Fugitive of the Week: Jason Guthrie (Provided photo)

CLEARFIELD – District Attorney William A. Shaw Jr. has announced Clearfield County’s Fugitive of the Week for the week of Aug. 24.

Shaw identified the fugitive as Jason Guthrie, 34, of Williams Street, Clearfield. Guthrie is wanted for failure to appear at a preliminary hearing held on June 17.

On May 14, Trooper Joshua Lawrence of the Pennsylvania State Police, Clearfield barracks, filed a criminal complaint against Guthrie. He charged Guthrie with multiple counts of forgery, F3; theft by unlawful taking, F3; and bad checks, S.

According to the affidavit of probable cause, on Oct. 24, 2014, state police at Clearfield received a report from the victim that Guthrie had allegedly stolen several checks and cashed them.

According to the victim, a local bank made contact with them after realizing that the signatures on the cashed checks did not match that of the victim. Upon making contact with the bank, Lawrence was able to identify the suspect, Guthrie, from surveillance pictures.

In all, Guthrie allegedly forged checks from the victim’s account, totaling $980.

A preliminary hearing was scheduled for June 17, at which time Guthrie failed to appear, and a warrant was issued for his arrest.

Guthrie is described as a Caucasian male standing 5 feet, 7 inches tall. He has brown hair and eyes.

Anyone with knowledge of Guthrie’s location is asked to call Clearfield County Crime Stoppers at 800-376-4700. All calls to Crime Stoppers are confidential.

Christopher James Handte (Provided photo)

CLEARFIELD – A Bellefonte man has been accused of the February robbery of a senior citizen, according to Clearfield County District Attorney William A. Shaw Jr.

Shaw identified the defendant as Christopher James Handte, 26, of Bellefonte. He is currently an inmate at the Centre County Correctional Facility.

Trooper William Mostyn of the Pennsylvania State Police, Clearfield barracks, filed a criminal complaint against Handte. Handte was charged with aggravated assault, F1; robbery, F1; kidnapping, F1; burglary, F2; arson, F3; criminal mischief, F3; theft by unlawful taking, F3; receiving stolen property, F3; unlawful restraint, M1; false imprisonment, M2; recklessly endangering another person, M2; simple assault, M2; access device fraud, M2; and harassment, S.

According to the criminal complaint, on Feb. 20, Trooper Matthew Gray of the Pennsylvania State Police, Clearfield barracks, was dispatched to the parking lot of a church for a report about a truck being on fire

Police determined that the truck was owned by a local business. An employee of the business told Gray that the truck was equipped with a GPS tracking device. Upon investigation state police allegedly determined that someone had gained access to the garage of the local business and stolen the truck.

Upon review of the travel report generated by the tracking device, Gray was able to determine when the truck was stolen and where it was driven to. According to the travel report, the truck had stopped at several area businesses and locations along Deer Creek Road late at night Feb. 19 and into the early hours of Feb. 20.

Surveillance video was recovered from the local businesses. Additionally, various items that were allegedly stolen from the garage of the local business were located along Deer Creek Road, according to the criminal complaint.

On Feb. 21, Mostyn was assigned to investigate an alleged robbery at a local residence. According to the criminal complaint, the victim received a knock at her door from an unknown male around 7 p.m. Feb. 20.

The male was allegedly in need of gas, and the victim invited him into her residence. The victim allowed the male to use her bathroom and phone while she made him a cup of tea.

The male asked for duct tape for his boots. However, he allegedly used it to tape the victim’s hands behind her back. When the victim was able to free her hands, it allegedly angered the male. He then allegedly taped the victim to the kitchen sink and struck her twice in the face.

After asking the victim if she had any ATM cards, the male allegedly left her residence, taking her vehicle, purse and the glass and tea cup he drank from.

After the male fled from the scene, the victim allegedly remained taped to the kitchen sink. She allegedly remained taped up until the following day at approximately 4 p.m. when she was discovered there. The victim was then transported to UPMC Altoona for treatment of her injuries and hypothermia.

On Feb. 23, the victim’s vehicle was located and within it was a ceramic mug. The mug was tested for DNA. Later that same day, troopers located a makeshift camp in the woods, according to the criminal complaint.

Upon investigation state police determined that many of the items at the camp belonged to another victim. This victim was interviewed and alleged that the items found had been stolen from his garage several days earlier. These items were also sent to the lab for DNA testing.

Shaw stated that on Monday Handte was scheduled to be arraigned by Magisterial District Judge Jerome Nevling. A preliminary hearing is scheduled for Sept. 11. Handte remains incarcerated in Centre County on unrelated charges.

Shaw noted that Handte was identified early on in the investigation as a potential suspect. He stated that, “I know the residents of Graham Township were concerned over this terrible event, but until we had evidence to support a prosecution, criminal charges couldn’t be filed.”

Shaw explained that the Pennsylvania State Police DNA lab is extremely busy, and it can take several months for lab results to be completed. Shaw stated that the charges were filed as soon as they had the results from the lab.

He stated that this case was too important, and it was critical to get it right because they only have one chance to prosecute the case.

Shaw further explained that Handte has been incarcerated in Centre County since this incident occurred. “Law enforcement was confident that Handte would be unable to victimize other residents in the community while the investigation was ongoing,” he stated.

Shaw stated that he was very pleased with the investigative efforts made by Mostyn and the troopers of the Pennsylvania State Police, Clearfield barracks.

Shaw stated that these types of brutal crimes will not be tolerated and continued efforts will be made to prosecute those responsible for this types of crime.

Anyone with knowledge of a crime is asked to call Clearfield County Crime Stoppers at 800-376-4700. All calls to Crime Stoppers are confidential.

Kane Cautions Pennsylvanians about Variations of IRS Scam

$

HARRISBURG — Attorney General Kathleen G. Kane has issued a warning to consumers about new variations of a scam in which con artists pose as officials with the Internal Revenue Service (IRS) as they attempt to defraud taxpayers.

The Office of Attorney General has continued to receive reports from Pennsylvanians concerning this new variety of scam. The office has learned that criminals are using increasingly sophisticated technology to target unsuspecting consumers.

These “imposter” scams come through telephones and e-mails. Those responsible for the scam allege the person owes money to the IRS. Here are some variations of the scam that consumers should be cautious of:

  • Calls in which the caller tries to convince people they owe the IRS back taxes and pressures them to buy reloadable pre-paid debit cards to transfer the funds to pay what they owe.
  • Robocalls with automated messages telling the consumer they owe back taxes that will result in imminent legal action and instructing the consumer to touch a number or call a number to receive directions on how to pay their taxes.
  • E-mail messages containing what appear to be legitimate IRS forms, directing consumers to contact the “agency” through a link in the e-mail and provide bank account or credit card information to pay for the back taxes.

These scam artists use software to mask information to show where the e-mails are coming from (this is called metadata in technological terms). They also use a phone technology known as Voice Over Internet Protocol (VOIP) to thwart Caller ID. Many of the scammers are based outside the country. With VOIP technology, the scammers can fake that their calls are originating locally or from Washington, D.C.

Kane warned consumers to be alert for these invasive and troubling calls. She reports that the Treasury Inspector General for Tax Administration (TIGTA) has taken the lead on investigating these predatory IRS impersonation scams. TIGTA advises it has received 10,000 complaints about these scams, with losses to consumers of more than $20 million. The average loss to individual consumers ranges from $2,500 to $5,000.

Kane cautions that these con artists may seem legitimate by referencing a consumer’s personal information that is not publicly available. Sometimes this information may have been stolen from companies which suffered data breaches.  This information may include:

  • The last four digits of the victim’s Social Security Number.
  • Information about the consumer’s family members.
  • “Spoofing” the IRS’s telephone number on the Caller ID.
  • Sending bogus e-mails that appear to be coming from the IRS.
  • Calling back and impersonating the local police or department of motor vehicles, again “spoofing” the caller ID to appear legitimate.

The caller may capitalize on the false impression caused by these things to pressure consumers to take action. Many victims have reported that these scam callers have been particularly aggressive and persistent, scaring them about imminent arrest or other dire consequences.

Kane reminds consumers that they should remain calm and verify their tax status directly with the IRS by calling 1-800-829-1040.

You should also report these IRS scam calls or emails to the TIGTA Web site at the following link.

Reports of this type of criminal activity should also be reported to local law enforcement. Police then have the information to warn local residents to be on the lookout for these scams.

Kane encourages Pennsylvanians to remember that the IRS always sends written notification of any tax due by mail and never asks for a credit card, debit card or prepaid card over the phone.

According to the IRS, the agency will never:

  • Call taxpayers about taxes they owe without first sending an official notice by mail.
  • Demand that taxes be paid without giving the taxpayer the opportunity to question or appeal the amount allegedly owed.
  • Require taxpayers to use a specific payment method for your taxes, such as a prepaid debit card.
  • Ask for credit or debit card numbers over the phone.
  • Threaten to bring in local police or other law-enforcement groups to have you arrested for not paying.

Kane said consumers can take the following steps to avoid becoming a victim of this or other phone scams:

  • Never give out sensitive personal or financial information over the phone, especially if you receive an unsolicited telephone call from a stranger.
  • Never wire money or purchase green dot-type prepaid cash or debit cards in response to a telephone appeal, whether it is from a stranger or someone who claims to know you or an organization you may be familiar with.
  • Never let emotion or fear overcome your common sense. If you get a call from someone claiming to be a government agency or law enforcement, slow down and verify everything. Do not be pressured to take action. You can always hang up and call the agency directly to verify.

For more information or to report any scam, Kane encourages Commonwealth residents to contact her Bureau of Consumer Protection at 1-800-441-2555.

Mandy Joann Rubly (Provided photo)

CLEARFIELD – A Clearfield woman accused of conspiring with her husband who was cooking methamphetamine at an apartment at the Lawrence Park Village waived her right to a preliminary hearing during Centralized Court on Wednesday at the Clearfield County Jail.

Mandy Joann Rubly of Clearfield has been charged with conspiracy/manufacture, delivery or possession with intent to manufacture or deliver; possession red phosphorus, etc. with intent to manufacture a controlled substance; risking catastrophe; operating a methamphetamine lab; and deposits, stores, disposes of chemical waste. Her bail was modified from $25,000 monetary to unsecured at her hearing.

According to the criminal complaint filed by Officer Elliott Neeper of the Lawrence Township police, on Aug. 20 officers received a call from State Parole Agent Keith Summerson, who requested assistance in conducting a follow-up with Larry Rubly Jr. Larry Rubly Jr. was to be staying in apartment 6B at Lawrence Park Village.

Upon arrival Summerson made contact with Mandy Rubly. She confirmed Larry Rubly Jr. was at the apartment, advised he was upstairs and showed the state parole agent to his location. When the state parole agent made contact with Larry Rubly Jr., he was in an upstairs bedroom.

Larry Rubly Jr.’s pants were down around his ankles, and he was allegedly attempting to stick himself with a needle in the leg area. The state parole agent was able to handcuff Larry Rubly Jr.; however, he (Larry Rubly Jr.) discarded the needle.

Larry Rubly Jr. was subsequently taken into custody by the state parole agent. The state parole agent also allegedly located a prohibited offensive weapon in the bedroom that Larry Rubly Jr. stayed in.

While the state parole agents searched for the discarded needle, they also allegedly located multiple items consistent with the manufacture of methamphetamine.

According to the criminal complaint, a two-liter Mountain Dew bottle was allegedly located on the far side of Larry Rubly Jr.’s bed in which a clear, small tube was sticking from the top. Another container was allegedly found directly beside the bottle with an unknown substance inside.  On the heater for the bedroom along the far wall, there allegedly was a container of Drano drain cleaner.

Upon officers looking around Larry Rubly Jr.’s bedroom, they allegedly observed in plain view a container of Ronsonol lighter fluid on a bedroom dresser. Also on the dresser, there was allegedly a coffee pot with residue and a large packet of clear baggies commonly used for drug distribution.

Officers also allegedly observed Larry Rubly Jr.’s driver’s license laying on the bed. While exiting the bedroom, officers allegedly observed a bag containing a packet of a 12-hour decongestant containing 20 tablets.

Based upon these observations, officers determined enough items were present to indicate the possibility of an active methamphetamine lab in Apartment 6B.

Police located a female inside the apartment. She was in the living room and told police she had health issues that prevented her from leaving her bed. She also indicated she was the owner of the apartment and advised Mandy and Larry Rubly Jr. had been staying with her.

Police obtained written consent to search the apartment. Then, police proceeded with an evacuation due to the inherent dangers that exist with the manufacture of methamphetamine.

While attempting to secure the scene after the evacuation, officers allegedly located additional items in plain view that are used for the manufacture of methamphetamine at the bottom of the staircase of the apartment. A large one-gallon container of muriatic acid was allegedly found along with a grocery bag containing used items for the manufacture of methamphetamine.

There was allegedly an additional one-gallon container with white residue with these items.  Inside the grocery bag, officers could allegedly observe used cold compress containers, used suspected lithium batteries, Ronsonol lighter fluid and plastic tubing.

Also inside the grocery bag in plain view, there allegedly was a receipt from Wal-Mart for the purchase of pseudoephedrine tablets on Aug. 19.

Officers then contacted the state Attorney General’s Drug Task Force Unit and the Pennsylvania State Police Clandestine Methamphetamine Lab Unit.

Police transported Mandy Rubly to the station for an interview about her knowledge of items used for the manufacture of methamphetamine being inside the apartment. She initially denied any knowledge that Larry Rubly Jr. was making or using any type of methamphetamine products.

However, she eventually admitted to viewing the two-liter bottle of Mountain Dew in the bedroom. She also stated that there was a liquor bottle that contained a brown liquid inside the bedroom.

Mandy Rubly stated when she confronted Larry Rubly Jr. about the two bottles he related he had urinated inside them. She stated that he told her that he would throw out the bottles.

According to police, Mandy Rubly also allegedly admitted to observing a clear bottle with a black top labeled salt.  She stated that she asked Larry Rubly Jr. about this, and he told her that he had been eating in the bedroom.  However, she told police she’d never seen him eating in the bedroom.

She also allegedly admitted to purchasing Sudafed at Wal-Mart sometime at the end of July. Police confirmed that she purchased Sudafed on Aug. 6. However, she denied purchasing pseudoephedrine for the purpose of manufacturing methamphetamine or for supplying Larry Rubly Jr. with it to manufacture methamphetamine.

Police received additional information from another female who was suspected of purchasing pseudoephedrine and supplying it to Larry Rubly Jr. She was located at Lawrence Park Village.

She told police that on Aug. 19 Larry Rubly Jr. asked her to purchase pseudoephedrine for him at Wal-Mart. She stated that she declined at first; however, Larry Rubly Jr. called repeatedly and she eventually agreed to.

The female said she met with Larry Rubly Jr. and Mandy Rubly. She said both were present when Larry Rubly Jr. handed her a gift card, gave her the pin number and told her specifically which type of medication to purchase and to also use the card as credit, if possible.

The female said they told her to buy one box of the 12-hour, generic Sudafed.  She went to Wal-Mart where she purchased the pseudoephedrine.  When she returned she said she met both Larry Rubly Jr. and Mandy Rubly to give them the pseudoephedrine. She said Larry Rubly Jr. opened the package to make sure it was what he’d requested her to purchase.

The female told police she put the gift card back in the Wal-Mart bag. Before she left she said Larry Rubly Jr. asked a male for any empty bottles that he had, and he took an empty Juicy Juice bottle.

When Mandy Rubly was interviewed a second time by police, she denied witnessing Larry Rubly Jr. giving the gift card to the female. She also denied going with Larry Rubly Jr. to obtain the pseudoephedrine from the female.

According to the affidavits of probable cause, Grenier Enterprises Inc. allegedly failed to provide the gravestones, markers and related items purchased by families for their deceased loved ones who were buried at the Crown Crest Memorial Park located at 2122 Washington Ave., in Hyde in Lawrence Township.

The president of Grenier Enterprises Inc. was Edmund Grenier Jr. In a letter dated Sept. 12, 2013 and signed by Brenda Grenier, she identified herself as the secretary and treasurer of Grenier Enterprises Inc. She allegedly admitted to withdrawing the funds due to Edmund Grenier ending her regular salary from the business. Brenda Grenier hasn’t been associated with the day-to-day operations or maintenance of the business since 2011.

On March 11, police executed a search warrant at S&T Bank, DuBois, for any and all accounts registered or owned by Edmund and Brenda Grenier and Grenier Enterprises Inc.

DUBOIS – Charges have been filed against a Luthersburg man accused of aiding in his estranged girlfriend’s suicide, according to court paperwork obtained from Magisterial District Judge Pat Ford’s office.

Brian Lee Schaffer, 44, of Luthersburg, was charged Thursday by DuBois City police with criminal homicide, F1; aiding suicide, F2; involuntary manslaughter, M1; and manufacture, delivery or possession with intent to manufacture or deliver, F.

According to the affidavit of probable cause, police were dispatched to a report for a female gunshot victim Jan. 2 on Grant Street in DuBois City. Upon arrival to the scene, police made contact with Schaffer, who allegedly stated that the victim had shot herself but was still breathing in the living room.

Police observed a small, silver pistol that was allegedly laying to the victim’s left on the floor. “The positioning of the gun did not appear to be consistent with falling from [the victim’s] hand after firing but as if it was moved afterwards” police stated in the affidavit.

The gun, according to police, was a .380-caliber Bersa semi-automatic pistol that belonged to Schaffer. A single .380 casing was recovered by police at the scene.

DuBois Emergency Medical Services arrived at the scene and started to provide medical care. The victim was then transported to the emergency department at Penn Highlands, where she was pronounced dead.

Police interviewed Schaffer immediately after the victim was transported to Penn Highlands on Jan. 2. Schaffer told police he was upstairs when he heard a gunshot; he ran downstairs and found that the victim had shot herself.

Schaffer later changed his story, stating he heard the back door shut and went downstairs to find the victim with the gun. Schaffer stated that he told the victim to put it down but when he ran to stop her it went off.

Due to conflicting statements, police requested that Schaffer submit to a polygraph examination on Feb. 19 with the Pennsylvania State Police. During the examination, Schaffer allegedly admitted that he had previously lied to police.

Schaffer allegedly stated that he and the victim were arguing on and off throughout the night and into the early morning hours of Jan. 2. In order to settle their argument, Schaffer allegedly retrieved his gun from his truck.

Schaffer returned to the living room with the gun. When the victim allegedly demanded to see the gun, he handed it to her empty, and she wanted to know where the bullets were. When he showed her the loaded magazine he allegedly stated she wanted him to show her how to load it.

Schaffer stated he loaded the gun while the victim held it. Also, he stated that he must have chambered a round for her because he doesn’t keep it that way. Schaffer said when the victim threatened to shoot herself he reached for it, but it went off.

Schaffer wasn’t sure if his hand was on the gun when it went off. However, he denied pulling the trigger or there being any struggle for the gun. He stated that the gun only fired once, striking the victim in the temple.

Schaffer allegedly stated he couldn’t watch the victim suffer. He allegedly picked up the gun and was going to shoot her and then himself. Schaffer stated that he couldn’t go through with it and called 911.

During the examination, he also allegedly admitted to buying methamphetamine and bringing it to share with the victim. He allegedly stated that the victim had consumed a lot of methamphetamine, and he had quit using sometime around midnight.

Schaffer allegedly stated that he and the victim had been using methamphetamine for three or four days straight prior to the incident. Another witness confirmed in an interview with police on Feb. 20 that there was methamphetamine in the residence, Schaffer had purchased it and they were all using it.

An autopsy was performed on the victim at the Lehigh Valley Health Network in Allentown on Jan. 3. The findings concluded that the victim died of a single, gunshot wound to the head.

During the examination, suspected bullet fragments were recovered from the wound. A toxicology screening also showed that the victim had methamphetamine, ethanol and amphetamine in her system.

CLEARFIELD – A Clearfield man pleaded guilty to assaulting a 2-year-old girl during plea and sentencing court.

Robert J. Misho, 28, 117 Smith St., Clearfield, was charged with aggravated assault and endangering the welfare of children after an incident on April 21 in Clearfield.

He pleaded guilty before Judge Paul E. Cherry and was sentenced to 16 months to five years in state prison. Misho was fined $2 plus costs and ordered to complete anger management counseling.

Before the sentence was announced, Misho apologized and stated he was “truly, deeply sorry for my actions”.

Testimony in the preliminary hearing came from the victim’s mother. She testified that she was in the shower when she heard her daughter crying. After she got dressed, she went to check on her and found her holding her head in her hand. The girl had a bruise on the top of her forehead.

Misho, who lived with her, came into the room. He admitted he slapped the girl and she fell into the crib, she testified. But he didn’t want her to take the child to the hospital because he was afraid he’d go to jail. They decided to just watch her overnight.

The next morning, the bruising was worse and the mother took her to the emergency room at Penn Highlands Clearfield.

A doctor ordered x-rays and a CAT scan for the child. The mother spoke with police officers and a caseworker from Clearfield County Children and Youth Services.

Elizabeth Frailey, a caseworker with CYS, testified that she met with the victim’s mother at the hospital. She saw the bruises on the girl’s face including her cheeks and forehead. Frailey spoke with her supervisor who said they should call police.

The girl was transferred to Geisinger Medical Center because the doctors wanted to be sure she had no underlying injuries.

A report from the hospital listed a total of 72 bruises on her forehead, cheek, neck, shoulder, chest, arm, upper back, abdomen, left flank, buttocks and lower back. A determination was made that these were the result of a beating by an adult.

Frailey said the doctor at Geisinger told her the girl was very lucky because the injuries could have been life threatening. Photos of the girl taken before she was released from Geisinger showed a severely bruised face.

Both the child and her 8-year-old brother are now in foster care, Frailey said.

Officer Nathan Curry of the Clearfield Borough police testified at the hearing that when he questioned Misho, he said he was disgusted with himself and that he deserved to rot in hell for hurting the girl. When shown a photo of the injuries on the left side of the girl’s face, Misho said “I own that.”

CLEARFIELD – A Clearfield man was sentenced to state prison for giving alcohol to pre-teen girls and asking them for sexual favors.

Richard Stephen English, 45, who is an inmate of state prison, pleaded guilty to three counts of corruption of minors, three counts of indecent exposure and five counts of selling/furnishing liquor to minors before Judge Paul E. Cherry.

English was sentenced to serve a consecutive period of 18 months to five years in state prison. He was fined $5,006 plus costs.

The charges stem from incidents that occurred in Clearfield in July of 2014.

One of the victim’s mothers addressed the court. To English she said “I want you to know how much you hurt her.” She went on to say he had taken years from her daughter’s life. She is now harassed by the other kids in school and “it’s heartbreaking” to see the fear in her eyes, the victim’s mother said.

English apologized to the court saying he was “sorry for all my wrongful acts.”

According to the affidavit of probable cause, two women contacted police regarding English attempting to sexually assault their daughters. Both women and their daughters were then interviewed regarding the allegations.

The first victim, an 11-year-old female said she was sleeping over at a borough residence. English, who was also there, offered to give the victim and her two friends cigarettes. Later this victim went into the bathroom and discovered English was already in there.

She apologized and tried to leave but he told her to stay. He grabbed her hand and tried to place it on his crotch. She pulled it away, but he tried it again. She was again able to pull her hand away and get out of the room.

On the second night she stayed at the residence, English offered her and the other two girls Smirnoff Blueberry Lemonade. They did drink some of it, she said.

The second victim, a 12-year-old girl told police a similar story. Both said that the third girl’s mother, who was at the home, was drunk and passed out on the couch during these events.

On the first night, they stayed at the home, the second victim said she went into a bedroom where English asked her for a “hickey.” When she refused, he asked her if the other girl would do it.

As he was speaking to her, he was playing with himself, she said. He then tried to put his hand up her shirt. She also stated that he played with himself in front of the three girls and asked them to touch him.

During the second evening, English offered this girl $20 if she would hug and kiss him. Then he offered her $50 in exchange for showing him a “good time” sexually.

The second victim said that she and the third victim watched porn at this residence on several occasions after English showed them, which channel to watch.

When he was questioned English stated that nothing happened. He said the girls walked in on him watching a porn movie but he covered himself with a blanket. He claimed they watch porn all the time. When asked why he was letting the young girls watch porn, he stated that he tried to stop it but nothing worked.
