Massachusetts Man Accused of Threatening a Woman Following a “Road Rage” Incident

DUBOIS – A Massachusetts man is facing charges following an incident of road rage.

According to an affidavit of probable cause filed with District Judge Patrick Ford’s office June 21, Benjamin Robert Reed, 26, 49 Adams St., Haverhill, Mass., is charged by the DuBois City police with terroristic threats, assault, stalking and two counts each of disorderly conduct and harassment.

According to the affidavit, on June 20, police were dispatched for a report of a man threatening a woman with a shovel. The victim was waiting at a nearby fire hall.

The officers met with the victim who told them that she was driving home with her young child in the vehicle. She approached the intersection of Spring Avenue and Brooks Alley and saw a blue pick-up truck with a Massachusetts license plate turn left onto Brooks Alley, then back onto Spring Avenue and was going to make a left onto Spring Avenue again. The victim said she was trying to make a right as the other driver was trying to make a left and the road was “tight” for both vehicles to pass. The victim said she saw the driver of the truck was yelling at her, but couldn’t make out what he was saying because her window was up.

The victim said she drove down the alley and pulled into her home, where her husband was standing and briefly told her husband what had happened, but she saw the driver of the truck walking down the alley. The victim said she was afraid for her safety, so she drove away, hoping the man would leave the area.

When the victim returned home, she backed into her driveway, got out of the vehicle and looked down the alley. The victim said she saw the man walk out of some bushes at the end of the alley. The victim told her husband the man was coming back and got back into her vehicle. The victim told police that the man allegedly had a shovel in his hand. The victim then drove to the fire hall to wait for police.

The offices spoke to the victim’s husband, who told them that he saw the man allegedly carrying a shovel and that the man was allegedly yelling that he was going to smash out his wife’s window and “split her head open.” The victim’s husband also showed police a shovel laying near the intersection of Brooks Alley and Spring Avenue, where the man was last seen.

The officers were able to locate the pick-up about a block away and spoke with the driver, later identified as Reed.

Reed allegedly told police that his truck was hit by the victim and she shouted an expletive at him. Reed allegedly told police he got out of his truck and yelled at the victim, but denied having a shovel. Reed then showed the officers the damage to his vehicle. The officers noted in the affidavit that there were small scratches on the door, which had a thin layer of dust on them, indicating the scratches were not fresh. There was also no damage to the victim’s vehicle to support Reed’s claim.

The victim was able to identify Reed as the man who came after her.

The woman, later identified as Johnson, allegedly admitted to police that she had changed the date on the prescription and allegedly told police that she had a drug problem for about a year and a half. Johnson also allegedly told police she had a spoon and syringes in her pants. She allegedly took them out and gave them to the officers.

Three Accused of Drug Possession Following Traffic Stop in Sandy Twp.

DUBOIS – Three men are facing drug-related charges following an incident in Sandy Township.

According to affidavits of probable cause filed with District Judge Patrick Ford’s office June 22, Dylan Tapper, 18, 375 14th St., Reynoldsville, is charged by Sandy Township police with possession of a controlled substance, possession of drug paraphernalia, fleeing or attempting to elude a police officer, careless driving, reckless driving and three summary traffic charges.

Austin Ryan Servidea, 19, 245 Hadfield Road, Penfield, is charged by Sandy Township Police with possession of a controlled substance and possession of drug paraphernalia, and Bryce Marvin, 20, 2549 W. Liberty Road, Reynoldsville is charged by Sandy Township police with possession of a controlled substance and possession of drug paraphernalia.

The charges stem from an incident Jan. 3.

According to the affidavit, officers on patrol in the area of Gamelands Road in Sandy Township saw a purple vehicle parked along the road with the headlights off. When the officer shined his spotlight on the vehicle, he saw the passenger side of the windshield was broken and the passenger was wearing a black and white hat. The officer also noticed that the driver had a green shirt and no hat. As the officer went to get out of the vehicle, the driver suddenly pulled away.

The officer followed the vehicle and could see the three passengers in the rear of the car moving “vigorously.” The officer saw a bright yellow bag and other bags being shoved from the rear and front of the vehicle into the trunk area.

The officer activated the emergency lights and followed the vehicle for about a quarter-mile, but then the vehicle stopped in the middle of the road. The officer saw the driver and front passenger switch seats, with the person in the green shirt moving to the passenger seat and the person with the black and white hat moving to the driver’s seat.

The officer approached the vehicle, noting there were five people inside. The officer asked the driver, later identified as Marvin, and the passenger, later identified as Tapper, to get out of the vehicle. The officer could smell a strong odor of marijuana.

The officer then asked the rear left passenger, later identified as Servidea, to get out. A “pat-down” of Servidea revealed plastic baggies, which had contained a substance that smelled like marijuana. The officer also searched two juveniles who were in the back of the vehicle.

The officer told Marvin that he could smell marijuana coming from the vehicle. Marvin allegedly said the vehicle belonged to his father. The officer explained that with the smell of marijuana coming from the vehicle, and the driver’s failure to stop for the patrol vehicle, he could apply for a search warrant, which would take about three hours to process, or Marvin could give the officer permission to search the vehicle. Marvin allegedly told the officer to get the warrant.

The officer then spoke to Marvin’s father on the phone and explained what was happening. The officer told Marvin’s father that he was in the process of getting a warrant and the father gave the officer permission to search the vehicle.

The officer lifted the back seat toward the trunk and found a bright yellow bag that contained two Mason jars full of marijuana; a black and red bag containing a gallon-sized zip-lock bag containing marijuana, a grinder, a glass smoking pipe, a third Mason jar that only had a small “bud” of marijuana inside; a digital scale and an orange bottle cap with a pipe inside for smoking.

The officer attempted to interview Marvin, who said he wanted a lawyer. The officer then spoke to Tapper, who allegedly denied being the driver of the vehicle. Upon further questioning, Tapper also asked for a lawyer.

The officer then spoke to Servidea and asked why Tapper was denying driving the car and Servidea said he didn’t know. Servidea also allegedly told police that he didn’t know about the marijuana in the vehicle.

Thomas Stephen Scott (Provided photo)

CLEARFIELD – A Hyde man will stand trial for pulling a gun and threatening to kill another man.

Thomas Stephen Scott, 49, 1407 Vaughn St., Hyde, is charged with terroristic threats, simple assault, recklessly endangering another person, disorderly conduct and harassment as a result of an incident in Lawrence Township on June 19. He waived his right to a preliminary hearing June 24 during centralized court. He remains in the Clearfield County Jail in lieu of $25,000 bail.

According to the affidavit of probable cause, Scott knocked on the door of the victim’s residence at 9 a.m. that morning. Scott then spoke with the victim on the front porch. He accused him of being responsible for suspending him from the Fraternal Order of Eagles in Clearfield the night before.

After a verbal altercation, Scott did brandish a revolver with a brown handle and black stainless steel barrel. He pointed the gun directly in the face of the victim while stating he was there to kill him. This statement was also heard by a witness who was inside the residence.

The verbal confrontation continued and eventually, Scott put the gun down and began to walk toward his vehicle. As he did this, he pointed the revolver at the victim approximately three more times while warning him that he needed to watch his back and again threatened to kill him.

Later that evening, police received information that Scott was at a tavern on Third Street in Clearfield. When they arrived, they saw Scott walking to his vehicle. He was taken into custody and searched.

Officers found he was in possession of a silver pipe, a baggy containing a green leafy substance and five pills later identified as oxycodone. As a result of this, Scott is facing additional charges of possession of a small amount of marijuana, knowingly or intentionally possessing a controlled or counterfeit substance by person not registered and possession of drug paraphernalia. He also waived his right to a hearing in this case.

As a result of the incident at the Eagles in Clearfield Borough on June 18, Scott is charged with a felony count of possession of firearm prohibited, a felony count of firearms not to be carried without a license, terroristic threats, simple assault, disorderly conduct and harassment. He waived his right to a preliminary hearing in this case Wednesday. His bail is $50,000.

According to the affidavit in that case, at 9:20 p.m., Scott confronted that victim, about coming up behind him and threatened to shoot him.  Noah Stiner stepped in front of Scott in an attempt to calm Scott down. The victim turned to leave and was kicked in the lower back by Scott.

While Stiner attempted to get Scott to calm down and away from the victim, Stiner felt an object pushing against his body. Stiner later saw the wooden handgrips on a pistol that Scott had concealed on his person.

Scott continued to threaten the others and cause problems for the bartender. The bartender shut Scott off and told him to leave the Eagles. Security camera footage shows Scott as he is walking out, pull the revolver from the rear inside of his waistband and put it in his hand.

The victim filed a written complaint with the Eagles about Scott’s actions. When Scott returned to the Eagles on June 19 at 9 a.m., he was given a 90-day suspension. Scott got upset with this, crumpled up the letter and threw it. After this he had the confrontation with the first victim who is the manager of the Eagles at his home.

The second victim told police he felt that the threat Scott made was serious and that he feared for his life. The first victim also stated he was fearful of his safety and the safety of the other members of the Eagles.

Police looked into Scott’s criminal history and discovered he was convicted of a simple assault in a domestic violence case, which prohibits Scott from possessing a firearm.

Charges Filed in CCCTC Sexual Misconduct Case

CLEARFIELD – Charges have been filed against a former substitute teacher for alleged sexual misconduct at the Clearfield County Career & Technology Center. Two former administrators have also been charged for allegedly failing to report the misconduct, according to court documents.

Darice J. Brady-McKee, 34, of LaJose has been charged by Lawrence Township police with two counts of dissemination of explicit sexual material to a minor, F3. She has also been charged with 32 counts of corruption of minors, M1.

Former CCCTC Executive Director William H. Weaver, 55, of Bellefonte has been charged with two counts of failure to report/refer, M2, and disorderly conduct, S.

Former CCCTC Assistant Director Cathy M. Thomas, 61, of Morrisdale has been charged with failure to report/refer, M2, and disorderly conduct, S.

Both Weaver and Thomas resigned from the CCCTC in May when allegations surfaced about their handling of the alleged sexual misconduct by Brady-McKee.

According to the affidavit of probable cause, on May 1 police received a report about an alleged incident of sexual harassment. Further, police were notified by a parent that a substitute teacher had made sexual comments to students.

Police were also notified that the administrators at the CCCTC were made aware of the alleged sexual harassment, which had occurred in March. However, police were told that nothing had been done about it and the substitute teacher was still there.

Police went to the CCCTC on May 1 and spoke to Weaver, who was then the executive director. He told police that on March 23-24, Brady-McKee substituted at the school. Weaver told police Brady-McKee had allegedly made comments about her personal sex life from the previous weekend to the students.

Weaver told police students complained to their regular teacher when she returned March 25. Weaver said he was absent from the CCCTC that day but when he returned he was informed by the assistant director about the alleged sexual misconduct.

Weaver said the regular teacher had her students write statements about the alleged sexual misconduct, which were given to the assistant director, Thomas, and later to him, when he returned to school on either March 26 or 27.

When asked about the content of the statements, Weaver told police the students alleged that Brady-McKee talked about her sex life and showed them bruises on her breasts, legs and buttocks areas. Weaver said when he asked Brady-McKee about it, she denied it.

Weaver told police that he had Brady-McKee placed on the list of substitutes only to call if absolutely necessary. He also said that Brady-McKee was not allowed to substitute in the Health Occupations class.

However, Weaver said there wasn’t anyone to substitute due to multiple teachers calling off work. He told police he allowed Brady-McKee to substitute for a business class on March 31 and in the IT Department on May 1.

When students from the health class noticed Brady-McKee on May 1, Weaver said they made complaints to him and began to text-message their parents. He said multiple students came to him, saying they didn’t feel safe and comfortable with Brady-McKee in the CCCTC.

According to Weaver, he didn’t believe the students were in any danger but confronted Brady-McKee. He informed her that it wasn’t working out due to the large number of complaints about her. Weaver said he also told Brady-McKee that she would have to leave the CCCTC.

Police asked Weaver for the students’ statements. After reading them, police asked Weaver if he’d notified parents, Children & Youth Services or Child-Line. Weaver said that parents only knew if their children had text-messaged them, and he’d just called Child-Line prior to police arrival.

Police asked Weaver why he didn’t notify Child-Line and police immediately after the incident had occurred in March. Weaver didn’t give police an answer.

Police interviewed students in the morning Health Occupations class who originally made complaints. When asked students provided similar information about Brady-McKee allegedly talking in “great” detail about her sex life and showing bruises on her body from “rough sex.”

Students told police that Brady-McKee made them feel uncomfortable and they were upset that she was permitted back into the CCCTC.

Students said when they saw Brady-McKee at the CCCTC on May 1, they went to Weaver. Students said Weaver told them not to worry about it and the matter was being handled by the administration. Students said they were upset and contacted their parents, which made Weaver and Thomas yell at them for cell phone use.

Police interviewed students in the afternoon Health Occupations class. Students told police that Brady-McKee had shared “intimate details” of her sexual experiences. Students also told police that she spoke about drug use multiple times and asked to go to the beach with them while she could provide them with alcohol and drugs.

Police also interviewed Cosmetology students at the CCCTC who alleged that Brady-McKee made them feel uncomfortable when she discussed drugs and her sex life over the last couple of years. Two students alleged that Brady-McKee showed them unknown males’ private parts when they were sophomores, which they reported to their teacher the next day; their teacher then reported the incident to the administration.

Police also interviewed a health teacher who took the initial complaint from her students upon her return to class. She had students write statements, which were turned over to the administration. When the teacher asked Weaver if it should be reported, he said, “Nah, I’ll take care of it.” The teacher said she contacted Child-Line when the substitute returned to the CCCTC, as it obviously hadn’t been taken care of.

Another teacher told police she had reported a photo incident to Weaver, who was the assistant director at the time of that complaint. The teacher said there wasn’t anything done about it; when she talked to Thomas about the alleged sexual misconduct this year, she was told the victims weren’t cooperating and the story couldn’t be validated as a result.

On March 27, police interviewed Brady-McKee about the allegations against her. She initially wouldn’t admit to the alleged incidents of sexual misconduct at the CCCTC.

She told police that she spoke to the students about drugs but never said she used or that drugs were OK. She said she did talk to the students about sex but only because they asked or it came up in conversation. She told police that she was only joking about buying the students alcohol for their trip and denied saying she’d buy them drugs.

When police asked Brady-McKee about the photos, she denied showing males’ private parts to students. Instead, she said students were talking about their boyfriends’ private parts, showed each other photos and asked her if she had any.

Police said Brady-McKee’s statements collaborated with that taken from the victims. However, police said she wouldn’t accept direct blame or admit to anything.

On June 15, police interviewed Thomas about Brady-McKee’s alleged sexual misconduct at the CCCTC. Thomas said she never thought about reporting it, and didn’t realize it should have been reported to authorities.

Preliminary hearings have been scheduled for Brady-McKee, Weaver and Thomas on July 29 at the Clearfield County Jail.

DUBOIS – A Brockway man stands accused of allegedly reporting a theft that never happened.

According to an affidavit of probable cause filed with District Judge Patrick Ford’s office June 29, Devin Michael Keith, 28, 45 Keith Ln., Brockway, is charged by the Sandy Township police with filing false reports.

According to the affidavit, police were called to the parking lot of the DuBois Mall for a stolen vehicle. The reports said the stolen vehicle was heading to the mud pits behind Lowe’s.

The victim, Keith, said he had parked his Jeep in the parking lot near Sears in the morning due to engine problems and got a ride from his friend. Keith said he then called his father to tell him the Jeep broke down and Keith and his father went to the mall to get the vehicle, but it was gone.

Keith’s father said he was going to go back to the mud pits to look for the vehicle. He returned and said the Jeep was there but the keys were missing.

Keith filled out a written statement and the officers asked if Keith was telling the whole story, and that he didn’t get the vehicle stuck in the mud the following night. Keith said no and insisted he had parked the vehicle in the parking lot.

The officers then attempted to contact Keith’s friend who claimed he had been behind the vehicle, but the calls went to voicemail.

Police then spoke to the friend that had picked Keith up at the mall parking lot. The friend said that Keith had told him that he had been out “mudding” with Keith all night but got the Jeep stuck in the mud behind Lowe’s. The friend said Keith asked him to try to pull the Jeep out, but he refused and took Keith home.

The officers then spoke to Keith, who allegedly admitted to getting the Jeep stuck and that it was never stolen. Keith said he “got scared” and didn’t know what else to do.
