Trial Gets Under Way for Duncansville Man Accused of Burglary, Assault

CLEARFIELD – The trial got under way Thursday in Clearfield County Court for a Duncansville man accused of breaking into a Bigler Township home and assaulting a male.

Andrew James Martin, 34, has been charged by Trooper Matthew Peacock of the Clearfield-based state police with felony counts of burglary and criminal trespass.

Martin has also been charged with three misdemeanor counts of simple assault as well as misdemeanor counts of defiant trespass, criminal mischief and use/possession of drug paraphernalia.

First Assistant District Attorney Ryan Dobo is presenting the case on behalf of the commonwealth. Martin is being represented by defense attorney Matthew Swisher.

The charges stem from an incident that occurred on the morning of May 29 at a McClelland Drive home in Bigler Township, according to trial testimony.

The female victim said around 8:30 a.m., she saw Martin on his knees crying in her front lawn. He had his face buried in the shirt in his hands.

She went outside to see if he was OK, at which point he asked if he could come inside. She replied no and he asked her to “let me talk to him.”

She asked him “who” and also indicated there wasn’t anyone there. He asked again and she stated she thought he needed to leave. She then re-entered her home and locked it.

Once inside, the victim said she heard Martin “rattle” her doorknob. She opened the door and he commented that he didn’t like people in his “space” and she informed him that it was her home.

She said after Martin threatened to kick her door in, she locked her home and contacted state police. She also called her brother who lived nearby because she was afraid.

The victim said her brother arrived five or six minutes later and she saw troopers had Martin on Blackburn Road. Later on, she said troopers informed them that Martin’s wife was coming to get him.

She said Martin “rattled” the doorknob again after the troopers left, her brother answered and warned him that he was trespassing and needed to leave the property.

She said her brother locked both doors and the deadbolt, and asked her to call state police again. She said Martin was kicking her door with her brother leaning against it to try to prevent his entry.

However, the victim said her door flew open and its parts flew off. She said her brother tried to hold Martin back, but Martin got him down and began punching and kicking him.

She testified that she went to the kitchen and got her gun because she was “scared for her life” and “just wanted him out.” She said when Martin saw her, he put his hands up and ran out.

She said her husband’s employee stopped Martin outside and restrained him until troopers returned to the scene. She also saw a knife in her front yard, and it was not far from Martin.

The male victim said that morning he received a call from his sister who was crying and distraught over a male trying to get inside her home.

He went down and saw two troopers speaking with a male at the bottom of her driveway. He said he tried to calm her down and the troopers later came up to speak with them for around 20 minutes.

He said troopers had warned Martin not to return and advised them that his wife was on her way to get him from the Altoona or Duncansville area.

The male victim said Martin returned to his sister’s home after troopers left and he answered the door. When Martin tried to enter, he advised him he was trespassing and he needed to leave.

He said he had to gently push Martin with one hand out of the doorway and told his sister to call state police. At this point, he saw Martin begin to pull his knife out of its sheath.

The victim said he began to draw his pistol from its holster, as he backed inside and locked both doors and the deadbolt. He said Martin began kicking the door and so hard he backed away.

He said he pointed his gun at Martin and chambered a round when the door flew open; however, there was a malfunction with its clip. He said Martin struck him and got him down, then began to punch and kick him.

By this point, he said his sister was “hysterical,” went for her gun and that made Martin run from the home. He said another male had him restrained outside and troopers were back within seconds.

Following the lunch recess, Dobo called his third witness and Swisher objected to him giving testimony. Swisher raised a discovery issue, saying he never received a list of eyewitnesses from the district attorney’s office.

Swisher commented that he “played fair” and decided to let the issue go for the first two witnesses. He said it could be assumed they would testify at trial, as they had in a previous hearing.

He indicated he knew “nothing” about this witness other than “one line from the affidavit of probable cause.” He noted the court previously granted a motion for the commonwealth to provide all discovery.

Dobo countered, arguing the defense was aware the witness existed because his name was in the provided discovery information, not to mention that it was in the affidavit.

Swisher said it’d be a burden on defense attorneys if they had to look up an address for every name in every affidavit. He also said he didn’t know which troopers or how many Dobo planned to call, other than Peacock.

Dobo said Swisher had the names of the troopers involved in this case and if he wanted to talk to any of them, all he had to do was contact the state police.

Ammerman granted Swisher’s objection and precluded the witness from testifying and asked if either wanted him to give any specific instructions to the jury.

He noted the witness was brought into the courtroom and it could be assumed he was seen by jurors who hadn’t all returned to the jury room. Swisher then motioned for a mistrial, which Ammerman denied.

When the trial reconvened, Ammerman advised jurors that due to legal issues, the previously-called witness couldn’t testify. He asked that they completely disregard what had happened.

Next to testify was Trooper John Bacher, one of three troopers who responded to a reported disturbance. He said troopers approached Martin along Blackburn Road and he was erratic and emotional.

He said because Martin didn’t have any warrants and hadn’t committed any crimes, he was advised not to return to the victim’s home and released with his wife en route to pick him up.

Under cross-examination, Bacher provided further explanation of Martin’s emotional state. He said he would go from being angry at troopers and wanting an attorney to crying and acting distraught.

However, he said they managed to calm him down enough that they felt it was OK to release him to wait for his wife. He testified that he was “in better shape” than what they found him in.

Bacher said he was within close proximity when troopers received the second dispatch and arrived on-scene first. He saw the home’s door was wide open and Martin was being restrained by a male.

He said he cuffed Martin and maintained security of him while Peacock completed the rest of his investigation. He said during a search of Martin’s person, he located a marijuana grinder in his short’s pocket.

Based upon his experience as a trooper, Bacher said he was able to detect the odor of marijuana on the grinder. He said he also observed a dagger knife with Martin’s shirt on the ground.

Peacock was the final witness to take the stand for the commonwealth. He said at 8:30 a.m. May 29, the initial call came in as a suspicious male crying in the victim’s front yard.

He said Martin was positively identified by name and date of birth and determined not to have any active warrants. He said he contacted his station to arrange transportation with Martin’s wife.

Peacock said troopers spoke with Martin for a while and he told him not to return to the victim’s home. Then, he went to speak to the female and male victims and to advise them of the situation.

He said Martin was on his cell phone with his wife when he drove by him later. He stopped and advised Martin for a second time that he wasn’t to return, which initially made him angry.

However, Peacock said he eventually thanked him for being there and they shook hands. After this, Peacock drove about 200 yards down Blackburn Road to keep an eye on Martin.

He said when the second dispatch came in, it was for the same address and a female was heard screaming. He said on-scene a male had Martin on the ground and a knife was in a sheath near the home.

Peacock said when he spoke with the male victim, he complained of headaches and he observed blood on his ear. He said he tried to question Martin, but he didn’t respond and just laid there.

Martin opted not to testify on his own behalf. Closing arguments will begin at 9 a.m. Friday in Courtroom No. 1 at the Clearfield County Courthouse. Afterward, Ammerman will instruct members of the jury and send them into their deliberations.

  • Police received a report about a suspicious male on South Fifth Street. However, police were unable to locate the male.
  • Police located a male who had an active warrant on East Cherry Street. He was able to satisfy the warrant.
  • Police stopped a vehicle along Nichols Street and learned the driver had an active warrant. She was able to satisfy the warrant on-scene.
  • Police reported that a bike was returned to its owner after it was located along North Second Street.
  • Police assisted a female who was in search of mental health resources.

Lawrence Township

  • Police received a report about an incident of harassment that occurred Wednesday in the area of the Riverside Motel. During the incident, a 57-year-old Clearfield man had allegedly made a lewd and or threatening comment in reference to a previous incident. While at the scene, police determined the caller was wanted by the Centre County Sheriff’s Department. She was taken into custody and housed at county jail. Police are continuing their investigation into the incident.
  • Police received a report about a theft that occurred Wednesday at Wal-Mart. During the incident, someone allegedly stole a woman’s debit card and then made 11 fraudulent transactions on her account in May and June. Police don’t have any suspects at this time, and their investigation is continuing.

Curwensville Borough

  • Police received a report about an incident of criminal mischief that occurred at a Thompson Street residence. During the incident, a known juvenile allegedly caused damage to property. Police handled the incident on-scene.
  • The school resource officer received a report about a fight between two juvenile males on campus. The offender received detention and will also be cited for his actions.
  • Police received a traffic complaint at the school. Several motorists were warned for violations entering school property. Police would like to remind citizens to obey all traffic signs entering and exiting the school and warn that all violators will be cited.
  • Police received a report from personnel at the high school office about a juvenile female who was allegedly found in possession of pills. The SRO subsequently confiscated the pills.
  • Police received a report about an incident of harassment via communications involving three adult females. Police have warned those involved to cease their inappropriate online activities, or they will be arrested.
  • Police are investigating an alleged incident of false reports.
  • Police are investigating several fraud cases reported by Curwensville Ambulance. In commission of the crime, several people allegedly received reimbursement checks from their insurance but didn’t forward the funds to the ambulance service, as required.

Martin Found Guilty in Bigler Twp. Burglary, Assault Case

CLEARFIELD – A Duncansville man accused of breaking into a Bigler Township home and assaulting a male was found guilty of all charges Friday in Clearfield County Court.

Following the verdict, President Judge Fredric Ammerman ordered the Probation Office to conduct a pre-sentencing investigation. Martin will then be scheduled for sentencing per court procedure.

During his closing, Swisher argued that it was only burglary if jurors believed Martin entered the victim’s home with the intent to commit the crime of simple assault.

He said the commonwealth presented evidence that showed Martin’s lack of intent. He pointed out that prior to forcing entry, he threw his knife – still in its sheath – out into the grass.

“When you pull out the intent, it’s like a Jenga piece,” Swisher said, adding it causes “the whole tower to fall.” He said the crime that occurred might have been something else, but it wasn’t burglary.

Dobo countered by arguing that Martin was determined to confront somebody inside the victim’s home that day. He said Martin was warned by the homeowner and a state trooper not to return.

“And, what does he do,” Dobo asked? “He leaves and comes back with a knife. What is that supposed to infer other than he had the intent to hurt somebody?”

“He was there and told to leave; state police told him not to go back, which we know he did. The victim’s brother told him that he must leave, he’s trespassing. It doesn’t get any clearer than that.”

He continued by calling into question why Martin began to remove his knife from its sheath, if there wasn’t any intent.

“Why didn’t he just leave? Why didn’t he just say, ‘hey, I’m sorry’ or ‘hey, why can’t I be here,’” Dobo asked. “You don’t get any more violent than kicking somebody’s door in.”

He said Martin got the male victim on the ground and began punching and kicking him about his body. He said the victim suffered from headaches for days and had lumps on his head.

Dobo added that both the male and female victims testified that they were absolutely terrified and feared for their lives. He asked the jury to put themselves in the victims’ place.

“Can you blame them?” he asked. “Both thought Martin could seriously injure or possibly kill them, and it was a very legitimate thought. In fact, [the female victim] was in such fear she went and got her gun.”

Clearfield Police Seeking Public’s Assistance in Locating Two Wanted Persons

CLEARFIELD – The Clearfield Borough police are seeking the public’s assistance in locating two wanted persons.

Steven Paul Shanechuck, 30, of Clearfield is wanted for the unauthorized use of an automobile.  According to police, on Sept. 4, Shanechuck used a relative’s vehicle without permission.

Shanechuck is described as being 5 feet, 6 inches tall and 200 pounds. He also has black hair and brown eyes.

Ryan Michael Luzier, 29, of Clearfield is wanted for theft from motor vehicles and receiving stolen property.

Police say on Aug. 12, Luzier entered two vehicles parked in a lot along Reed Street. He allegedly removed two purses and prescription medication.

Luzier is described as being 5 feet, 8 inches tall and 125 pounds. He has red/auburn hair and gray eyes.

State police at Clearfield

  • State police received a report about an assault that occurred Saturday on Sawmill Street in Beccaria Township. During the incident, a 36-year-old Beccaria woman allegedly stated to relatives that she was going to set the male victim’s home on fire while he and her child were inside. State police say a 49-year-old Houtzdale man then forced his way into the victim’s home and struck him in the face with a closed fist; he also went inside the victim’s garage and caused damage to his vehicle. Both suspects were located and lodged in county jail to await arraignment.
  • State police received a report about a case of theft that occurred from 2016 into 2018 at the Winburne Fire Company. During the timeframe, a known suspect had access to the company’s bank account and allegedly stole approximately $52,000 for personal use. State police are continuing their investigation at this time.

State police at DuBois

  • State police are currently investigating a case of Facebook fraud that occurred Thursday on Taylor Avenue in Falls Creek Borough. During the incident, the victim sent iTunes gift cards’ serial numbers through social media. She did this under the notion the account was for the Federal Assistance Program in Washington, D.C. However, it was allegedly a fake account and she was defrauded out of $650.

State police at Punxsutawney

  • State police received a report about an incident of reckless endangerment that occurred Friday on Route 119 in Young Township. During the incident, a 29-year-old Big Run woman allegedly left two young children – ages 2 and 3 years old – unattended in a vehicle in the Wal-Mart parking lot.

State police at Ridgway

  • State police received a report about a burglary that occurred between Sept. 16 and Saturday on Burning Well Road in Jones Township. During the incident, someone allegedly smashed the front window to enter the victim’s residence as well as a window in a detached garage and one in a camper located behind the residence. State police say multiple items were taken from the victim’s property, including a few sets of chains, a generator, a set of wrenches, a rear axle from a vehicle, approximately $30 in change, an Interstate battery and a 5,000-watt inverter. Also, the suspect(s) dumped a black freezer, five tires, a cart dolly and a television on the property. Anyone with information is asked to contact state police at 814-776-6136.

Lawrence Township

  • Police received a report about an incident of trespassing that occurred Thursday at the Lawrence Park Village. Upon arrival, officers encountered a female and asked if she was aware of the whereabouts of Brandon Ogden, 31, of Clearfield. They also asked for her consent to look around her apartment for Ogden. She refused both of the officers’ requests. Later police observed a male jump over the guiderails at the apartment complex and flee in an unknown direction. Police did indicate that it’s unknown if the male was Ogden. Charges have been filed against Ogden for trespassing.
  • Police received a report about an incident of disorderly conduct that occurred Friday on Capitol Hill Road in Glen Richey. According to police, the incident involved an adult female and several juveniles who were name-calling, “picking,” etc., and the possible use of obscene language by an adult. Police advised those involved to cease their actions to avoid further action.
  • Police received a report about the theft of trailers that occurred Sept. 3 on Airstream Way in Clearfield. Police say the first trailer is enclosed, the second is aluminum and the third is refrigerated. It’s suspected the trailers were taken by a female who was formerly in partnership with the victim.
  • Police reported on a drug-related incident that occurred Saturday at the Economy Inn. According to police, a call came in for unwanted persons who were trespassing and possible drug activity due to the odor of burnt marijuana. Upon arrival, police advised the individuals to leave, which they agreed to do. However, police were unable to locate the source for the odor of marijuana. Police cleared the scene but had a second call come because a male in a neighboring room allegedly admitted to smoking marijuana. The male also made the same admission to police, and he was found in possession of the drug. Charges are currently pending at this time.
  • Police received a report about an incident of trespassing that occurred Sunday at the Economy Inn. According to police, a known male was supposed to remain off the property due to a previous incident. Officers confirmed that he was packed and just waiting for a ride.
  • Police received a report about an incident of criminal mischief that occurred during the nighttime hours Friday on Flegal Road. During the incident, someone allegedly smashed out the victim’s mailbox. Officers noted there was also a recent incident on Pifer Road, and it’s believed the incidents are related. Anyone with information is asked to contact township police and those caught will be punished to the fullest extent of the law.

DuBois City

  • Police responded to a reported alarm Friday at a business, located on Beaver Drive. Upon arrival, police determined that it was a false alarm.
  • Police were requested to check the welfare of a male Friday in the 800 block of East DuBois Avenue. He was reportedly carrying a sign that stated: “Homeless and Hungry.” Police checked the area but were unable to locate the male.
  • On Friday police received a report about a female who had left the Penn Highlands Hospital with a monitor that belonged to the hospital. Upon arrival, police learned staff had been able to get the female to return to the emergency room and they had received the monitor.
  • Police received a report about criminal mischief that occurred to a vehicle Saturday in the first block of North Brady Street. Upon arrival, police were advised that a can of black spray paint was put under a vehicle tire. When the vehicle was backed over the can, it caused it to spray paint all over the vehicle.
  • Police received a report about a possible domestic dispute Saturday in the 100 block of East Long Avenue. Upon arrival on-scene, police determined that it was only verbal in nature.
  • Police received a report about a domestic dispute Saturday on East Washington Avenue. Upon arrival on-scene, police learned that it was only verbal in nature, and a female agreed to leave the residence for the night.
  • Police received a report about a possible domestic dispute Saturday in the 300 block of Olive Avenue. Upon arrival on-scene, police learned that it was only verbal in nature, and a male agreed to leave the residence for the night.

State police at Clearfield

  • State police responded to a single-vehicle crash Tuesday on Interstate 80 in Lawrence Township. Kimberly Holcombe, 31, of Alabama was operating a tractor-trailer eastbound when she lost control. It traveled off the left side of I-80 and impacted an embankment, causing it to overturn. It came to a rest in the median on top of the embankment. Both Holcombe and her passenger were transported to the Penn Highlands DuBois Hospital for medical treatment. Her tractor-trailer sustained severe damage in the crash.

Lawrence Township

  • Police received a report about an incident of harassment that occurred Sunday on the Clearfield – Shawville Highway. During the incident, a 16-year-old boy was allegedly involved in an altercation at a local business. Police are continuing their investigation at this time.

Clearfield Borough

  • Police received a report about an incident of harassment on North Second Street. During the incident, a male allegedly made harassing statements via text messages. Police contacted the male and advised him of the complaint.
  • Police received a report from a West Market Street resident who was being harassed by their neighbor.
  • Police responded to a reported traffic complaint along Turnpike Avenue. According to police, a large branch had fallen and it was causing a hazard. Police were able to remove the branch from the roadway.
  • Police received a report after several syringes were located in a drain along North Fourth Street. Police were able to remove them with the assistance of the Street Department.
  • Police received an animal complaint along Turnpike Avenue. However, police were cancelled because the dog owner had been located.
  • Police arrested a female for suspicion of driving under the influence of alcohol after she was stopped for a traffic violation along Third Street.
  • Police received a report about two males who were breaking items in the roadway along North Third Street. However, police were unable to locate the males.
  • Police received a report about an unwanted female on Spruce Grove Lane. Upon arrival, police were able to handle the situation on-scene, as the female voluntarily left.
  • Police received a report about an intoxicated male who had thrown a cigarette into a passing car on North Second Street. Police located and arrested the male as a result.
  • Police received a report about a possible disabled vehicle on Woodland Road. Upon arrival, police found the driver had pulled off to use a cell phone.
  • Police received a report about a mental health patient who had left the hospital. Police located the patient and were able to return them to the hospital.
  • Police located a male who held several active warrants along Bigler Avenue. He was subsequently turned over to Curwensville Borough Police Department.

State police at Clearfield

  • State police received a report about a theft that occurred Saturday on Elizabeth Street in Beccaria Township. During the incident, a couple was allegedly involved in the removal of chainsaws, leaf blowers, hedge trimmers and other miscellaneous items from the victim’s property without permission. Charges are expected to be filed through the district court.
  • State police received a report about a lost/found firearm Saturday at the Goodwill Store in Philipsburg. Anyone with information is asked to contact state police at 814-857-3800.

Clearfield Borough

  • Police received a report about a possible Protection from Abuse order violation. Police are continuing their investigation at this time.
  • Police received a report about a disabled vehicle along South Second Street.
  • Police are investigating a hit-and-run crash that occurred along West Front Street. According to police, a vehicle was rear-ended by a black truck, which fled the scene; it was last seen traveling up Nichols Street. Police are continuing their investigation at this time.
  • Police received a report about a suspicious male on Martin Street. Police located the male who was waiting for a friend.
  • Police received a report about trespassing on East Locust Street. Upon arrival, police encountered a group of individuals and advised them of the complaint. One male had an active arrest warrant through the Clearfield County Sheriff’s Office. He was subsequently taken to the jail on the warrant.
  • Police received a report about an alarm on East Locust Street. Police located a vehicle, which was experiencing mechanical issues, and its horn was going off. Police were able to locate the owner.
  • Police assisted a motorist who had locked their keys inside their vehicle along East Cherry Street.

Curwensville Borough

  • Clearfield Borough police located a wanted male. Upon arrival of Curwensville Borough police, he was served his active warrants and transported to the magistrate’s office. Police say a hearing was held and the male was found guilty of all charges.
  • Police received a report about an unwanted male with warrants at the Curwensville Commons. Upon arrival, police learned that Ethan Eles was present and had active warrants through multiple agencies. Although Eles attempted to hide from police, he was located and taken into custody. He was subsequently transported to the jail on the warrants.
  • Police received a report about an unwanted male with an arrest warrant at a Hill Street address. Upon arrival, police located Steven Shanechuck, who was wanted by Clearfield Borough police. He was taken into custody and turned over to the Clearfield police.

During the incident, the suspect(s) allegedly gained access through an apartment building window and removed several items. The stolen items had a total value of $3,300.   • Police received a report about a male who was allegedly intoxicated and urinating in a residential housing parking lot. However, he was gone upon police arrival at the scene.

  • Police received a report about the theft of medication that occurred at the Snappy’s Convenience Store. The victim told police that a known female entered his vehicle and removed several Subutex pills from his prescription bottle. Upon investigation, the female was allegedly found with several drug-related items in her purse. Police are continuing their investigation at this time.

Sandy Township

  • Police responded to a report of a motor vehicle crash on Friday. According to police, a vehicle driven by a 23-year-old Clearfield man hit a vehicle driven by a 40-year-old Reynoldsville man while the two were traveling along the Bee Line Highway. While investigating the crash, officers discovered the 23-year-old showed signs of impairment and he was taken to Penn Highlands for a legal blood draw after he failed field sobriety testing. Officers were assisted on-scene by the DuBois City Police Department.
  • Police received a report about a false alarm at Pizza Hut on Saturday.
  • Police received a report about a domestic dispute that occurred Sunday in Treasure Lake. According to police, a 45-year-old DuBois man was at his 24-year-old girlfriend’s residence, and they were involved in an argument. He said that she scratched him on his arm. Officers handled the situation without incident.
  • On Monday police received a report from a 61-year-old Sierra Heights Road man who stated that two handguns were missing from his residence. He told police they were possibly taken while he was on vacation. Police are continuing their investigation at this time.
  • On Monday police received a report from Triangle Tech employees who stated that someone broke into a shed behind their building and took a five-gallon gas can.
  • On Monday police received a report from a 53-year-old DuBois man who stated that while his Jeep was parked at Wal-Mart, someone hit and damaged the front passenger’s side fender.
  • On Monday police received a report from Wal-Mart employees who stated that a female was seen putting items for sale in her purse and then leaving the store without paying for them. She left the parking lot before employees could stop her. Police are continuing their investigation at this time.
  • Police responded to a motor vehicle crash on Monday. According to the report, a vehicle driven by a 24-year-old Falls Creek woman failed to stop in time to avoid hitting a vehicle driven by a 32-year-old Falls Creek resident. Minor damage and no injuries were reported to police.

Suspected Meth Traffickers Appear for Preliminary Hearings

CLEARFIELD – Three people accused of being involved with trafficking methamphetamine and other drugs in Pennsylvania and Ohio were scheduled to appear for their preliminary hearings Wednesday.

Sondra L. McQuillen, 53, of Houtzdale has been charged by the Attorney General’s Office with 10 felony counts of manufacture, delivery or possession with intent to manufacture or deliver and felony counts of conspiracy, criminal use of communication facility, dealing in proceeds of unlawful activities, knowledge that property is proceeds of illegal act, corrupt organizations and conspire to violate 911b1, 911b2, 911b3.

Jason L. Merritts, 36, of Clearfield has been charged with 14 felony counts of manufacture, delivery or possession with intent to manufacture or deliver and felony counts of conspiracy, criminal use of communication facility, dealing in proceeds of unlawful activities, knowledge that property is proceeds of illegal act, corrupt organizations and conspire to violate 911b1, 911b2, 911b3.

Joyce L. Merritts, 32, also of Clearfield, has been charged with five felony counts of manufacture, delivery or possession with intent to manufacture or deliver and felony counts of conspiracy, criminal use of communication facility, dealing in proceeds of unlawful activities, knowledge that property is proceeds of illegal act, corrupt organizations and conspire to violate 911b1, 911b2, 911b3.

Both Jason and Joyce Merritts have also been charged with a felony count of endangering the welfare of children. Two children were present at the couple’s residence during many of the alleged drug sales.

McQuillen and Joyce Merritts waived their rights to preliminary hearings during centralized court Wednesday at the Clearfield County Jail. Jason Merritts had his preliminary hearing continued until Oct. 3. Bail remains set at $100,000 monetary in all three cases.

The charges stem from a grand jury investigation into the distribution of methamphetamine in the Clearfield County area by Donald Mullens, McQuillen, Jason and Joyce Merritts and other co-conspirators.

According to the grand jury presentment, in September of 2017, an AG narcotics agent was introduced to a confidential informant who wanted to provide information about the local distribution of the drug.

The CI’s information was subsequently corroborated by law enforcement’s investigative techniques, such as surveillance, other information sources and grand jury testimony.

From Sept. 29, 2017 through July 6, law enforcement made 18 controlled purchases through the use of the CI. He/she arranged the purchases of methamphetamine via phone calls and text messages.

Each controlled purchase allegedly occurred at the apartment of Jason and Joyce Merritts at the Lawrence Park Village Apartment Complex, Clearfield, except for one that occurred in February at the Super 8 Motel, Clearfield.

Testimony revealed that Jason and Joyce Merritts obtained their quantities of methamphetamine from Mullens and McQuillen. This information was supported by tracking device data, surveillance, etc.

The Merritts reportedly made statements during several controlled purchases that further connected Mullens and McQuillen to the methamphetamine. Jason Merritts also reportedly admitted to the CI that his supply came from Mullens and McQuillen.

Subsequent to several controlled purchases, investigators identified the local sources as Mullens and McQuillen, as well as their source in Akron, Ohio, James Thomas, who is alleged to have supplied up to one-pound quantities of methamphetamine to Mullens and or McQuillen on several occasions when they traveled to Ohio to meet him.

In April, Mullens allegedly purchased one-pound of the drug from Thomas once or twice a week. Thomas told McQuillen he charged Mullens $10,000 per pound. The Grand Jury also learned that McQuillen often traveled to Ohio for Mullens, who was under state supervision.

Text messages received by the CI confirmed that Mullens and McQuillen made trips to Ohio for short periods of time, approximately two hours. Such trips, based upon expert testimony from two AG narcotics agents, were consistent with drug dealers obtaining additional supplies for re-sale.

Mullens remained part of the drug ring’s operation until his overdose death May 22. After Mullens’ death, McQuillen continued to distribute methamphetamine, according to the grand jury presentment, but restricted customers to those with whom she had “close relationships” with, such as the Merritts.

Investigators said that she continued to travel to Ohio and obtained at least four ounces of methamphetamine from Thomas on every trip. Phone records determined she made 26 trips between January and July.

On July 26, law enforcement officers followed McQuillen to meet Thomas. She allegedly purchased methamphetamine and other drugs for $3,800 from him. On her trip back to Clearfield, a traffic stop was conducted and investigators searched her vehicle.

Investigators seized six ounces of methamphetamine; two, one-eighth ounces of cocaine/crack; a small quantity of marijuana; and a quantity of pills suspected to be prescription medications.

A search warrant was executed on the residences of McQuillen and the Merritts. From McQuillen’s home, police seized $10,000, drug paraphernalia, prescription pills and multiple telephones.

At the Merritts’ residence, investigators recovered drugs and paraphernalia, a handgun and a cellular telephone.

The Grand Jury learned that McQuillen and the Merritts used proceeds from drug sales to purchase more methamphetamine and drugs. Proceeds were also reportedly used for their basic living expenses.

Joint coordination between the Attorney General’s Office, Akron, Ohio law enforcement and the Drug Enforcement Administration (DEA) led to Thomas being charged federally in connection with drug seizures of approximately one pound of methamphetamine, cocaine, firearms and almost $50,000 cash from his home and business.

The estimated street value of all of the crystal methamphetamine, cocaine and other drugs distributed by this drug ring during its operation is $1.5 million, according to a previously-published press release from the AG’s Office.

State police at Punxsutawney

  • State police reported a drug-related incident Sept. 22 on Pine Tree Road in Henderson Township. State police say that during the incident, six syringes were left on a Sykesville man’s property. Upon arrival on-scene, troopers properly disposed of the syringes.
  • State police received a report about an incident of theft that occurred Aug. 16 at Wal-Mart in Young Township. During the incident, a couple entered the store and allegedly removed three Motorola Zebra TC-70 mobile computers/barcode scanners, which are valued at $800. State police are continuing their investigation and anyone with information is asked to contact 814-938-0510.
  • State police received a report about an incident of harassment that occurred Sept. 23 on East Main Street in Mahaffey Borough. During the incident, an 18-year-old male allegedly directed threats toward the victim. State police are continuing their investigation at this time.
  • State police received a report about an incident of indecent assault that occurred Aug. 14 in Big Run Borough. During the incident, a suspect allegedly subjected a 13-year-old DuBois boy to unwanted physical contact. State police are continuing their investigation at this time.
  • State police received a report about an incident of statutory rape/sexual assault that occurred Aug. 9 in Mahaffey Borough. During the incident, a suspect allegedly engaged in sexual acts with a 14-year-old Dixonville, Pa. girl. State police are continuing their investigation at this time.

Lawrence Township

  • Police received a report about a theft that occurred Wednesday on Lawrence Grange Road. During the incident, someone allegedly removed a hunting blind from a camp site. The victim also told police there were several kerosene lanterns that had either been broken or thrown into the woods. Police are continuing their investigation at this time.
  • Police received a report about an incident of harassment by communications that occurred Wednesday on Village Road. During the incident, threats were allegedly directed toward the victim on Facebook. Police say the posts were in relation to another incident that they were made aware of prior by another male. Police spoke with those involved in the situation.

Hearings Held for Two Out-of-state Men Allegedly Involved in I-80 Traffic Stop That Turned Up $160K

CLEARFIELD – Two of the three out-of-state men involved in a traffic stop that allegedly turned up a huge sum of cash, marijuana and an illegal firearm were scheduled for hearings Wednesday.

Hassan Ali Sheikh, 22, of Columbus, Ohio and Isaiah O. Mokeme, 22, of South Portland, Maine, have been charged by the Pennsylvania State Police with felony counts of dealing in proceeds of unlawful activities and firearms not to be carried without a license and a misdemeanor count of marijuana/small amount for personal use.

Both Sheikh and Mokeme had all charges held for county court following a preliminary hearing Wednesday at the Clearfield County Jail.

Online court documents indicate that bail was previously set at $100,000 monetary for both Sheikh and Mokeme. Sheikh has remained incarcerated while Mokeme posted bail Sept. 10.

The charges stem from a traffic stop on a Jeep Grand Cherokee at approximately 12 p.m. Sept. 7 on Interstate 80 westbound in Graham Township, according to the affidavit of probable cause filed with the office of Magisterial District Judge Jerome Nevling.

Co-defendant Jebrel S. Ennaw, 24, of Auburn, Maine and Mokeme were located in the driver’s and passenger’s seats. Shiekh was located in the rear, driver’s side passenger seat.

A state trooper detected a strong odor of marijuana emitting from within the vehicle. A probable cause search was subsequently conducted and an aftermarket compartment was located under the driver’s seat.

The compartment appeared to contain 16, $10,000 bundles, or approximately $160,000 in cash. There was also a Glock handgun found inside; bags of marijuana were recovered from the center console, glove box and stuffed under the rear passenger’s side seat.

Ennaw faces the same set of charges and his bail was previously set at $100,000 in his case, which he’s posted, according to online court documents. Ennaw’s hearing is scheduled for 11:30 a.m. Oct. 10 at the jail.

State police at Clearfield

  • State police received a report about an incident of harassment that occurred Monday on Simpson Street in Gulich Township. During the incident, a 20-year-old Tyrone man was involved in a verbal dispute. It escalated when he allegedly began to throw items at the victim. Charges have been filed through the district court.

State police at Punxsutawney

  • State police received a report about an incident of harassment that occurred Aug. 16 at the Jefferson County Jail. During the incident, a 19-year-old Clearfield man, Preston Dotts, allegedly engaged in a physical altercation with the victim. Charges were filed against Dotts through the district court.

Lawrence Township

  • Police reported on a trespassing and drug incident that resulted in a warrant service Thursday in the area of Beaches and River roads. According to police, a male – identified as Gage Wilsoncroft – was located in a posted area and when contact was made, he was found to have an active warrant. He was allegedly in possession of a controlled substance and drug paraphernalia. Wilsoncroft was housed in county jail on the warrant and charges are pending for this incident.
  • On Thursday police received a report about a wanted female who was at the laundromat in Hyde. When contact was made, she was identified as Brittany Watson of Clearfield; she was taken into custody on warrants through Domestic Relations and Lawrence Township and Clearfield Borough police. During a search, Watson was allegedly found in possession of a controlled substance and various items of drug paraphernalia. Charges have been filed against Watson for the incident.
  • Police reported on a drug-related incident that resulted in a warrant service Thursday in the area of Beaches and River roads. Upon investigation, police learned a wanted person – Christina Lenhart, 30, of Clearfield – was staying in a tent on private property. She was taken into custody and suspected methamphetamine and drug paraphernalia were found inside her tent.
  • Police responded to an incident of disorderly conduct that occurred Friday in the area of U.S. Route 322 and Beauty Lane. According to police, there were several calls to check the welfare of a male who was walking in the middle of the roadway. When contact was made the first time, police requested that he stop creating a hazard. Police were later called back because he was reportedly standing on the bridge railing in the area of Route 322 and Beauty Lane. He had to be advised repeatedly to cease his actions and to leave the area. As a result, police cited the male for this incident.

Munson Woman Accused of Neglecting Babysitting Duties

MORRIS TOWNSHIP – A Munson woman has been accused of endangering the welfare of the 2-year-old boy she was babysitting.

According to Clearfield-based state police, on Friday the child’s parents left him in the care of Alesia Cusick, 24. She allegedly neglected her duties by allowing the boy to walk away from the residence on his own.

State police say the boy was found “out of distance,” standing in the roadway and wearing “wet pants.” He wasn’t wearing any shoes.

A “Good Samaritan” stopped to help the child and contacted state police.

Cusick will be charged with felony endangering the welfare of children and misdemeanor recklessly endangering another person.

State police at Clearfield

  • State police received a report about a theft from a motor vehicle that occurred Sept. 25 on Grouse Drive in Morris Township. During the incident, someone allegedly entered the victim’s vehicle and removed a black purse, bank card, Pennsylvania driver’s license, birth certificate and social security card.   • State police received a report about an incident of theft from a motor vehicle that occurred Sept. 25 on Deer Creek Road in Morris Township. During the incident, someone allegedly entered the victim’s vehicle and removed a tan with floral platter, an Amazon Kindle, a leather case, a white gold chain with a half-karat pendant and cash. Anyone with information is asked to contact state police at 814-857-3800.
  • State police received a report about an incident of harassment that occurred Friday in Decatur Township. During the incident, two Morrisdale women engaged in a verbal dispute that turned physical when one allegedly pulled the other’s hair. Then, she fled the scene. Charges were filed through the district court as a result.
  • State police received a report about an incident of criminal mischief that occurred Friday on McAteer Street in Woodward Township. During the incident, someone allegedly scratched the victim’s car.
  • State police received a report about a theft from a motor vehicle that occurred Saturday or Sunday on Lake Street in Bradford Township. During the incident, someone allegedly entered a vehicle and removed a Tom Tom GPS unit and Springfield firearms. Anyone with information is asked to contact state police at 814-857-3800.

State police at Punxsutawney

  • State police received a report about a theft that occurred Sept. 9-10 in the area of Brink and Black Elk roads in Chest Township. During the incident, someone allegedly took two road closed signs before fleeing the scene. State police are continuing their investigation and anyone with information is asked to contact 814-938-0510.
  • State police received a report about an incident of harassment that occurred Thursday on Alleghany Boulevard in Brookville Borough. During the incident, a female allegedly threatened a Brookville police officer. State police say the female admitted to committing the crime, and she was charged through the district court.

State police at Ridgway

  • State police reported on an incident of DUI that occurred Saturday on Shelvey Road in Fox Township. During a traffic stop, a 29-year-old Brockport man was allegedly found to be under the influence of alcohol. He was subsequently transported to Penn Highlands Elk for a legal blood draw. Charges are currently pending at this time.

Clearfield Borough

  • Police conducted a vehicle stop along West Front Street. According to police, a male had an active arrest warrant for drug-related charges through the Pittsburgh Police Department.  In addition, police allegedly located drug paraphernalia, and the male was transported to county jail.
  • Police encountered a suspicious vehicle in the Clearfield Driving Park. According to police, the male driver had an active arrest warrant for a trespassing incident through the Lawrence Township police.  Township officers arrived on-scene and transported the male to the jail on the warrant.
  • Police responded to a parking complaint along East Locust Street. However, the complaint was unfounded.
  • Police assisted several motorists who had locked their keys inside their vehicles.
  • Police received a report about a disturbance on Elm Avenue. According to police, a male and female became engaged in an argument that turned physical.  Charges are currently pending as a result of the incident.
  • Police were requested to check the welfare of a male on South Fourth Street. Police were able to make entry and found the male in need of medical attention.  Emergency personnel responded to the scene and transported the male to the hospital.
  • Police received a report about kids who were sitting on the roadway along West Front Street.
  • Police located a female who was reportedly trespassing in Lower Witmer Park. She was offered services but declined them.  She was requested to leave the park area.
  • Police received a parking complaint on East Walnut Street. However, police were unable to locate any violations.
  • Police arrested a male for public intoxication along East Market Street after he was reportedly found under the influence of controlled substances.

Lawrence Township

  • Police conducted a traffic stop that resulted in a warrant service Monday on state Route 879 near Wolf Run. When contact was made, police discovered the vehicle displayed an expired inspection sticker. In addition, it was discovered the male driver – Michael S. Gearhart, 31, of Clearfield – had an active warrant through the Clearfield County Sheriff’s Department. He was taken into custody and subsequently to county jail, where he was housed on two citations.
  • Police responded to a reported trespassing incident Wednesday at the Edgewood Apartments. Upon arrival on-scene, police located Jeremy M. Sipe, 39, of Clearfield hiding in an upstairs bedroom closet. While he was being detained, he allegedly jumped from a second-story window and fled into a wooded area behind the apartment complex. A search of the area had negative results and police have obtained a warrant for Sipe on the charges of resisting arrest, flight to avoid apprehension and disorderly conduct. Anyone with information on Sipe’s whereabouts is asked to call 911. Clearfield-based state police and Clearfield and Curwensville Borough police assisted with the incident.
  • Police conducted a warrant service Saturday at the Wal-Mart Supercenter. During a traffic stop, a passenger who was identified as Tyler Holt was found to have three active warrants through the township and Clearfield Borough police. Holt was subsequently housed in county jail on the warrants.
  • On Friday police received a report about a gun possibly being stolen from a Clarendon Avenue residence in Hyde. According to police, a woman stated she was in the process of settling her father’s belongings after his passing and discovered a Smith & Wesson 380 Body Guard handgun was missing. Police haven’t been able to locate the gun and it was entered into the National Crime Information Center and CLEAN.
  • Police received a report about a domestic dispute Friday on Garman Lane. During the incident, a couple engaged in a verbal altercation over property while they were moving out of their apartment. It was witnessed by neighbors and reportedly became physical in nature. Both were cited for harassment and disorderly conduct through the district court.
  • Police conducted a traffic stop Saturday on Washington Avenue. When contact was made, police detected an odor of marijuana coming from inside the vehicle. Subsequently, a search of the vehicle allegedly turned up a small amount of marijuana and drug paraphernalia. Charges are to be filed through the district court.
  • Police reported that car keys were located Saturday at the Hyde Post Office. Anyone who lost their keys here should contact the township police station.

Sandy Township

  • On Sept. 25, police received a report about a phone scam. During the incident, a caller contacted a 58-year-old DuBois man claiming to be from Microsoft and requesting remote access to his computer due to a hack. After he permitted the caller to have access, they were able to take personal information, including a credit card number, that was allegedly used to make several purchases.
  • On Sept. 26, police received a report about a phone scam. During the incident, a caller contacted a 74-year-old woman and allegedly attempted to scam her out of money. However, she recognized it as a scam and hung up.
  • On Sept. 26, police received a report about a woman screaming in the area of Royer’s on Watson Highway. Officers checked the area but were unable to hear anything.
  • Police reported a false alarm occurred Sept. 26 at Station 101.
  • On Thursday police received a report from Wal-Mart employees who stated that while using the self-checkout, a 28-year-old Scribner Avenue man used the wrong UPC code to ring up merchandise.
  • On Thursday police received a report about two small children walking along the roadway in the area of Rockton and Home Camp roads. However, officers were unable to locate the children.
  • Police reported a false alarm that occurred Thursday at Napa.

Chester Hill Woman Gets State Prison Time for Selling Meth

CLEARFIELD – A Chester Hill woman will be spending time in state prison for selling methamphetamine.

Danielle Renee Durlin, 35, pleaded guilty Monday to delivery of a controlled substance, criminal use of communication facility and possession of drug paraphernalia.

Judge Fredric J. Ammerman sentenced her to 21 months to four years in state prison.

Prior to sentencing, Ammerman commented that her sentence was long because she had a previous felony on her criminal record that included cases in Texas.

According to the affidavit of probable cause, a confidential informant contacted Durlin inquiring if she had any “Molly” or ecstasy for sale. This informant then contacted a state trooper who told him/her to also ask Durlin if she had any methamphetamine for sale.

A controlled purchase was arranged for both drugs with the informant set to meet Durlin outside her home. While on the way, Durlin advised the informant that she only had meth to sell.

At the home, officers saw the informant talk with Durlin from her car and then go inside the residence. When the informant left the home, he/she traveled to another location where he/she met with the trooper and provided the two bags of suspected meth.

The informant told the trooper when Durlin spoke with him/her at the vehicle, she asked for the money to take into the house to her husband. The informant told Durlin he/she was not giving up the money. After this, Durlin went inside then came back out to say it was OK to go in.

Inside the residence, Durlin went into the front bedroom and came back with a CD case with meth inside. The informant then gave Durlin the money.

The informant reported that Durlin’s mother and Durlin’s two children were also in the home at the time of the sale.

 


Miller Facing Felony Insurance Fraud Charges

DUBOIS – A Ridgway man is facing felony insurance fraud charges.

Kyle A. Miller, 29, was charged by the attorney general’s office with false/fraud insurance claim and criminal attempt/theft by deception as a result of an insurance claim he filed on Oct. 18, 2017.

According to the affidavit of probable cause, the insurance company contacted the Western Regional Office of the insurance fraud section of the AG’s office regarding the claim.

Miller reportedly said his vehicle, a 2004 Nizzan Z350, had been vandalized. He allegedly claimed that the exterior was keyed, the interior front seats had been slashed and the radio and shift knobs had been stolen. The amount of this claim was over $2,000.

The previous owner of the vehicle had filed a claim for the same damages on the vehicle in June of 2017 with the same insurance company, investigators said.

When the previous owner was contacted, she said Miller purchased the vehicle from her for $100 without any repairs being made because her claim was denied or had been withdrawn.

She explained to investigators that the damage occurred after the vehicle broke down and had to be left on the side of the road overnight in June of 2017.

The next day when she went back to the car, she discovered someone had keyed it, slashed the seats and removed the stereo, according to the complaint.

Miller waived his right to a preliminary hearing Friday during centralized court in DuBois. He is free on $10,000, unsecured bail.

Motion Dismissed: Houtzdale Woman Whose Home Was Used for Drug Ring Doesn’t Get Shorter Sentence

CLEARFIELD – The attorney for a Houtzdale woman whose home was a base for a local drug ring, was in court Monday asking a judge to give her a shorter sentence.

Pamela Gavlak, 52, and her two children, Robert Gavlak and Catherine Anderson were part of a group selling cocaine in Clearfield County.

Todd Mequim Anderson, 46, Catherine’s husband, was determined to be the leader of the drug enterprise and the one bringing the drug into the area from Beaver County, according to a press release from the Attorney General’s office.

Gavlak’s attorney, Robert Donaldson filed a motion for reconsideration of sentence asking Judge Fredric J. Ammerman to reduce her state prison sentence of 22 months to five years to the lesser sentences given to her children.

In court Monday, Donaldson stated that it was her daughter and son who actually sold the drugs.

Each of them received sentences of 11.5 months to two years less one day in the county jail, according to previous reports.

Donaldson claimed Pamela Gavlak was “minimally involved” and would be better served by a lesser sentence.

Deputy Attorney General David Gorman, who prosecuted the case, noted that both of Gavlak’s children agreed to cooperate in the case. She was offered the same deal, but she did not take it.

Gorman said Gavlak used her home as the base for Todd Anderson, who received an eight to 16-year sentence. Gorman told Ammerman he felt Pamela Gavlak’s sentence was appropriate.

Before ruling on the motion, Ammerman referred to a letter he received from her brother-in-law, Ronald Gavlak and read part of it into the record.

In it, Ronald Gavlak said he couldn’t be silent about his brother’s widow, Pamela Gavlak. He said he watched what transpired at the home until everyone was arrested.

“Everyone in the neighborhood knew what was going on,” he wrote in the letter.

Ronald Gavlak mentioned that he testified before the grand jury and would have testified if this case had gone to trial.

He wrote that Pamela Gavlak was a “habitual liar” and a “good actress,” who had a nice home and a good job before she got into her daughter and her husband’s lifestyle.

“She brought disgrace to my brother and the Gavlak name,” he said.

Ammerman then dismissed the motion, allowing Gavlak’s sentence to stand.

On Tuesday, a motion regarding a post-conviction relief act petition filed by Todd Anderson was discussed briefly. An attorney will be appointed to represent him.

The original press release regarding this case explained that these individuals were identified after a series of controlled drug purchases.

Investigators seized more than 70 grams of cocaine, $2,750 in cash and drug paraphernalia through raids in Houtzdale in March of 2017 and Philipsburg in June of 2017.

“This drug ring was selling more than $10,000 of cocaine a month – pumping their poison into Clearfield and surrounding communities,” said Attorney General Josh Shapiro.

Lawrence Township

  • Police reported on a drug-related incident and warrant service that occurred Wednesday in the Sheetz parking lot. According to police, a vehicle driven by Shane Irwin, 24, of Clearfield was stopped for an expired registration and because he was wanted. He was subsequently taken into custody on a warrant through the Clearfield County Sheriff’s Department. During a search, police found that he was in possession of suspected methamphetamine and other drug paraphernalia. Irwin was housed in county jail and charges are currently pending.
  • Police received a report about an incident of theft that occurred Sept. 28 at the Super 8 Hotel. During the incident, a known 21-year-old Kylertown man allegedly took approximately $100 in cash, plus shoes from the victim. Police are continuing their investigation at this time.
  • Police received a report about an incident of harassment that occurred Wednesday at Sheetz. During the incident, a male confronted two people and allegedly threatened to assault them over a previous incident. Then, the male left the scene. When contact was later made, it was found his driver’s license is suspended due to a previous DUI. Police have cited the male for the incident.

CURWENSVILLE – Curwensville police are investigating numerous vehicle break-ins in the areas of Anderson Street, Beech Street, Park Avenue and Park Avenue Extension.

According to police, unknown individual(s) is/are gaining access to unlocked vehicles and removing money and other personal belongings.
