Former Chief Claims Arson Was “A Joke,” But Co-defendant Tells Different Tale

DUBOIS- A former fire chief claims he was “just joking” when talking to a fellow firefighter about lighting brush fires. However, a co-defendant in the case claims the fires were set to “generate call volume.”

According to an affidavit of probable cause filed with District Judge Patrick Ford’s office July 28, Christopher George Leone, 24, 1398 Treasure Lake, DuBois, is charged by the DuBois-based state police with official oppression, criminal mischief and two counts of arson.

According to the affidavit, on April 15, a fire broke out in a wooded area at the intersection of Jolly Roger and Harborview roads in Treasure Lake. A second fire of similar nature broke out on May 8.

Aaron Kulbacki, a co-defendant in the case was interviewed by police and confessed to starting the April 15 fire. Kulbacki allegedly told police that he is a member of the Treasure Lake Fire Company and Treasure Lake Security.

He said there has been “general conversation” for some time within the fire company about causing small fires in order to generate call volume. He told police that he was in a vehicle with Leone on April 15, heading back from fire training in Tionesta, when Leone started talking about setting fires.

Kulbacki told police that Leone allegedly told him to set a brush fire with a flare. Kulbacki told police that Leone had allegedly told him to set the fire in an area that was easy to reach and near no homes. Kulbacki said Leone brought up starting a brush fire again on the way home from training.

Kulbacki told police Leone was at the fire station when Kulbacki took a flare and went to the intersection of Harborview and Jolly Roger roads. Kulbacki said he lit the flare and threw it over an embankment, then went home. Kulbacki told police he was home for about 15 minutes before someone reported the fire.

Kulbacki told police that he allegedly spoke to Leone after the fire had been put out and told police that Leone allegedly laughed and told Kulbacki he wouldn’t get caught.

Police then spoke to Leone who agreed to an interview. Leone allegedly told police that he was the Treasure Lake Fire Chief on April 15 and that he did not set any fires in Treasure Lake.

Leone allegedly told police he believed the fire on April 15 was possibly set by “kids messing around with a rust-oleum can. He then allegedly told police he had been “joking around” with Kulbacki about setting fires on the way home from fire training in Tionesta.

After denying his involvement in the April 15 fire for about a half-hour, Leone allegedly told police that after coming back from Tionesta, he went back to the Treasure Lake Fire Station and said he “joked around,” saying “we can go for a call tonight.”

Leone again told police that his statements to Kulbacki were “a joke.”

Leone allegedly told police that he had “joked” to Kulbacki about going for a call on a brush fire that night because it was brush fire season. Leone allegedly told police that he did not intend for it to be serious or for it to “go that far.” Leone told police that he did not provide the materials to set the fire.

Bench Warrant Issued for Former CCCTC Executive Director

CLEARFIELD – All charges were held for court against the former executive director of the Clearfield County Career & Technology Center, and a bench warrant was issued after he failed to appear for his preliminary hearing Wednesday.

Former CCCTC Executive Director William H. Weaver, 55, of Bellefonte has been charged with two counts of failure to report/refer, M2, and disorderly conduct, S. Weaver is one of two CCCTC administrators accused of not properly reporting sexual misconduct by a former substitute teacher of the school.

Former CCCTC Assistant Director Cathy M. Thomas, 61, of Morrisdale has been charged with failure to report/refer, M2, and disorderly conduct, S. She had previously waived the charges against her to court.

After a hearing last week, former substitute teacher Darice J. Brady-McKee, 34, of LaJose had  two counts of dissemination of explicit sexual material to a minor, F3, and 30 counts of corruption of minors, M1, held for court.

According to the affidavit of probable cause, on May 1 police received a report about an alleged incident of sexual harassment. Further, police were notified by a parent that a substitute teacher had made sexual comments to students.

Police were also notified that the administrators at the CCCTC were made aware of the alleged sexual harassment, which had occurred in March. However, police were told that nothing had been done about it and the substitute teacher was still there.

Police went to the CCCTC on May 1 and spoke to Weaver, who was then the executive director. He told police that on March 23-24, Brady-McKee substituted at the school. Weaver told police Brady-McKee had allegedly made comments about her personal sex life from the previous weekend to the students.

Weaver told police students complained to their regular teacher when she returned March 25. Weaver said he was absent from the CCCTC that day but when he returned he was informed by the assistant director, Thomas, about the alleged sexual misconduct.

Weaver said the regular teacher had her students write statements about the alleged sexual misconduct, which were given to the assistant director, Thomas, and later to him, when he returned to school on either March 26 or 27.

When asked about the content of the statements, Weaver told police the students alleged that Brady-McKee talked about her sex life and showed them bruises on her breasts, legs and buttocks areas. Weaver said when he asked Brady-McKee about it, she denied it.

Weaver told police that he had Brady-McKee placed on the list of substitutes only to call if absolutely necessary. He also said that Brady-McKee was not allowed to substitute in the Health Occupations class.

However, Weaver said there wasn’t anyone to substitute due to multiple teachers calling off work. He told police he allowed Brady-McKee to substitute for a business class on March 31 and in the IT Department on May 1.

When students from the health class noticed Brady-McKee on May 1, Weaver said they made complaints to him and began to text-message their parents. He said multiple students came to him, saying they didn’t feel safe and comfortable with Brady-McKee in the CCCTC.

According to Weaver, he didn’t believe the students were in any danger but confronted Brady-McKee. He informed her that it wasn’t working out due to the large number of complaints about her. Weaver said he also told Brady-McKee that she would have to leave the CCCTC.

Police asked Weaver for the students’ statements. After reading them, police asked Weaver if he’d notified parents, Children & Youth Services or Child-Line. Weaver said that parents only knew if their children had text-messaged them, and he’d just called Child-Line prior to police arrival.

Police asked Weaver why he didn’t notify Child-Line and police immediately after the incident had occurred in March. Weaver didn’t give police an answer.

Police interviewed students in the morning Health Occupations class who originally made complaints. When asked students provided similar information about Brady-McKee allegedly talking in “great” detail about her sex life and showing bruises on her body from “rough sex.”

Students told police that Brady-McKee made them feel uncomfortable and they were upset that she was permitted back into the CCCTC.

Students said when they saw Brady-McKee at the CCCTC on May 1, they went to Weaver. Students said Weaver told them not to worry about it and the matter was being handled by the administration. Students said they were upset and contacted their parents, which made Weaver and Thomas yell at them for cell phone use.

Police interviewed students in the afternoon Health Occupations class. Students told police that Brady-McKee had shared “intimate details” of her sexual experiences. Students also told police that she spoke about drug use multiple times and asked to go to the beach with them while she could provide them with alcohol and drugs.

Police also interviewed Cosmetology students at the CCCTC who alleged that Brady-McKee made them feel uncomfortable when she discussed drugs and her sex life over the last couple of years. Two students alleged that Brady-McKee showed them unknown males’ private parts when they were sophomores, which they reported to their teacher the next day; their teacher then reported the incident to the administration.

Police also interviewed a health teacher who took the initial complaint from her students upon her return to class. She had students write statements, which were turned over to the administration. When the teacher asked Weaver if it should be reported, he said, “Nah, I’ll take care of it.” The teacher said she contacted Child-Line when the substitute returned to the CCCTC, as it obviously hadn’t been taken care of.

Another teacher told police she had reported a photo incident to Weaver, who was the assistant director at the time of that complaint. The teacher said there wasn’t anything done about it; when she talked to Thomas about the alleged sexual misconduct this year, she was told the victims weren’t cooperating and the story couldn’t be validated as a result.

On June 15, police interviewed Thomas about Brady-McKee’s alleged sexual misconduct at the CCCTC. Thomas said she never thought about reporting it, and didn’t realize it should have been reported to authorities.

CLEARFIELD – After an in-depth investigation by Lawrence Township police, Franklin William Wilson, 41, of Clearfield has been accused of sexually abusing six girls between 2001 and 2015.

Wilson was arraigned Wednesday by Magisterial District Judge Jerome Nevling. He remains incarcerated at the Clearfield County Jail in lieu of $500,000 bail. Wilson’s preliminary hearing has been scheduled for 12 p.m. Aug. 12 at the jail.

According to the affidavit of probable clause, Lawrence Township police received a report about alleged child abuse from Clearfield County Children & Youth Services on Feb. 17. A caseworker provided a report to police in which a 10-year-old girl had alleged being inappropriately touched by Wilson.

On Feb. 20, police went to the Child Advocacy Center of Centre County in Bellefonte to observe a forensic interview that was conducted with the victim. During the interview, the victim allegedly detailed sexual assaults that occurred between Dec. 30, 2014 and Feb. 13.

The victim said that on three, different mornings, she went downstairs and sat next to Wilson in the living area of his residence. She alleged that Wilson would watch pornography on his cellular phone and made her watch it, as well.

One time while Wilson was watching pornography, the victim alleged that he inappropriately touched her. She said she felt afraid but was too afraid to yell for help. The victim also alleged that Wilson inappropriately touched himself in front of her. When she asked him to stop, he did not; when he did she said he told her not to tell anyone.

On or about Feb. 20, a search warrant was requested and obtained for Wilson’s cellular phone. It was executed by township police that day at Wilson’s residence.

Then, a search warrant was requested for any and all data contained within the phone, internally or within removable memory. On or about Feb. 26, it was approved by the district attorney and obtained through Magisterial District Judge Richard Ireland.

Police transported all warrants and Wilson’s cell phone to Detective John W. Aston of the State College Police Department on Feb. 26. Aston was requested to conduct a cell phone analysis and data extraction.

On March 6, police arrived at the State College Police Department to retrieve Wilson’s cell phone and reports on its forensic analysis. Aston released two DVDs with cell phone data. Upon reviewing Aston’s report, police allegedly determined Wilson’s cell phone contained hundreds, possibly thousands, of images that were embedded in the memory of the phone.

According to the affidavit, all of the images were allegedly previously viewed on Web sites, videos, etc. It was also allegedly found that Wilson’s cell phone had accessed hundreds of adult Web sites that contained pornography, including ones reported by the victim.

A second tool through the State College Police Department was used to conduct another data extraction from Wilson’s phone. Once the tool was activated by investigators, dozens of Web sites were flagged that were similar to the ones found during the first extraction.

“The extraction confirmed that there were hundreds, possibly several thousand, images all being flagged as suspicious and or pornographic and or depicting images of females that appeared youthful or minor in age or relevant to the overall investigation,” said police.

Upon further review of evidence on a DVD, police found an image from the phone’s memory. It allegedly depicted a male and female performing a sex act, which was similar to one described by the victim.

While progressing through the investigation, police received another report involving Wilson from CYS. A provided CYS report stated that the victim, now 20 years old, experienced childhood sexual abuse from the approximate age of 6 years old until she was 16 years old.

On April 17, police interviewed the second victim who alleged Wilson had sexually abused her for 10 years. When she was approximately 6 years old the victim alleged that Wilson inappropriately touched her, and she was scared.

The second victim alleged that Wilson continued to sexually abuse her, and it occurred more frequently as she got older. She said that it escalated to being “more serious and violent.” In some incidents, she alleged that the sexual abuse involved other victims.

The second victim told police that she never reported Wilson, as she was afraid he’d harm her family. She said she had found bullets to guns that Wilson owned throughout the residence, as well as a knife in a dresser drawer and razor blades on the head board of a bed.

Police also conducted interviews with each of the other victims.  On May 23, the third victim told police she and her sister would visit Wilson’s residence, when she was 9 or 10 years old. In 2004-2005, she alleged that they would be alone with Wilson while hanging out with the second victim, and he was “perverted and inappropriate” towards them.

The fourth victim alleged that while at Wilson’s residence, he showed them a pornographic magazine. She told police that it wasn’t the only time that he’d shown them pornography, and he also had an adult pornography movie playing in the room. The fourth victim alleged that after being forced to watch the movie, Wilson proceeded to sexually abuse them.

On May 23 police interviewed a fifth victim who alleged that there were multiple incidents of sexual abuse when she was approximately 14 years old. For example, she alleged Wilson would order pornographic movies on television and make them watch the movies. She also alleged that Wilson would mimic sex acts from the movies with her.

On May 24 police interviewed a sixth victim who alleged multiple incidents of sexual abuse when she was 14 years old. While watching a movie, she alleged that Wilson inappropriately touched her. One time she alleged they were getting ready for a four-wheeler ride when Wilson told them they couldn’t leave until they finished a movie he put in.

She alleged that other times Wilson would have inappropriate contact with her and attempt to get her to touch him inappropriately.

Police arranged to interview Wilson with Trooper Kimberly Ronan of the Clearfield-based state police. When police reminded him of the interview Wilson said he wasn’t sure if he would show up and would let them know the day before. On June 9, Wilson didn’t appear for his interview at the Clearfield barracks.

CLEARFIELD – All charges were held for court against a man accused of stalking and having inappropriate contact with a hotel clerk following a preliminary hearing Wednesday.

Joshua Leverett, 19, has been charged with indecent assault without consent of other, stalking and harassment. Leverett remains incarcerated at the jail in lieu of $50,000 bail.

According to the affidavit of probable cause, on Aug. 2, Lawrence Township police received a report about an alleged sexual assault. Police made contact with the victim who related that during her shifts for the past several days, a resident of the EconoLodge who goes by “Joshua” has been following her around and won’t leave her alone.

When she arrived to start her shift Aug. 2 she noticed Leverett sitting on a bench outside the entrance to the EconoLodge. She said he followed her into the lobby area and remained there for the majority of her shift. At first she said they engaged in small talk and Leverett was polite.

As her shift progressed, the victim alleged that Leverett continually referred to how he’s been in jail and asked her several times to go back to his room. She told police she was trying not to be overly rude but did tell Leverett that she wouldn’t be going to his room.

According to the victim, she kept her answers short in hopes that Leverett would “get the hint” and leave her alone. Although she’s not to leave the front desk, she told police she kept asking the bartender if they needed help, as she wanted to get away from Leverett.

Throughout the course of her shift, the victim alleged that she’d pretend to be busy, so that Leverett would leave, which he did not. As part of her duties, the victim said she has to lock entrances into the pool area when it closes at 10 p.m.

When she needed to lock the pool area the victim said she sensed Leverett was close behind her. She explained that the hallway leading to the pool area is very narrow, and she worried that Leverett “would try something.” The victim said in order to lock the pool area you have to pull the door completely closed while turning the key for the dead bolt.

While locking the pool area, she alleged that Leverett came up behind her and put his hand on her shoulders and started to breath on her, which made her feel uncomfortable. She also alleged that he proceeded to reach in front of her and grabbed her hands and asked her to “let me help” while pulling her against him.

The victim told police she turned to her left to get her back against the wall and pushed Leverett away. When she tried to make her way back to the front desk, she alleged that Leverett tried to grab her and she again pushed him away.

When she returned to the front desk she said Leverett asked her if they were going to talk about what happened at the pool. She said she told him nothing happened but wasn’t sure what to say as she feared he’d hurt her before the end of her shift in an hour.

The victim alleged that Leverett remained in the lobby, asking her to come to his room. The victim told police she contacted a co-worker to advise him of the situation and that she was very scared. She also requested that someone walk her to her vehicle for fear of what Leverett might do outside.

According to the victim, Leverett allegedly made continued attempts to get her phone number. She alleged that he left his on a note, asking her to text him when she was at her car.

The victim said once her co-worker came in Leverett left and went down the hallway leading to his room.

After leaving at the end of her shift, the victim said she “broke out crying” and advised her manager of what had happened. When she got home she contacted police.

CLEARFIELD – The case against a Hawk Run man who has been accused of inappropriately touching a young girl will go to the jury on Thursday morning in Clearfield County Court.

Wescott Pusey, 41, of Hawk Run is facing one count of involuntary deviate sexual intercourse with a child. He is also facing 30 counts each of aggravated indecent assault of a child, aggravated indecent assault of a person less than 13 years, corruption of minors and indecent assault.

Clearfield County District Attorney William A. Shaw Jr. is prosecuting the case on behalf of the commonwealth. Pusey is being represented by defense attorney Ron Collins of Clearfield. Judge Paul Cherry is presiding over the trial.

The alleged victim testified first on behalf of the commonwealth. However, Shaw requested that the courtroom be cleared during her testimony with the exception of the necessary personnel.

According to the affidavit of probable cause, on May 25, 2014, the alleged victim told her mother that Pusey had been inappropriately touching her. When interviewed by state police at Clearfield the alleged victim said this happened “a lot” and more than 30 times. During one incident, the alleged victim said Pusey inserted an object inside of her.

Her mother testified that on May 25, 2014, the alleged victim was watching television when Pusey noticed she was chewing her nails. She said Pusey told the alleged victim to stop, as it was a “dirty habit.”

She said the alleged victim replied to Pusey, saying she knew his “dirty habit.” She said Pusey told the alleged victim to “shut her mouth or she would get into trouble.” After giving the exchange some thought, she later asked the alleged victim about Pusey’s “dirty habit.”

According to her, she expected the alleged victim to tell her that Pusey had been chewing snuff. She said that initially the alleged victim was very reluctant to talk about it but eventually whispered to her that Pusey had been inappropriately touching her.

Later that day, the alleged victim’s mother said Pusey text-messaged her because no one was around. She told him he needed to get out by 5 p.m. or she would contact police. She said when they returned Pusey was not there.

After he left, the alleged victim’s mother said Pusey would communicate with her via e-mail, text-message and Facebook. In these communications, she said Pusey admitted his sins had been made known. She also said he left the alleged victim a note, telling her what happened wasn’t her fault but his own.

A sibling who allegedly witnessed Pusey inappropriately touching the victim said it occurred once or twice a week over a period of several months. The sibling said he reported what he’d seen to their mother after the alleged victim did.

Trooper Justin Jones of the Clearfield-based state police said he interviewed the alleged victim, her mother and her siblings. He also observed a forensic interview with the alleged victim at the Child Advocacy Center. Jones said upon the completion of his investigation, he filed the charges against Pusey.

Under cross-examination by Collins, Jones said the alleged victim had undergone a medical exam as part of the procedure at the Child Advocacy Center. When asked he indicated that the alleged victim had a “clear exam,” meaning it didn’t show any injuries.

Pusey chose not to testify at the trial. Collins didn’t present any defense witnesses. Pusey’s trial will resume at 9 a.m. today with closing arguments and then jury instructions.
