State police at Punxsutawney

  • An incident of DUI occurred Saturday on Route 322 in Pine Creek Township. Further, a Sykesville man failed to negotiate a left-hand curve, traveled off of the roadway and impacted a traffic sign and utility pole. He left the accident scene, traveling east until stopping and allegedly attempting to tie his passenger door shut. After field sobriety testing, he was taken into custody for DUI and transported to the Brookville Hospital where he refused a blood test. Charges of DUI and related offenses were filed through the district court, state police said.

Clearfield Borough

  • Police responded to an alleged verbal domestic dispute at an East Pine Street residence. The parties were separated and warned for their actions, police said.
  • Police responded to an alleged verbal domestic dispute at a Gulich Avenue residence. The parties were separated and warned for their actions, police said.
  • Police responded to a two-vehicle accident at the intersection of East Market and North Front streets. One driver didn’t report any injuries; however, their vehicle required towing from the scene. The other driver was pregnant and transported to the hospital for an evaluation while her vehicle was driven from the scene.
  • Police responded to an East Pine Street residence for an alleged incident of harassment by communications. The actor was warned for his actions, police said.

Lawrence Township

  • Police received a report about an alleged burglary at the Lawrence Park Village Apartments. The incident remains under investigation at this time, police said.
  • Clearfield Borough police were assisted with serving a warrant at a township residence. The male was taken into custody without incident, police said.
  • Police received a report about the alleged unauthorized use of a motor vehicle. Police determined it was a civil matter and advised the caller to contact the magistrate.
  • Police received a report about an alleged domestic disturbance at a Woodland Road residence. The incident remains under investigation with charges pending, police said.
  • Police received a report about an accident in the area of Route 879 and Route 322. Further, a vehicle impacted a roadway sign and its driver fled the scene.

 


Dimmick Gets State Prison for Ordering Woman to Take Off Clothes Inside Business

CLEARFIELD – A Clearfield man charged with entering a business and ordering a woman to take off her clothes was sentenced to state prison in Clearfield County Court.

William Scott Dimmick, 55, 146 W. Market St., Clearfield, pleaded guilty to terroristic threats and two counts of harassment before Judge Paul E. Cherry. He was sentenced to two to five years in state prison.

The two incidents occurred on Feb. 18 and March 4 in Clearfield Borough. The victim reported that in the first incident a disguised Dimmick entered her business, locked the door and asked her to take off her clothes.

Prior to sentencing, the victim’s husband addressed the court. He stated that she felt threatened during these incidents and was still “very upset about this.”

Attorney Curtis Irwin, who was representing Dimmick, explained Dimmick felt remorse for his actions, and he never intended to harm her. He intended it to be a joke.

Dimmick apologized and stated “this shouldn’t have happened.”

His parole on a previous disorderly conduct charge was also revoked. For this he was sentenced to 172 days in jail, which is time served in that case. His new sentence will run consecutive to the revocation.

According to the affidavit of probable cause, the first incident occurred on Feb. 18. A man with a black mask covering his face and dressed all in black walked into the business and slammed the door behind him. He locked the door and ordered her to “get your clothes off and get in the back room.”

As he walked toward her, she recognized him and called him by name. He paused and said “what?” She called him by name again. He turned around and looked at himself in a mirror and asked how she recognized him.  She told him it was because they grew up together and he was a regular customer.

After paying and receiving services at the business, he asked if he could come to her house since her husband was gone. She said “never” and he left.

On March 4 he returned. He asked if she was busy and he noted there was no one else there. He then locked the door behind him and said “now let’s go in the back room.”

She told him that was not happening and unlocked the door. He locked it again. She reached behind him and unlocked it once more. She stated that what he wanted would never happen, adding that she was happily married.

He stated “all happiness must end someday” and he left.

Several minutes later he called and claimed he was going to take her to the movies to see “Fifty Shades of Grey.” Then, he said they would go back to his house and re-create the scenes.

State police at DuBois

  • An incident of burglary occurred Saturday along McVitty Road in Washington Township. During the incident, a known juvenile male allegedly removed items from the victim’s residence. The appropriate charges will be filed against the male, state police said.
  • On Aug. 21, a known person was taken into custody on a felony theft warrant and allegedly found to be in possession of drug paraphernalia, a small amount of marijuana and a stolen credit card. Charges are pending at this time, state police said.
  • An incident of theft occurred Sunday on the Rockton Mountain Highway in Union Township. During the incident, someone allegedly stole multiple guns that belonged to the victim.
  • Samantha Anne Malfara, 25, allegedly failed to register under Megan’s Law requirements within three business days. She left Just for Jesus on July 20; a warrant has been issued for Malfara, state police said.
  • An incident of criminal mischief occurred Monday at an Interstate 80 eastbound rest area in Pine Creek Township. During the incident, someone allegedly smashed out the passenger’s side window of a red Ford Taurus while it was parked at the rest area. Anyone with information is asked to contact the state police at DuBois at 814-371-4652.

State police at Philipsburg

  • An incident of burglary occurred Aug. 16 on North Ninth Street in Philipsburg Borough. During the incident, someone allegedly broke into the victim’s garage and removed a pressure washer. Anyone with information is asked to contact the state police at Philipsburg at 814-342-3370.
  • An incident of disorderly conduct occurred Tuesday on Beaver Street in Philipsburg Borough. During the incident, an Osceola Mills man allegedly stood up from his wheelchair and urinated on the sidewalk.

Lawrence Township

  • Police received a report about an alleged physical domestic dispute in the Woodland Road area.
  • Police received a report about drug paraphernalia that was allegedly located in the area of Elliott Park.
  • Police received a report about an alleged incident of child abuse at a business along Plaza Drive.
  • Police received a report about an alleged incident of theft by deception/fraud from a business on Route 879.

Decatur Township

  • Police received a report about an alleged incident of fraud. During the incident, a male on Craig’s List attempted to purchase a laptop with alleged fraudulent checks. Police would like to encourage residents to use caution when making online purchases.
  • Police received a report about an alleged incident of assault. Further, a female told police she was choked by the suspect at the Sheetz in Philipsburg. The incident remains under investigation at this time, police said.
  • Police handled a barking dog complaint in Osceola Mills.
  • Police received a complaint about a dog running loose and defecating on other persons’ property in the Hudson Street area.
  • Police received a report about all-terrain vehicles being driven on Eliza Street in Houtzdale Borough. Police would like to remind residents that ATVs aren’t permitted on roadways.
  • Police engaged in a pursuit with a motorcyclist through Houtzdale Borough. The motorcycle wasn’t licensed to be on the roadway, police said. The motorcyclist eventually stopped after initially trying to flee from police.
  • A Philipsburg man was taken to the Clearfield County Jail after allegedly being found under the influence on Cowfer Road. Police noted that the male was detained by probation.
  • Police responded to the Stumptown Trailer Park, where the victim was allegedly being threatened by a male with a gun. Upon arrival the victim didn’t want to pursue charges, police said. Police advised those involved to contact them to handle neighborhood complaints.
  • Police were notified about an alleged gas drive-off at the Country Convenience Store in Osceola Mills. Further, a male allegedly pumped $56 worth of gas and then drove away toward Philipsburg.

Hanson Waives Charges in Osceola Mills VFW Shooting Case

CLEARFIELD – A man accused in an April 1 shooting incident outside of the Veterans of Foreign Wars in Osceola Mills waived all charges during Centralized Court on Wednesday at the Clearfield County Jail.

Robert Dwayne Hanson, 55, of Bellefonte has been charged with criminal attempt/murder of the first-degree; two counts each of aggravated assault and simple assault; recklessly endangering another person; and possession of a firearm prohibited. Hanson remains in jail in lieu of $500,000 bail.

According to the affidavit of probable cause, Hanson was in the Osceola Mills VFW on April 1. He was seated with a female at the bar; both were consuming alcohol. A male entered the VFW and shortly after Hanson borrowed car keys from the female.

Hanson allegedly exited the bar and entered the female’s vehicle parked nearby. While inside the vehicle, the male allegedly gave Hanson a .22-caliber pistol, which he put in his waistband. Both Hanson and the male re-entered the VFW. After the male left, Hanson sat down next to the female and allegedly told her he’d gotten a gun and intended to shoot Jeff Swanson for ripping him off.

The female then left the VFW and went home. When she got home she called another bar and talked to Swanson. She allegedly told Swanson to stay away from Hanson, because he had a gun and intended to shoot him. When Swanson left the bar he walked up the street to the VFW and opened its door. He allegedly yelled for Hanson to come outside, which he did, and the men engaged in an argument.

Swanson allegedly slapped Hanson across his face and then punched him several times in the head and face area. Hanson fell to the ground, at which point the gun came out of his waistband. Both Hanson and Swanson allegedly grabbed for and struggled over the gun.

According to the affidavit, the gun went off and fired into the air. It went off a second time, which allegedly grazed the side of Hanson’s head. Swanson then began to walk away from Hanson when Hanson allegedly yelled “Hey Jeff.” Swanson stopped and turned around, and Hanson allegedly fired a shot that hit Swanson in the right side of his chest.

Swanson then fell to the ground while Hanson was escorted back into the VFW by other patrons. A VFW staff member had called 911 while the fight and shooting was occurring outside. Upon arrival to the scene, emergency personnel began providing medical treatment. Both Hanson and Swanson were taken by ambulance and then by helicopter to UPMC Altoona for treatment of their injuries.

Hanson was treated for minor injuries and released the next day. Swanson, however, suffered injuries to his chest area, including his right lung, as a result of a gunshot wound, according to the affidavit.

Swanson has also been charged as a result of the alleged shooting incident. He waived charges of simple assault and harassment. Swanson is free on $10,000 unsecured bail.

State police at Clearfield

  • An incident of fraud and forgery occurred sometime between Aug. 28 and Tuesday on Graham Road in Bradford Township. During the incident, someone allegedly compromised the victim’s personal information through unknown means. Further, they were allegedly able to have the victim’s Social Security check deposited onto a Go Direct card instead of her checking account. The incident remains under investigation, and anyone with information is asked to contact the state police at Clearfield at 814-857-3800.

State police at Punxsutawney

  • An incident of retail theft occurred Tuesday at the Wal-Mart store in Young Township. During the incident, a Punxsutawney woman allegedly removed two bottles of cooking wine valued at $5.24 from the shelf and then attempted to leave the store until being approached by personnel. Charges are pending through the district court, state police said.
  • An incident of retail theft occurred July 16 at the Wal-Mart store in Young Township. During the incident, a Punxsutawney woman allegedly removed and concealed a tank top valued at $6.86 and exited the store. Charges are pending through the district court, state police said.

Clearfield Borough

  • Police received a report about an incident of criminal mischief. During the incident, someone allegedly loosened the lug nuts on one wheel of the victim’s vehicle.  Extra patrols were requested, police said.
  • Police received a report about an alleged stolen cat. The incident remains under investigation at this time, police said.
  • Police responded to a two-vehicle accident near North Second and Reed streets. No injuries were reported, and both vehicles were driven from the scene, police said.
  • Police responded to a residence along West Front Street for an alleged incident of criminal mischief. The complaint was unfounded, police said.
  • Police received a report about a dog bite that occurred along South Fourth Street. Officers made contact with the owner who advised that the dog’s shots were up to date.  The incident was forwarded to Dog Law, police said.
  • Police received a report about a suspicious vehicle outside of the caller’s house. The caller then stated that the vehicle had left but requested extra patrols, police said.
  • Police conducted a traffic stop on a vehicle along East Pine Street. After allegedly failing a field sobriety test, the driver was taken into custody for DUI and transported to the hospital for a blood draw.  Charges are pending the results of the blood draw, police said.
  • Police responded to a 911 hang-up call at a residence along South Fourth Street. Upon arrival officers learned that a couple was allegedly engaged in a domestic dispute outside of the caller’s residence.  The male actor, however, fled prior to police arrival.
  • Police responded to a South Fifth Street residence for a male who was wanted on State Parole warrants. The male was located, taken into custody and transported to the jail, police said.
  • Police responded to a West Locust Street residence for an intentional overdose. Upon arrival the male was conscious and alert, police said. Emergency personnel transported the male to the hospital for an evaluation.  Police said that the male was also found to have an active warrant through State Parole.
  • Police responded to a residence along Williams Street for a welfare check. The male was found to be OK, police said.
  • Police responded to a report about a suspicious vehicle along Cemetery Road. One female was found to be intoxicated while on probation; another female was found to hold several, active warrants, police said. The female who was allegedly intoxicated was housed at the jail on a probation detainer. The other female was transported to the police station to address warrants and released afterward.
  • Police received a report about an alleged incident of criminal mischief to a vehicle. The complaint was unfounded, police said.
  • Police responded to a residence along South Fourth Street for a report about barking dogs. Officers spoke with the owner and advised them of the complaint.

Lawrence Township

  • Police received a report about an alleged incident of harassment.
  • Police received an animal complaint that occurred on Moose Street.
  • Police were requested to check the welfare of a male on Park Avenue Extension.
  • Police received a report about a civil dispute regarding a repossessed vehicle.
  • Police received a report about speeding vehicles in the Turnpike Avenue area.

  • Police received a report about an alarm on Turnpike Avenue.
  • Police were contacted about the repossession of a motorcycle.

  • Police received a report about an alleged incident of harassment.
  • Police received a report about the alleged theft of a computer and personal items that occurred last week.
  • Police received a report that someone had allegedly entered a Meadow Street residence; however, there wasn’t anything reported missing.

DuBois City

  • Police received a report about an alleged domestic disturbance Tuesday on East Weber Avenue. Police made contact with a female who advised everything was OK. The male, however, left the residence prior to police arrival.
  • Police received a report about an alleged domestic disturbance Tuesday at the intersection of North Franklin Street and West Weber Avenue. Officers allegedly observed a female standing outside of her vehicle and yelling at the driver of another vehicle that was on the roadway. Police will cite the female for the incident.
  • Police received a report about an alleged domestic disturbance Tuesday in the 100 block of West Washington Avenue. Upon their arrival to the scene, police learned from witnesses that a female who was operating a black van struck a male. Police determined that the male jumped from the vehicle and left the area on foot. The female also left the scene, police said. Police checked with hospital personnel who reported that no one had received treatment related to a vehicle accident.
  • Police received a report about an alleged incident of harassment on Wednesday. Further, a woman told police that her ex-husband was harassing her daughter. Officers offered to contact her ex-husband; however, the woman wasn’t able to provide his information.
  • Police received a report about a hit-and-run accident Wednesday at the parking lot of Martin’s Grocery Store. A witness told police a vehicle struck an unattended vehicle while its operator was pulling into a parking space. The operator, police said, entered the store and exited quickly and fled the scene without making contact with the vehicle’s owner or leaving information. Police were able to obtain information on the suspect vehicle from the witness, and its operator will face charges.
  • Police received a report about a suspicious female Wednesday inside Giant Eagle. Police were allegedly advised the female was naked in the women’s restroom and washing her body. An employee requested police to respond and remove the female from the store. Police made contact with the female when she was fully clothed and escorted her from the store; no further action was required of police.
  • Police received a report about an alleged incident of criminal mischief Wednesday in the 400 block of Pifer Street. The victim told police that someone knocked on their door so hard it broke the Plexiglas, and it has been an ongoing problem. Police have suspects and the investigation is ongoing.
  • Police responded to the 300 block of West Long Avenue on Wednesday for a female who was allegedly sleeping on the floor outside of the caller’s apartment. Upon arrival police found the female was waiting for a friend who lived there and had fallen asleep. Police asked the female to leave, which she did without incident.

Charges Bound Over in Rape Case

CLEARFIELD – All charges were bound over for court against a man who has been accused of rape and then falsely identifying himself to police after a preliminary hearing on Wednesday before Magisterial District Judge Jerome Nevling at the Clearfield County Jail.

Demmin D. McKinney, 40, an inmate, has been charged with rape/forcible compulsion; involuntary deviate sexual intercourse/forcible compulsion; IDSI/threat forcible compulsion; indecent assault; false identification to law enforcement; and failure to register with Pennsylvania State Police. Bail has been set at $50,000 monetary.

The victim testified that she went to Clearfield Borough police to file a report about an alleged rape March 27, which had occurred the previous night. Further, the victim told police that the male suspect was known to her as “Dwayne McKenze,” and he stayed at her apartment.

The victim testified that McKinney forcibly raped her, and she had asked him to stop. The victim also testified that she didn’t give consent to McKinney that night before the alleged rape incident.

When asked about what happened when the incident was over the victim said she stayed in bed. She said she should have left but was fearful of McKinney. The next morning, she said she discussed what happened with someone and then went to police.

While he was in jail, the victim also testified that she received a letter from McKinney in April. She said he apologized for what happened on the night of the alleged rape and asked her not to tell anyone about the letter or they would both get into trouble.

Officer Adam Raybuck said when the victim filed the report she asked to obtain an emergency Protection from Abuse Order. Upon attempting to serve the PFA, he said that police were unable to properly identify the defendant as the name given by the victim.

After several, different names and birthdates were allegedly provided and returned no record Raybuck said that police transported McKinney to the jail in order to use the live scan system to identify him.

Upon arrival to the jail, Raybuck said that the defendant eventually provided police with his correct name, “Demmin McKinney,” and birthdate. Also, he said McKinney admitted that he had fled from a halfway house near Pittsburgh.

In a case before Magisterial District Judge James Hawkins, William Paul Carnell, 31, an inmate of the jail, had charges bound over to court, including 10 counts of involuntary deviate sexual intercourse with a child; aggravated indecent assault; 11 counts of corruption of minors; and 10 counts of another sex-related offense. His bail is set at $100,000 monetary.

Two alleged victims, both minor children, testified for the commonwealth. However, the hearing room was cleared with exception to the necessary personnel during their testimony.

According to the affidavit of probable cause, the alleged incidents occurred at different times at a Coalport residence between July 6, 2014 and Feb. 16. The first incident occurred on or around July 6, 2014 when Carnell allegedly forced the victim to perform a sex act on him.

On approximately eight, other occasions between the above timeframe, Carnell allegedly forced the victim to perform a sex act on him. On at least one occasion, he allegedly inappropriately touched the victim’s private area.

Sometime between Feb. 12 and Feb. 16, Carnell allegedly forced the victim to perform a sex act on him as well as on the second victim.

State police at Clearfield

  • An incident of harassment occurred Wednesday on Hannah Street in Houtzdale. During the incident, a couple had allegedly engaged in a domestic dispute, which was initially verbal in nature but turned physical. Both were charged through the district court, state police said.

State police at Philipsburg

  • On Aug. 27 a male was allegedly found in possession of a small amount of drugs and paraphernalia during a traffic stop on Coaldale Road in Rush Township. Charges will be filed through the district court, state police said.
  • An incident of criminal mischief occurred sometime Tuesday or Wednesday on North Centre Street in Philipsburg Borough. During the incident, someone allegedly damaged a camper that belonged to the victim. Anyone with information is asked to contact the state police at Philipsburg at 814-342-3370.

Clearfield Borough

  • Police responded to a report about wires down along West Seventh Street. Officers determined that the wire was cable-related and contacted the appropriate agency.
  • Police responded to an active burglar alarm at a business along East Pine Street. Upon arrival it was discovered to be an accidental trip, police said.
  • Police responded to a vehicle lockout at a residence along NW Fourth Street. Officers were able to gain access without any damage.
  • Police responded to Spruce Street for a found dog. The owner of the dog was located and retrieved it, police said.
  • Police responded to an establishment along Daisy Street for a report about an intoxicated male who was allegedly trying to fight another male. Both individuals were separated and released to sober adults; both declined to press charges, police said.
  • Police responded to a welfare check along East Eighth Street. Upon arrival officers found everything to be OK.
  • While conducting a traffic stop, police found that a male passenger had several active warrants and was allegedly in possession of drug paraphernalia. The male was taken into custody and transported to the Clearfield Borough police station, where he handled the warrants. Charges are being filed on the male for the drug paraphernalia, police said.

Sandy Township

  • Police received a call from a home health worker who could not make contact with their elderly patient at his home on Wednesday. Upon arrival the man had come to the door, and it was determined he was OK, police said.
  • On Wednesday a 31-year-old South Brady Street man alleged that his girlfriend’s ex-boyfriend was harassing her through text messages and driving by the house. Officers handled the situation without incident.
  • On Wednesday a 35-year-old Hungry Hollow Road woman alleged that two people who live with her, a 31-year-old woman and 23-year-old man, were involved in an argument that turned physical. When she attempted to take them to the police station both fled from the vehicle.
  • A 53-year-old Emporium man alleged that while traveling on Sykes Street Extension on Wednesday, the operator of a tractor-trailer was tailgating him. When he attempted to pull off the roadway he alleged that the tractor-trailer hit his vehicle. He also alleged that the operator yelled at him and then fled the scene; minor damage and no injuries were reported, police said.
  • Police received a report about a false alarm at Rent A Center on Wednesday.
  • On Thursday a West Long Avenue man reported that his vehicle was struck and damaged by someone while it was parked at Wal-Mart.
  • On Thursday a vehicle driven by a Brookville woman began to back up in the Taco Bell drive-up lane. It ultimately hit the vehicle behind it that was driven by a 25-year-old DuBois woman. No injuries and minor damage were reported, police said.
  • Employees of Christ the King Manor alleged that a former employee was at the nursing home and acting erratically on Thursday. The 37-year-old Luthersburg woman was gone from the area upon police arrival.  A “Check Welfare Be-On-The-Look-Out” alert was issued, police said. The woman was later located by state police and found to be OK.
  • A 33-year-old Luthersburg man reported that while driving on Oklahoma Salem Road, his vehicle caught on fire on Thursday. He pulled off the roadway and the fire department was able to extinguish the flames quickly.  No injuries were reported, police said.
  • On Thursday a 57-year-old Brockway woman alleged that while she was working at Triangle Tech, someone took her cell phone.

Schaffer Waives Charges for Allegedly Aiding in Estranged Girlfriend’s Suicide

DUBOIS – A Luthersburg man accused of aiding in his estranged girlfriend’s suicide waived all charges to court Friday at Pat Ford’s office.

Brian Lee Schaffer, 44, of Luthersburg, has been charged by DuBois City police with criminal homicide, F1; aiding suicide, F2; involuntary manslaughter, M1; and manufacture, delivery or possession with intent to manufacture or deliver, F.  Bail has been set at $1,000,000.

According to the affidavit of probable cause, police were dispatched to a report for a female gunshot victim Jan. 2 on Grant Street in DuBois City. Upon arrival to the scene, police made contact with Schaffer, who allegedly stated that the victim had shot herself but was still breathing in the living room.

Police observed a small, silver pistol that was allegedly laying to the victim’s left on the floor. “The positioning of the gun did not appear to be consistent with falling from [the victim’s] hand after firing but as if it was moved afterwards” police stated in the affidavit.

The gun, according to police, was a .380-caliber Bersa semi-automatic pistol that belonged to Schaffer. A single .380 casing was recovered by police at the scene.

DuBois Emergency Medical Services arrived at the scene and started to provide medical care. The victim was then transported to the emergency department at Penn Highlands, where she was pronounced dead.

Police interviewed Schaffer immediately after the victim was transported to Penn Highlands on Jan. 2. Schaffer told police he was upstairs when he heard a gunshot; he ran downstairs and found that the victim had shot herself.

Schaffer later changed his story, stating he heard the back door shut and went downstairs to find the victim with the gun. Schaffer stated that he told the victim to put it down but when he ran to stop her it went off.

Due to conflicting statements, police requested that Schaffer submit to a polygraph examination on Feb. 19 with the Pennsylvania State Police. During the examination, Schaffer allegedly admitted that he had previously lied to police.

Schaffer allegedly stated that he and the victim were arguing on and off throughout the night and into the early morning hours of Jan. 2. In order to settle their argument, Schaffer allegedly retrieved his gun from his truck.

Schaffer returned to the living room with the gun. When the victim allegedly demanded to see the gun, he handed it to her empty, and she wanted to know where the bullets were. When he showed her the loaded magazine he allegedly stated she wanted him to show her how to load it.

Schaffer stated he loaded the gun while the victim held it. Also, he stated that he must have chambered a round for her because he doesn’t keep it that way. Schaffer said when the victim threatened to shoot herself he reached for it, but it went off. Schaffer wasn’t sure if his hand was on the gun when it went off.

However, he denied pulling the trigger or there being any struggle for the gun. He stated that the gun only fired once, striking the victim in the temple.

Schaffer allegedly stated he couldn’t watch the victim suffer. He allegedly picked up the gun and was going to shoot her and then himself. Schaffer stated that he couldn’t go through with it and called 911.

During the examination, he also allegedly admitted to buying methamphetamine and bringing it to share with the victim. He allegedly stated that the victim had consumed a lot of methamphetamine, and he quit using sometime around midnight.

Schaffer allegedly stated that he and the victim had been using methamphetamine for three or four days straight prior to the incident. Another witness confirmed in an interview with police on Feb. 20 that there was methamphetamine in the residence, Schaffer had purchased it and they were all using it.

An autopsy was performed on the victim at the Lehigh Valley Health Network in Allentown on Jan. 3. The findings concluded that the victim died of a single, gunshot wound to the head.

During the examination, suspected bullet fragments were recovered from the wound. A toxicology screening also showed that the victim had methamphetamine, ethanol and amphetamine in her system.

State police at Clearfield

  • An accident occurred Sunday on Interstate 80 westbound in Graham Township. Further, a vehicle exited the left side of the roadway and traveled up an embankment before coming to a rest on the berm. The operator was wearing their seatbelt, state police said.
  • A hit-and-run accident occurred Saturday on East Hepburnia Road in Penn Township. While approaching the Mahaffey – Grampian Highway, the vehicle exited the southern side and impacted a porcelain sink, breaking it. The vehicle continued traveling off of the roadway and impacted a traffic sign, knocking it over; it continued traveling and impacted a ditch at the 12 o’clock position. At that point, the vehicle proceeded to travel east in reverse and re-entered the roadway. The vehicle then fled the scene, state police said.   • An accident occurred Sunday on Interstate 80 westbound in Lawrence Township. Further, a freightliner was in the left-hand lane traveling west. It merged into the right-hand lane and made contact with a vehicle, causing minor damage. All occupants in both vehicles were wearing their seatbelts, and no injuries were reported, state police said.
  • An accident occurred Friday on Rose Street in Irvona Borough. Further, an Irvona teen was negotiating a left-hand curve when he lost control of his vehicle. It subsequently exited off the southbound lane and impacted another vehicle. The impact caused that vehicle to be pushed backward into another vehicle and a utility pole.
  • On Saturday several juveniles allegedly threw tomatoes at passing vehicles along Route 322 in Mineral Springs, Bradford Township.
  • An incident of criminal mischief occurred sometime Friday or Saturday on Gray Hollow Road in Morris Township. During the incident, someone allegedly damaged the victim’s posted signs on their property. Anyone with information is asked to contact the state police at Clearfield at 814-857-3800.

  • An incident of criminal mischief occurred Aug. 17 on Walnut Street in Smithmill. During the incident, someone allegedly cut a garden hose and attempted to use it to siphon home heating fuel from an outdoor fuel tank at a residence.   • An incident of criminal mischief occurred sometime between Sept. 2 and Monday on Gillingham Road in Girard Township.   • An incident of burglary occurred Monday on Lamb Drive in Morris Township. During the incident, three people allegedly made forced entry into the victim’s residence, located two video games and fled the scene.   • An incident of theft/access device fraud occurred Aug. 17 on Baxter Drive in Brisbin. During the incident, two known individuals allegedly removed a debit card from the victim’s mail and used it to make several purchases at convenience stores in the Brisbin area. The incident remains under investigation at this time, state police said.
  • An incident of forgery occurred sometime between Feb. 17, 2012 and June 10, 2012 on Union Street in Coalport. During the incident, a known individual allegedly removed several checks from the victim’s purse, filled them out to herself and cashed them. The incident remains under investigation at this time, state police said.

State police at DuBois

  • An incident of DUI occurred Saturday on Route 119 near Save-A-Lot in Sandy Township. During the incident, a known DuBois man was allegedly stopped for vehicle code violations and determined to be under the influence of alcohol. He was subsequently placed under arrest for suspected DUI, and charges are currently pending lab analysis, state police said.
  • An incident of DUI occurred Friday on Interstate 80 in Pine Creek Township. During a traffic stop, Derek M. Bowser, 26, of DuBois was allegedly found to be under the influence of a controlled substance. He was placed under arrest for DUI, and charges are pending blood test results. State police also determined that Bowser was wanted by Pennsylvania State Probation and Parole and the Jefferson County Sheriff’s Office.
  • An incident of DUI occurred Friday on I-80 westbound in Union Township. Further, a Clearfield male was allegedly stopped for a traffic violation and placed under arrest for suspected DUI. Charges are currently pending the results of chemical testing, state police said.
  • An incident of disorderly conduct occurred Friday on Main Street in Falls Creek Borough. During the incident, a male and female allegedly engaged in a verbal argument. Both were cited for the incident through the district court, state police said.
  • An incident of unlawful restraint/simple assault occurred Sunday on Sykes Street Extension in Winslow Township. During the incident, a male and the victim allegedly engaged in a verbal argument that turned physical. He allegedly struck the victim numerous times in the face, as well as forced her up a set of stairs while covering her mouth. The male fled upon state police arrival at the scene. He is facing charges for the incident, and an arrest warrant has been obtained by state police. State police noted that active attempts are being made to locate the male, who has been identified as Michael Steven Siple II, 31, of Sykes Street Extension. State police at Philipsburg

  • An incident of criminal mischief occurred Sept. 2-3 in the parking lot of the Trinity United Methodist Church in Philipsburg Borough. The victim told state police he had his red-colored Saturn parked in the lot and noticed two young boys playing near it. When he went to the lot he allegedly found that the passenger’s side mirror was broken and gravel was strewn about the top of his vehicle. Interviews are pending with the two boys who were observed near the vehicle, state police said.

State police at Ridgway

  • An incident of unauthorized use of a motor vehicle occurred Friday on Keystone Road in Horton Township. During the incident, the suspect allegedly used the victim’s vehicle and failed to return it. The vehicle was described by state police as a 2009 Nissan Murano that is brown in color with gold pinstripes. Clearfield Borough

  • Police received a noise complaint that occurred overnight. The caller was advised to call when the incidents are in progress in order for timely police response.
  • A male came to the Clearfield Borough police station to turn himself in on a warrant. The male was taken into custody and transported to the Sheriff’s Department as the warrant was held there, police said.
  • Police responded to a report about an alleged theft along North Fourth Street. The incident remains under investigation, police said.
  • Police received a report about a lost wallet. The wallet was found and turned into the state police.  The owner was then contacted and advised to contact state police to retrieve the wallet.
  • Police responded to a welfare check at a residence along Daisy Street. Officers were unable to make contact with anyone, and it was believed that the occupant wasn’t at home.
  • Police responded to a South Second Street business for a vehicle lockout. Officers were able to gain entry without damage.
  • Police conducted a traffic stop along Bridge Street. After allegedly failing a field sobriety test, the driver was taken into custody and transported to the hospital for a blood draw. Charges are currently pending at this time, police said.
  • Police received a report about an alleged incident of harassment by communication, where an unknown person keeps calling the victim but will not say anything. The incident remains under investigation at this time, police said.
  • Police responded to a residence along West Front Street for a welfare check. Everything was found to be OK, police said.
  • Police responded to a report about a male going door-to-door asking about electric service. Contact was made with the male who was advised that he needed a permit from the borough, police said.
  • Police received a report about a stolen bicycle from Sheetz. Officers spoke to the suspect who admitted to it and turned the bicycle over to police. A victim has not come forward yet, police said.
  • Officers responded to a residence along Dorey Street for a welfare check.
  • Police responded to a Leavy Avenue residence for a report about a dog stuck on a fence. Shortly after police arrival, the owners returned home and were able to help the dog.
  • Police responded to a noise complaint near the intersection of East Ninth and Daisy streets. The actor was warned for the violation and advised to turn down the music or charges would be filed, police said.
  • Police responded to a local business for a report about an open door. Officers searched the interior with negative contact; a key holder responded and secured the business.
  • Police responded to an alleged incident of criminal mischief along Daisy Street, where an actor cut the lock off of a soda machine. Anyone with information is asked to contact the Clearfield Borough police.
  • Police responded to a report about a female who was allegedly passed out in a vehicle in a parking lot along South Second Street. Officers arrived and located the vehicle still running. After making contact with the female, she allegedly failed a field sobriety test and was transported to the hospital for a blood draw. Charges are currently pending the result of the blood test, police said.
  • Police responded to a report about an alleged incident of criminal mischief along Daisy Street, where an actor slashed tires on a vehicle. Anyone with information is asked to contact the Clearfield Borough police.
  • Police responded to a single-vehicle accident at the corner of South Second and East Walnut streets. Upon arrival police found that the driver was having a seizure.  Police also found that the accident may have been intentional.  The male was transported to the hospital for injuries and a psychological evaluation; his vehicle was towed from the scene, police said.
  • Police responded to a welfare check along Spruce Street. The individual was found to be OK, police said.
  • Police responded to a Spruce Street residence for an alleged verbal domestic dispute between a mother and son. Both parties were separated and warned for their actions, police said.
  • Police responded to the 700 block of Nichols Street for a waterline break. Officers confirmed the break and contacted the Water Authority.
  • A black diaper bag was found and turned into police. The owner was contacted and responded to station to claim the item.
  • Police responded to a barking dog complaint in the area of Weaver and Merrill streets. The complaint was unfounded, police said.
  • Police responded to an alleged fight in progress involving four individuals along Margarita Street. Upon arrival police learned that the altercation involved a boyfriend, girlfriend, the boyfriend’s brother and the girlfriend’s estranged husband.  Charges are being filed as a result of the fight, police said.

  • Police checked the welfare of a male in a vehicle and determined he’d fallen asleep.

DuBois City

  • A vehicle was allegedly stolen Friday from the 100 block of Quarry Avenue. Further, the vehicle had been left running; when the owner returned their vehicle wasn’t there. However, state police stopped the vehicle on I-80, and the actor, a DuBois man, was taken into custody. Charges are currently pending at this time, police said.
  • On Friday a 23-year-old DuBois man was arrested for public drunkenness after he was allegedly observed stumbling in traffic by an off-duty police officer. He was found to be on state parole and lodged at the Clearfield County Jail.
  • On Saturday a 42-year-old DuBois woman was arrested for public drunkenness after she was allegedly found to be intoxicated and laying on the roadway on West Weber Avenue.
  • Police stopped a vehicle after its operator allegedly swerved across the centerline Saturday. Further, the operator, a 23-year-old Stump Creek man, was allegedly found to have been consuming alcohol. He was taken into custody for DUI and for blood testing. Charges are currently pending toxicology results, police said.
  • On Saturday a 27-year-old Big Run woman was allegedly threatened by an unknown woman, as she exited an establishment in the 200 block of West Long Avenue. The incident remains under investigation at this time, police said.
  • On Saturday someone allegedly kicked in the basement door at a residence in the 200 block of South Brady Street. However, the suspect left when they saw someone in the residence. The incident remains under investigation at this time, police said.
  • A 30-year-old DuBois man was arrested and removed from the emergency room at Penn Highlands after he allegedly threatened the staff on Saturday. He was found to be on probation in Clearfield County and lodged in the CCJ on a detainer. The man will be charged for the incident at the hospital, police said.
  • On Saturday police received a report about a laptop allegedly being stolen from a residence in the 200 block of West DuBois Avenue. The incident remains under investigation at this time, police said.
  • On Sunday police initiated an investigation into the alleged theft of a bicycle from a residence in the 800 block of West Long Avenue.
  • On Sunday a vehicle operated by a 48-year-old DuBois man crossed the oncoming lane and sheared off a telephone pole and a fire hydrant. The operator told police that he must have fallen asleep while driving his vehicle. He will be cited for the accident, police said.
  • Police received a report about an alleged domestic dispute Sunday. Upon investigation police found it was only verbal in nature.
  • A 43-year-old man was arrested for public drunkenness after a witness called police and alleged that he’d fallen while trying to cross North Main Street on Sunday. Upon arrival police allegedly found that the man was visibly intoxicated.
  • Police received a report about a residential alarm Sunday in the 500 block of West Long Avenue. Upon arrival police found everything to be OK.

State police at Clearfield

  • An incident of burglary occurred sometime between Sept. 4 and Monday on Main Street in Bradford Township. During the incident, someone allegedly made entry by forcing open a basement window of the victim’s residence. Once inside they allegedly located silver coins and a gold necklace and earrings and then fled the scene. The total value of the alleged theft is estimated at $400; the incident remains under investigation at this time, state police said.

State police at Philipsburg

  • An incident of criminal trespass occurred Sept. 4 on South High Street in Port Matilda Borough. During the incident, the victim allegedly observed the suspect leaving his residence when he returned home. The suspect was described as an approximately 25 –year-old male who stands 5 feet, 6 inches tall and weighs 150 pounds; he had a beard and shoulder length hair. He allegedly fled west on Spruce Street. Anyone with information is asked to contact the state police at Philipsburg at 814-342-3370.

State police at Punxsutawney

  • An incident of DUI occurred Sept. 2 on Route 322 approximately a half-mile east of the Pine Creek Township line in Winslow Township. While on patrol, state police allegedly encountered a 28-year-old DuBois man alongside the roadway. He was allegedly found to be DUI. Charges for DUI and related offenses were filed through the district court, state police said.
  • An incident of theft by unlawful taking occurred Sept. 3-4 on Airport Road in Bell Township. During the incident, someone allegedly removed a construction barricade from Route 310 and placed it into a private drive on Airport Road. The barricade, according to state police, was removed without damage and returned to HRI Contracting. Anyone with information is asked to contact the state police at Punxsutawney at 814-938-0510.

Lawrence Township

  • Police assisted a stranded motorist on University Drive.
  • Police received an animal call that occurred in Plymptonville. During the incident, a dog was reportedly running loose and jumped up on someone.
  • Police received a report about an alleged illegal dumping incident in the Moose Creek area. The incident remains under investigation at this time, police said.
  • Police received a report about a psychological emergency on Leonard Street. The individual was transported to the hospital, police said.
  • Police received a report about an alleged disturbance at a hotel on Route 879. Police made contact with those involved in the incident and charges are currently pending.
  • Police located a suspicious vehicle along Firetower Road.

DuBois City

  • Police received a report about an alleged domestic disturbance Monday on Quarry Avenue. Further, a female told police that her live-in boyfriend kicked in the door to their apartment; she said they engaged in an argument, and he left with his clothing. The female also told police that threats were made during the incident. The investigation is continuing into the incident, police said.
  • On Monday police were requested to check the welfare of a male on North Main Street. He was found to be having medical issues and transported to the Penn Highlands Hospital by DuSan Ambulance.
  • Police were contacted by the state police at Ridgway on Monday. Troopers had taken a female into custody on a warrant for charges filed by the DuBois City police. The female was transported to the Clearfield County Jail and will be arraigned by the on-call magistrate, police said.

Sandy Township

  • Police received a report about a false alarm at Rite Aid on Monday.
  • Police were called to a Kilmer Road residence for a report about a 45-year-old man who was threatening to harm himself. Upon arrival officers found the man in the driveway where he was allegedly acting erratically.  When officers approached him he allegedly became aggressive.  Family members were on scene and told police that he had been drinking heavily and was upset about personal issues.  The man was taken into custody and transported to Penn Highlands DuBois, police said.
  • On Tuesday a woman alleged that her boyfriend’s trailer license plate was missing.
  • On Tuesday a DuBois man alleged a generator valued at $1,100 was missing from a storage shed.
  • Treasure Lake Security alleged that someone threw rocks in the toilet Tuesday at a comfort station in Cayman Landing, which caused considerable damage.
  • A Falls Creek woman reported losing her wallet at Wal-Mart on Monday.
  • Police received a report about a false alarm at Kay Jewelers on Tuesday.

Former Fire Chief Waives Hearing in Alleged Arson Case

DUBOIS – A former fire chief has waived his right to a preliminary hearing.

Christopher George Leone, 24, 1398 Treasure Lake, DuBois, is charged by the DuBois-based state police with reckless burning, official oppression, criminal mischief and dangerous burning. Bail in this case has been set at $5,000, unsecured.

According to previously published GANT articles, on April 15, a fire broke out in a wooded area at the intersection of Jolly Roger and Harborview roads in Treasure Lake. A second fire of similar nature broke out on May 8.

Aaron Kulbacki, a co-defendant in the case was interviewed by police and confessed to starting the April 15 fire. Kulbacki allegedly told police that he is a member of the Treasure Lake Fire Company and Treasure Lake Security.

He said there has been “general conversation” for some time within the fire company about causing small fires in order to generate call volume.

He told police that he was in a vehicle with Leone on April 15, heading back from fire training in Tionesta, when Leone started talking about setting fires. Kulbacki told police that Leone allegedly told him to set a brush fire with a flare.

Kulbacki told police that Leone had allegedly told him to set the fire in an area that was easy to reach and near no homes. Kulbacki said Leone brought up starting a brush fire again on the way home from training.

Kulbacki told police Leone was at the fire station when Kulbacki took a flare and went to the intersection of Harborview and Jolly Roger roads. Kulbacki said he lit the flare and threw it over an embankment, then went home.

Kulbacki told police he was home for about 15 minutes before someone reported the fire.

Kulbacki told police that he allegedly spoke to Leone after the fire had been put out and told police that Leone allegedly laughed and told Kulbacki he wouldn’t get caught.

Police then spoke to Leone who agreed to an interview. Leone allegedly told police that he was the Treasure Lake Fire Chief on April 15 and that he did not set any fires in Treasure Lake.

Leone allegedly told police he believed the fire on April 15 was possibly set by “kids messing around with a rust-oleum can. He then allegedly told police he had been “joking around” with Kulbacki about setting fires on the way home from fire training in Tionesta.

After denying his involvement in the April 15 fire for about a half-hour, Leone allegedly told police that after coming back from Tionesta, he went back to the Treasure Lake Fire Station and said he “joked around,” saying “we can go for a call tonight.”

Leone again told police that his statements to Kulbacki were “a joke.”

Leone allegedly told police that he had “joked” to Kulbacki about going for a call on a brush fire that night because it was brush fire season. Leone allegedly told police that he did not intend for it to be serious or for it to “go that far.” Leone told police that he did not provide the materials to set the fire.

CLEARFIELD – District Attorney William A. Shaw Jr. has announced Clearfield County’s Fugitive of the Week for the week of Sept. 9.

Shaw identified the fugitive as Nicole Kritzer, 26, of Grassflat Avenue, Morrisdale. Kritzer is wanted for failure to appear at a preliminary hearing held Sept. 2.

On July 23, Trooper David Patrick of the Pennsylvania State Police, Clearfield barracks, filed a criminal complaint against Kritzer. Patrick charged Kritzer with false reports to law enforcement, M2, and harassment, S.

According to the affidavit of probable cause, on June 15, Patrick received a report about an alleged sexual assault from deputies of the Clearfield County Sheriff’s Office. Patrick requested that the alleged victim be transported to the Clearfield Penn Highlands Hospital for a medical/rape examination.

Patrick then made contact with deputies and Kritzer at the hospital. At that point, Kritzer allegedly refused to enter the hospital and instead requested to go to the Mount Nittany Medical Center. Patrick requested that Kritzer go to the Pennsylvania State Police, Clearfield barracks, for an interview prior to going to the Mount Nittany Medical Center.

During an interview, Kritzer related that the alleged perpetrator had knocked her unconscious and then had sexual intercourse with her. She also related that the alleged perpetrator had cut her with a knife.

Also, Kritzer allegedly related that she had gone to the Clearfield Penn Highlands Hospital prior to making contact with deputies and had requested medication for her injuries. After staff refused her request, she allegedly refused an examination and left the hospital.

Upon investigation state police allegedly determined that Kritzer had initially told a deputy that a different person had raped her on the day in question.

Further investigation by Patrick allegedly revealed that Kritzer had told a friend and the Pennsylvania State Police, Philipsburg barracks, that a third individual had caused her injuries and raped her. However, state police allegedly determined that this individual had been in an inpatient facility during the date and time of the alleged rape.

Additional investigation allegedly revealed that a later report by Kritzer in which she related being examined at Mount Nittany Medical Center on June 15 for this incident was false.

A preliminary hearing was scheduled for Sept. 2, at which time Kritzer failed to appear, and a warrant was issued for her arrest.

Kritzer is described as a Caucasian female who stands 5 feet, 1-inch tall. She has brown hair and green eyes.

Ohio Man Snagged for Allegedly “Shooting up” at Snappy’s

DUBOIS – An Ohio man is facing charges for allegedly using drugs in a gas station bathroom.

According to an affidavit of probable cause, filed with District Judge Patrick Ford’s office Aug. 31, Dwight D. Woodyard, 30, 55 Center St., Crown City, Ohio, is charged by the Sandy Township police with driving under the influence of alcohol or a controlled substance, possession of drug paraphernalia and driving while operating privilege is suspended or revoked.

According to the affidavit, police were called to Snappy’s on the Bee Line Highway for a man who was believed to have “shot up” heroin in the bathroom.

As the officers were responding, they were told that an employee saw a suspicious man wearing jeans, a red belt and black shirt, go into the bathroom for a long period of time.

When the man came out, an employee went into the bathroom before any other customers could go in, and found a used needle in the garbage can.

The employees were told to lock the bathroom door and not to touch anything.

While the officers were en route, they saw a black Ford Explorer traveling toward them. The officers got a good look at the driver and identified him as Woodyard, having had encounters with him before, which involved drug paraphernalia.

The officers pulled the vehicle over, and saw one of the occupants throw something out the window.

When asked for driver’s license, Woodyard allegedly said he didn’t have his license. The officer then asked Woodyard what he had thrown out of the window. Woodyard denied throwing anything out of the vehicle.

Woodyard was asked to get out of the vehicle and the officers searched him. The officer found a large knife and located two “stamp bags” made out of wax paper containing a brown, granule substance. The officer also found an orange needle cap.

A second officer searched the area where the object was thrown out the window and found a blue glass pipe.

The officers asked Woodyard when he had last used drugs. Woodyard allegedly told police he took his prescribed Subutex a little while ago. The officers allegedly noted fresh needle marks on Woodyard’s arm and that his speech was slow and slurred.

After failing field sobriety tests, Woodyard was taken for blood testing, which was positive for amphetamines, methamphetamines and morphine.

Juvenile Charged for Alleged Involvement in Knife-point Robbery

DUBOIS- A juvenile has been charged in connection with an armed robbery.

According to an affidavit of probable cause filed with District Judge Patrick Ford’s office, the 17-year-old female has been charged by the Sandy Township police, with two counts of robbery in connection with an incident Aug. 27.

Also charged in connection with the incident are Roderick Joe Gregory Jr., 23, 254 N. Wood Ave., DuBois, Mackenzie Alexa Carlson, 19, 602 Locust St., DuBois, and Jeanmal McPhee, (no house number given) Wilson Ave., DuBois. All are charged with two counts of robbery and one count each of burglary, assault, theft by unlawful taking, recklessly endangering another person, criminal trespass and criminal conspiracy.

According to the affidavit, police responded to Hungry Hollow Road to meet with a man reporting he had been robbed.

The victim allegedly told police that he was at his trailer when three men came in. The victim did not know the individuals and allegedly told police the three men were wearing masks and all had knives.

The victim allegedly told police that the three men used physical force and threatened to kill him if he didn’t open his safe. The victim said one man allegedly held a knife to his throat while the other two rummaged through the victim’s possessions.

The victim said he opened his safe and the men took about $400, six knives, two packs of cigarettes and some prescription drugs before fleeing on foot.

The victim said he feels he was “set up.” He allegedly told police about an hour before the robbery, he allegedly received a call the 17-year-old juvenile asking if he would pick her and a friend up at a gas station. The victim said he picked the juveniles up and took them back to his trailer.

The victim said he became suspicious because the 17-year-old was texting someone while the other female stood outside the trailer. The victim allegedly told police that both juveniles fled with the three men.

A witness to the incident then came to the police station to speak to an officer about the robbery.

The witness allegedly told police that his girlfriend and Carlson went to a house on West Long Avenue to visit with Gregory. The witness said that McPhee, a juvenile and another woman were also at the house.

The witness allegedly told police that McPhee and the juvenile were going to “set a guy up and take his drugs.” The witness allegedly told police that the juvenile was to call the victim and get him to take her to his trailer.

The witness allegedly said the arrangements were made to meet the victim. The witness said he, McPhee, Carlson and Gregory were in Gregory’s car and followed the victim to his trailer. The witness allegedly told police he dropped McPhee, Carlson and Gregory off near the victim’s trailer.

Police then spoke to one of the juveniles, whose mother allegedly provided text messages between the other juvenile and McPhee where they communicated and arranged for McPhee, Gregory and Carlson to enter the victim’s property and commit the robbery.

State police at DuBois

  • An incident of criminal mischief occurred Monday on Dutch Road in Brady Township. During the incident, someone allegedly damaged property at the victim’s residence. The incident remains under investigation, and anyone with information is asked to contact the state police at DuBois at 814-371-4652.
  • An accident occurred Monday on the Bennetts Valley Highway in Huston Township. A vehicle was traveling north when a seven-point buck entered into its path. The vehicle subsequently struck the deer, and its operator drove off of the roadway.

State police at Philipsburg

  • An incident of theft occurred sometime between July 15 and Aug. 15 on Burge Street in Decatur Township. During the incident, the victim allegedly attempted to purchase a mobile game app from E-Bay for $800. The victim’s account was allegedly debited in that amount; however, the account information wasn’t ever forwarded. The incident was reported to the state police in Philipsburg but transferred to the state police at Clearfield for a follow-up investigation.
  • An incident of harassment/drug possession occurred Monday on Smith Street in Rush Township. During the incident, the actor and victim allegedly engaged in a physical altercation. Upon arrival state police allegedly found the actor in possession of drug paraphernalia. He was placed under arrest and taken to the Centre County Correctional Facility. He was arraigned with his bail set at $5,000 straight, and a preliminary hearing to be held Sept. 16.
  • An incident of public drunkenness occurred Wednesday in the area of Front and East Pine streets in Philipsburg Borough. During the incident, a male was allegedly found passed out on a bench. He was allegedly found to be under the influence of marijuana and cited for the incident.

Lawrence Township

  • Police received a traffic complaint for a motorist who was reportedly driving all over the roadway. Further, police determined that the motorist was OK.
  • Police received a report about an alleged incident of sexual harassment that occurred at a school.
  • Police received a report about several alleged retail thefts that occurred at a local business.

DuBois City

  • Police received a report about a suspicious vehicle Wednesday in the area of East Long Avenue and Rose Alley. A caller told police a Jeep was being driven around the block, and its headlights were turned off. Upon arrival to the scene, police found the operator of the Jeep was waiting for his girlfriend.
  • While on patrol Wednesday, police allegedly heard a female from a block away on West Long Avenue. Police located the female in a parked vehicle and learned she’d engaged in an argument with her boyfriend over the phone. Police asked the female to not argue in public and to lower her voice.
  • Police received a report about an unwanted person Wednesday on South Franklin Street. Upon arrival police found the person had already left. Police made contact with the person and asked them not to return.
  • Police received a report about a two-vehicle accident Wednesday at the intersection of Liberty Boulevard and Park Avenue. Further, a vehicle operated by a Reynoldsville woman reportedly rear-ended another vehicle operated by a Big Run woman. Police determined that the accident wasn’t reportable, and assisted with information exchange. No injuries were reported, police said.
  • Police received a report about an alleged domestic disturbance Wednesday in the 600 block of West Long Avenue. Upon arrival police made contact with the victim who was allegedly bleeding from her mouth. She told police that her husband had struck her. Officers then arrested David Olewinski, 47, of DuBois for simple assault and harassment. He was on Clearfield County Probation and transported to the jail to await arraignment. Police said the female was also cited for harassment.
  • Police received a report about an alleged fight, which involved six kids Wednesday at the City Park near the YMCA. Upon arrival police checked the area with negative contact with anyone fighting. Kids who were in the city park were asked to leave the area, police said.

Decatur Township

  • Police received a report about an alleged domestic dispute on Brisbin Street in Houtzdale. Police cleared the call after a female agreed to leave the residence.
  • Police received a report about a psychological emergency involving a handgun in Decatur Township. A male was apprehended and taken to the hospital without further incident, police said.
  • Morris-Cooper police were assisted with a wanted male at the Flat Run Speedway. Police learned there were two misdemeanor warrants for his arrest.
  • Clearfield-based state police were assisted with a possible dog being locked in a motor vehicle at the Hometown Market. Police were unable to locate the dog or the vehicle.
  • Police received a report about a suspicious male near the Dollar General in Osceola Mills. However, the male wasn’t located upon police arrival to the scene.
  • Police responded to a two-vehicle accident at the intersection of Dinky and Copelin roads. No injuries were reported; both vehicles weren’t drivable, police said.

Kephart’s Theft Case Discussed in Motions Court

CLEARFIELD – The case against the former president of the Kephart Trucking Company, Timothy Lee Kephart, 56, of Morrisdale was discussed in motions court on Thursday.

In July, Kephart was sentenced to a minimum of eight years to a maximum of 32 years in prison and ordered to pay back more than $40,000 to his employees by Clearfield County President Judge Fredric Ammerman.

Kephart was accused of stealing funds from his employees’ 401K plans and medical insurance premiums between June of 2010 and the closure of the Kephart Trucking Company in late 2013.

On Thursday Kephart’s attorney, Chris Pentz, said he wanted to present a post-sentence motion. He also advised he’d tried to arrange for Kephart to participate via video conferencing, which couldn’t be done.

Pentz said he “made every effort” to have Kephart available. He said the case against Kephart consisted of more than 60,000 pages of documents, and it would be helpful to have Kephart available due to his familiarity with them.

Pentz said he wanted to present a post-sentence motion on the complicated issue of restitution, a matter discussed at length in court prior to Kephart’s sentencing in July. He said it would involve a lot of information on medical bills, premiums, etc.

Clearfield County District Attorney William A. Shaw Jr. said he believed video conferencing was possible but an issue to be resolved by the IT Departments. At the same time, Shaw also commented that there might not be a need for a hearing.

Ammerman then directed for the case to be rescheduled for a future session of court.

During Kephart’s restitution hearing in July, several of his long-time employees addressed the court. Employees said the trucking company started out as “family-oriented” and one they were all proud to work for. However, employees said when Kephart took over for his father it became “a terrible place to work.”

Employees said they experienced significant financial stresses from not being paid and losing their medical insurance coverage. Employees spoke about how it became extremely difficult to pay their every day bills and to put food on the table while also facing unexpected medical bills that they became responsible for.

Employees said they experienced additional stress when they started to receive phone calls from collection agencies. “[Kephart] left many lives in shambles,” one employee said. Employees said they didn’t believe Kephart felt any regret or remorse for what he had done to them over the years.

Ammerman said at the July hearing that he’d received 32 letters from Kephart’s employees or family members on their behalf. He said many expressed the same themes of showing loyalty to the trucking company and having Kephart leaving them dealing with financial stresses and depression.

Also during the hearing, Shaw said that the commonwealth was seeking more than $40,000 in restitution in regards to employees’ medical bills. He pointed out that total restitution exceeded $300,000 for the case; however, Kephart had voluntarily surrendered his own 401K to pay back his employees.

When Kephart testified at the hearing, he disputed that he owed his employees any restitution for medical bills. Shaw countered, arguing that Kephart allowed employees to believe they still had medical insurance coverage when in fact they did not. Shaw also said Kephart didn’t notify his employees that their medical insurance was cancelled until September of 2013.

According to the affidavit of probable cause, Kephart was the president of the Kephart Trucking Company and handled its daily operations. While he was the company’s president, his employees’ paychecks indicated funds were being withheld for 401Ks and medical insurance.

However, these withholdings were held in the trucking company’s checking account and instead used for other expenses. This, in turn, caused a shortage in the individual 401K funds, as well as a break in the payment of medical insurance premiums.

More specifically, 401K plans were behind and not funded by Kephart from November of 2011 through February of 2012. Because Kephart neglected to pay medical insurance premiums, the insurance company cancelled his employees’ coverage retroactively, and numerous employees became responsible for unexpected medical bills.

Also, employees told police that Kephart hadn’t paid some for days of service and vacation pay. After the completion of an extensive investigation, police determined 131 victims were affected by Kephart’s actions.

According to the affidavit of probable cause, the victims told police that Kephart had admitted funds were missing and promised that he’d pay them all back.

In spring of 2012, the Kephart Trucking Company needed funds and utilized an investor group based in Lancaster. Representatives for the investor group told police that they had put more than $6 million into the Kephart Trucking Company with specific funds to cover employees’ 401Ks, which were short.

A contractor also told police that Kephart made personal checks out for a $300,000 barn behind Kephart’s residence to house his horses. At times Kephart’s checks would bounce, and he’d directly transfer money. However, the contractor indicated to police that he wasn’t certain from which account Kephart transferred payment out of.

Judge Rejects Bail Reduction Motion in Luttman’s Police Stand-Off Case

CLEARFIELD – The case for a DuBois man who was allegedly involved in a police stand-off was in motions court Thursday before Clearfield County Judge Fredric Ammerman.

Gregg Matthew Luttman, 32, of DuBois, was charged by Sandy Township police in July with aggravated assault, terroristic threats, harassment and disorderly conduct. Luttman was incarcerated on those charges in lieu of $50,000 bail.

Luttman, who participated via video conference, asked Ammerman to consider reducing his bail, so that he could care for his father after the recent passing of his mother. He said it would also give him the chance to get mental health treatment.

Luttman told the judge that he regretted his actions that resulted in his current incarceration. Ammerman indicated to Luttman that his actions must have been pretty alarming to the district judge for him to set bail at $50,000.

Assistant District Attorney Ryan Dobo advised Ammerman that Luttman’s actions created “an almost hostage situation” in DuBois, and the commonwealth opposed a reduction in bail. Dobo further noted that Luttman’s actions also resulted in roadways being shut down.

Ammerman then requested to review the affidavit of probable cause for the case.

Afterward, Ammerman denied Luttman’s motion for a bail reduction. He said it was clear Luttman suffered from mental health issues. Ammerman believed that Luttman remained a danger to not only the public, but also to himself.

According to the affidavit, on July 10, Sandy Township police responded to check the welfare of Luttman, who had just been released from a mental health treatment facility. He had also allegedly commented that he may harm himself.

Police made contact with Luttman outside of his residence, where he allegedly swung a 15-inch pry bar at them. He also allegedly struck a bell on his porch, which caused it to fly through the air in the direction of police.

Luttman allegedly told police that they would have to kill him. When he re-entered his residence, Luttman allegedly commented to police that he would kill anyone who came inside.

According to the affidavit, Luttman allegedly appeared to be under the influence of an unknown substance. His demeanor was allegedly highly irrational, erratic and threatening toward police and the general public. Police were also concerned that Luttman had access to a long rifle that may still be within the residence, the affidavit states.

Police made contact with Luttman to ask him to come out of the residence. He allegedly refused, saying that the police would have to come inside and shoot him.

Police were subsequently forced to establish a perimeter around Luttman’s residence. Police also evacuated nearby residences and the street was shut down. Additional police personnel and a special emergency response team were summoned to the scene, along with fire and emergency personnel to be on stand-by.

During the more than four-hour stand-off, Luttman allegedly opened the front window several times. At one point, he allegedly appeared on the back deck and demanded cigarettes and heroin. Police allegedly asked Luttman again to come outside; however, he refused to do so.

According to the affidavit, police requested and obtained an involuntary emergency examination and treatment warrant based upon Luttman’s actions and observations by family members. At 2:43 p.m., police entered the residence, and Luttman was taken into custody without further incident.

  • An alleged incident of corruption of minors occurred. Sept. 6 on Route 119 in Young Township. The incident remains under investigation, state police said.
  • An alleged incident of harassment occurred sometime between Sept. 1 and Sept. 8 on St. Johns Road in Perry Township. Further, the alleged incident involved a message on Instagram.

Clearfield Borough

  • Police responded to a report about an alleged incident of criminal mischief at a building along Power Avenue. Extra patrols were requested, police said.
  • Police received a report about an alleged incident of harassment by communications by an unknown person. The incident remains under investigation, police said.
  • Police received a report about an alleged incident of harassment by a known actor. The incident remains under investigation, police said.
  • Police received a report about alleged child abuse along South Second Street. Police contacted Children & Youth Services and the actor who was interviewed by officers and CYS.  The incident remains under investigation, police said.
  • Police received a report about an alleged theft of mail at a residence along Reed Street. The incident remains under investigation, police said.
  • Police received a phone call about issues concerning a custody exchange. The caller just wanted the incident documented for the time, police said.
  • Police responded to the Courthouse for a psychological emergency. Officers made contact with the patient who was transported by emergency personnel to the hospital for an evaluation.
  • Police responded to an alarm at a business along East Market Street. Officers searched the building resulting in negative contact with anyone.
  • Officers responded to a Williams Street residence for an overdose with the patient being unconscious. Officers assisted emergency personnel with removing the patient from the residence and placement into the ambulance.  Emergency Personnel then transported the patient to the hospital for treatment.
  • Police received a report about an alleged erratic driver along Route 322. Officers located the vehicle and were able to conduct a traffic stop.  The driver was not impaired and warned for his actions, police said.
  • Police stopped to assist a disabled motorist whose vehicle was overheating. The vehicle was removed from the roadway to a safer location, police said.
  • Police responded to the 300 block of Clearfield Street for a report about an alleged incident of disorderly conduct. Officers learned that a male and female were arguing over custody of a child. The incident remains under investigation with charges pending, police said.
  • Police responded to a report about a missing child who was located at a residence along Williams Street. Officers responded to the residence and made contact with the juvenile who was turned over to his mother.

  • Police responded to a report about a hold-up alarm at a business along Spruce Street. The alarm was unfounded, police said.

  • Police received a report about a hit-and-run accident on Supercenter Drive.
  • Police received a report about a runaway juvenile who left his parents at McDonald’s on South Second Street. Police said that the 13-year-old male stands 5 feet, 4 inches tall and weighs 120 pounds; he was wearing a gray hoody, blue shorts and red sneakers.
  • Police received a report about a 911 hang-up call that occurred at Appalachian Wood Products. Police learned that everything was OK.
  • Police received a report about a minor accident on River Road.
  • Police received a report about a suspicious person in the area of River Road. Further, police allegedly found the person to be under the influence and in possession of a controlled substance. The person was transported to the jail, police said.
  • Police received a report about an alleged retail theft that occurred at Supercenter Drive. The incident remains under investigation at this time, police said.
  • Police received a report about a male juvenile who allegedly left school property. Police were later cancelled after the juvenile was located.

Peters Pleads Guilty in Aggravated Assault Case

CLEARFIELD – A Clearfield man accused of severely beating a man outside Mary’s Place in Clearfield pleaded guilty.

Tyler Peters, 23, an inmate of the jail, pleaded guilty to aggravated assault and was sentenced to 10 to 20 months in jail and two years consecutive probation. Peters was ordered to complete anger management counseling and was fined $250 plus costs.

President Judge Fredric J. Ammerman told Peters that if he came back into court again, he would be going to state prison.

According to testimony from the victim at a preliminary hearing, he got “the crap beaten out” of him in a parking lot near Mary’s Place in May.

The victim encountered Peters, whom he had never met before, inside the bar that night when Peters asked him to buy him a beer. The victim thought Peters might be under age, but   realized Peters was intoxicated to the point that the bartender would no longer serve him. The victim refused to help him.

He overheard Peters calling his father and the victim thought he was asking his father to come to the bar. The call ended quickly and the victim asked if Peters’ dad hung up on him. Peters said he did and the two then started arguing and calling each other names.

The victim admitted he didn’t know which of them first mentioned taking their disagreement outside. Eventually they went out to the parking lot. They were still “just arguing” when the bartender came out and warned them not to fight on the property of Mary’s Place. The victim said he and Peters went to an area behind the bar.

Peters knocked the victim out cold. The next thing he knew, a man was helping him up. The bartender gave him an ice pack and the victim asked what it was for.  He told the victim to trust him, because he needed it for his face.

The victim said his right eye was completely swollen shut, and his left eye was almost as bad. He had a fracture in his cheek bone and he thought at first his nose was broken, but it wasn’t.

Someone called the police and when they arrived, the victim hid behind a dumpster. He admitted he is currently on parole and was not supposed to be in a bar or drinking. The victim is on parole for drug charges for his involvement in the “Operation Drive Thru” drug ring.

An officer found him and then an ambulance took him to the hospital.

From the ambulance, the victim identified Peters as the one who struck him, according to the testimony of a Clearfield Borough police officer.

Peters asked to be taken to the hospital and he wanted photos taken of his face even though he didn’t appear to be injured. At the hospital, Peters was belligerent with the nurses and had to be told to calm down. He repeatedly cursed at everyone, the officer said. By the time the doctor cleared Peters for release, he was asked to get out.

As he was put into the patrol car, he swore at his mother who was now on the scene. Peters kicked the car door and was put into the vehicle. Then he kicked the window. He was taken out of the vehicle and shackled before being placed into the car a second time, the officer testified.

Peters was on probation for theft from a motor vehicle at that time of the assault. In June he was sentenced to 30 days to one year in jail and one year probation for violating that probation by committing the assault. His previous record includes another assault in 2011.
