Jury Finds Pusey Guilty on All Charges

CLEARFIELD – A jury of nine women and three men deliberated for a half-hour Thursday before finding a Hawk Run man guilty of inappropriately touching a young girl.

Wescott Pusey, 41, of Hawk Run was found guilty of one count of involuntary deviate sexual intercourse with a child. He was also found guilty of 30 counts each of aggravated indecent assault of a child, aggravated indecent assault of a person less than 13 years, corruption of minors and indecent assault.

Clearfield County District Attorney William A. Shaw Jr. prosecuted the case on behalf of the commonwealth. Pusey was represented by defense attorney Ron Collins of Clearfield. Judge Paul Cherry presided over the trial and revoked Pusey’s bail immediately after the verdict.

Yesterday, the alleged victim testified first on behalf of the commonwealth. However, Shaw requested that the courtroom be cleared during her testimony with the exception of the necessary personnel.

According to the affidavit of probable cause, on May 25, 2014, the victim told her mother that Pusey had been inappropriately touching her. When interviewed by state police at Clearfield the victim said this happened “a lot” and more than 30 times. During one incident, the victim said Pusey inserted an object inside of her.

The victim’s mother told jurors that Pusey would communicate with her via e-mail, text-message and Facebook after she found out about it. In these communications, she said Pusey admitted “his sins had been made known.” She also said he left the victim a note, telling her what happened wasn’t her fault but his own.

During his closing arguments, Collins said Pusey wasn’t disputing that he had inappropriately touched the victim. “He didn’t deny it or try to come in and call anyone a liar,” he said. “Instead we would suggest to you that the commonwealth made it into more than what he did.”

Collins claimed to jurors that the commonwealth wanted them to believe Pusey subjected the victim to something even more awful than what had actually occurred. He asked jurors to be fair in their deliberations and to only punish Pusey for indecent assault.

Shaw countered, telling the jurors that Pusey inappropriately touched the victim two or three times weekly between January of 2011 and May of 2014. He said Collins wanted them to believe that the commonwealth was over-prosecuting Pusey when he could have been charged with 1,000-plus counts.

He asked jurors to recognize that Pusey didn’t want to accept responsibility for what he’d done to the victim. As a result, he said that Collins was trying to make Pusey’s behavior appear less criminal.

“We’re not here trying to make it into anything other than what it is,” said Shaw. He called the jurors’ attention back to Pusey’s message to the victim’s mother in which he admitted that his sins had been made known. “It’s not consistent with the defense’s argument.”

Pusey, according to Shaw, will serve “considerable time,” which theoretically could be a minimum of 10 or 30 years in jail. However, he said it will be up to the judge to determine Pusey’s sentence on the charges and if it will run consecutive or concurrent.

State police at Clearfield

  • An alleged incident of theft by deception occurred Friday on Anderson Road in Penn Township. Further, the victim told state police that they noticed money missing for their bank account.

State police at Punxsutawney

  • An incident of theft by unlawful taking occurred Tuesday in Reynoldsville. During the incident, someone allegedly removed an electric dryer from the victim’s front porch. The estimated value of the stolen property is $50; the incident remains under investigation at this time, state police said.
  • An incident of criminal mischief occurred sometime Wednesday or Thursday on Colonel Drake Highway in Bell Township. During the incident, someone allegedly gouged a 2001 Dodge Neon. Damage is estimated at $200, state police said. Anyone with information is asked to contact the state police at Punxsutawney at 814-938-0510.

  • The Pennsylvania State Police Fire Marshal and the Ridgway Fire Department investigated a structure fire Thursday at a residence on North Broad Street in Ridgway. Upon investigation state police ruled the fire accidental in nature; damage is estimated at $20,000.

  • Police received two reports about alleged incidents of theft by deception regarding a business. The incidents are under investigation, police said.
  • Police received a report about an alleged neighbor dispute.
  • Police received a report about a suspicious vehicle.
  • Police received a report about a traffic violation that occurred on South Second Street.
  • Police received a report about a traffic violation that occurred on Route 879.

Sandy Township

  • Charges are pending against three Michigan men who were allegedly seen taking gift cards without paying for them by Wal-Mart employees on Tuesday.
  • A South Main Street resident alleged that he and some family members were working in their yard when their 62-year-old neighbor began to verbally harass them on Tuesday. He further alleged that the neighbor entered his home, retrieved a shotgun and threatened them. Upon arrival police allegedly found that the neighbor appeared highly intoxicated; he was also allegedly uncooperative with police.  He was taken into custody and transported to the jail.
  • Police received a report about a dog that was left in a trailer on Circle Road on Wednesday. Neighbors alleged that the people who lived there had moved out and left the dog behind.  Police were able to contact the former resident who stated they had been by to feed the dog and were trying to locate a new home for it.  The dog was taken by a neighbor, and the situation was handled without incident, police said.
  • On Wednesday police received a report about two males and a female who were in a yellow-colored Neon on West Long Avenue and throwing bottles from inside of it. The vehicle was gone from the area upon police arrival.
  • On Thursday police received a report about three juveniles who were allegedly walking into the woods near Triangle Tech with a gun. Police located the boys and found they were fishing and handled the situation without incident.
  • A 29-year-old Clearfield man was allegedly caught by Wal-Mart employees attempting to take more than $150 worth of merchandise without paying for it on Thursday. Charges are currently pending, police said.
  • On Thursday employees of Snappy’s alleged that a suspicious man came into the store and went into the restroom and then left. Employees felt the man may have been using drugs.  Police located the vehicle and the 30-year-old Ohio man who allegedly showed signs of being impaired. He was transported to Penn Highlands for a legal blood draw and then taken to the jail.  Charges are currently pending at this time, police said.
  • A 63-year-old St. Mary’s woman was unable to stop in time to avoid hitting a vehicle driven by a 70-year-old DuBois woman that was stopped for a red light at the Interstate 80 off-ramp at Route 255 on Thursday. One vehicle was towed from the scene and no injuries were reported, police said.
  • A woman reported that her dog was missing in the area of Bee Line Highway on Thursday. The dog is a gray mini char pay with a pink collar, police said.

Ware Gets State Prison for Bringing Crack Cocaine to Clearfield Co.

CLEARFIELD – Luther L. Ware Jr., the New York man found guilty of bringing large amounts of crack cocaine into Clearfield County has been sentenced.

Ware, 64, of Bronx, NY, was convicted of two counts of possession with intent to deliver a controlled substance, criminal use of communication facility, dealing in proceeds of unlawful activity, criminal conspiracy and delivery of a controlled substance in one case and possession with intent to deliver a controlled substance, criminal conspiracy/delivery of a controlled substance, corrupt organizations, criminal conspiracy/corrupt organizations, dealing in proceeds of unlawful activity, and criminal use of communication facility in a second case after a trial in June.

President Judge Fredric J. Ammerman sentenced him to a total of 11 to 25 years in state prison during plea and sentencing court.

According to testimony in his trial, Ware recruited individuals to travel back and forth from New York with $5,000 to $10,000 of crack cocaine at a time. He also had several local people working for him.

Prior to sentencing, Ammerman read from a transcript from a session of revocation court held in May of 2013 during which Ware spoke for a defendant, Tanya Nunez. Ware did this while standing in court wearing a suit and tie, and claiming to be a substance abuse counselor while “in reality he was a drug dealer” and a supplier, Ammerman said.

In that court hearing, Ware said he would help Nunez if she was released and stated “she’s doing what she has to do now.”

Ware addressed the court, reading from a written statement. He stated the Commonwealth failed to disclose information regarding alleged phone calls.

He claimed that the informant in the case was “verbally assaulted” by one of the undercover agents and was told what to write in the statement he gave police. Ware referred to the testimony in his trial as “scripted.” After he made a verbal motion for a new trial, Ammerman denied it.

Charges in the first case stem from an undercover purchase and the execution of a search warrant at Ware’s Clearfield residence in October.

A confidential informant was able to purchase crack cocaine from Ware for $100. Officers searching the residence found 18.30 grams of cocaine, 4.05 grams of synthetic marijuana and 2.11 grams of heroin, according to the affidavit of probable cause.

Ware’s arrest was the result of a lengthy investigation by agents with the Pennsylvania Office of the Attorney General, Bureau of Narcotics Investigation and Drug Control. The second set of charges was based on testimony before a Grand Jury in October during which Ware was mentioned as a source of crack cocaine by 15 to 20 different individuals.

Testimony in the June four-day trial came from some of these same people, including undercover agents, police officers, people who sold drugs for Ware and a few of Ware’s customers.

When Ware took the stand in his own defense, he claimed everyone else was lying and even went as far as to say that he did not even know some of the witnesses.

Amusement Ride Operator Waives Charges in Indecent Assault Case

CLEARFIELD – An amusement ride operator accused of having inappropriate contact with a girl when they met in the backyard at her house fair week waived the charges to court Wednesday.

Tyler J. Sears, 21, of Mebane, NC has been charged with indecent assault of person less than 16 years of age and harassment. He remains incarcerated at the jail in lieu of $20,000 bail.

According to the affidavit of probable cause, the victim allegedly met a male, Sears, at the Clearfield County Fair on Aug. 2. Sears operated a ride known as the Himalayan.

On Aug. 4, the victim gave Sears her phone number, and they started to text-message each other. On Aug. 5, the victim asked Sears to come to her house and they met in her backyard.

While engaged in conversation, the victim alleged that Sears grabbed her breast and she pushed his hand away.  She alleged that Sears then kissed her on the neck.

Afterward the victim told police she jumped up and ran into her house with a friend. She also told police she’d let Sears know she was 13 years old when they started to text-message on Aug. 4.

However, the victim told police that she had deleted all of the messages that she had exchanged with Sears. Police interviewed the victim’s friend who confirmed her story.

On Aug. 8, police went to the fairgrounds and located Sears. He was requested to come to the township police station for questioning, which he did.

While speaking with Sears, he denied meeting the victim or her friend. Police received consent to search his phone and located a text-message conversation with the victim.

Sears then changed his story, admitting he’d met the victim after midnight on the date in question. Sears denied kissing the victim and claimed the three of them only hung out before he left.

During the investigation, Sears corroborated the victim and her friend’s stories.  He later admitted to placing his arms around the victim prior to leaving her house.

Sears also admitted to police that he knew the victim was 13 years of age. He also said he knew a “skin-on-skin” exchange would come of it, and he had “messed up.”

DA Shaw: Three Inmates Charged in SCI Houtzdale Riot

CLEARFIELD – Three inmates have been charged for the April riot at the State Correctional Institution at Houtzdale, announced Clearfield County District Attorney William A. Shaw Jr. today.

Shaw identified the defendants as Norman Wothman, 51, Yafest Oliver, 26, and Richard Adams, 34, all formerly inmates at SCI Houtzdale.

Trooper David Patrick of the Pennsylvania State Police, Clearfield barracks, filed criminal complaints in which he charged the defendants with aggravated assault, F1; assault by prisoner, F2; riot, F3; simple assault, M2; disorderly conduct, M3; and harassment, S.

According to the criminal complaints, at approximately 2:34 p.m. April 28, corrections officers at SCI Houtzdale responded to an alleged physical altercation between two inmates. When COs approached they allegedly observed Adams kicking another inmate in the head and face area, while he was laying on the ground.

COs then allegedly ordered Adams to cuff up; however, he refused all orders and took a fighting stance. As COs gained control of Adams, they were allegedly assaulted by multiple inmates.

Upon investigation state police allegedly determined that Adams, along with Oliver, kicked, stomped and punched a CO, while he was on the ground. The CO was subsequently flown to UPMC Altoona to be treated for injuries, according to the criminal complaints.

State police allegedly determined that Oliver also assaulted other COs by kicking, punching and even using a staff radio. During the melee, Wothman was also allegedly observed striking a CO in the head with a closed fist.

After the victims were removed from the area to be transported to UPMC Altoona for treatment, Wothman allegedly refused to follow any orders. Instead, Wothman allegedly threatened other inmates who were attempting to leave and wanted others to stay in the yard and assault the other COs.

Shaw stated that officials from SCI Houtzdale, as well as investigators from the Pennsylvania State Police have identified a number of inmates who participated in the riot. He stated that further arrests will be made in the riot.

Preliminary hearings for the first three inmates charged in the riot will be held in the near future, according to Shaw.

Shaw stated he was extremely proud of the quick response from officials at SCI Houtzdale to “quash” the disturbance and to prevent the situation from escalating further. Shaw stated that negotiators and special response teams from the Department of Corrections were able to gain immediate control of the situation and to prevent further incident.

Shaw believed that community members should feel safe and recognize the professionals from SCI Houtzdale and the state police are prepared to handle to events.

Shaw explained that this type of violent, criminal activity is completely unacceptable and continued efforts will be made to identify, investigate and prosecute criminals responsible at SCI Houtzdale.

Shaw stated that working in a state prison is a stressful and dangerous job, and the men and women who work tirelessly to supervise convicted criminals are entitled to feel safe in the work place.  Assaults of this nature are unacceptable and will be prosecuted, Shaw stated.

Tennessee Man Pleads Guilty in Car Theft, Resisting Arrest Cases

CLEARFIELD – A Tennessee man accused of stealing a car from a DuBois parking lot pleaded guilty in Clearfield County Court.

Steven Duane Gillis, 31, of Harriman, Tenn., pleaded guilty before President Judge Fredric J. Ammerman to theft by unlawful taking and criminal mischief in the car theft case and to resisting arrest and disorderly conduct for his actions at a local restaurant later that same day. He was sentenced to five months to one year in jail and one year consecutive probation. He was fined $375 plus costs and he must pay over $3,200 in restitution.

According to the affidavit of probable cause, the victim told police he parked his vehicle in the lot at 12:30 p.m. June 24. When he returned to the lot at 1:25 p.m., the 2015 black Dodge Dart vehicle was gone. A suspect had left his phone in the Hitching Post.

An officer contacted several people listed in the phone and learned the owner was Steven Gillis.

A Lawrence Township police officer contacted DuBois City police to report they had the vehicle and the driver who was identified as Gillis.

In order to access the vehicle, Gillis smashed out three windows.

The second affidavit outlines how an officer in Lawrence Township answered a call for a disturbance at the Dutch Pantry in Clearfield where a man who did not pay for his food was scaring customers away.

Staff members followed him into the parking lot and told him he needed to pay his bill. He went back into the restaurant and then into the bathroom. When he returned to the dining area he asked the other patrons for food.

When officers arrived, the man, later identified as Gillis, was sitting alone. He admitted he placed a food order and ate the meal. He said when the bill came, he left without paying.

An officer asked Gillis if he had any money and he said yes, agreeing to pay the bill. The manager requested that he be escorted off the property due to his erratic behavior. After he paid for his food, officers took him to the parking lot.

Gillis stated he just wanted to go home. When he was asked where his vehicle was, he pointed to a black sedan parked on the Interstate 80 eastbound off ramp. He claimed the vehicle had broken down. While in the process of checking Gillis’s information, the officers discovered the vehicle was stolen.

As officers tried to put Gillis in the rear of the patrol vehicle for questioning, he tensed up and attempted to pull away from the officers. Gillis broke free and ran. He had to be taken to the ground where he struggled with officers. He refused to calm down and attempted to kick them. Gillis had to be tased twice before he was subdued. He was restrained by leg shackles and a harness and transported to the county jail.

While he was being searched at the jail, he resisted jail staff and was placed on the ground. He later admitted to being under the influence of cocaine, xanax and pain management drugs.

 

 

Three Sentenced in Clearfield Borough Drug Bust

CLEARFIELD – Three people found with drugs after a traffic stop in Clearfield Borough were sentenced in Clearfield County Court.

Marlon Treneil Womack, an inmate of the Centre County Jail, pleaded guilty to delivery of a controlled substance-heroin, possession of drug paraphernalia and criminal conspiracy/delivery of a controlled substance. He was sentenced to 18 months to 36 months in state prison by President Judge Fredric J. Ammerman. He was fined $3 plus costs.

Joshua Tyler Dillon, 29, Philipsburg, an inmate of the jail, pleaded guilty to criminal conspiracy/possession with intent to deliver a controlled substance. He was sentenced to 168 days to one year in jail and three years consecutive probation. He was fined $200 plus costs.

Tyler Jefferson Smith, 36, State College, an inmate of the jail, pleaded guilty to criminal conspiracy/possession with intent to deliver a controlled substance-heroin. He was sentenced to six months to one year in jail and two years consecutive probation. It was noted that Smith cooperated with authorities and assisted with the cases against the others. He was fined $250 plus costs.

The charges stem from an incident Feb. 23. According to the affidavit of probable cause, police found 12 bags of cocaine, 31 stamp bags of heroin, three benzodiazepines, marijuana and three cell phones in the vehicle they were traveling in.

A fourth person charged in this case, Adreanna Margot Torres, 20, of Lancaster, who was also in vehicle is scheduled to be sentenced in September.

According to the affidavit of probable cause, police saw the vehicle traveling north on North Third Street Street in Clearfield and noticed one of the headlights was out. It was stopped in a parking lot.

When the officer got to the vehicle he noted an odor of marijuana coming from the car. The driver, Dillon, was driving with a suspended license. Dillon was taken into custody for a domestic relations warrant and because he was wanted by Pennsylvania State Police in both Philipsburg and Clearfield.

The front seat passenger identified himself as Tyler Davis but later he admitted his last name was Smith. It was revealed he was on probation in Centre County. Smith was found to have $370 in cash.

The rear seat passenger, Torres, was asked to exit the vehicle. After she was asked if she had anything on her, she took some items out of her pocket including a bag of marijuana. She had $965 in her purse.

The other rear seat passenger, Womack, was also asked to exit the vehicle. Because he was wanted in Lancaster County and on probation, he was taken into custody.

The vehicle was a rental that was due to be returned Feb. 16.

State police at Clearfield

  • An accident occurred Friday on Interstate 80 eastbound in Graham Township. A truck was traveling east in the right-hand lane when debris from it struck a car in the left-hand lane. The truck’s operator failed to stop and continued traveling east on I-80. The car sustained minor damages, and the accident remains under investigation, state police said.
  • An incident of harassment occurred Friday on Alexander Road in Madera. During the incident, a Madera man allegedly engaged in a verbal altercation with the victim. He also allegedly grabbed the victim by the arms and scratched her forearm. The man was charged for the incident through the district court, state police said.
  • The investigation continues into the cause of a fire that occurred Saturday on Palestine Road in Graham Township. It originated in an unattached garage adjacent to a residence; however, the fire quickly spread to the residence.
  • A protection from abuse order violation occurred Saturday on Hardscrabble Road in Morris Township. During the incident, a known Philipsburg man was allegedly harassing the victim by sending her text messages. He was charged through the district court, state police said.
  • An incident of burglary occurred Friday on Church Street in Morris Township. During the incident, someone allegedly entered the victims’ residence and removed several items. The victims weren’t at home at the time, state police said. Anyone with information is asked to contact the state police at Clearfield at 814-857-3800.

  • An incident of theft by deception occurred Saturday on Pine Swamp Road in Brady Township. During the incident, suspects allegedly arrived at the victim’s residence, stating they had extra paving material and wanted to fix her driveway. Before the victim could say no, they allegedly sprayed the material and attempted to charge her a substantial amount. Once she contacted state police, the suspects fled the area.   • An incident of criminal mischief occurred Aug. 6-7 on Shaffer Road in Warsaw Township. During the incident, someone allegedly damaged the victim’s trampoline in his yard. Anyone with information is asked to contact the state police at DuBois at 814-371-4652.
  • An incident of theft by deception occurred Aug. 8-9 on Donahue Road in Brady Township. During the incident, someone allegedly removed two aluminum benches and a power sander from a new home under construction.   • An incident of burglary occurred Aug. 12 on Hilltop Lane in Snyder Township. During the incident, someone allegedly entered the main door to an attached garage and then the victim’s house. State police at Philipsburg

  • On July 28, a State College man was allegedly found to be in possession of needles and other paraphernalia during a traffic stop in the area of Chestnut and Mulberry streets.
  • A single-vehicle accident occurred Sunday at the intersection of North Ninth and East Spruce streets in Philipsburg Borough. Further, Richard M. Knepp Jr. of Brisbin was traveling south and exited the west side of the roadway. He subsequently struck a utility pole. Knepp will be cited for the accident, state police said.

State police at Punxsutawney

  • An incident of burglary/theft occurred Friday on Sprankle Mills Road in Ringgold Township. During the incident, someone allegedly entered the victim’s residence and removed $400 in cash. Anyone with information is asked to contact the state police at Punxsutawney at 814-938-0510.

State police at Ridgway

  • An incident of corruption of minors reportedly occurred at a residence in Horton Township. During the incident, a couple allegedly showed the victim sexually explicit images when she was 7 years old and in their care. The incident remains under investigation at this time, state police said.
  • An alleged incident of sexual assault occurred sometime between Thursday and Saturday in Jones Township. Further, Keith A. Chaplain, 39, of Brandy Camp allegedly sexually assaulted the victim. He was charged for the incident and arraigned in district court; he was lodged in the Elk County Prison in lieu of bail.

Clearfield Borough

  • Police responded to an alleged domestic dispute at a residence along Daisy Street.  Police spoke to all of those involved, and they denied the altercation being physical.  Police warned the individuals that if the noise continued, they would all receive citations for disorderly conduct.
  • Police responded to a Park Avenue residence for a report about excessive noise.  The actors were warned for their actions, police said.
  • Police received four, different complaints about bad checks. The investigation is continuing into the complaints, police said.
  • Police responded to a vehicle accident along North Third Street near Market Street.  Upon arrival police found that a red van had driven onto the sidewalk and struck a garbage can.
  • Police received a report over property being sold to another. The incident was found to be civil in nature and no criminal actions had taken place; the complainant was advised to seek legal counsel, police said.
  • Police responded to a report about a homeless female who was allegedly soliciting for money along South Second Street.  Officers have been dealing with the female in the past few weeks and put her in connection with an organization to help her; however, she failed to follow through.  The female was advised to cease her actions, police said.
  • Lawrence Township police were assisted with an alleged domestic dispute along Daisy Street Extension.
  • Police received a complaint about suspicious persons along South Fourth Street.  The actors were gone upon police arrival, and the complainant just wanted documentation of the incident.
  • While on patrol, police located an alleged incident of criminal mischief along North Third Street. The incident remains under investigation at this time, police said.
  • Police responded to a Daisy Street address to assist the resident with removing a bat.  However, the bat was gone upon police arrival.
  • Police booted a vehicle along East Cherry Street due to multiple, unpaid parking tickets.  Police removed the boot upon full payment of the tickets.
  • Police responded to a parking complaint along West Fifth Street, as there weren’t any parking spots in front of the caller’s home.  The caller was reminded that on-street parking was public and on a first come, first serve basis, police said.
  • Police received a complaint about a known actor who was allegedly damaging a fence.  The caller only wanted the incident documented, while the actor is making arraignments to have the fence fixed.
  • Police responded to a residence to assist personnel from Children & Youth Services with a custody issue. Police learned that the mother had tested positive for drug use.  CYS personnel turned over custody to the father who arrived and took the children.
  • Police received a report about an alleged incident of harassment. Police attempted to make contact with the actor with negative results. The incident remains under investigation at this time, police said.
  • Police responded to a local business for a report about an open door.  Police searched the interior with negative contact. A key holder secured the business, police said.
  • Police responded to a Daisy Street residence for a parking complaint.  Upon arrival police found that an actor had parked her vehicle, which was blocking the caller’s garage.  The actor was contacted and moved the vehicle without incident, police said.
  • Police responded to a parking complaint along South Fourth Street near Margarita Street.  The vehicle was gone upon police arrival in the area, police said.
  • Police responded to a report about an alleged retail theft at a local establishment.  The incident remains under investigation at this time, police said.

  • Police responded to an alleged DUI along South Third Street. Upon arrival police located the vehicle and conducted a traffic stop. The driver wasn’t impaired but was issued a citation for an expired registration. A passenger was found to hold several, active warrants through the township police.  Township police arrived at the scene and took custody of the female passenger.
  • Police received a report about an alleged sexual assault that occurred more than 50 years ago. The caller refused to provide the names of the victim or actor.  Due to lack of information an investigation cannot be conducted, police said.
  • Police responded to a parking complaint along Dorey Street.
  • Police responded to a two-vehicle accident at the intersection of East Market and South Third streets.  No injuries were reported and both vehicles were driven from the scene, police said.
  • Police received a report about a suspicious male in a brown truck who was allegedly attempting to talk to kids.

  • Police responded to a report about an alleged domestic dispute.  Upon arrival both parties were intoxicated, separated and released to sober adults, police said.
  • Police responded to a possible structure fire along Bigler Avenue.  Upon arrival police learned that the issue was electrical in nature.  Police remained on standby and assisted fire personnel as needed.
  • Police responded to an East Fifth Street residence for an alleged domestic assault.  Upon arrival police learned that the assault had occurred earlier along Mount Joy Road.  Township police responded to take the report, as it had occurred within their jurisdiction.
  • Police responded to an alleged burglary along South Second Street.  Upon arrival police learned that the actor was the caller’s boyfriend and wasn’t welcomed there. Police said that the actor was allegedly intoxicated and on probation with a “no alcohol” clause.  Probation detained the male in the Clearfield County Jail.
  • Police responded to a noise complaint along Nichols Street.  The actors were warned for their actions and that if it continued, then citations would be issued, police said.
  • Police allegedly observed a male known to have an active warrant along Nichols Street.  Police made contact with the male who was able to pay the warrant in full.

  • Police responded to a Williams Street residence for a psychological emergency, where a female allegedly took an unknown amount of pills.  Emergency personnel transported the female to the hospital.  Police petitioned for a 302 warrant on the female following an evaluation.

DuBois City

  • On Friday police received a phone call from a Scribner Avenue woman who reported that her fiancé was missing. She told police they had engaged in an argument, he had left the residence and had been gone for more than 20 minutes. While police were speaking to the woman, her fiancé returned home.
  • Police received a report about a male and female who were allegedly sleeping in the City Park on Friday. Upon arrival police located a female sleeping in the doorway to the women’s room and a male sleeping on the bleachers. Both were offered assistance, which they refused. Police advised the park closes at dark, and they were not to sleep there. Both left the park without incident.
  • Police received a report about an irate patient Friday at a doctor’s office on Beaver Drive. Upon arrival police learned the patient had fled prior to their arrival. Staff members at the office weren’t able to provide additional information and police cleared the scene.
  • Police received a report about a motor vehicle accident Friday in the parking lot of the Medical Arts building on Hospital Avenue. Upon arrival police found a vehicle operated by a Clearfield woman had struck another vehicle. The woman provided information to be placed on the vehicle, and police attempted to locate the owner.
  • Police received a report about a vehicle running into the Rosco Medical Complex on Friday. Upon arrival to the scene, police found a Punxsutawney woman had mistakenly hit the gas pedal, jumped the curb and impacted the building. The woman’s vehicle sustained moderate damage; the medical building had minor damage, police said.
  • Police received a report about a male who was allegedly arguing with employees and becoming increasingly agitated Friday at a North Brady Street business. Police found he had left prior to employees contacting them. Police directed them to call 911 if the man returned to the business.
  • On Friday a West Weber Avenue resident alleged that someone had attempted to steal his inspection sticker. He told police his vehicle was recently inspected, and it appeared someone had attempted to remove his sticker.
  • Police received a report about a woman who was allegedly sleeping in the driver’s seat of a vehicle Friday on South Jared Street. Upon arrival police found the woman had fallen asleep while parked along the curb. She explained that she had taken new medication and was on her way home. Police advised the woman not to drive her vehicle.
  • Police received a report about an activated burglar alarm at a business Friday in the 200 block of Beaver Drive. Upon arrival police found everything to be OK; the alarm company advised police the key holder wouldn’t be responding to the scene. Police cleared the scene without incident.
  • Police were dispatched for three males who were allegedly being disorderly in and outside of the bar Saturday at the Hitching Post. Upon arrival police located the males who were from Kentucky and working in the area. Of those, one male was taken to the CCJ on charges of public drunkenness and disorderly conduct. He was later arraigned and released by the on-call district judge.
  • Police received a report about a dog that had been left inside of a vehicle Saturday in the 600 block of Liberty Boulevard. Upon arrival police located the dog, which wasn’t in any distress with all four windows nearly halfway down. When the dog’s owner exited a business he advised the dog had been checked on regularly and he would be leaving soon.
  • Police received a report about an alleged domestic disturbance Saturday at an apartment in the 500 block of Liberty Boulevard. Upon arrival police located a female who was waiting outside for her live-in boyfriend to leave. Police located the live-in boyfriend who advised he would leave. Neither the male nor female sustained injuries or wanted any charges filed for the incident, police said.
  • Police received a report about a car jack that was allegedly stolen Saturday from a garage located in the first block of West Scribner Avenue. The incident remains under investigation at this time, police said.
  • Police received a report about a license plate that was allegedly stolen Sunday from a motorcycle parked in the 200 block of West Long Avenue. The incident remains under investigation at this time, police said.
  • Police received a report about someone allegedly throwing a glass bottle against a GMC Envoy parked in the 500 block of Locust Street. It damaged the vehicle and then smashed onto the roadway, police said.
  • While on patrol Sunday in the 200 block of West Long Avenue, police allegedly observed a group of four men engaged in an argument in which they pushed each other. Police subsequently dispersed the group.
  • A 34-year-old DuBois woman was stopped for allegedly committing traffic violations Sunday on South Main Street. During the traffic stop, police allegedly found that she was intoxicated, and she was taken into custody for suspected DUI. Charges are currently pending blood test results, police said.
  • Police received a report about three, small children who were allegedly in the roadway without any supervision Sunday in the 700 block of West Long Avenue. A neighbor allegedly told police she was able to get the children home; however, she couldn’t get an adult to answer the door. Upon arrival police were able to make contact with the mother; police determined the children weren’t in any immediate danger. Police, however, referred the incident to CYS.
  • Police received a report about a child who was allegedly on a roof Sunday in the 200 block of South Brady Street. Upon arrival police spoke to the mother who related she’s had problems with her 5-year-old climbing out of the window and onto the roof. She told police she was taking additional steps to secure the window. Police found the child was in a safe environment and that no further investigation was necessary.
  • Police received a report about a man who was allegedly hitting a woman Sunday in the 500 block of Liberty Boulevard. Police checked the area but were unable to locate anyone.
  • On Sunday three people allegedly took trash dumped near their property and disposed of it on the property of the person who they believed it belonged to. The owner put the trash in that location and out for collection, police said. Charges are currently pending at this time.

Sandy Township

  • On Friday a 56-year-old Falls Creek woman was allegedly caught by Wal-Mart employees, leaving the store with $46.31 worth of merchandise in her purse that she did not pay for. Charges are currently pending, police said.
  • On Friday Wal-Mart Loss Prevention told police that a 40-year-old Curwensville woman who was an employee at the store had allegedly taken a total of $90 from her cash register. Charges are currently pending, police said.
  • A woman alleged that an unknown man was harassing her in the Commons parking lot on Friday. She stated the man kept saying he wanted to go to Guatemala. Police located the 39-year-old man who had allegedly been drinking and handled the situation without incident.
  • A 57-year-old DuBois woman failed to stop her vehicle in time to avoid hitting a vehicle driven by a 17-year-old Luthersburg girl who was stopped at the light at Blinker Parkway and Behringer Highway on Friday. The girl’s vehicle then hit the vehicle in front of her that was driven by a 43-year-old DuBois woman. No injuries were reported, and all vehicles were driven from the scene, police said.
  • Police received a report about a vehicle sitting in a driveway on Hand Street with blasting music on Saturday. The vehicle was gone upon police arrival.
  • On Saturday a 50-year-old Circle Road woman alleged that a $200 money order was missing from her purse, and she felt her 29-year-old son took it. The incident remains under investigation, police said.
  • A woman alleged that she was threatened by her ex-boyfriend while they were involved in an argument over money Saturday. Police handled the situation without incident.
  • On Saturday a 34-year-old Brockway man was following his GPS, which attempted to lead him through the back gate of Treasure Lake. This caused him to hit and damage the lift arm on the gate, police said.
  • A vehicle driven by a 34-year old-DuBois man failed to stop in time to avoid hitting a vehicle driven by a 56-year-old woman that was stopped at the traffic light Sunday at Shaffer Road and Maple Avenue. Minor to moderate damage and no injuries were reported, police said.
  • An 11-year-old Circle Road girl was riding her bike when a neighbor’s dog came out of the yard and bit at her leg on Sunday. The dog ripped the girl’s pants and caused a small superficial wound to her leg.  The incident was turned over to the county dog law officer, police said.

CLEARFIELD – District Attorney William A. Shaw Jr. has announced Clearfield County’s Fugitive of the Week for the week of Aug. 17.

Shaw identified the fugitive as Kasey Condon, 24, of Valley View Drive, Clearfield. Condon is wanted for failure to appear at Plea and Sentencing Court held on Aug. 11.

On Jan. 30, Officer Julie Curry of the Lawrence Township Police Department filed a criminal complaint against Condon. She charged Condon with retail theft, M2, and receiving stolen property, M3.

According to the affidavit of probable cause, on Jan. 9, police received a complaint about an alleged theft at a local business the previous day. Upon investigation police determined that a store employee had allegedly witnessed Condon concealing items in her purse.

Condon was then allegedly observed paying for several items; however, she did not pay for the items that were concealed within her purse. Condon allegedly refused to stop when confronted by store personnel.

A preliminary hearing was scheduled for March 11, at which time all charges were held for court. On Aug. 11, Condon failed to appear at Plea and Sentencing Court, and a warrant was issued for her arrest.

Condon is described as a Caucasian female who stands 5 feet, 1-inch tall. She has hazel eyes and brown hair.

Former Truancy/Community Service Officer Gets Jail for Soliciting Pictures from 15-Year-Old

CLEARFIELD – A former truancy and community service officer will spend time in jail for soliciting photos from a 15-year-old.

During plea and sentencing court, Robert Dean Laska Jr., 33, 8 Love St., DuBois, pleaded guilty to corruption of minors and loitering and prowling at nighttime.

President Judge Fredric J. Ammerman sentenced him to 30 days to one year in jail and one year consecutive probation. He was ordered to complete 50 hours of community service and was fined $300 plus costs.

The charges stem from an incident July 12, 2014 when Laska was prowling around a DuBois neighborhood where one of his 15-year-old clients lived.

According to the affidavit of probable cause, the victim explained to police that she was watching a movie with her friend when she received a text from Laska asking if she was home. The victim said she thought Laska was helping her probation officer by checking on her.

She replied to Laska’s message confirming she was home. He began sending additional text messages, saying he had given the victim credit for more community service hours than she had completed and he wanted to know what the victim was “going to do for that.” The victim said Laska told her if she sent him a picture of herself, he would give her additional community service hour credits.

Laska said he was walking in her neighborhood and wanted to meet, she said. He also asked her to delete the messages.

As he met Laska behind her house, one of her friends walked up the alley, startling him. After the friend talked with Laska, he ran through nearby yards and hid behind a tree.

The victim and her friend went to another friend’s house where they called the police.

When the officers spoke with the victim’s friend, she said she asked Laska how old he was and Laska said he was 24. The friend asked Laska what he was doing at the victim’s home, and he said he was “just passing through.”

The friend confronted Laska about the victim’s age and told him he shouldn’t be there. Laska then ran away, the friend told police.

The officers checked the area but could not find anyone. The officers then called Laska’s phone number and after two calls, were able to make contact with him. He was told to meet the officers at the police station.

When he was questioned at the station, Laska said he went to check on the victim who he supervises due to truancy issues. Laska said when he arrived, the victim had a friend there and he felt he was being “targeted” due to some of the remarks the victim and her friend made.

The officers could smell alcohol coming from Laska and asked him if he felt it was appropriate for him to show up at a 15-year-old’s house drunk and ask to see pictures of her. Laska hung his head and said, “I messed up.”

Laska also admitted to drinking between six and eight beers prior to contacting the victim.

The officers examined the victim’s phone and found text messages sent by Laska that confirmed the victim’s story.

State police at Philipsburg

  • An incident of criminal mischief occurred sometime between July 15 and Aug. 13 on Shady Lane in Rush Township. During the incident, someone allegedly keyed the passenger’s side of the victim’s car, which caused damage to its paint.

State police at Punxsutawney

  • On Friday state police stopped Adam Dinsmore of Dayton on Route 119 in Young Township. He was allegedly found to have an active warrant out of Trumbull County, Ohio. He was arraigned and lodged in the Jefferson County Jail in lieu of $40,000 bail to await extradition back to Ohio.

State police at Ridgway

  • A motorcycle accident occurred Monday on the Quehanna Highway in Benezette Township. Joseph M. Obringer of Morrisdale was traveling north when his motorcycle experienced a mechanical malfunction. He lost control and was thrown from the motorcycle; his motorcycle then struck the guiderails on the right side of the roadway. Obringer sustained major injuries and was flown to the Altoona Trauma Center, state police said. Obringer’s motorcycle was towed from the scene; state police were assisted at the scene by the Jay Township Fire Department and Fire Police and the Sinnemahoning Fire Police.
  • An accidental fire occurred Sunday at a Poplar Road residence in St. Marys City.  Upon investigation state police determined it was accidental in nature, and that damage was estimated at $100,000.

Clearfield Borough

  • Police responded to a vehicle accident in the area of South Third and East Walnut streets. Upon arrival police found that a vehicle had struck an individual who was in a motorized wheelchair; the victim sustained a broken leg and was flown for medical treatment. Charges have been filed on the driver, police said.
  • Police responded to SW Fourth Street for a report about children who were allegedly playing on the roadway. However, the children were gone upon police arrival.
  • Police responded to Bigler Avenue for a report about a cat struck by a car. The cat was taken by police to a local vet for treatment.  Anyone with information on the ownership of the cat or who would like to adopt the cat is asked to contact the Clearfield Borough police.
  • Police received a complaint about an alleged incident of identity theft. The victim just wanted the incident documented at the time, police said.
  • Police received a report about an alleged sexual assault on children. The incident remains under investigation at this time, police said.
  • Police received a report about a custody matter in which there wasn’t an agreement in place. The complainant was advised to seek legal counsel, as the incident was civil in nature, police said.
  • Lawrence Township police were assisted with a four-person altercation in progress. Officers responded and assisted as needed, police said.
  • Police received a complaint over the custody of a child. Upon speaking with the complainant over the phone, police learned that the incident was solved without incident.

Lawrence Township

  • Police received a report about multiple code violations in the area of Mount Joy Road.
  • Police received a report about an alleged incident of criminal mischief that occurred on Williams Street. During the incident, someone allegedly caused damage to the victim’s yard.
  • Police were requested to conduct a welfare check on River Road.
  • Police responded to an accident involving three vehicles and a boat on Washington Avenue. One person was transported for medical treatment; one vehicle was towed from the scene, police said.
  • Police received a report about a hit-and-run accident that allegedly occurred near Dairy Queen and Kwik Fill.
  • Police received a report about a hit-and-run accident that allegedly occurred in the Wal-Mart parking lot. The accident remains under investigation at this time, police said.
  • Police received a report about a dog that was allegedly left unattended in a vehicle on Plaza Drive.
  • Police received a report about an alleged physical domestic dispute on Washington Avenue.

Curwensville Borough

  • Police received a noise complaint that occurred Friday at the Curwensville Commons. It was handled by officers at the scene.
  • Police received a report about a female who was allegedly being stalked by a medium- to large-sized, brown dog on Friday. She allegedly attempted to command for it to leave several times; however, it attacked her and she needed treatment for her injuries. Police are asking for the public’s assistance in identifying the dog.
  • Police received a report about an alleged domestic incident that occurred Saturday at a Thompson Street residence. Upon arrival police found it was a verbal argument.
  • Police received a report about an alleged incident of disorderly conduct/loitering and prowling at night in the area of Schofield Street on Sunday. Police apprehended two juveniles as a result of the incident.
  • Police received a report about an alleged incident of criminal mischief that occurred to a vehicle on Ridge Avenue.
  • Police allegedly located drug paraphernalia Saturday and the investigation is ongoing at this time.

DuBois City

  • Police were dispatched to an alleged theft Monday in the 100 block of East Park Avenue. The incident remains under investigation at this time, police said.

Irate Customer Accused of Trying to Ignite Inferno Over Smoking Infraction

DUBOIS – An irate customer risked igniting an inferno at Sheetz over a smoking infraction.

According to an affidavit of probable cause, filed with District Judge Patrick Ford’s office Aug. 17, Andrea Joyce Snedden, 50, 214 Dixon Ave., DuBois, is charged by the DuBois City police with arson and related offenses, causing or risking a catastrophe, recklessly endangering another person, disorderly conduct, following an incident at Sheetz on North Brady Street.

According to the affidavit, on Aug. 17, police were called to the store for a woman who was spraying gasoline on the ground and attempting to light it on fire near the gas pumps.

As police made their way to the store, they were told by the 911 center that the woman had left the area.

The officers spoke to staff at the store who allegedly told police that a woman had sprayed gasoline all over the parking lot and tried to light it on fire with a cigarette.

An employee pointed out the woman who was laying on a stone wall behind the store. Police also noticed a lot of gasoline on the ground with kitty litter on top and a cigarette in the middle of the kitty litter.

The officers spoke to the woman, later identified as Snedden. When asked what she was doing, Snedden allegedly replied that she was “disturbing the peace.”

Police could smell alcohol coming from Snedden and noticed she was smoking a cigarette that appeared to be the same kind as the cigarette, which had been used in an attempt to light the gasoline.

Snedden was handcuffed and detained.

Police continued to interview employees at the store who said Snedden came into the store smoking a cigarette and was told she was not allowed to smoke inside the store and had to leave. Snedden had paid for $5 in gas and then walked out of the store.

An employee saw a vehicle parked at pump three and turned it on. A few minutes later, the employee saw the vehicle leaving pump three, but saw Snedden standing at the gas pump island with a lit cigarette.

The employee went out and asked Snedden if she got her gas. Snedden allegedly told the employee she needed to get her gas from pump six. The employee went back into the store and turned on pump six, thinking Snedden needed to fill a gas can.

The employee then allegedly told police that when they turned back around they saw Snedden walking around the pump with the lit cigarette and walked back out to see if Snedden needed any help. The employee said they allegedly saw Snedden using the nozzle to spray gasoline all over the ground near pump six, while still smoking the cigarette.

The employee told police they ran back into the store to tell the other employees.

Another employee ran outside and saw gasoline pouring down the parking lot and a lit cigarette laying in the middle of the gasoline. The employee began to get fluid stoppers and kitty litter to prevent the gas from going any further and saw Snedden light another cigarette while standing next to the gas pumps.

The employee was able to get Snedden away from the pumps and allegedly asked Snedden what she was doing. The employee said Snedden allegedly said “see, it isn’t real gas or it would have lit up.”

Police noticed that the employees were all shaken and nervous, thinking that Snedden would blow up the store.

Police obtained security video, which confirmed what the employees had told police.

The officers then asked Snedden what happen. Snedden allegedly told police that she poured about $5 in gasoline into the parking lot and put her cigarette out in the gas to prove a point that it wouldn’t light on fire.

Police searched Snedden and found a pack of cigarettes, which were the same as the cigarette that was used to attempt to light the gas.

State police at Philipsburg

  • An incident of burglary occurred Wednesday on South High Street in Port Matilda Borough. During the incident, three people allegedly entered two sheds in the victim’s backyard. They fled the scene prior to state police arrival; no items were reported as stolen, state police said. Anyone with information is asked to contact the state police at Philipsburg at 814-342-3370.
  • An accident occurred Friday on North Centre Street at its intersection with East Spruce Street in Philipsburg Borough. Further, a vehicle driven by Nicholas L. Jordan of Leesville was traveling south while another driven by Raymond P. Martell of Philipsburg was traveling east. When the Martell vehicle traveled onto North Centre Street, it was struck by the Jordan vehicle. Martell was transported to the Clearfield Penn Highlands Hospital with unknown injuries.
  • An incident of burglary occurred sometime between Aug. 1 and Friday at a Tyrone Pike residence in Taylor Township. During the incident, someone allegedly entered the victim’s residence and removed a boat engine from the basement. Anyone with information is asked to contact the state police at Philipsburg at 814-342-3370.

State police at Ridgway

  • The Pennsylvania State Police Fire Marshal and the St. Marys City police have completed an investigation into a fire that “significantly damaged” a residence at 646 S. Michael Rd., St. Marys, on Aug. 17, 2013. The cause of the fire was determined to be arson, and Jeremiah E. Bucher, 25, of St. Marys was arrested on Tuesday. Bucher was arraigned in district court and released on $30,000 unsecured bail.

Lawrence Township

  • Police were requested to check the welfare of someone at a Powell Avenue residence.
  • Police assisted with a 302 warrant on Clark Street.
  • Police received a report about an alleged incident involving unlawful restraint in the Hyde area. The incident was unfounded, police said.

Decatur Township

  • Police received a report about an alleged phone scam. During the incident, someone who claimed to be with the IRS called the victim and demanded that she paid money or she would go to jail. Police would like to remind residents that this is a common scam and not to provide personal information.
  • Police received a report about an alleged incident of retail theft at County Market. A known male who fled the area will be cited for the incident, police said.
  • A known male fled from police on Logan Road. When police interviewed him he allegedly confessed to the violation.
  • Police responded to a two-vehicle accident at Snappy’s Convenience Store in Houtzdale. Further, the operator of a vehicle backed into another vehicle that was unoccupied at a gas pump. No injuries were reported, and both vehicles were driven from the scene, police said.
  • Police were requested to help an elderly man who was lost in Houtzdale. Further, police were able to assist him with getting to where he stayed in Philipsburg.
  • Police received a report from a local garage owner about an alleged incident involving a male who made fraudulent charges on accounts while employed there. The incident remains under investigation at this time, police said.
  • Police assisted Children & Youth Services with a case in Decatur Township. Further, CYS had received a complaint about a male who was allegedly growing marijuana while his child was at the residence.
  • Police received a report about an alleged verbal domestic dispute on Scotch Hollow Road. Police were able to handle the incident at the scene.
  • Police received a report about a psychological emergency in Decatur Township. Police determined the female was not a threat to herself.
  • Police responded to the Laundromat in Houtzdale, where a male was allegedly sleeping and intoxicated. After attempting to find the male several places to stay, police found he was being uncooperative and had outstanding warrants. Police transported the male to the magistrate’s office and released him.
  • Police responded to a Horseshoe Curve address for a report about shots being fired into a camp. The incident remains under investigation at this time, police said.

Sandy Township

  • A 20-year-old Lilly woman and a 20-year-old Clearfield man were allegedly caught by Wal-Mart employees taking $40.44 worth of merchandise without paying for it on Monday. Charges are currently pending at this time, police said.
  • A 27-year-old DuBois man alleged that he ordered and paid for 64 iPhones from an online merchant and never received the phones. He has been unable to contact the merchant, police said.
  • A 32-year-old DuBois woman and 31-year-old Richmond, Va., man were allegedly caught by Wal-Mart employees attempting to take merchandise from the store without paying for it on Monday.
  • Police received a false alarm at Stotz on the Watson Highway on Tuesday.
  • Police received a report about unknown persons removing mail from mailboxes along Shaffer Road. The incident remains under investigation, police said.

CLEARFIELD – Clearfield County District Attorney William A. Shaw Jr. has announced the capture of a wanted fugitive.

Shaw identified the fugitive as Benjamin Colyer, 20, of Lilly Street, Philipsburg. Colyer was added to the Clearfield County Fugitive of the Week list on Aug. 10.

On May 25, Patrolman Adam Raybuck of the Clearfield Borough Police Department filed a criminal complaint. He charged Colyer with theft by unlawful taking, M2; theft by deception, M2; and receiving stolen property, M2.

According to the affidavit of probable cause, on April 25 police received a complaint that someone had allegedly stolen 15 video games from the victim. Upon investigation police allegedly determined that Colyer had removed the video games from the victim’s home. In addition, Colyer later allegedly sold the video games to a local business.

A preliminary hearing was scheduled for July 8, at which time Colyer failed to appear, and a warrant was issued for his arrest.

Shaw stated that Colyer was apprehended Saturday by troopers from the Pennsylvania State Police, Clearfield barracks. Colyer is currently lodged in the Clearfield County Jail.

Shaw thanked the Pennsylvania State Police, Clearfield Barracks, for their assistance with this case.

Woman Accused of Setting Fire to Get Her Son to Respond Waives Charges

CLEARFIELD – A woman accused of setting a fire in her room at the Economy Inn in order to see her son when he responded to the scene waived all charges to court Wednesday at the Clearfield County Jail.

Robin Lynn Miller, 39, of Clearfield has been charged with arson-danger of death; arson-inhabited building or structure; aggravated arson-bodily injury; aggravated arson-person present inside property; arson-intent destroy unoccupied building; arson endangering property-reckless endangerment of inhabited building; reckless burning or exploding, two counts; dangerous burning; causing catastrophe; risking catastrophe; criminal mischief, two counts; recklessly endangering another person, 17 counts; aggravated assault; simple assault, 18 counts; disorderly conduct, two counts; and possessing instrument of crime. Bail has been set at $50,000 monetary.

According to the affidavit of probable cause, Lawrence Township police were dispatched to a structure fire at 2:13 a.m. June 26 inside Room 106 of the Economy Inn. Upon arrival to the scene, police found a woman, Miller, who was crying and sitting outside of the room. Police entered the room to find the fire was out and heavy smoke emitting from inside.

When police asked Miller what caused the fire in the room she resided in, she allegedly said, “I admit I went and got the kerosene can, took it to the room and I dropped the lighter.” When Miller was transported to the police station, an officer asked if she wanted to discuss the fire, at which point she replied, “No, I want an attorney.” Police advised that was OK and they wouldn’t discuss the fire without her attorney present.

Police contacted the on-call Clearfield County probation officer who asked if criminal charges would be filed in relation to the fire. When advised yes, the PO had police house Miller at the jail. Police then advised Miller that she would be detained by adult probation, and police would file new criminal charges.

While being transported to the jail, Miller said she wanted to speak with police about the fire. Police advised Miller she had already indicated she wanted her attorney to be present, and police would not speak with her about the fire. Miller was subsequently housed at the jail on a probation detainer.

Police returned to take control of the fire scene, where evidence was laying in the parking lot area outside of Room 106. A Pennsylvania State Police Fire Marshal was requested and dispatched to the scene. Upon arrival a fire marshal began to photograph and log evidence, which included: liquid from a partially burnt red fuel container; a partially burnt red fuel container; burnt fabric from a chair, which had caught fire; pieces of carpet material from inside the room; and a multi-colored lighter.

On the night of the fire, police interviewed Miller’s live-in boyfriend. He said Miller tried to provoke an argument with him earlier that night, and he told her they’d discuss what was troubling her in the morning. After he’d gone to bed, he allegedly heard Miller “messing around” in the room and then saw flames on the floor.

According to Miller’s live-in boyfriend, he panicked and attempted to put out the fire with a pillow. He also attempted to put out the fire with a blanket and other items within his reach. At one point, he attempted to jump over the flames to get out of the room for fire extinguishers. He was able to retrieve fire extinguishers and put out the fire.

He told police that he’d injured his foot at some point. As a result, he was taken to the Clearfield Penn Highlands Hospital by private vehicle for medical treatment. His foot injury, according to police, was classified as a second-degree burn.

On July 10, police interviewed Miller’s live-in boyfriend a second time. When asked to explain the events that occurred during the early morning hours June 26 he provided the same statement as given during his first interview with police.

When asked he didn’t believe Miller was trying to hurt him by starting the fire. He then explained that Miller was upset that her son wouldn’t come to the motel to see her. He said Miller made the comment that she would “get her son there one way or the other.”  He believed Miller was so upset she set a small fire, so that she would see her son when he responded with the fire department.

Miller’s live-in boyfriend told police that there were 18 renters staying at the motel, which included him and Miller.

The fire marshal told police that evidence and Miller’s statements showed that the fire was clearly arson. Evidence present at the scene showed a combustible substance was poured in different areas within the room. The fire marshal believed Miller lit the floor area, which likely spread to a nearby chair and caught it on fire.

State police at Clearfield

  • An incident of harassment occurred Wednesday on Railroad Street in Coalport Borough. During the incident, a Coalport man allegedly subjected the victim to physical contact. Charges were filed against him as a result of the incident, state police said.
  • An accident occurred Wednesday on Interstate 80 at mile-marker 117.8 in Lawrence Township. Shawn P. Young of Muncy lost control of his freightliner and struck a guiderail during a sudden heavy rain storm. No injuries were reported, and towing services assisted at the scene, state police said. Lawrence Township Fire Police also assisted with traffic control, and the left lane of I-80 was closed for about one hour.

State police at DuBois 

  • An incident of harassment occurred Tuesday on the Bennetts Valley Highway in Huston Township. During the incident, two females allegedly engaged into a physical altercation. Charges were filed as a result of the incident, state police said.

State police at Philipsburg

  • An incident of burglary occurred Thursday at a North Sixth Street residence in Philipsburg Borough. During the incident, a known suspect allegedly entered the residence and removed a wallet containing cash and credit cards. The incident remains under investigation at this time, state police said.
  • An incident of criminal mischief and disorderly conduct occurred Tuesday on North Sixth Street in Philipsburg Borough. During the incident, a known juvenile allegedly threw a bicycle that belonged to a man. The juvenile was cited for criminal mischief and the man for swearing and causing a disturbance, state police said.
  • A domestic assault incident occurred Sunday on East Spruce Street in Philipsburg Borough. During the incident, a 16-year-old boy allegedly pushed a 53-year-old man who then assaulted him (the boy). The man was subsequently arrested for simple assault and harassment and arraigned at the Centre County Jail; he was released on $25,000 unsecured bail, state police said.
  • An incident of theft occurred Aug. 11 at CNB Bank in Philipsburg Borough. During the incident, someone allegedly removed the 150th anniversary plaque presented to the bank by Philipsburg Borough during Philipsburg Heritage Days. They also allegedly removed the stand used to display the plaque. The plaque and stand are valued at $75, state police said. Anyone with information is asked to contact the state police at Philipsburg at 814-342-3370.

State police at Punxsutawney

  • An alleged incident of simple assault was investigated by state police after it occurred sometime between May 10 and Aug. 5 on North Main Street in Young Township.

Lawrence Township

  • Police responded to the Wal-Mart intersection to direct traffic due to a malfunctioning traffic light.
  • Police received a report about an alleged incident of theft by deception and deceptive business practices that occurred at a local cemetery.
  • Police received a report about an alleged incident of harassment.
  • Police received a report about an alleged incident of child endangerment. Children & Youth Services assisted police.
  • Police received a report about an alleged mail scam.
  • Police received a report about an alleged retail theft and a fraudulent return scam at Wal-Mart. Upon arrival police allegedly determined that several people were working together to steal items from the store and then return them for gift cards. Police obtained video surveillance and identified the suspects; charges are pending the completion of the investigation, police said.
  • Police received a report about an alleged incident of loitering and prowling on Wood Avenue. Police, however, were unable to locate anyone around the residence.

Meth Lab Busted at Lawrence Park Village

CLEARFIELD – A Clearfield woman, Mandy J. Rubly, is in jail on charges for allegedly conspiring with her husband who was cooking methamphetamine at an apartment at the Lawrence Park Village. Her husband, Larry R. Rubly Jr., was arrested on a state parole violation and will be charged at a later date.

According to the criminal complaint filed by Officer Elliott Neeper of the Lawrence Township police, on Thursday officers received a call from State Parole Agent Keith Summerson, who requested assistance in conducting a follow-up with Larry Rubly Jr. Rubly was to be staying in apartment 6B at Lawrence Park Village.

Upon arrival Summerson made contact with Mandy Rubly. She confirmed Larry Rubly Jr. was at the apartment, advised he was upstairs and showed the state parole agent to his location. When the state parole agent made contact with Larry Rubly Jr., he was in an upstairs bedroom.

Larry Rubly Jr.’s pants were down around his ankles, and he was allegedly attempting to stick himself with a needle in the leg area. The state parole agent was able to handcuff Larry Rubly Jr.; however, he (Larry Rubly Jr.) discarded the needle.

Larry Rubly Jr. was subsequently taken into custody by the state parole agent. The state parole agent also allegedly located a prohibited offensive weapon in the bedroom that Larry Rubly Jr. stayed in.

While the state parole agents searched for the discarded needle, they also allegedly located multiple items consistent with the manufacture of methamphetamine.

According to the criminal complaint, a two-liter Mountain Dew bottle was allegedly located on the far side of Larry Rubly’s bed in which a clear, small tube was sticking from the top. Another container was allegedly found directly beside the bottle with an unknown substance inside.  On the heater for the bedroom along the far wall, there allegedly was a container of Drano drain cleaner.

Upon officers looking around Larry Rubly Jr.’s bedroom, they allegedly observed in plain view a container of Ronsonol lighter fluid on a bedroom dresser. Also on the dresser, there was allegedly a coffee pot with residue and a large packet of clear baggies commonly used for drug distribution.

Officers also allegedly observed Larry Rubly’s driver’s license laying on the bed. While exiting the bedroom, officers allegedly observed a bag containing a packet of a 12-hour decongestant containing 20 tablets.

Based upon these observations, officers determined enough items were present to indicate the possibility of an active methamphetamine lab in Apartment 6B.

Police located a female inside the apartment. She was in the living room and told police she had health issues that prevented her from leaving her bed. She also indicated she was the owner of the apartment and advised Mandy and Larry Rubly Jr. had been staying with her.

Police obtained written consent to search the apartment. Then, police proceeded with an evacuation due to the inherent dangers that exist with the manufacture of methamphetamine.

While attempting to secure the scene after the evacuation, officers allegedly located additional items in plain view that are used for the manufacture of methamphetamine at the bottom of the staircase of the apartment. A large one-gallon container of muriatic acid was allegedly found along with a grocery bag containing used items for the manufacture of methamphetamine.

There was allegedly an additional one-gallon container with white residue with these items.  Inside the grocery bag, officers could allegedly observe used cold compress containers, used suspected lithium batteries, Ronsonol lighter fluid and plastic tubing.

Also inside the grocery bag in plain view, there allegedly was a receipt from Wal-Mart for the purchase of pseudoephedrine tablets on Wednesday.

Officers then contacted the state Attorney General’s Drug Task Force Unit and the Pennsylvania State Police Clandestine Methamphetamine Lab Unit.

Police transported Mandy Rubly to the station for an interview about her knowledge of items used for the manufacture of methamphetamine being inside the apartment. She initially denied any knowledge that Larry Rubly Jr. was making or using any type of methamphetamine products.

However, she eventually admitted to viewing the two-liter bottle of Mountain Dew in the bedroom. She also stated that there was a liquor bottle that contained a brown liquid inside the bedroom.

Mandy Rubly stated when she confronted Larry Rubly about the two bottles he related he had urinated inside them. She stated that he told her that he would throw out the bottles.

According to police, Mandy Rubly also allegedly admitted to observing a clear bottle with a black top labeled salt.  She stated that she asked Larry Rubly about this, and he told her that he had been eating in the bedroom.  However, she told police she’d never seen him eating in the bedroom.

She also allegedly admitted to purchasing Sudafed at Wal-Mart sometime at the end of July. Police confirmed that she purchased Sudafed on Aug. 6. However, she denied purchasing pseudoephedrine for the purpose of manufacturing methamphetamine or for supplying Larry Rubly Jr. with it to manufacture methamphetamine.

Police received additional information from another female who was suspected of purchasing pseudoephedrine and supplying it to Larry Rubly Jr. She was located at Lawrence Park Village.

She told police that on Wednesday Larry Rubly Jr. asked her to purchase pseudoephedrine for him at Wal-Mart. She stated that she declined at first; however, Larry Rubly Jr. called repeatedly and she eventually agreed to.

The female said she met with Larry Rubly Jr. and Mandy Rubly. She said both were present when Larry Rubly Jr. handed her a gift card, gave her the pin number and told her specifically which type of medication to purchase and to also use the card as credit, if possible.

The female said they told her to buy one box of the 12-hour, generic Sudafed.  She went to Wal-Mart where she purchased the pseudoephedrine.  When she returned she said she met both Larry Rubly Jr. and Mandy Rubly to give them the pseudoephedrine. She said Larry Rubly Jr. opened the package to make sure it was what he’d requested her to purchase.

The female told police she put the gift card back in the Wal-Mart bag. Before she left she said Larry Rubly Jr. asked a male for any empty bottles that he had, and he took an empty Juicy Juice bottle.

When Mandy Rubly was interviewed a second time by police, she denied witnessing Larry Rubly Jr. giving the gift card to the female. She also denied going with Larry Rubly Jr. to obtain the pseudoephedrine from the female.

State police at Ridgway

  • Police received a report about an alleged disturbance in the Plymptonville area. Police handled the incident at the scene.

  • Police received a report about a suspicious vehicle near the Clearfield Airport. However, police didn’t find any signs of criminal activity.
  • Police received a report about an alleged disturbance/unwanted person in the East End area. Police handled the incident at the scene.

DuBois City

  • Police stopped the operator of a vehicle for suspected DUI on Wednesday on East DuBois Avenue. The operator, according to police, failed each field sobriety test administered to them and was placed under arrest for DUI. The operator was taken to Penn Highlands, where they refused to submit to a blood test; the operator was released to a friend, police said. Charges were filed against the driver through the district court.
  • Police received a report about a dog that was left inside a vehicle Wednesday on East Long Avenue. Upon arrival police made contact with the dog’s owner who allegedly admitted to leaving the dog unattended inside the car with the windows only cracked for at least 30 – 45 minutes. The dog’s owner was cited as a result, police said.
