Lutz Gets Probation for Stealing More Than $5K from Morrisdale Moose

CLEARFIELD – A Philipsburg woman accused of stealing more than $5,000 from the Morrisdale Moose Lodge pleaded guilty Tuesday during plea and sentencing court.

Jennie Lynn Lutz, 55, 206 N. Center St., Philipsburg, was charged with theft by unlawful taking in September after officials realized, Lutz, who was hired to pay the bills, had been writing out unauthorized checks to herself.  She would then list the check number and amount in the register as being a payment on a bill, according to the criminal complaint.

President Judge Fredric J. Ammerman sentenced her to two years probation. As part of her plea agreement to receive a probation only sentence, she paid restitution of more than $6,300 in full prior to sentencing.

Ammerman commented that representatives of the Moose Lodge in Morrisdale were concerned with getting the money back and were not looking for her to serve any jail time. It was noted that they did, however, want her to have the theft charge on her record to alert any possible employers of her behavior.

According to the affidavit of probable cause, the unapproved check writing began in April of 2013 and ended in January of 2014. Trustees discovered money was missing from their accounts and some bills had not been paid, leading to an investigation.

It was thought that Lutz was marking the ledger as if the bills had been paid, but was writing her own name on the checks or writing them out to cash.

The first questionable check from May of 2013 was made payable to Lutz and was for $500. The ledger showed the check with this number was made out for Moose International. The amount of $500 was listed correctly.

The investigation revealed there were 18 checks totaling more than $5,700 that were listed incorrectly. A closer inspection of the transactions with the bank confirmed Lutz as the person who cashed the checks.

Babysitter Accused After Child Gets Out of Apartment Waives Hearing

CLEARFIELD – A woman accused after a young child she was babysitting got out of her apartment and was found without a coat in very cold temperatures near an area of heavy traffic in Clearfield Borough will stand trial.

Jennifer Marie Williams, 29, of Clearfield has been charged by police with endangering welfare of children, M1. She waived her right to a preliminary hearing Wednesday during centralized court at the Clearfield County Jail. Williams’ bail is set at $10,000 unsecured.

According to the affidavit of probable cause, on March 4 police were dispatched to the Clearfield Presbyterian Church, while a small child was brought there by two men working in the area of North Second and East Pine streets.

The area is near state Route 153, a two-lane highway with heavy traffic flow, police noted in the affidavit. Upon arrival to the scene, police spoke with one of the workers and a staff member from the church and pre-school.

The worker told police he was in the area of North Second and East Pine streets when he observed the child standing on the street corner. The child was not wearing a coat, and the temperature was very cold between 25 and 34 degrees, he said.

He said that the child looked very cold and was calling out for her mother. He tried to talk with the child who had difficulty verbalizing her name, and he wasn’t able to understand her, according to the affidavit.

Police then spoke to a church staff member. She didn’t recognize the child from being in the pre-school or from playing in the neighborhood. Police then attempted to get the child’s name, age and mother’s name from her; however, it was difficult to understand her due to her age.

As a result, police had the child taken into protective custody.  The child was turned over to Clearfield County Children & Youth Services. Police then began searching the neighborhood for the child’s mother.

Police received information the operator of a sports utility vehicle had been driving in the area, and it was believed the occupants were looking for the child. Police were subsequently directed to an apartment on East Pine Street.

In the area of the apartment, police observed a female yelling a name in a private parking lot. When police knocked on the apartment door, they made contact with Williams. Williams appeared to be upset, had watery eyes and a flushed face.

Williams told police she was babysitting for an acquaintance. The child, she said, must have opened her apartment door and walked away. She pointed to the door and stated it looked like it was locked by the position of the locking mechanism.

However, police alleged in the affidavit that her apartment door was not locked, and the child was able to open it. Williams said that she had been sleeping, and the child’s mother had gone to Wal-Mart.

While at the scene, police questioned Williams about any prescription medication she may have taken. She told police she was on methadone, and she provided her address as being on North Second Street.

Williams was instructed by police to report to CYS to take custody of the child. She was also told to contact the mother and notify her of the location of her child.

Williams later reported to Clearfield County Adult Probation, where she admitted to taking Ativan without a prescription. Further, she told probation that she had taken the Ativan on March 1, according to the affidavit.

Couturiaux Accused of Cutting Hole in Security Fence at Wal-Mart to Steal Merchandise

DUBOIS – An Allport man has been accused of cutting a hole in a security fence at a Wal-Mart store in an effort to steal merchandise.

Kyle V. Couturiaux, 26, 600 Old Turnpike Rd., Allport, is facing a felony retail theft charge and a misdemeanor count of criminal mischief as a result of his actions on April 27.

He was charged by Sandy Township police on May 2, and he is scheduled for a preliminary hearing during centralized court in DuBois on June 3.

According to the affidavit of probable cause, police received a report from the Wal-Mart in Sandy Township that a man tried to push a shopping cart out of a hole in the security fence. The suspect had left the cart and fled.

A Wal-Mart employee told police he saw the man in the store around 12:30 a.m. At that time, he was wearing a dark colored sweatshirt and was pushing a cart full of items. This man then put the cart around the area of the service desk and left the store.

He got into an older red Ford truck with a loud exhaust system. About 20 to 40 minutes later the truck was seen in the lot again. The same man was in the store but he had changed into a white sweatshirt, the employee said.

This was later confirmed to be the same man who tried to push a cart through the hole in the fence.

The outside security fence had been cut in two vertical lines then the fence was bungee corded up. Two shopping carts were found in that area. The one that the man was pushing had 24 items in it valued at $564.92. The other cart that was pushed all the way out and was in the access road to the rear of the store had 75 items valued at $1,082.46.

While police were still at the Wal-Mart store, they received a dispatch that a fire hydrant had been hit and was laying the middle of Industrial Drive.

The investigating officers found that a vehicle had driven over a curb, through the grass and then hit the hydrant. This was on the same side of the lawn and garden area of Wal-Mart where the man had fled.

It appeared that the vehicle dragged the hydrant over 200 yards across the rear of the store. The hydrant became dislodged in the middle of the road. A bumper light was found near it.

The vehicle that struck the hydrant was now leaking a large amount of anti-freeze, leaving a trail across the parking lot, to Shaffer Road and state Route 255 to Interstate 80.

Officers followed this but were unable to find the vehicle.

At 6 a.m. police received a call from state police that a disabled vehicle fitting the description of the truck was found on I-80. It had severe damage to the front bumper and the radiator area. It had a bumper light identical to the one found earlier by the police. The truck was registered to Couturiaux.

After an officer reviewed surveillance footage, he was able to identify the suspect as Couturiaux because he had prior contact with him. Local authorities were contacted and arrangements were made for Couturiaux to meet with the investigating officer in the Morris-Cooper police station.

During his interview, Couturiaux told police he was in DuBois to meet someone for a date but she stood him up. He explained that when he was returning home the fan belt slipped off his truck, it became overheated and then disabled. He continued to talk about the truck while avoiding eye contact with the officer.

When the officer asked if he remembered him from two years ago, Couturiaux said he didn’t. The officer then told him he knew what happened and he needed to tell the truth.

Couturiaux then admitted he was in the DuBois Wal-Mart where he had loaded up a shopping cart. He said he got scared and left the cart in the store. He got into his truck, left the parking lot, changed his hat and put on a white sweatshirt before returning.

This time he loaded up two carts and took them to the garden center where he left them. He exited the store from the front entrance and drove his truck around the back and parked, he told police.

He walked to the outside of the garden center and cut the security fence with wire cutters. He was able to get one cart out of the fence and when he was pushing out the other cart, he saw an employee and fled. He said he did drive over the curb but thought he hit a traffic sign. He was unaware he hit a hydrant, he said.

NJ Man Charged for Allegedly Reporting Tractor-trailer as Stolen After Fuel Leak

DUBOIS – A New Jersey man is facing charges for allegedly reporting his tractor-trailer stolen after he abandoned it because fuel was leaking out.

Samuel A. Procopio Jr., 55, 14 Johnson Pl., Edgewater, New Jersey, was charged with false reports, accident to unattended vehicle or property and failure to notify police of accident by Sandy Township Police on May 3. The charges stem from an incident on April 27.

According to the affidavit of probable cause, Procopio called police and stated his tractor-trailer had been stolen from the Pilot Travel Center along Rich Highway. He told police he dropped off a load at DuBois Logistics and then traveled to the Pilot Travel Center.

He parked the truck, took a nap in the sleeper and then went into the business to take a shower. When he returned about an hour later, the truck was gone. He said he had left it running because the starter on the truck was acting up.

He gave police a description of the vehicle but did not know any of the plate numbers. He called the owner to advise him of the situation. The owner said someone would call back with the truck registration information and VIN number.

Although Procopio claimed he had taken a shower and had a trash bag that contained clothes, the officer could smell a strong odor of diesel fuel coming from him. The officer also noted that Procopio didn’t seem concerned about the theft of the truck and this officer had a feeling something was not right with his story.

Later that day, the truck was found in DuBois behind the Peking Restaurant. It was up over a curb and the gas tank had been ruptured, disabling the vehicle. This location was between DuBois Logistics and Pilot. The officer felt Procopio was not telling the truth about it being stolen.

When the officer called Procopio, he was 60 miles away. This officer questioned Procopio telling him he thought he had made up the story about the truck being stolen. He advised Procopio that the Pilot station had video surveillance of all the trucks that entered the lot and he was going to be checking to see if the truck was ever in the lot.

After Procopio was told this was going to be the only opportunity to tell the truth, he stated he was sorry for wasting the officer’s time, but he had panicked and didn’t know what to do. He admitted he was the one who got the truck stuck and disabled it on the curb. He added that he tried to plug the hole in the tank with a branch from a tree, once he realized how much fuel was leaking and how expensive the clean up bill would be.

The City of DuBois Public Works Department and the City of DuBois Fire Department did respond for the containment and mitigation of the fuel spilled. The cost was $1,543.32.

Procopio is scheduled for a preliminary hearing during centralized court in District Judge Patrick Ford’s office on June 3.

BREAKING: State Trooper Accused of Assaulting, Threatening Wife with Duty Weapon Waives Charges

Terry Drew Jordan (Provided photo)

CLEARFIELD – A state trooper who has been accused of brutally assaulting and then threatening his wife with his duty weapon waived all charges to court at his preliminary hearing today before Magisterial District Judge Jerome Nevling at the Clearfield County Jail.

Terry Drew Jordan, 46, of Clearfield has been charged with aggravated assault, F1; two counts of simple assault, M2; terroristic threats, M1; reckless endangering another person, M2; harassment, M3; and two counts of harassment and one count of public drunkenness, all summary offenses.

Jordan is currently incarcerated in lieu of $1 million bail at the Clinton County Prison, according to court documents.  He is being represented by defense attorney Carl John Zwick, Esq. of DuBois.

Zwick discussed the case with Jordan prior to and again today at the jail, and he said Jordan was prepared to waive the charges to court. However, Zwick indicated that the commonwealth wanted bail to remain $1 million, and he wanted to request a reduction.

District Attorney William A. Shaw Jr. adamantly opposed any bail reduction, calling attention to the fact that Jordan brutally assaulted the victim in the case and directed threatening statements toward her and others while holding her at gunpoint.

“He was a state trooper,” he said, “… The victim is deathly afraid; two others are also deathly afraid.” Shaw also called attention to a Centre County case in which a retired trooper was released following a domestic and carried out his threats in a murder-suicide in 2013.

“There is a bona fide concern for the safety of our victim and witnesses. The defendant has the ability to do some real damage [if he gets out].” Shaw stressed that if Jordan was to get out on bail, there wasn’t any way to ensure safety of the victims and others involved in the case.

Nevling said he heard the arguments of both Zwick and the district attorney and was well aware of the County Market shooing involving a  retired state trooper in Philipsburg a few years ago. He said for him, the “big thing,” was  the brutal assault with a weapon and the threatening comments. Nevling then ruled for bail to remain the same.

According to the affidavit of probable cause, on April 21 Clearfield County Control advised Lawrence Township police about a female caller who was on the line to report that her husband had allegedly assaulted her and then threatened to kill her and himself.

The victim also advised her husband was a trooper with the Pennsylvania State Police. The weapon, he had in his possession was a “duty weapon,” she reported, and she had locked herself into a closet. She was using his work cell phone while he had hers in his possession.

While responding to the scene, police were advised by County Control that the victim’s husband was Jordan. Police were also advised that the victim wasn’t any longer able to hear Jordan outside of the closet door, and she wasn’t sure if he was still in the home.

Upon arrival to the scene, police observed a dark-colored Chevrolet sports utility vehicle in the driveway. Police asked County Control to find out from the victim what vehicles were to be in the driveway, and she indicated the SUV and a blue Honda passenger car, which was missing.

Police proceeded to approach the residence and asked County Control to let the victim know that police were at the home and would make entry. Police announced their presence three times after which the victim came out to them.

She told police that she and Jordan had dinner and a few drinks. They went to a friend’s residence for drinks in Clearfield Borough. When they returned to their home Jordan allegedly grabbed her and struck her, and it caused a large bruise and lump on the left side of her head.

Jordan grabbed her again and slammed her head into the wall. She went to the floor, and Jordan began to kick her numerous times in the back and in her right side area. Jordan then put a handgun against her head, stating “I’m going to kill you and then kill myself,” the affidavit alleges.

Clearfield Emergency Medical Services was summoned to the scene, as the victim was complaining of pain. Officers observed she’d suffered a bloody lip, a large scratch to the left side of her neck and a very large lump and bruise to the left side of her head. She was examined by emergency personnel at the scene and wanted to go to the hospital by private vehicle.

Police were then advised a vehicle was approaching the home. Lawrence Township and Clearfield Borough police and Clearfield-based state troopers observed a blue-colored Honda Coup pull into the driveway, and Jordan was the operator. Jordan parked the vehicle and placed his hands in the air.

Jordan proceeded to exit the vehicle and was handcuffed by police. He was taken to and placed inside a patrol vehicle, and a handgun was removed from the passenger’s seat of his vehicle. Police also detected a strong odor of a malt beverage coming from Jordan, according to the affidavit.

When Jordan was being placed in the patrol vehicle he asked if the victim was OK. He was advised she was experiencing pain from her injuries. Jordan was transported to the jail on a 48-hour detainer due to his level of intoxication and until his arraignment.     Breaking-News-Alerts-Sign-up-Now

CLEARFIELD – District Attorney William A. Shaw Jr. has announced Clearfield County’s Fugitive of the Week.

Shaw identified the fugitive as Daniel Donnelly, 32, of Weber Ave., DuBois. Donnelly is wanted for failure to appear at a preliminary hearing May 6.

On April 4 Officer Scott Johnson of the Sandy Township Police Department filed a criminal complaint in which he charged Donnelly with retail theft, F3, two counts.

According to the affidavit of probable cause, on Feb. 24 Johnson was assigned to investigate the report of a retail theft at a local business. Upon arrival at the scene, Johnson met with employees who stated that several electronic devices were observed to be missing.

Upon review of the surveillance video, Johnson observed an individual who was allegedly removing several electronic devices and concealing them under his coat before leaving the store.

After consulting with other officers from the Sandy Township and DuBois City police departments, Johnson was able to identify the individual as Donnelly.

Upon further investigation, it was determined that Donnelly was also involved in another incident of retail theft Sept. 28, 2015. Store personnel provided information and surveillance video from the incident in which Donnelly was allegedly observed removing several electronic devices.

A preliminary hearing was held May 6, at which time Donnelly failed to appear, and a warrant was issued for his arrest.

Donnelly is described as a Caucasian male who stands 5 feet, 11 inches tall. He has brown hair and blue eyes.

Anyone with knowledge of Donnelly’s location is asked to call Clearfield County Crime Stoppers at 800-376-4700. All calls to Crime Stoppers are confidential.

Anonymous tips can also be submitted by visiting the Clearfield County District Attorney Web site at “www.ClearfieldDA.org” and selecting “Report A Crime.”
