana leaves and a small amount of processed marijuana were found, according to the affidavit.

When the investigating trooper advised Rabenstein of the search warrant, she blurted out that she planned on getting her medical marijuana card.

The evidence was transported to the Clearfield-based state police barracks, where a trooper NIK tested the marijuana. It showed a positive result for the drug.

Clearfield Man Waives Hearing on Resisting Arrest, Drug Charges

CLEARFIELD – A Clearfield man has been accused of resisting arrest and being found in possession of methamphetamine after a traffic stop.

Kevin Lee Straw, 36, has been charged by Trooper Chad D. Ryen of the Clearfield-based state police with misdemeanor counts of intentional possession of a controlled substance, use/possession of drug paraphernalia, make/repairs/sell, etc. offensive weapon, resisting arrest and flight to avoid apprehension and seven summaries.

Straw waived his right to a preliminary hearing Wednesday during centralized court at the Clearfield County Jail. His bail has been set at $20,000 monetary.

The charges stem from a traffic stop on a 2005 silver Pontiac G6 Sedan at 10:31 a.m. Aug. 28 on Post Office Road in Bradford Township, according to the affidavit of probable cause filed with the office of Magisterial District Judge Jerome Nevling.

Ryen approached Straw at his driver’s side and positively identified him by name and date of birth. Straw related that he knew the vehicle was not legal for the road and was just driving it from Clearfield to Woodland for a friend.

Straw was arranging for a ride and to get the vehicle off the roadway while Ryen ran his information through NCIC/CLEAN. It was learned that Straw’s driver’s license was under suspension and he was wanted on bench warrants in Clearfield and Centre counties.

Ryen contacted his PCO who confirmed the warrants and he advised Straw that he was being taken into custody. Straw reportedly commented that he “wasn’t going to jail” and resisted when Ryen tried to handcuff him.

A struggle ensued and Ryen and Straw fell down an embankment.  Straw fled on foot down the hill into the woods; however, Ryen was able to apprehend him at the bottom and take him into custody.

When Ryen conducted a standard custodial search of Straw, he found a tin containing approximately one gram of suspected methamphetamine in a small plastic baggie, an empty baggie with residue and a small spoon; a glass smoking pipe; a hypodermic needle; and a handled knife with a spring-assisted blade.

The vehicle’s registration expired in September of 2017 and inspection in October of 2017. Its front tires were worn, it had rusted out rocker panels and it wasn’t insured. Straw also wasn’t wearing his seatbelt at the time of the stop.

Straw was housed in county jail due to the active bench warrants.

Sandy Township

  • Police responded to a motor vehicle accident Monday. According to the report, a 23-year-old Penfield man lost control of his vehicle due to water on state Route 255 south. His vehicle hydroplaned across the roadway and down an embankment near Mount Run Road. The driver was transported to Penn Highlands for treatment of his injuries, and his vehicle was towed from the scene.
  • Police received a report about a vehicle that was wrecked just outside the back gate to Treasure Lake on Tuesday. No one was around the vehicle, so it was towed from the scene.
  • On Tuesday police received a report from a Wilson Avenue man who stated that a known Hand Street resident traveled through his yard with a truck and tore up the grass. Officers located the man who admitted to causing the damage and agreed to repair it.  Officers handled the situation without incident.
  • On Tuesday police received a report from a woman who stated that her daughter was being harassed by the mother of her child’s father over custody.
  • On Tuesday police received a report about a dispute. According to police, a 54-year-old Brookville woman and her husband began arguing with an 18-year-old man who they felt parked too close to their vehicle. The argument persisted with the woman commenting that she was going to videotape the 18-year-old who reportedly retaliated by knocking the woman’s phone from her hand. There wasn’t any damage to the woman’s phone, and officers handled the situation without incident.
  • On Tuesday police received a report from a 40-year-old Phillips Creek Road woman who stated that her 66-year-old mother came to her house accusing her of having her car key. When the woman closed the door and asked her to leave the residence, her mother continued to scream outside. However, she did leave prior to police arrival.  Officers handled the situation without incident.

State police at Clearfield

  • State police received a report about an incident of harassment that occurred Wednesday on State Street in Curwensville Borough. A Curwensville couple engaged in a verbal argument, during which a male allegedly raised his hand and was in the female’s face as though he was going to strike her. State police say she slapped the male in the face and then he left on foot. Both will be cited for the incident through the district court in Clearfield.
  • State police received a report about an incident of harassment that occurred Wednesday on Pine Air Court in Boggs Township. During the incident, a 36-year-old Clearfield man and a 39-year-old Altoona man engaged in an altercation over the repossession of the Clearfield man’s vehicle. As a result, the Clearfield man allegedly struck the other man in the face with his shoe, causing a minor lip injury. The Clearfield man will be cited for the incident through the district court in Houtzdale.

Lawrence Township

  • Police received a report about an incident of trespassing that occurred Thursday at Lawrence Park Village. As a result, Brandon M. Ogden, 31, of Clearfield was arrested and housed in county jail; he was arraigned by Magisterial District Judge James Glass. Ogden is currently awaiting his preliminary hearing.
  • Police reported on a drug violation that occurred Thursday on Montgomery Run Road. According to police, a male was seen walking and believed to be under the influence. When contact was made, it was determined that the male had consumed K2, a controlled substance, which was allegedly on his person.  He was subsequently transported to the Penn Highlands Clearfield Hospital for an evaluation, as it was believed he’d overdosed. Charges are to be filed as a result of the incident.
  • Police received a report about an incident of retail theft involving two females that occurred Sept. 4 at the Ollie’s Bargain Outlet at the Clearfield Mall. One female was wanted on warrants through Domestic Relations and the police department. She was transported and lodged in county jail; charges are pending against both females.

BREAKING: Mahaffey Woman Accused of Murder Agrees to Plead Guilty

CLEARFIELD – A Mahaffey woman accused of murder has agreed to plead guilty.

Kayce Marie Lee, 31, was charged by state police in February with murder, involuntary manslaughter, aggravated assault, simple assault and harassment for the stabbing death of Richard Bennett, who was found dead just 30 feet from their Mahaffey home.

Lee signed a plea agreement on Thursday during a pre-trial conference, according to court documents. She is scheduled to be sentenced in October.

According to the affidavit of probable cause, police received a call at 7:40 p.m. Feb. 4, reporting that Bennett had not been seen since 1 a.m. that morning when he left his home following an argument with Lee. She told police she may have stabbed him prior to him fleeing on foot.

When troopers arrived at the home at 11:43 p.m., they discovered the victim lying approximately 30 feet from the home. He was deceased.

He was reportedly clothed in only a long-sleeve thermal shirt and briefs with no footwear of any type.

In an interview with police, Lee admitted she stabbed the victim during an argument.

She recalled that after returning home from shopping, she drank a few shots of whiskey and Bennett drank the rest of the bottle before passing out in a chair in the living room.

When he awoke, she stated that he “was a totally different person” and she could tell “by the look in his eyes” that he was very agitated. The two began arguing because their daughter was not in bed yet.

She went upstairs with the girl to watch a movie but when they returned downstairs, he began yelling at her again about their daughter being awake.

Lee told police during the following argument, Bennett slapped her twice in the head.

With the intention of scaring him, she retrieved a knife from the block on the counter. He smacked her in the face so hard, it knocked her glasses off and her dentures flew out of her mouth, she said.

She made a stabbing motion with the knife, but she wasn’t sure where she stabbed him, but by the time she picked up her glasses and dentures, he was gone, she told investigators.

She looked out the door and yelled for him, but he didn’t answer and she didn’t see him anywhere.

Because she feared the victim would come back with a gun, she took her daughter to her grandmother’s house. She then returned to the residence but claimed she was still unable to locate the victim.

She returned to her grandmother’s residence and slept there. When she awoke, she called around to see if any of his family members had seen the victim.

At approximately 6 p.m., she went back to the home, but again Lee said she was unable to find him. While there she cleaned up some of the blood on the kitchen floor.

After returning to her grandmother’s home, she stated she made more phone calls to the family and the hospital.

When confronted by police with that fact that he had only walked 30 feet from the home before collapsing and dying, she maintained she never saw the victim lying between the swing set and driveway, even though she would have driven directly passed him on at least three occasions.

When she was told the victim was stabbed directly in the chest, she conceded that she had stabbed him “a little harder” than she originally said.

The troopers checked Lee for injuries. The only injury seen was a small scratch on the left side of her neck, which did not appear to be related to any type of assault. There were also several small scratches on her hands, which she attributed to carrying firewood.

A witness told police that he has known the couple for years. About a month prior, Bennett arrived at his residence with injuries to his right arm. This witness said Bennett was covered in blood and he observed multiple stab marks.

When the witness asked what happened, Bennett said Lee had stabbed his arm with a knife and tried to stab him in the chest.

Another witness said she previously saw Bennett with scratches to his neck and face and with a black eye last summer that he said they were caused by Lee.

State police at Clearfield

  • State police received a report about an incident of theft that occurred Sept. 8 on Rolling Stone Road in Cooper Township. During the incident, a 37-year-old Munson man left his cell phone in the bathroom at the Kylertown Kwik Fill. When he returned to retrieve his phone, it was gone.
  • State police reported on a drug incident that occurred Friday in the area of River Hill and Deer Creek roads in Covington Township. During a traffic stop, state police detected a strong odor of marijuana coming from the vehicle, and a 19-year-old Woodland man was allegedly found in possession of a small amount of the drug and paraphernalia. Charges are to be filed through the district court.
  • State police investigated an incident of terroristic threats that occurred Saturday on Rock Lane in Bradford Township. During the incident, a 33-year-old Woodland man went onto a 51-year-old Bigler man’s property and allegedly fired one round from a handgun into the ground. Then, state police say he continued to point the handgun at the victim and four teenage males. State police took the man to county jail to await arraignment on charges of reckless endangerment, terroristic threats, simple assault and public drunkenness.
  • State police received a report about an incident of criminal mischief that occurred Saturday or Sunday on Friendly Acres Road in Penn Township. During the incident, someone allegedly damaged a 2018 Nissan Versa by busting out the rear windshield. State police say the vehicle was leased through Hertz Vehicles LLC, and the damage is estimated at $300. Anyone with information is asked to contact state police at 814-857-3800.
  • State police received a report about an incident of criminal/simple trespass that occurred Sunday on Kirk Street in Woodward Township. During the incident, a 43-year-old Womelsdorf, Pa. man allegedly tried to gain entry inside the victim’s residence but discovered it was locked. As a result, he fell asleep on the glider located on her enclosed porch, and she didn’t know him. When state police spoke with the man, he said he thought he was at a friend’s residence. He will be cited for the incident through the district court in Houtzdale.
  • State police received a report about an incident of theft that occurred sometime between July 20 and Aug. 26 at a Bi Co Lane residence in Decatur Township. During the incident, a known 51-year-old man allegedly opened a credit card account in the victim’s name and social security number, knowing the victim didn’t have the mental capacity to give consent for use of his information. Charges have been filed through the district court.
  • State police received a report about a burglary that occurred Sept. 8-9 on Gilbert Road in Ferguson Township. During the incident, someone allegedly gained entry to a vacant house and removed a black leather couch and chair, a front-load dryer and a refrigerator. The estimated value of the stolen items is $375, state police say.

State police at DuBois

  • State police received a report about an assault that occurred Friday in the area of Alexander Street and Seventh Avenue in Brockway Borough. During the incident, two juvenile males allegedly engaged in a physical altercation at a pavilion near the Brockway football stadium. Brockway Ambulance personnel assisted on-scene. State police are continuing their investigation at this time.

State police at Punxsutawney

  • State police received a report about an incident of assault that occurred July 17 on Route 28 in Pine Creek Township. During the incident, two teenage females, both of Brookville, engaged in a physical altercation with the suspect. State police are continuing their investigation at this time.
  • State police received a report about a theft that occurred Aug. 21 on Clawson Street in Bell Township. During the incident, someone allegedly stole three checkbooks, a diamond necklace and 10 rings, which were valued at $1,940, from the victim’s residence. Anyone with information is asked to call state police at 814-938-0510.
  • State police received a report about a burglary that occurred between Aug. 31 and Sept. 5 on Native Road in McCalmont Township. During the incident, someone allegedly gained entry to the victim’s house and removed a camera bag containing a Cannon Rebel T5 DSLR camera and a Sony Vixia HF R62 camcorder valued at $1,000. Anyone with information is asked to call state police at 814-938-0510.

Clearfield Borough

  • Police arrested a male for the suspicion of driving under the influence of a controlled substance after he was stopped for a traffic violation along South Fourth Street.
  • Police received a report about an altercation on South Third Street. During the incident, someone allegedly threw an object and struck a male in the shoulder.
  • Police received a report about a suspicious person on Crozier Avenue. However, they had left prior to police arrival.
  • Police are investigating a harassment complaint that occurred at the Clearfield Driving Park.
  • Police received a report about an altercation on Fifth Street. Police were able to handle the situation on-scene.
  • Police were requested to check the welfare of a resident along West Locust Street. Police were able to contact her and found her to be OK.
  • Police received a report about a damaged vehicle on Merrill Street. At the scene, police found that the tires had been punctured on a vehicle.
  • Police reported that a female was transported to the jail after she was found to have an active warrant. She was taken into custody by the Dubois City police and then turned over to the Clearfield Borough police.
  • Police received a report about a broken window on Turnpike Avenue. Upon arrival, police found the tenant was attempting to open a window when it broke.
  • Police responded to an activated alarm along South Second Street. Upon arrival, police found the business to be secured.
  • Police reported that a female was arrested for public intoxication after she was stopped along East Market Street. She was subsequently transported to the jail.

Lawrence Township

  • Police received a report about a disorderly runaway juvenile Sept. 10 on Lawhead Street in Hyde. According to police, the mother called police saying her 17-year-old daughter had skipped school with her boyfriend and hadn’t returned home for multiple days. Police said this was the third time the girl has skipped school, not returned home for days and not contacted her parents. Each time police noted she was entered as a missing person and then she would later return home.
  • Police received a report about an incident of disorderly conduct and public drunkenness that occurred Friday on Whiskey Hill Road in Glen Richey. According to police, a woman called saying her boyfriend was pounding on her door. Upon arrival, police encountered the male – Corey Kendall, 30 – who was manifestly under the influence of alcohol. He was also acting nervous and jittery. Officers cuffed him for safety purposes, at which point he became confrontational. He allegedly refused to obey the officers’ commands; he was taken to county jail, where he became confrontational and disorderly again. Kendall has been charged and arraigned for the incident.
  • Police received a report about an incident of harassment that occurred Saturday on Burchfield Street. Upon arrival, officers learned that it was a verbal argument and nothing physical had occurred there. Police didn’t make any arrests as a result of the incident.
  • Police received a report about a theft from a motor vehicle that occurred Saturday on Clarendon Avenue. During the incident, someone allegedly removed $10 in cash and a flashlight. Anyone with information is asked to call police.
  • Police received a report about theft of services that occurred Friday at LA Nails. During the incident, a female received a manicure at the salon and allegedly left without paying. She was last seen driving from the scene in a black Chevrolet Tahoe. Police obtained a license plate number for the vehicle, and the investigation is ongoing.
  • Police received a report about a theft that occurred Sept. 11 at Wal-Mart in Clearfield. According to police, an unknown male and female parked a red Ford Focus in the lot and entered the store. Once inside, they separated and the female allegedly picked up two pricing devices with a replacement value of $768.42 each. Then, the couple left the store separately before meeting back at their vehicle and leaving the scene. Police say it’s suspected that the couple has been involved in multiple thefts of this nature at other Wal-Mart stores.

Sandy Township

  • Police received a report about a false alarm Sept. 12 at a David Reed Road residence.
  • Police received a report about a retail theft Sept. 12 from Pat Catan’s employees. During the incident, a 40-year-old Penfield woman entered the store and allegedly attempted to leave without paying for her merchandise. When confronted, the woman went back into the store and paid for the items in her cart; however, it was noted that employees believe she might have had items in her purse, also.  Police are continuing their investigation at this time.
  • On Sept. 12, police were called by Treasure Lake Security, which reported that a large truck had impacted and damaged the rock bed at the entrance of Treasure Lake. Officers were able to contact the company the truck belonged to and it agreed to take care of the damages.
  • On Sept. 12, police were called by a Drifting woman who reported the while her vehicle was parked in the Commons parking lot, someone had impacted and damaged the front of her vehicle. Police are continuing their investigation at this time.
  • Police received a report about a suspicious man and woman who had gotten their van stuck Sept. 13 on San Spur Road. The couple was last seen walking toward Wayne Road but was gone upon police arrival.
  • On Sept. 13, police were called by a Juniata Street resident who reported hearing eight gunshots in the area. However, officers were unable to hear the shots and could not locate their source.

DuBois City

  • On Friday police received a report about a rifle that was found along the railroad tracks of DuBois Street. The caller left the rifle in its case and went to contact police. Upon police arrival, the rifle was gone and the investigation is ongoing.
  • Police received a noise complaint Friday on South Main Street. Upon arrival, police located several people talking on a front porch, and they were asked to keep the noise level down.
  • Police responded to a reported hazard Friday at the intersection of Beaver Drive and Division Street. A caller told police a gas can was on its side and leaking fuel. However, police found the can upright and not leaking; it was in the grass off the roadway.
  • Police responded to an activated intrusion alarm Friday on West Long Avenue. Upon arrival, police determined the alarm was accidental in nature.
  • Police received a report about a suspicious vehicle that had been observed in the Martin’s Grocery parking lot every morning for the past two weeks. A vehicle registration was obtained and police have been attempting to locate the owner.
  • Police received a report about a phone scam on Friday. According to police, someone contacted a resident and claimed to be with Direct TV. When the caller requested personal information, she ended the call.
  • Police had a stray dog at the station Friday. Its owner was located.
  • Police received a report about a Protection from Abuse order violation Friday on DuBois Street. According to police, Robyn Kiehlmeier was found consuming alcohol, which was in violation of an active order. Kiehlmeier was taken to county jail and has been charged for the violation.
  • Police received a report about a domestic dispute Saturday on East Long Avenue. During the incident, a couple was engaged in a physical confrontation, and charges are currently pending.
  • On Saturday police were requested to check the welfare of an unattended child outside a residence on West Scribner Avenue. A witness told police the 2-year-old was outside only wearing a diaper and walking towards a steep embankment in the backyard. Upon arrival, police found the child hadn’t been injured and the mother was located inside their residence. Police are continuing their investigation at this time.
  • Police received a report about a domestic disturbance Saturday on Spring Avenue. It was found to be verbal in nature, and those involved had stopped fighting prior to police arrival on-scene.
  • Police received a report about a hit-and-run crash that occurred sometime Friday or Saturday on Chestnut Street between West Long and Washington avenues. Anyone with information is asked to call police.
  • On Saturday police received a report about all-terrain vehicles being driven on the roadway in the 900 block of West Washington Avenue. Police made contact with the owner and advised it was unlawful to operate an ATV on city streets and alleyways.
  • Police received a report about an incident of theft Saturday. During the incident, someone allegedly stole a boy’s bicycle from the 100 block of Fuller Avenue around Labor Day. It was blue in color and looked like a dirt bike. Anyone with information is asked to call police.

Maines Charged with Aggravated Assault by Vehicle While DUI in Lawrence Twp. Crash

CLEARFIELD – A former Clearfield man has been accused in a high-speed police pursuit, which resulted in a motor vehicle crash that seriously injured his passenger, while he was under the influence of drugs.

Jonathan Taylor Maines, 19, an inmate at SCI Camp Hill, has been charged by Officer Zachary Cowan of the Lawrence Township police with felony counts of aggravated assault by vehicle while DUI, aggravated assault by vehicle and fleeing or attempting to elude an officer.

He has also been charged with three misdemeanor counts of DUI/controlled substance; misdemeanor counts of recklessly endangering another person, simple assault, possession of marijuana and use/possession of drug paraphernalia; and six summaries.

According to the affidavit of probable cause, Cowan and Officer Elliott Neeper were traveling along state Route 879 on May 2. The officers saw a GMC Jimmy enter the Sheetz parking lot; however, its occupants never got out.

The officers resumed their regular patrol and re-entered the Sheetz parking lot a short time later. When they left the area, they observed that the occupants still hadn’t exited the vehicle, which they felt was suspicious since 15 to 20 minutes had elapsed.

Cowan and Neeper proceeded to patrol other areas of the township. While traveling east on River Road, they observed the same vehicle pass by in the westbound lane. Cowan conducted a U-turn, at which point it appeared the Jimmy’s operator had accelerated with its speed exceeding the posted limit of 35 miles per hour.

Cowan tried to catch up to the vehicle, which turned off and started fleeing on Good Street. Cowan traveled onto the next street – Bowman’s Hill Road – which runs parallel to Good Street. The officers reportedly could still tell the operator was traveling too fast for a residential neighborhood.

Cowan and Neeper continued on Bowman’s Hill Road until it was observed that the Jimmy had entered the perpendicular road – Mapes Avenue. As they approached the said intersection, the operator reportedly sped by carelessly at approximately 60 miles per hour.

The vehicle left a large cloud of dust and was traveling all over the roadway, the officers said. Cowan subsequently activated their unit’s emergency lights, caught up with the vehicle and conducted a traffic stop in the area of Patton Street and Kerr Avenue.

The officers notified Clearfield County Control of the traffic stop and proceeded to approach the vehicle.  Cowan heard and saw Neeper order the passenger to get back inside; he also saw that Neeper had drawn his taser, so he drew his duty weapon for safety purposes.

The passenger re-entered the vehicle and Neeper approached the passenger’s side while Cowan approached the driver’s side. When Cowan reached to open the driver’s side door, the operator allegedly put the vehicle into drive, sped off and did a “burn out.”

The Jimmy then turned right onto Kerr Avenue and a pursuit ensued with the operator failing to stop at posted stop signs at the roadway’s intersections with Palmer Street and River Road. The officers’ pursuit continued through a “large cloud of dust,” and they were able to view the vehicle’s taillights in the distance, as the operator gained a lead on the officers on River Road.

Cowan reached a speed of approximately 70 miles per hour in an effort to catch the vehicle. The officers lost sight of the vehicle as it crested the hill prior to High Level Road, and they alerted Clearfield Borough police of their direction of travel.

Cowan then slowed their patrol unit down to try to determine if the operator had continued straight on River Road or turned off onto High Level Road.

Upon cresting the hill, the officers noticed large skid marks, which started in the opposing lane and appeared to enter High Level Road. On High Level Road, they observed the Jimmy had crashed and overturned in the center of the roadway; there was a large cloud of dust and smoke visible.

Upon exiting their patrol unit, Cowan and Neeper drew their duty weapons and went to approach the vehicle.  Neeper was able to identify the front-seat passenger who had been ejected through the passenger’s side window. He was reportedly severely bleeding from his head and body, and it was noted he held approximately five warrants through the township police.

Neeper notified County Control and also requested emergency personnel and a medical helicopter. Cowan approached the driver who was still seated and secured in the driver’s seat and identified him as Maines due to previous arrests for DUI and drug use. He was also aware that Maines’ driver’s license was currently under suspension.

While speaking with Maines about injuries, specifically to his left shoulder, Cowan detected a strong odor of marijuana coming from the vehicle. He observed that Maines had glossy, blood-shot eyes and that his pupils were extremely dilated, a common side effect of marijuana use.

Cowan asked Maines if he had consumed any drugs and he admitted to having recently smoked marijuana. The officers notified County Control that another ambulance unit would be needed for Maines.

When Cowan attempted to remove Maines’ seatbelt, he located one marijuana grinder in plain view on the driver’s side floor. It was seized and later it was discovered to contain a small amount of marijuana.

Maines told officers that he was willing to cooperate and continually commented that he “didn’t want to get in trouble,” which was why he fled. He said he was willing to submit to a legal blood draw, and it was conducted on-scene in the presence of Neeper.

With both men in custody of emergency services, Neeper related that he saw a clear, plastic container on the rear seat in plain vehicle. A subsequent search of the vehicle allegedly turned up one green bong containing burnt residue, which was seized from the center console, along with two cellular devices and a GPS unit.

Both men were flown to the UPMC Altoona Hospital and officers requested a Pennsylvania State Police Accident Reconstructionist and a forensics unit to respond to the scene.

Upon completion of the on-scene forensics and reconstruction, Cowan and Neeper transported seized evidence to the police station. It was discovered the clear box contained a small amount of marijuana; a clear bubble glass pipe, which is commonly used for methamphetamine consumption; one blue glass pipe, which is commonly used for marijuana consumption; small baggies; and a digital scale.

On May 10, Cowan spoke with Maines’ passenger and he agreed to an interview.  He said he was aware Maines had smoked marijuana prior to picking him up because he could smell it inside his vehicle and he knew Maines also had marijuana, pipes and a bong.

He said when Maines saw officers, he became “paranoid” because he was on probation and had bail set in previous cases. He said when officers did the U-turn, Maines accelerated, which he told him not to do.

He went on to say that when Maines took the turn onto Good Street at 40 miles per hour, it almost caused him to crash the vehicle. He said he told Maines not to act “suspicious,” but Maines continued to drive aggressively and he suspected their vehicle had “gotten air” when they passed officers on Mapes Avenue at approximately 60 miles per hour.

At one point, the passenger said he wanted out and Maines pulled over. However, he re-entered the vehicle and Maines told him he was going to “run” because he had his mind set on it. He said he didn’t want to, but Maines refused to listen to him.

The passenger said just before they crashed, he looked to the speedometer and it read approximately 115 miles per hour.

On May 18, Cowan received a laboratory report, which showed that Maines was under the influence of various controlled substances, including amphetamine, methamphetamine, Hydrocodone and THC.

On May 23, Cowan interviewed Maines about the pursuit and subsequent crash. He said the reason he fled was because he had a suspended driver’s license, was under the influence and he was in possession of drugs and paraphernalia.

Maines allegedly admitted that he’d taken Hydrocodone the previous night and had consumed marijuana and methamphetamine inside the vehicle about 10 minutes before he operated it. He also admitted that all of the drugs and paraphernalia, which officers had seized, belonged to him.

Cowan asked Maines how fast he was driving at the time of the crash, and he indicated approximately 100 miles per hour. Maines was then asked about his passenger’s condition to which he said he would likely have scars, due to several lacerations, on his facial area and right arm for the rest of his life.

As part of his investigation, Cowan obtained medical and toxicology records for Maines and his passenger. These confirmed the presence of drugs and the serious nature of injuries that the passenger had sustained, and Cowan photographed pictures of his “permanent disfigurement.”

Maines is scheduled to appear for a preliminary hearing at 10:15 a.m. Nov. 7 at the Clearfield County Jail.

Coalport Man Pleads Guilty to Ordering Bath Salts from China

CLEARFIELD – A Coalport man pleaded guilty to ordering bath salts from China during colloquy court on Monday.

Karl Anthony Sill, 40, pleaded guilty to criminal attempt/possession with intent to deliver a controlled substance and criminal use of communication facility, both felony charges, and purchase of a controlled substance by an unauthorized person.

Judge Paul E. Cherry sentenced him to 12 months to three years in state prison.

The charges stem from an incident in October of 2017 after the attorney general’s office received information that Sill was ordering bath salts from China and having them shipped to a P.O. Box in Coalport because at the time, he was staying at Tomorrow’s Hope in that town.

Prior to sentencing, Sill made a comment that after he goes into prison and then gets out, he does the same things.

Cherry responded that he hoped that the programs at state prison would help him and stop the cycle of incarceration, which Sill has been in since 2006.

Online court records show Sill has had drug and theft charges in both Blair and Cambria counties.

According to the affidavit of probable cause, a state parole officer approached Sill because he had violated a condition of his parole.

This officer was then able to search Sill’s phone where she found e-mails regarding the purchase of a controlled substance.

Further investigation of the phone revealed the tracking numbers associated with the shipment.

When it arrived in the area, it was taken by Homeland Security since it was from China. The package was opened and then turned over to a postal inspector.

The inspector told an AG agent that it contained bath salts weighing approximately 114 grams.

It was then picked up by that agent and taken to the Clearfield County Drug Task Force office where it was inspected by the agent and a Lawrence Township police officer before being sent for testing.

The crime lab in Erie determined the substances to be three different types of substitute cathinone, which is a schedule 1 drug.

BREAKING: Convicted Murderer Dustin Thomas Sentenced to Life in Prison Without Parole

CLEARFIELD – Dustin T. Thomas, who was found guilty of first-degree murder, was sentenced to life in prison without parole Tuesday.

Thomas, 28, of Hawk Run was accused of the murder of Brett Bamat of Philipsburg in October and was convicted after a trial in August.

Thomas shot Brett Bamat as they were arguing and shoving each other outside a Morris Township residence, according to testimony.

Prior to sentencing, Valerie Bamat, sister-in-law of the victim, addressed the court saying: “I can’t believe you did this to our family.”

She referred to Thomas as a “cold-hearted killer” and said the events of that evening “will haunt me the rest of my life.”

She urged him to take responsibility and “be a man about what you did that night.”

Thomas then apologized to the family for this “horrible accident.”

According to Valerie Bamat’s testimony, she, Thomas and Brett Bamat were at the residence that night as Brett Bamat and Thomas did some odd chores around the home.

Thomas was angered after a phone call from Valerie’s husband, Tim Bamat, during which Tim Bamat said he did not want Thomas at their residence.

Thomas cried and claimed he was more of a brother to Tim Bamat than Brett Bamat, she said.

Thomas then pulled out a gun declaring it was his “muscle.” Brett Bamat responded by flexing his arm, showing his muscle.

Things calmed down and Thomas put the gun away.

A short while later, the two got into a shoving match again after Thomas pulled the gun while Brett Bamat’s back was turned, she testified.

She suggested they go outside.

In a further effort to separate the men, Valerie Bamat asked Brett Bamat to take some food to her car. She then tried to get Thomas to leave.

But when Brett Bamat came back to the porch, they started pushing each other again. She stepped into the home for “maybe 20 seconds” when she heard a gunshot.

She went back out where she saw Brett Bamat lying on his side on the ground.

Instead of helping Brett Bamat, Thomas went to his car. Valerie heard another shot and she ran to the vehicle.

“I just want to kill myself,” is what he said to her at that point, she testified.

After she told him that would not help anyone, he said he wanted to go home and drove away.

Bamat died as a result of a chest wound.

Thomas testified that he does not remember much of what happened that evening because he was drinking.

When he woke up the next morning in the county jail, he thought he had been arrested for driving under the influence, he said.

He claimed he was unaware of Brett’s death until a state trooper questioned him at the jail about the murder.

  • Police received a report about a domestic dispute Sunday in the 300 block of West Weber Avenue. During the incident, a group of friends engaged in an argument over money. A person involved was requested to leave and officers cleared the scene.
  • Police received a report about an unwanted person at a building in the 100 block of West Long Avenue. A male caller told police the male showed up at his apartment and now he wouldn’t leave the building. Officers arrived and encountered the male who left when requested to.

  • Police received a report about a theft that occurred Monday or Tuesday on Hill Street. During the incident, someone allegedly took a bicycle from a resident’s backyard. It’s a 20” Kent bicycle that’s pink with green hand grips, rims and pegs with a graphic that reads: “TROUBLE.” Anyone who locates the bicycle can turn it in to township police.

I-80 Traffic Stop Turns Up $160,000

CLEARFIELD – One of the three out-of-state men involved in a traffic stop that turned up a huge sum of cash, marijuana and an illegal firearm was scheduled for court Wednesday.

Hassan Ali Sheikh, 22, of Columbus, Ohio has been charged by the Pennsylvania State Police with felony counts of dealing in proceeds of unlawful activities and firearms not to be carried without a license and a misdemeanor count of marijuana/small amount for personal use.

However, Sheikh had his preliminary hearing continued until 11:15 a.m. Sept. 26 during centralized court at the Clearfield County Jail. His bail remains set at $100,000 monetary.

The charges stem from a traffic stop on a Jeep Grand Cherokee at approximately 12 p.m. Sept. 7 on Interstate 80 westbound in Graham Township, according to the affidavit of probable cause filed with the office of Magisterial District Judge Jerome Nevling.

Co-defendants Jebrel S. Ennaw, 24, of Auburn, Maine and Isaiah O. Mokeme, 22, of South Portland, Maine were located in the driver’s and passenger’s seats. Shiekh was located in the rear, driver’s side passenger seat.

A state trooper detected a strong odor of marijuana emitting from within the vehicle. A probable cause search was subsequently conducted and an aftermarket compartment was located under the driver’s seat.

The compartment appeared to contain 16, $10,000 bundles, or approximately $160,000 in cash. There was also a Glock handgun found inside; bags of marijuana were recovered from the center console, glove box and stuffed under the rear passenger’s side seat.

Both Mokeme and Ennaw face the same set of charges and bail was also set at $100,000 in their cases, which the two men have posted, according to online court documents.

Mokeme is scheduled to appear for his preliminary hearing at 11:15 a.m. Sept. 26, while Ennaw’s hearing is scheduled for 11:30 a.m. Oct. 10 at the jail.

Clearfield Borough

  • Police arrested a female who was found to have an active warrant when she was located on South Front Street. She was subsequently transported to the magistrate’s office and arranged payments.
  • Police were requested to check the welfare of a male on Thompson Street. Police were later informed that he was located and determined to be OK.
  • Police handled an incident of harassment that was occurring over the phone and social media outlets.
  • Police received a report about an incident of theft from a North Fourth Street resident. During the incident, someone allegedly removed a grill cover from a grill.
  • Police were called to Leavy Avenue after items of drug paraphernalia were located there. Upon arrival on-scene, police retreived the items.
  • Police received a report about a suspicious vehicle on East Market Street. Upon arrival, police found the vehicle belonged to a local business employee.
  • Police assisted a motorist with a traffic complaint along Gulich Avenue.
  • Police received a report about a suspicious vehicle parked along Park Avenue. Police checked on the driver and learned that he was on the phone.
  • Police responded to assist emergency personnel with an overdose along Bigler Avenue. The male was transported to the hospital for treatment.

Lawrence Township

  • While on routine patrol Wednesday, police observed two people reportedly trespassing at the Lawrence Township Rec Park. When contact was made, officers determined the male, identified as Vincent Stevenson, 25 of Philadelphia, had an active warrant for his arrest in an aggravated assault case in the state of Delaware. Stevenson was taken into custody and lodged in county jail.
