Coombs Sentenced to State Prison for Gibby’s Fire

CLEARFIELD – A Punxsutawney man accused of setting fire to the Gibby’s Warehouse in DuBois has pleaded guilty.

Zachary Thomas Coombs, 21, 1025 Big Run Prescottville Rd., Punxsutawney, was sentenced to state prison after pleading guilty to arson, risking a catastrophe, three counts of criminal mischief, burglary, theft by unlawful taking and 10 counts of recklessly endangering another person.

He was given a three to six-year sentence by President Judge Fredric J. Ammerman. An original plea agreement for an 18-month minimum sentence was rejected by Ammerman, who asked for a three-year minimum sentence.

Coombs’s attorney, Douglas Campbell, argued for a lower maximum sentence, but Ammerman said although he didn’t want to send a 21-year-old man to state prison, the maximum sentence in this case had to be six years.

Coombs must pay almost $300,000 in restitution.

Ammerman noted that “this was a very serious fire” with numerous area fire departments responding.

“Thank goodness no one got killed,” he said.

Also charged in this case was Timothy J. Young, 19, 1406 Million Dollar Hwy., Kersey. He pleaded guilty to burglary, three counts of criminal mischief and criminal trespass.

Ammerman sentenced him to nine months to 18 months in the county jail and two years consecutive probation. It was noted that Young cooperated with authorities in the investigation. He was fined $350 plus costs and must pay $477.50 in restitution.

According to the affidavits of probable cause, the fire was considered suspicious after fire department personnel noticed the side door of the building was pried open. The building had been spray painted with “DTY” and “bomb.” That same night several other buildings in the area were marked with these words.

Police received information Jan. 6 from a witness who said Coombs and Young had stayed at his East Park Avenue residence. Coombs had painted the word “bomb” on his daughter’s bedroom wall.

The witness later found comic books, a knife with a train engraved on the blade, a flashlight, costume jewelry and a photograph had been brought into his home by the two men.

Young was questioned on Jan. 7 and admitted that he and Coombs had walked around town and tagged buildings. They tried to get into the Gibby’s Building after they stopped at the Dollar Store but it was locked with a pad lock, he said. They returned to the witness’ residence.

After midnight they climbed out of a window and walked back to Gibby’s, according to Young. He said Coombs had a flat head screwdriver with him that they used to pry open the door at the Gibby’s building.

Coombs located a flashlight that assisted them in looking around the building. Coombs found comic books, a knife and a binder full of cards that he kept. Young said he didn’t find anything he wanted.

After they found a can of spray paint, they used it to spray motorcycles inside the building.

Young told police that Coombs kept saying they should burn the building down. He found a can of lighter fluid and said they could use it but he did not spray the fluid around. They walked outside because Coombs wanted to show Young how cans of jell that they found in the building stay lit but the wind kept blowing them out. They went back into the building where Coombs lit the cans again near a locker inside the door. Young said he went back outside at this point and Coombs stayed inside for two or three minutes.

They tagged the building and other buildings as they walked around. Before returning to the witness’ residence Coombs told Young that he had put pallets on top of the flames that he lit when Young left the Gibby’s building. They returned to the witness’ residence and climbed back in through the window, Young said.

Two other witnesses told police that Coombs told them that he had started the fire.

When police spoke with Coombs he was wearing a camouflage cap with “bomb” written on the bill. He explained that “bomb” is his tag because he’s been described as a short fuse bomb.

He admitted to tagging some of the buildings but said they never went inside the Gibby’s building. He said he wouldn’t go in there because of all the bad things that happened to his friends there and it should be burnt to the ground.

When asked if he did try to burn it to the ground, he responded “if I wanted to burn the building down I would do it right.”

He changed his story several times but eventually admitted to being in the building and taking the items found at the witness’ residence. He said they were lighting spray cans when the flame came back onto the nozzle. He said he threw the can before it blew up and they left.

While Coombs was incarcerated in the Jefferson County Jail, he sent his father a letter admitting to setting the fire.

“I burndt down Gibbies,” he wrote. The letter goes on to say he saw himself as a “philanthropist” and claimed multiple girls were raped or people attempted to rape them in the building.

“I officially had nothing to lose but my freedom,” he wrote.

According to previous reports, the building sustained more than $500,000 damage, a fire truck suffered damage costing more than $13,600 and damage to the buildings that were spray painted is estimated at $830.

HARRISBURG — Attorney General Kathleen G. Kane has announced the arrest of two Allegheny County men charged with various crimes, including conspiring to deal heroin.

The arrests were made Sunday in Logan Township, Blair County. Investigators also seized nearly 900 packets of heroin as part of the investigation.

The arrests were the result of a joint operation between agents from the Office of Attorney General’s Bureau of Narcotics Investigation, members of the Attorney General’s Region 4 West Task Force and the Altoona City Police Department.

Sha’ron Raymere Wilson, 23, 2704 Stewart St., McKeesport, and Darrell Maurice Lewis, 22, 7303 Burton St., Pittsburgh, were the defendants taken into custody.

Investigators on Sunday reported conducting a controlled purchase of heroin with Lewis along the 400 block of Orchard Avenue. After the purchase, investigators said they followed Lewis to a room at the Motel 6 located at 1500 Sterling St.

Investigators set up surveillance on the room and said they later arrested Lewis as he was leaving. He was allegedly found with six packets of suspected heroin and a .38 caliber revolver, which investigators said was reported stolen.

Wilson also was spotted peering out of the same motel room’s window, investigators allege. They obtained a key card to the room and took Wilson into custody.

After obtaining a search warrant, an additional 880 packets of heroin — with a street value of roughly $17,600 — and a 9 mm handgun were reportedly seized. Investigators also seized $1,100, two cell phones and a small amount of marijuana.

Lewis is charged with three counts of possession of a controlled substance with intent to deliver and two counts each of criminal conspiracy/possession of a controlled substance with intent to deliver and possession of a controlled substance.

Other single counts filed against Lewis are possession of heroin, possession of a small amount of marijuana, persons not to possess a firearm, carrying a firearm without a license, receiving stolen property and criminal use of a communication facility.

Wilson is charged with two counts of possession of a controlled substance and one count each of criminal conspiracy/possession of a controlled substance with intent to deliver, criminal conspiracy/delivery of heroin, delivery of heroin, possession with intent to deliver heroin, criminal use of a communication facility and possession of a small amount of marijuana.

Lewis and Wilson are both being held in the Blair County Prison in lieu of $30,000 bail. Preliminary hearings are tentatively scheduled for July 23. The suspects will be prosecuted by the Blair County district attorney’s office.

Kane thanked the Altoona City Police Department, Region 4 West Task Force members and Operation Our Town for their efforts during the investigation.

Martin Pleads Guilty to Stealing More Than $64K from Elderly Woman

CLEARFIELD – A Clearfield woman accused of taking more than $64,000 from an elderly woman while serving as her power of attorney pleaded guilty during plea and sentencing court.

Kathy Ann Martin, 57, 301 Ogden Ave., Clearfield, pleaded guilty to 15 counts of theft by unlawful taking and was sentenced to serve six months to five years in state prison.

Originally she was charged with 763 counts each of theft by unlawful taking, theft by deception, receiving stolen property and 549 counts of other reason access device is unauthorized by user. She must pay $64,668.18 in restitution.

Prior to sentencing, attorney Chris Pentz stated that it was “not a plan” for her to take these funds and commented that sometimes people just step over the line. Now she has been snapped back to reality and is ready to accept her punishment, he said. He noted that the recommended sentence was six times the sentencing range for someone with no criminal record.

Judge Fredric J. Ammerman responded that the 89-year-old victim lost her home due to foreclosure and this case was not just a mishandling of funds.

The victim “asked for money for glasses and special shoes and was told she did not have the money for that,” Ammerman said. This was while Martin was using the victim’s money for gambling and taking trips.

No restitution has yet been made and Ammerman noted that the victim will not get her money back in her lifetime.

He said the guideline sentencing in this case did not match the crime. When he started sounding as if he were going to send her to state prison, Pentz asked to withdraw the plea, but Ammerman refused.

Martin apologized and as she cried, admitted she made a mistake.

The charges stem from her actions while serving as power of attorney for the victim from March 29, 2001 to Oct. 1, 2013.

According to the affidavit of probable cause, Valerie Darrow, Protective Services Manager at the Clearfield County Area Agency on Aging told police that Martin had been using the victim’s checking account as her own. There were charges for Pittsburgh Pirate tickets, campsite reservations and many other questionable transactions on her account.

The victim spoke with police explaining Martin would take $20 out of her account once in a while to buy something that she needed. Martin did not have permission to take out more than that. At other times, she would order food for the victim, but not very often.

The investigation uncovered numerous transactions to First Energy and Fuel & Save for Martin and her husband’s accounts. Martin had been using the victim’s account to pay her fuel bill as early as 2004.

Numerous transactions were found to a Timberland Credit Union account that totaled $16,195. It was also discovered that Martin had written checks for regular trips to a casino. The bus driver said Martin and her husband traveled to the casino almost every month.

It was determined that Martin had taken $64,668.18 from these transactions, none of which benefited the victim.

SANDY TOWNSHIP – A male has been accused of making threatening actions and comments during a nearly five-hour stand-off with local police on Friday.

The male has been charged by Sandy Township police with aggravated assault, terroristic threats, harassment and disorderly conduct. He’s been incarcerated at the Clearfield County Jail in lieu of $50,000 bail.

Police were dispatched to check the welfare of a male at 10:04 a.m. Friday at a Mountain Run Road residence. In addition, police were advised the male was recently released from a mental health facility and may attempt to harm himself.

According to the report, police initially made contact with the male outside of his residence. He allegedly possessed a pry bar approximately 15 inches in size in his hand. Officers allegedly observed the male swinging the pry bar back and forth in a threatening manner towards them.

According to the report, the male allegedly struck a metal bell that was hanging from the porch, causing it to fly through the air towards officers. He also allegedly threw a bucket at them.

The male allegedly told officers that “they would have to kill him today.” He also allegedly commented that “he was not being tasered, and we would have to shoot him,” police said. When the male went back inside his residence he allegedly told officers he would kill anyone who came in.

Once the male was inside his residence, police allegedly heard him screaming, “I’m going to make you shoot me” and to come get him. According to police, the male allegedly appeared to be under the influence of an unknown substance, and his demeanor and actions were “highly irrational, erratic and threatening towards officers and the general public.”

According to the report, police received information that firearms had been removed from the residence. However, police were advised that a long rifle may still be inside of the residence and accessible by the male.

According to the report, police attempted to make phone contact with the male. After making a loud speaker announcement, police made phone contact with him and requested that he come outside.

While allegedly refusing to the male told police they would have to come in and get him, and he would fight with them. He also told officers they would have to shoot him.

According to the report, officers pulled back and established a containment perimeter. Police evacuated nearby residences and closed the street. Police requested back-up from DuBois City and the Pennsylvania State Police, including a Special Response Team, due to the nature of the incident.

In addition, police requested personnel from the Sandy Township Fire Department and Emergency Medical Services to be on standby at the scene. Members of Sandy Township’s Public Works Department assisted with traffic detours.

According to the report, police continued to attempt to communicate with the male without any avail. Police made loud speaker announcements to request that the male come out of the residence while officers were there to help him.

According to the report, the male allegedly refused to come out of his residence to speak with police. After a period of time on several occasions, he allegedly opened the front window and exited onto the back deck to make demands for cigarettes and heroin.

Police again requested the male via a loud speaker announcement to come out, which he allegedly refused to do. He then allegedly made several Facebook posts, such as: “I didn’t know trashing your own house was illegal these days. [Expletive] the police;” “I don’t need a gun, I kill [expletive] with my hands;” and “death by cops will be fun. I always wanted it to be heroin, but that would be too easy.”

According to the report, police subsequently obtained an Involuntary Emergency Examination and Treatment Warrant (302) based upon the male’s alleged actions and observations by family members.

After nearly five hours, police prepared to enter the male’s residence at approximately 2:43 p.m. The male, however, exited the residence and was taken into custody.

Inside the residence, police allegedly observed damage that was caused by the male. Police also allegedly located a firearm.

According to the affidavit of probable cause, Clearfield Borough police received a report about an alleged rape March 26, which had occurred the previous night. Further, the victim alleged to police that the male suspect was known to her as “Dwayne McKenze.”

The victim requested and received an emergency Protection from Abuse Order through the district magistrate’s office. Upon attempting to serve the PFA, police were unable to properly identify the defendant as the name given by the victim.

When several, different names and birthdates were given police transported the defendant to the jail in order to use the live scan system to identify him. Upon arrival to the jail, the defendant provided police with his correct name, “Demmin McKinney,” and birthdate.

HARRISBURG — Attorney General Kathleen G. Kane today announced the arrest of two individuals from Allegheny County charged with criminal conspiracy, among other crimes, after allegedly being found with 10 bricks of heroin.

The arrests were made Monday evening in Altoona, Blair County. They were the result of a joint investigation between the Office of Attorney General’s Bureau of Narcotics Investigation, the Blair County Drug Task Force, the Altoona Police Department, the Logan Township Police Department and Pennsylvania State Police.

Bruce Larenz Hatten, 33, 15 A Bell Ave., McKees Rocks, and Keisha Leann Rodgers, 35, 120 Hazel Place, Pittsburgh, were the defendants taken into custody.

The heroin they were found with — approximately 500 packets labeled “Passion” and “Top Five” — have an estimated street value of approximately $10,000, investigators allege. It was seized after investigators said they observed a controlled purchase in which Hatten was attempting to sell $4,500 worth of heroin.
