Former Firefighters to Pay More Than $92K in Restitution in Arson Case

CLEARFIELD – Three former firefighters who set a Chester Hill home on fire will pay more than $92,000 in restitution.

When they were sentenced, Hunter Thomas Harris, 22, Philipsburg, Samuel Wilbur Connor V, 20, Howard, and Kenneth Moore, 21, Lanse were ordered to pay a total of more than $52,900 to the owner of the house that burned in October of 2015.

Each of them pleaded guilty to burglary, arson and related charges and received a sentence of 12 months less two days to two years less one day in jail and an additional five years’ probation.

Attorneys for Harris (Chris Pentz) and Conner (William Fleming), both inmates of the county jail, filed a motion for reconsideration of the restitution amount that was discussed in Clearfield County Court before President Judge Fredric J. Ammerman.

Moore, although sentenced in October, has not yet reported to the jail because he is recovering from a serious health problem.

Only one person, the owner Patrick Coval, testified in court.

Coval explained that the home on Ida Street in Chester Hill was purchased for $20,000 as an investment. The plan was to “flip” it by renovating it and selling at a higher price.

As he and his wife, worked on it, gutting it completely, replacing wiring, plumbing, redoing the kitchen and bathrooms, they began to consider either moving into it, or renting it. He called it a “completely brand-new house inside.”

He and his wife did a lot of the work themselves, but they also spent between $40,000 and $50,000 into it, including all new appliances, he said.

His insurance company only paid him $30,000 plus $1,500 to tear it down. That cost including having the rubble removed was actually $7,400.

Coval stated that he has a disagreement with the insurance company over the amount received because he said he paid for additional insurance on the property that wasn’t credited to his policy. He is filing a civil suit against them in Centre County.

Both the commonwealth and the defense attorneys supplied appraisals for the home. The defense was saying it was worth $80,000 and the commonwealth’s figure was $84,000.

Even though the estimated cost to replace the home was $158,000, Ammerman explained according to the law, is able to only order restitution for the assessed worth of the property.

After a brief recess for the defense to review receipts supplied by Coval, Ammerman ruled that the three split a total of $61,345.84 paid to Coval and $31,500 to be paid to the insurance company.

Coval’s amount was determined by taking $84,000 for the value of the house, plus $1,445.84 paid for the new appliances and $7,400 to tear it down, minus the $31,500 paid by his insurance.

Ammerman commented that he sympathized with Coval and called the fire “a despicable act.”

According to the affidavit of probable cause, police were asked to investigate the fire by Chester Hill Fire Department’s chief. It was determined that the fire started inside a shed attached to the back of the home where a direct flame was used deliberately on some combustible materials. From there the fire spread up the exterior rear of the unoccupied home and into the residence.

When the three men were interviewed about the fire on Oct. 26, 2015, they independently confessed after receiving their Miranda warnings. Their statements were consistent with each other, with the damage and the evidence at the scene.

They said while they were at the Hope Fire Station in Philipsburg in the early morning hours of Oct. 9, 2015 they talked about starting a fire in a vacant home Moore had previously located. They wanted a fire so they could respond there with their fire company that provides aid to the Chester Hill Fire Department.

Using hay, a cardboard toilet paper roll, a paper wrapper from a new toilet paper roll and a paper plate they created a fuel package for ignition. They traveled to the home where Moore dropped Harris and Connor off.

Harris placed the package inside an opening of the wood frame shed and he used a lighter that he obtained from Moore’s vehicle to ignite the fuel package. Harris and Connor went to the parking lot of Highway Pizza where they met back with Moore.

They then returned to the fire station in Philipsburg to wait for the call that came about 15 minutes later for the fire company to respond to a structure fire in Chester Hill. The three men returned to the scene with the fire company and assisted with putting out the fire.

Two People Allegedly Involved with Robbery in Attempt to Recover Naked Photos Appear in Court

CLEARFIELD – Two people allegedly involved in a robbery that was an attempt to recover naked photos were in Clearfield County Court Monday.

Michael Jerome Irby Jr., 26, Altoona, is facing felony counts of criminal conspiracy/burglary, burglary, conspiracy/robbery, robbery, conspiracy/theft, theft by unlawful taking and misdemeanor counts of terroristic threats, simple assault and recklessly endangering another person.

Sara Ann Wolfe, 24, Altoona, is charged with felony counts of criminal conspiracy/burglary, conspiracy/robbery and conspiracy/theft. They are both inmates of the county jail and were scheduled for sentencing court Monday.

The charges stem from an incident in Mahaffey in June when Irby allegedly forced his way into the victim’s home and threatened to kill him if he didn’t turn over his computer, phone and camera that had photos of Irby’s girlfriend, Wolfe.

The plea agreements in each case were for a six-month minimum sentence.

The victim addressed the court, stating that Irby put a gun in his face and told him he was going to die in his home. Because of this incident, he said he has barricaded his home and keeps a gun near his bed.

The victim stated he didn’t understand why it “had to come to this.” Wolfe had called him, he explained, asking for the photos while he was in Cleveland and unable to retrieve them. He told her he would give them to her when he returned to his home in a few days.

When President Judge Fredric J. Ammerman asked the victim if the plea had been discussed with him, the victim said it was explained to him that some of his statements were causing problems with the case. Initially he had misidentified the man who entered his home, but was able to pick Irby out of a photo lineup, he said.

After a discussion with the defense attorneys, Ammerman rejected both pleas. The cases will be added to the trial list.

According to the affidavit of probable cause, the victim told police he is a photographer who has his own magazine and does numerous photo shoots across the country. In May he did a photo session with Wolfe, and he had taken photos of her on other occasions. Previously she appeared on both the front and back cover of the magazine.

Before he took any photos, he said she signed a model release form and after they were finished, he said she was pleased with the photos that included a few nude shots.

The victim explained to police that he had known her for about five years and she was working for him doing marketing. CLEARFIELD – A Clearfield woman charged with endangering the welfare of a child after her daughter was found outside in only a diaper and T-shirt asked to withdraw her guilty plea Monday.

Nicole Lynn Luzier, 27, is charged with endangering the welfare of a child, recklessly endangering another person, harassment and disorderly conduct in once case and harassment, disorderly conduct and defiant trespass for allegedly fighting with her mother who found the child.

According to the affidavits of probable cause, the temperature was approximately 20 degrees when Luzier’s mother found the two-year-old girl, who was crying, on her front porch Dec. 11 at 10:40 a.m. Luzier allegedly then fought with her mother and repeatedly phoned her. The two ended up in a physical altercation.

On Monday, Luzier’s attorney, Marc Decker, asked the court to allow her to withdraw her guilty pleas in both cases. He claimed she was not “well enough informed” to sign the agreements.

“She wholeheartedly disagrees with the facts” of the case, he said, adding the child was only outside unsupervised for a short period of time.

Luzier, who was on parole at the time of these incidents, was also the subject of a revocation hearing. President Judge Fredric J. Ammerman revoked her parole due to her violating it by committing the new offenses. She will remain in jail until she serves the remainder of her six-month sentence on a previous driving under the influence charge.

Ammerman did allow her to withdraw both guilty pleas in the new cases but re-set her bail at $10,000, straight on each case. Her original bail had been lowered from $10,000 to $1,000 at the time of her preliminary hearing.

The criminal complaint details the incident beginning when the victim found the child, who lives a short distance away, on her porch. She had severe redness to her hands and feet and was shaking uncontrollably. She was wearing one shoe and one boot. The girl was brought into the home and efforts were made to warm her up.

According to the affidavit, the length of time the child was outside is unknown.

For more details, see the story on the preliminary hearing here.

DuBois Couple Accused of Having Meth Lab in Their Home, Endangering Children

DUBOIS – Charges have been filed against a DuBois couple who allegedly had a meth lab in their home endangering their three children.

Jeffrey Joel Bish, 38, and Samantha Marie Bish, 34, were each charged by DuBois City police with criminal conspiracy, 14 counts of operating a methamphetamine lab, possession of liquefied ammonia for purpose other than agricultural, manufacture/delivery/possession with intent to deliver a controlled substance, intentional possession of a controlled substance, risking a catastrophe, three counts of endangering the welfare of children, six counts of recklessly endangering another person and possession of drug paraphernalia.

The charges stem from an incident Oct. 12 when police said they were serving arrest warrants on the couple and found meth and substances used to make meth in their home.

According to the affidavit of probable cause, when Jeffrey Bish opened the door, he was taken into custody. On his person, officers report they found three baggies containing a white powdery substance later identified as methamphetamine.

He also allegedly had two plastic tubes with white powder residue, a container with hydrocodone, dextoampheramines and methylphenidate. When asked where his wife was, he said upstairs.

The officers located Samantha Bish in a bedroom where they saw a container with a white powdery substance and a glass jar with a white powdery substance on the bottom and liquid on the top, which appeared to be a possible meth lab, according to the complaint.

At this time, two children were in the home and another had already left for school.

Samantha Bish was taken into custody and she gave permission to police to search the residence. She allegedly told them she was aware of drugs and drug making items in the home.

Jeffrey Bish said there was stuff in their bedroom cooking meth, but it was not finished yet, according to the complaint. He also reportedly directed the officers to the back porch where there was a bucket full of run-off material from making meth.

The home and a neighbor’s home were evacuated due to the fumes coming off the bucket on the porch.

Police said they recovered seven plastic bottles containing various colors of a chunky substance, a metallic substance, tablet pieces, a clear liquid, one bottle with residue, seven plastic bottles containing a white crystalline substance, other items used to make methamphetamine, scales, straws and bags with white powder or residue.

All of the items seized contained the ingredients for the manufacture of methamphetamine. The total weight of items seized that contained methamphetamine was 1,112.09 grams, according to the complaint.

The arrest warrants on the original case that brought officers to the Bish home involve the alleged sale of oxycodone to a confidential informant in January of 2016. Both Jeffrey and Samantha Bish face drug charges in that case, as well.

They waived their rights to a preliminary hearing on charges of manufacture/delivery/possession with intent to deliver a controlled substance, and recklessly endangering another person in those cases in October.

Their preliminary hearings in these new cases are scheduled for March 3 in District Magistrate Patrick Ford’s office.

Tobias Will Stay in Jail for Allegedly Breaking into Vehicles During Church Services

CLEARFIELD – A Clearfield man accused of breaking into vehicles parked at churches during worship services will be staying in jail.

Larry David Tobias, 34, is charged with two felony counts of theft by unlawful taking, a felony count of possession of firearm prohibited, two felony counts of receiving stolen property, three misdemeanor counts of receiving stolen property and three counts of theft from a motor vehicle.

The charges stem from incidents when Tobias allegedly entered several vehicles parked at the First Baptist Church of Curwensville and Community Baptist Church, both in Pike Township, and the Missionary Alliance Church of Curwensville in Curwensville Borough.

Tobias’ bail was originally set at $25,000, monetary, but it was decreased to $10,000, monetary after he waived his preliminary hearing in December.

A motion to lower his bail again was discussed during Tuesday’s session of motions court.

His attorney, Curtis Irwin, explained that Tobias has been incarcerated since Dec. 12 and he can’t afford his current bail.

Assistant District Attorney Ben Baker said he was opposed to lowering his bail because of the seriousness of the charges. He pointed out that Tobias is looking at serving a lengthy sentence.

Tobias told the court that he wanted to get out of jail so he could take care of a few things before he is sentenced.

“You can’t even leave your cars unlocked during church,” commented President Judge Fredric J. Ammerman before he denied the motion.

According to the affidavit of probable cause, police received a report Dec. 4 that cash had been removed from a vehicle at the First Baptist Church sometime between 8 a.m. and 2 p.m.

Surveillance video showed a purple vehicle driving through the lot during the morning worship services. The driver of this vehicle got out and started opening numerous car doors and then entering the vehicles.

He also looked inside the church where the church’s younger children would be located at that time. Later another victim from that location reported a hunting rifle was missing from his vehicle.

The next day, there was a report of a theft from a vehicle that had been in the lot of the Missionary Alliance Church during their morning service. The item missing was another hunting rifle.

Police were able to identify the owner of the vehicle that the thief was driving and found the car parked at 96 Putty Rd., in Clearfield. When they knocked on the door, it was opened by Tobias.

He was questioned about the thefts and he allegedly confessed to committing the crimes. He explained he took money, GPS systems and the two rifles. He showed the officer where the items were located in the residence, police said.

During transport to the police station, Tobias allegedly expressed great remorse and said he wanted to return the items, but wasn’t sure how to do it.

In his statement to police, Tobias admitted to the thefts again and wrote he did this because he was unemployed and desperately needed money for Christmas gifts and bills, according to the complaint.

CAST’s Ex-President/Treasurer Waives Theft Charges to Court

CLEARFIELD – The ex-president and treasurer of the Clearfield Arts Studio Theatre Inc. (CAST) who has been accused of stealing more than $4,500 from the organization waived the charges to court Wednesday.

William John Grigsby, 27, of Clearfield has been charged by Clearfield Borough police with two counts of theft by deception and 61 counts each of other reason access device is unauthorized by issuer and receiving stolen property.

According to the affidavit of probable cause, on Oct. 27 police received information that Grigsby had made transactions not approved by CAST, beginning in January of 2016 and ending in September of 2016.

Grigsby allegedly used two CAST accounts, including its Building Fund and VISA card, to make 61 unauthorized transactions for personal benefit. The total amount stolen from CAST was $4,565.98; the CAST is a 501(c)3 corporation under the operation of strictly volunteers.

When interviewed by police Nov. 3 in the presence of his attorney, Grigsby admitted that he made some of the purchases.

Grigsby sent a text message to a CAST board member Oct. 12, which was provided to police. According to the affidavit, the message read, “…. These charges are mine, and I am truly sorry that it happened. I will pay this back, and I hope that I don’t have to go to jail but will tender my resignation.

“I know that I am in no position to ask but would like some discretion, if possible. I obviously don’t have $1,600 or whatever it comes to but will still work hard at paying it back. I have $400 to my name, but if I lose my job, it will become more difficult to pay it back. That’s why I am asking for discretion.”

Grigsby also stated in the message that he never thought he would steal from an organization that he’d worked so hard to help build, he was truly unable to answer why and he wasn’t proud of doing it.

An executive officer meeting was called prior to a meeting Oct. 12 to discuss the findings of unauthorized purchases.

During the meeting, Grigsby was asked if he knew anything about the charges, which he stated he did not. Grigsby was asked to turn in the CAST VISA card, which he did. Grigsby sent the text message to the CAST board member admitting to making the charges after the meeting.

Woman Charged for Allegedly Having Sex with 15-year-old

DUBOIS – A DuBois woman has been charged with statutory sexual assault for allegedly having sex with a 15-year-old male.

Bobby Jo Gregor, 42, is also charged with indecent assault person less than 16-years-old and corruption of minors. The charges were filed by Sandy Township police in regard to a June of 2016 incident.

According to the affidavit of probable cause, the victim’s parents and a family friend reported the crime. The witness explained that she received several texts from the victim who is a friend of her son.

She said he sent her a text, saying what he had done was something “bad.” She asked him what it was and the victim replied that he had sex with the mother of another friend.

The witness advised the teen to tell his parents, but he said he didn’t want to tell his mother, which is why he was confiding in her. The next day this witness and her husband told the victim’s parents what the teen said in these texts.

The victim’s mother told police that the witness came to their home and after they asked the victim what happened, he became teary eyed. They told him he was not in trouble but they needed details.

The victim then began to cry. He said he knew it was wrong because he did not stop it. He said it started when Gregor began sending him nude pictures. While he was at her home, he said Gregor kissed him and they then had sex on the couch, according to the report.

The victim’s mother noted to police when she picked him up from Gregor’s house, he was not acting like himself.

When police interviewed the victim, he said the morning after he stayed with Gregor’s son, his friend and his brother left with their father while the victim stayed at the home. The incident happened when he and Gregor were alone after her husband left to go to work.

He said she told him she loved him and kissed him on the lips before they had sex on the couch. Shortly after this, his mother picked him up. Before he left Gregor’s home, the victim said they kissed again.
